    Armed Oath Keepers Vow to Stop Future Kim Davis Arrests

    The Oath Keepers – a loosely organized band of gun enthusiasts who brand themselves a “Christian patriot” militia – will descend upon Rowan County, Kentucky to thwart any future arrests of Kim Davis.

    Their action follows participation in last year’s contentious Bundy Ranch standoff in which they aimed loaded firearms at federal officials in addition to fear-mongering during the Ferguson protests (under the guise of “helping” the local militarized police force contain African-American protesters).



    Posting on the organization’s website yesterday
    , Oath Keepers founder Stewart Rhodes stated he’d been in touch with Mat Staver of the Liberty Counsel to discuss offering protection for Kim Davis against further incarceration. He said in part:

    We believe Federal District Court Judge David Bunning grossly overstepped his bounds and violated Mrs Davis’ due process rights, and in particular her right to a jury trial. This judge has assumed unto himself not just the powers of all three branches of government, but has also taken on the powers of judge, jury, and “executioner.” What matters to us is not whether you agree with her position on gay marriage or her decision to not issue marriage licenses. What matters is that the judge is violating the Constitution in his anger and desire to punish her for going against his will.

    Later in the article he concluded:

    No one man should have that kind of power in his hands alone to decide guilt and impose a sentence of indefinite detention.

    Under our Constitution, that dictatorial power does not exist.

    We must stand against this. And so we will protect her and prevent it from happening again.

    Rhodes additionally published a phone call with Jackson County (KY) Sheriff Denny Peyman in which he states he and other Oath Keepers are en route to Rowan County now.
    Arguing that the Rowan County Sheriff failed to perform his legal duties in “interceding” on Davis’ behalf, Rhodes stated his organization will have to step in in their stead. As far as we’re concerned, this is not over,” Rhodes said, “and this judge needs to be put on notice that his behavior is not going to be accepted and we’ll be there to stop it and intercede ourselves if we have to.

    If the sheriff, who should be interceding, is not going to do his job and the governor is not going to do the governor’s job of interceding, then we’ll do it.”
    When asked by Rhodes what he would have done were he the Sheriff of Rowan County, Peyman responded It remains to be seen if Judge Bunning will hold Davis in contempt of court again when she returns to her office next week. Even with a contempt order incarceration isn’t a guarantee given the media circus it created the first time around.

    Whatever the case, it appears armed right-wing resistance is ready to heed Huckabee’s call to anarchy in ignoring laws that conflict with a person’s religious beliefs.

Gay marriages were banned under Texas law and under Texas law this Judge has no obligation to perform marriage ceremonies, so she broke no law, committed no crime, and therefore there is no cause for arrest or jail.

    Kim Davis violated the law, she violated a court order, she was in contempt of court, and the law says she is to be arrested at the discretion of the Judge and rot there until she decides to comply. That's the way contempt of court works in the United States, for everyone, lawyers, journalists, witnesses, anyone who is failing to comply with the orders of a Court. Ask all those people in Ferguson who couldn't pay their tickets under court order. They rotted in jail until the ticket was paid.

    I hope they throw Kim Davis in jail and throw away the key if she tries to prevent her deputies from issuing marriage licenses to gay couples. This picking on gays because of "christianity" is illegal and unChristian. I wanted to puke listening to Huckabee and that Liberty Institute lawyer. They should rename the institute "Liberty For Me, But Not For Thee Institute", phony hypocrites.

    During an radio appearance Thursday, presidential candidate and former Sen. Rick Santorum (R-PA) compared Kentucky county clerk Kim Davis to civil rights hero Martin Luther King Jr., saying he was "very proud" of Davis for going to jail for her beliefs.

    On New York's AM970 The Answer, Santorum said he knew "this assault of people of faith is going to happen" after the U.S. Supreme Court decision legalizing gay marriage came down, in an interview first flagged by BuzzFeed's Andrew Kaczynski.

    "Martin Luther King went to jail because he didn’t follow the law. There’s a long precedent in America from people saying, ‘You know the law has to change to accommodate what is the right thing to do, in their own moral judgment,'" Santorum said.


    He called the ruling that made gay marriage the law of the land an "abuse" by the Supreme Court and said "we shouldn't be in this position" where a clerk is faced with either violating her religious beliefs or going to jail.


    "I can tell you I’m very proud of the fact that she stood up for those convictions and she should stood up for what I believe," Santorum said. "This shouldn’t be a requirement in this country that you have to cooperate with something that in many religions is a grave sin in order to hold a job."

    And this is one of the reasons you'll never be President. We wouldn't want you to hold a job you would refuse to do. We've already had enough of that out of our government.

    MOREHEAD, Ky. (AP) — Kim Davis sat in a church pew on a Sunday morning about four years ago, listening as the man in the pulpit preached of forgiveness and God’s grace.

    Davis until then might have seemed an unlikely candidate to wage a moral war over the institution of marriage. She has acknowledged through her attorney that she had made ‘‘major mistakes’’ before she was born again.

    But that Sunday morning, as the preacher spoke from the book of Galatians, Davis — then 44 years old — repented and pledged the rest of her life to the service of the Lord.


    Now as the Rowan County clerk, Davis is refusing to surrender in a battle over who can and can’t be wed. She invoked ‘‘God’s authority’’ Tuesday as she defied a series of federal court orders and once again denied marriage licenses to same-sex couples.


    Since the Supreme Court legalized gay marriage across the nation, couples have stood in her office and wept. They have shouted and called her a bigot. They have tried to reason with her.


    But Davis, who usually wears a skirt that reaches her ankles and her hair to her waist, refuses to relent, even under the threat of a contempt of court charge, steep fines or jail time.


    ‘‘She has found herself in a situation she never envisioned,’’ said Mat Staver, founder of the Christian law firm Liberty Counsel that is representing Davis in her bid to refuse marriage licenses.


    After the Supreme Court’s landmark decision in June, Davis announced she would issue no more marriage licenses.


    Four couples, two gay and two straight, sued her, arguing she must fulfill her duties as an elected official despite her personal Christian faith. U.S. District Judge David Bunning ordered her to issue the licenses, an appeals court affirmed that order, and the Supreme Court on Monday refused to intervene, leaving her no more legal options.

    ‘‘It is a heaven or hell decision,’’ she said in a statement.

    At the time she repented in the church pew, Davis had been divorced three times, according to court records. Her current husband, Joe Davis, arrived at the courthouse Tuesday to check in on his wife as a protest raged on the courthouse lawn. It’s been an ordeal for her, he said. People have threatened to kill her and set their house on fire.


    Joe Davis, who described himself as ‘‘an old redneck hillbilly,’’ pointed to the rainbow-clad protesters on the opposite side of the lawn.


    ‘‘They want us to accept their beliefs and their ways,’’ he said. ‘‘But they won’t accept our beliefs and our ways.’’


    He said he and his wife have been together 19 years, but declined to elaborate on how much of that time they've spent married.


    Court records detail Kim Davis’ turbulent marital history: She has been married to her current husband twice, with a divorce and another husband in between.


    She married her first husband, Dwain Wallace, when she was 18, and divorced him in 1994.


    She acknowledged in a 2008 divorce filing having had two children in 1994 while she was not married.


    In 1996, at age 30, she married Joe Davis for the first time. They divorced in 2006.


    The next year, at 40 years old, Davis wed Thomas McIntryre, though their marriage lasted less than a year. She re-married Joe Davis in 2009.


    ‘‘She made some mistakes,’’ Staver said. ‘‘She’s regretful and sorrowful. That life she led before is not the life she lives now. She asked for and received forgiveness and grace. That’s why she has such a strong conscience.’’


    On Tuesday morning, April Miller and Karen Roberts, tailed by television cameras and rival activists, were there Davis opened her office doors. They hoped Davis would accept that her fight was lost and issue the licenses.


    Instead, Davis turned them away. On their way out, Miller and Roberts passed David Ermold and David Moore, 17 years a couple. ‘‘Denied again,’’ Roberts whispered in Moore’s ear.


    Ermold said he almost wept. They demanded to talk to Davis, who emerged briefly on the other side of the counter.


    ‘‘We’re not leaving until we have a license,’’ Ermold told her.


    ‘‘Then you’re going to have a long day,’’ Davis replied. She retreated into her office, closed the door and shut the blinds as a tense standoff erupted in the office around her. Dozens from both sides of the issue packed into the lobby.


    ‘‘Do your job,’’ marriage equality activists chanted.


    ‘‘Stand firm,’’ Davis’ supporters shouted back. They compared her to the Biblical figures Paul and Silas, imprisoned for their faith and rescued by God.


    But lawyers for the rejected couples, in asking the judge to hold her in contempt of court, requested that she not be sent to jail, and instead be issued a fine ‘‘sufficiently serious and increasingly onerous’’ to ‘‘compel her immediate compliance without delay.’’


    Bunning ordered Davis and her six deputy clerks to appear before him Thursday morning at the federal courthouse in Ashland.


    County taxpayers pay Davis $80,000 as the elected clerk. Staver said Tuesday that she does not have a fortune squirreled away somewhere to pay whatever punishment Bunning hands down. But she also refuses to resign.
