Alaska man sues for proof of Obama's eligibility

JUNEAU, Alaska (AP) - A Juneau man has filed a lawsuit trying to compel the state of Alaska to prove that President Obama is qualified to be on the ballot.

Gordon Warren Epperly claims in the lawsuit filed in Juneau Superior Court that Obama's citizenship status is unknown, and that Obama was illegally inaugurated in 2009, KTOO reported (http://is.gd/quT1TH).

He also claims that Obama, by taking office, has committed a crime of trying to overthrow the U.S. government. Epperly is acting as his own attorney.

The lawsuit is seeking the state Division of Elections to obtain a physical, "verified" copy of Obama's birth certificate.

Epperly also questions U.S. Rep. Nancy Pelosi's right to run for federal office. He claims that as a woman, Pelosi has no inherent right to be a U.S. citizen or to hold office.

"There are no provisions in the Constitution of the United States that grants Women 'Political Rights' of Suffrage to hold any Political Office of the United States Government," the lawsuit says.

The lawsuit was filed against Obama, Pelosi, the state's election director and Lt. Gov. Mead Treadwell, a Republican who oversees Alaska elections.

The state has filed a motion to dismiss, with Assistant Alaska Attorney General Elizabeth Bakalar calling Epperly's statements incoherent, "repugnant and absurd."

She also says there's no factual basis for his claims, other than "wholly discredited conspiracy theories regarding President Obama's ineligibility to hold office." Bakalar wrote Epperly has no standing to bring a lawsuit, nor can he claim any personal harm to justify it.

The court has not scheduled a hearing.
