    JUDGE'S DECISION MAY LEAD TO GOVERNMENT SANCTIONED STARVATION

    Dairy farmers in Wisconsin have joined a man and his wife who are appealing a judge's ruling that they don't have a fundamental right to own a dairy cow or drink the unprocessed milk from their own cows.

    Farmers Mark and Petra Zinniker wished to sell raw milk obtained from their cows through their new farm store. But a judgment in August from Wisconsin Circuit Court Judge Patrick Fiedler ruled against them in what one attorney characterized as a "bizarre judicial leap." http://www.hall-law.org/?tag=judge-patrick-j-fiedler

    In response, shareholders joined the Zinnikers and retained public-interest lawyers from the Farm to Consumer Legal Defense Fund (FTCLDF) who had filed a motion for Judge Fiedler to clarify his court decision. http://www.ftcldf.org/raw-milk.html

    What shocked many Wisconsin residents -- and a growing number of Americans across the nation -- is the fact that Judge Fiedler's ruling denies the fundamental rights to food and farming. For example, he ruled that the plaintiffs -- the Zinnikers -- don't have a fundamental right to own and use a dairy cow or a dairy herd, in spite of their legally purchasing the farm animals.

    The judge also ruled that the Zinnikers -- and Americans in general -- don't have a fundamental right to drink the milk from their cow, and they do not have a right to choose, produce and consume foods and liquids.

    "Judge Fiedler's bizarre, unreasonable and harsh court ruling on the rights of farmers is likely to have a far greater effect, if it is allowed to stand," said political strategist and attorney Mike Baker.
    "Basically, that Wisconsin jurist is legislating from the bench based on his own personal interpretation of the U.S. Constitution's commerce clause," Baker said. He added that this case may be part of a larger attempt by government officials to dictate what Americans can and cannot consume.

    "The Nanny State is becoming more and more intrusive as politicians and black-robed lawyers wish to decide what we can eat, how much we are allowed to eat, and when we're allowed to eat," Baker noted.

    Food Control?

    After the massive Obamacare bill passed in 2010 giving the government control of one-sixth (1/6) of the U.S economy, they immediately began the pattern of creating a crisis, selling their remedy to the crisis and passing legislation that doesn't alleviate the crisis, but gives lawmakers and the President more power. That new crisis is obesity, according to several political observers.

    "First, we had the First Lady Michelle Obama speaking frequently about childhood obesity, adult obesity, American obesity. The subtext of her message is that Americans are overfed, fat slobs who needed to be prodded away from the refrigerator," said Baker.

    Then, according to the congressional record, after more than a year of consideration, the U.S. Senate passed the U.S. Food Safety Modernization Act by a vote of 73-25. That meant not only did the Senate Democrats pass the bill but at least 20 Republicans consented to yet another government takeover. http://www.foodsafety.gov/news/fsma.html

    The bill passed in the House, then it was affirmed by the Senate Health, Education, Labor and Pensions (HELP) Committee in November 2009. President Barack Obama was more than happy to sign the bill into law since it have his minions at the FDA more power which increased the power of the Obama White House, noted Thomas Spence, a food and beverage industry specialist, who served as a food and nutrition expert at the Department of Justice during the Vietnam War.

    "The "Act" gives even greater authority to the Food and Drug Administration (FDA) allowing the agency to hire additional bureaucrats to conduct more frequent inspections at food processing plants and assigns more governmental authority in recalling food," Spence said.

    The "Act" also requires food processing companies to register with the FDA in order to detail their safety plans, and it allows the FDA to create more food safety regulations. Moreover, it establishes stricter standards on food safety. An intended or unintended consequence is the rise in food prices as a result of increased production costs necessary to comply with FDA regulations.

    The Centers for Disease Control reports that tens of millions of Americans are made ill by food-borne illnesses, resulting in thousands of deaths every year. In an effort to prevent future outbreaks of such illnesses, the bill requires farmers and food processors to declare to the Food and Drug Administration how they are preparing the foods to keep them safe at various stages of production, the magazine The New American reported.
