An openly gay Texas judge says she refuses to conduct marriage ceremonies for straight couples. No one tried to put her in jail. No federal judges tried to condemn her.

The Dallas County Judge Tonya Parker explained her decision at a monthly meeting for the Stonewall Democrats of Dallas.

“I do not perform them because it is not an equal application of the law. Period,” she said, according to the Dallas Voice, a newspaper for the gay community.

Parker is believed to be the first openly “gay” African-American elected official in the history of the state, according to NY Daily news.

Parker told the audience that while she refuses to conduct the ceremonies, she explains her reasoning to the couples.

“I use it as my opportunity to give them a lesson about marriage equality in the state because I feel like I have to tell them why I’m turning them away,” she said.

Her refusal to marry people based on the fact that they were not homosexuals wasn’t backed by any faith based belief or anything other than a personal vendetta.

So why isn’t this a big deal? Well, most people that go to her and get turned down go somewhere else.

People that know she is just being an attention seeker go somewhere else without even considering her as an option.

Now we bring up Kim Davis. A Kentucky county clerk who has become a symbol of religious opposition to same-*sex marriage who was jailed Thursday after defying a federal court order to issue licenses to gay couples.

So why was Kim Davis jailed and not the judge? Why did this gay couple come from another state, go to the only place not issuing gay marriage licenses, bring the media, then demand Kim Davis denounce her faith? Why couldn’t they have just went somewhere else?

Gay-Hating Westboro Church Protests Ky. Clerk Who Denied Same-Sex Marriages

Westboro Baptist — the Kansas church known for its virulently anti-gay agenda — has waded into the controversy over the Kentucky court clerk who refuses to issue same-sex marriage licenses in defiance of court orders.

But it is taking aim at Kim Davis, who has gone to jail for refusing to allow gay people to marry on the basis that it would violate her Christian beliefs.

Westboro, or WBC, is notorious and widely scorned for picketing funerals for service members of victims and mass shootings to draw attention to its "God Hates Fags" argument that God is punishing America for accommodating homosexuality.

Referring to Jeremiah 3:20 — the King James version of which reads, "Surely as a wife treacherously departeth from her husband, so have ye dealt treacherously with me, O house of Israel, saith the LORD" — WBC undertook a P.R. campaign over the weekend, attacking the thrice-divorced (and legally remarried) Kim Davis in a string of Tweets and YouTube videos as an "oath breaker" and a "lawbreaker" — meaning, of course, God's law.

"Get this straight: you can NOT repent of a sin you actively live. Kim must leave that man who's not her husband," the organization said on Twitter.

Attorneys for Davis, who was jailed Thursday, on Sunday filed filed an appeal, The Associated Press reported.

As if to clarify how it could so viciously attack someone who's fighting for its own principles, the group said, "Proud adulterers who divorce/remarry and refuse to call it a sin are no more a WBC member than a proud fag."

A Kentucky county clerk who is refusing to issue marriage licenses to same-sex couples despite this summer’s Supreme Court ruling that such marriages are a civil right is now asking the high court to cut her a break.

Attorneys for Rowan County clerk Kim Davis are petitioning the Supreme Court for an emergency order protecting her from being fired until her lawsuit against Gov. Steve Beshear (D) is resolved. Earlier Friday, the Rowan County Attorney formally requested that the state government charge Davis with misconduct, the first step in ousting her from her post.

Davis’ core argument is that granting a marriage license to a same-sex couple would violate her religious beliefs. Since this summer’s high court ruling on marriage makes it illegal to grant licenses to heterosexual couples while denying them to same-sex couples, Davis is simply refusing to issue them to anyone — and appealing every court decision that goes against her, perhaps in hopes of putting her religious liberty argument before the country’s ultimate legal arbiter.

Hours after the court’s June decision in Obergefell that same-sex couples have the same right to marry as heterosexual ones, Davis stopped issuing marriage licenses entirely. Multiple same-sex couples who were denied licenses by Davis’ across-the-board licensing freeze have sued her, and she has appealed initial defeats in those cases. After Beshear ordered her to either issue licenses to both hetero and same-sex couples or resign her post, Davis sued the governor’s office in hopes of persuading the courts that even playing a small bureaucratic role in facilitating same-sex weddings would violate her right to religious freedom.

Specifically, Davis points to Kentucky law’s requirement that marriage licenses bear the signature of the county clerk — and therefore make her an active participant in bringing a same-sex marriage into being. Davis appears to consider such participation irredeemably sinful: “If it happened, there is no absolution or correction that any earthly court can provide to rectify,”

SCOTUSBlog quotes her complaint as saying.

Davis is making a novel argument in seeking the emergency order from the nation’s top judges. She is employed by the people of Kentucky, and one of the duties her job exists to perform is the granting of marriage licenses to qualified couples. Davis is apparently arguing that her civil rights protect her from being terminated for misconduct over her nonperformance of a key duty of the job for which she is paid.

In previous lower court rulings, Davis has suggested that same-sex couples can either go to a neighboring county or seek the signature of a different Rowan County official. She has also suggested that the state could change the law about marriage license signatures, removing the requirement that she sign her name to couples she finds sinful. The lower-court judge has rejected all three arguments.

As an elected official, Davis is difficult to fire. Friday’s request for misdemeanor official misconduct charges against her by the Attorney General begins a slow process that could only actually kick her out of office if the state legislature votes to impeach her. She has also risked contempt charges by continuing to refuse to issue licenses in defiance of a court order. If the Supreme Court grants her request from Friday night, it would keep her in office until her suit against Beshear is ultimately resolved — potentially even by The Nine themselves.

Governor Beshear has released a statement on county clerks who refuse to issue same-sex marriage licenses in response to the Supreme Court ruling on gay marriage bans.

Beshear emphasizes that clerks do not have to agree with the ruling, but reminds clerks that they took an oath to uphold the constitution.

"Our county clerks took an oath, as elected officials, to uphold the Constitution of the United States and the Constitution of Kentucky and to provide important duties in their communities.

This oath does not dictate what our clerks must believe, but it certainly prescribes how they must act in carrying out their duties as elected officials.

Same-sex couples in Kentucky are now entitled to the issuance of a marriage license by every county clerk, based on Friday’s ruling by the United States Supreme Court. While there are certainly strongly held views on both sides of this issue, the fact remains that each clerk vowed to uphold the law regardless of his or her personal beliefs. I appreciate the clerks who are fulfilling their duties, issuing licenses to all couples, and I would expect others to execute the duties of their offices as prescribed by law and to issue marriage licenses to all Kentuckians.” reads the statement by Gov. The statement comes in light of the Rowan Co. Clerk refusing to issue the marriage licenses.

Clerk Kim Davis is standing firm on her decision to stop issuing marriage licenses, despite dozens of protesters who gathered outside the courthouse Tuesday.

"My conscience will not allow me to issue a license for a same sex couple," says Kim Davis, "because I know that God ordained marriage from the very foundation of this world to be between a man and a woman."

Davis says she decided to oppose the Supreme Court ruling on same sex marriage after prayer and fasting. She says anyone who wants to get a marriage license must do so in another county. The Lawrence County Clerk, though, tells LEX 18 that he's backing down and will now issue same sex marriage licenses.

Judge orders Kim Davis released, bars her from withholding marriage licenses

(CNN)A Kentucky clerk who was jailed for refusing to issue marriage licenses to same-sex couples can now go free, a judge said Tuesday -- albeit with a caveat she may not be willing to accept.

U.S. District Judge David Bunning ordered that Rowan County Clerk Kim Davis be released from jail Tuesday -- five days after he sent her there -- on the grounds that her deputies issued marriage licenses to same-sex couples in her absence.

But Bunning's new order says Davis, once free, still cannot interfere with her deputies issuing marriage licenses to all legally eligible couples.

It wasn't immediately clear how Davis would react to the order, but she has said she will not authorize her office to issue marriage licenses to same-sex couples if her name remains on the certificate.

Bunning's order makes no mention of revising the licenses to accommodate Davis, who says issuing a license with her name on it would violate her Christian convictions against same-sex marriage.

The latest order came on the day that Republican presidential hopefuls Mike Huckabee and Sen. Ted Cruz of Texas were to meet with Davis in the Carter County Detention Center, where she has been held since last week.

Contempt of court

Last week, Bunning ordered Davis to jail after finding her in contempt of court for refusing to issue marriage licenses to gay couples in Rowan County following June's U.S. Supreme Court ruling legalizing same-sex marriage.

Davis' legal team has filed appeals to the 6th U.S. Circuit Court of Appeals. It is asking that the state take her name off the licenses -- a move that her attorneys say would accommodate Davis while allowing same-sex couples to receive licenses.

"If (Davis' deputies) can issue licenses under someone else's authority ... Kim Davis would not stand in the way of that," one of her attorneys, Roger Gannam, told CNN's "New Day" on Tuesday.

Davis' legal team on Monday asked the appeals court for an injunction that would prompt Kentucky Gov. Steve Beshear to remove her name from the licenses -- something her attorneys say Beshear has the power to do through an executive order.

The lawyers say removing Davis' name would be a reasonable accommodation, such as that required under Kentucky's Religious Freedom Restoration Act.

The 2013 law prohibits the state government from substantially burdening a person's freedom of religion unless the government both proves it has a compelling interest in doing so and has used the least restrictive means to do it.

Davis should not have to resign or be jailed, Gannam said, because "accommodation of religious conscience is the law in Kentucky, including for elected officials."

"It's the duty of the Kentucky government to accommodate that, and they very easily could do so," Gannam said. "Gov. Beshear is the one who should do his job or resign."

Beshear's office said Monday he wouldn't respond to news of the appeals, saying the case was a "matter between her and the courts."
The state Legislature also could pass a law removing clerks' names from the licenses, but it won't be in session until January.

Beshear said the Legislature can do as it wishes, but he won't call lawmakers for a special session to deal with the issue, adding that doing so would cost "hundreds of thousands of dollars of taxpayers' money."

After Bunning found Davis in contempt of court Thursday, five of her deputies agreed to issue marriage licenses in her absence. The Rowan County clerk's office began doing so Friday.

"Her spirits remain high," another Davis attorney, Horatio Mihet, said Monday. "She was brought to tears when she heard that so many people outside the jail and around the country are praying for her."

Newmexican, here's the link to the original report on this gay judge, who made her announcement in 2012, 3 years before the US Supreme Court Ruling on same sex marriage. I remember when this report came out and under Texas law, she couldn't marry gay couples, so she decided not to marry straight couples, and she had the legal right to decide not to conduct marriage ceremonies, which is what she decided to do, so there was nothing to arrest her for since she was breaking no laws and was not discriminating against anyone.

Compiled information here is definitive that equal justice under the law in America is only a farce.

The Kim Davis rally did not go the way Ted Cruz planned

In the battle of Kim Davis' groupies, former Arkansas Gov. Mike Huckabee (R) is the clear winner.

The Republican presidential candidate made sure he was front and center Tuesday when the Kentucky clerk jailed for refusing to issue same-sex marriage licenses was released from jail. He stood next to Davis when she greeted supporters waiting for her outside, and even vowed to, if it was possible, go to jail "in her place."

Fellow GOP candidate Sen. Ted Cruz (Texas) also made the journey down to Kentucky, but his plan to show solidarity and share the spotlight with Davis was foiled by Huckabee, who sent an aide over to physically block him from speaking with reporters. The New York Times reports that after the incident, Cruz "appeared incredulous."

A few moments later, Huckabee stood shoulder to shoulder with Davis onstage, while "Mr. Cruz stood off to the side, keeping an unusually low profile during the event."

Before you start feeling too bad for Cruz, the trek wasn't a complete bust for the determined senator; his eyes were able to barely photobomb a snapshot of Davis with her husband and Matt Bevin, a Republican running for governor of Kentucky. If you squint, grab a magnifying glass, and hope for the best, you'll see them to the left.
