    • Shaken-baby case: Mother to spend 3½ years in prison before deportation

    ST. CHARLES TOWNSHIP — Another woman's arms comforted 8-month-old Angel Osornio as he fussed outside the courtroom Thursday.

    Inside, his mother sat handcuffed awaiting sentencing in the March 2004 death of her infant son, Michael. A jury convicted Angeles Sanchez of involuntary manslaughter in June.

    "I just want to fight for all my children and let my son Michael rest in peace," 18-year-old Sanchez said, pleading with 16th Circuit Judge Patricia Piper Golden to give her probation.

    Her pleas went unanswered when Golden sentenced Sanchez to 3½ years in the Illinois Department of Corrections. She also faces deportation upon completion of her term.

    "Nothing that happens today will ..." Golden said, pausing for a few minutes, "change Michael's short life."

    Michael died of injuries caused by shaken-baby syndrome. Kane County Assistant State's Attorney Pam Monaco said Sanchez inflicted the injuries on the baby, causing his death. Sanchez did not seek medical assistance for hours and later lied about the injuries, she said.

    "That is quite unimaginable, not only that someone would do this to a baby, but that she would not help this little baby," Monaco said.

    She asked that Sanchez be sentenced to the maximum five-year term to send a message to others.

    "We want it to be clear to everyone that no one should ever, ever, ever shake a baby," Monaco said.

    Defense attorney Glenn Jazwiec pointed out that Sanchez did not have a criminal history, had a sixth-grade education and had her first child at age 14.

    "This is a tragic situation," he said. "It is a tragedy that Michael Osornio died. It is a tragedy Ms. Sanchez sits here today convicted of involuntary manslaughter. It is a tragedy Ms. Sanchez did not have a normal childhood."

    He said the jury's verdict of involuntary manslaughter indicated Sanchez did not intend to harm her baby. He added that she has suffered the ultimate punishments, losing both Michael and his brother and sister.

    The Department of Children and Family Services took custody of Angel and his 4-year-old sister, who Thursday occasionally looked into the courtroom through a window. The little girl, in a blue ruffled skirt and glittery vest, later cried when a relative shooed her away from the window. She accompanied her father, who had no comment after the hearing.

    Sanchez did not express remorse over Michael's death in her statement to the court; instead, she focused on that she had followed all the rules while she was out of jail on bond and that she wanted to be released from jail so she could fight for her children.

    "I just want to ask you to be fair," Sanchez told the judge. "I will comply with everything you tell me. I will do whatever, but let me get out."

    Golden said Sanchez's request for mercy so she could get her children back was "not very realistic" given that DCFS had custody. She later ordered Sanchez to undergo a mental health evaluation and receive any necessary treatment.

    Although Sanchez did not have a criminal history, Golden said she felt deterrence was a very important aggravating factor.

    "This is certainly a situation where a child had a child," Golden said, explaining the sentence. "It is very tragic, but in terms of the authority I have today, it is a just sentence."

    Let's see, 3 1/2 yrs for shaking a baby to its death! It astounds me how little the children in our society, be they legal or illegal are worth, esp if they are killed by their own parents.
    Build the dam fence post haste!

    This is a another example of being in a bad twilight zone episode The sad thing is when she gets out and if she is deported, she will sneak back lickity split and start pumping out more babies

    The mother is charged with involuntary manslaughter and only sentenced to 3 1/2 years Sounds more like she is guilty of 1st degree murder of her child.
