Obama Administration Losing 88 Percent of HHS Mandate Court Cases

Obama Administration Losing 88 Percent of HHS Mandate Court Cases

    Sarah Jean Seman | Jan 02, 2014

The 2013 scorecard for abortion pill mandate cases made on religious freedom claims is 53 – 7, and the Obama Administration is losing.
The mandate requires employers to provide abortion-inducing drugs and contraceptives to their employees. Nuns, private Christian colleges and religiously-run companies such as Hobby Lobby have filed court cases against the U.S. Department of Health and Human Services.
The Obama Administration is fighting an uphill battle, according to a tally released by Alliance Defending Freedom Tuesday:
To date, there have been 60 rulings touching on the merits religious freedom claims against Obamacare’s abortion pill mandate. 41 involve family - or religious - run businesses, and 19 involve non-profit religious organizations. Overall, the score is 53–7 in favor of religious liberty, involving 53 injunctions against the abortion pill mandate.Within these cases, the score in favor of families doing business is 35–6. The score in favor of non - profit religious entities is 18–1.
The First Amendment “free exercise clause” and the Religious Freedom Restoration Act are two key laws being used to invalidate the mandate.
Matt Boman, Senior Legal Counsel with ADF stated:
“Many people have seen the administration’s failures and scandals over the past year, particularly involving Obamacare and government overreach. But, not many things illustrate those failures more concretely than the Administration’s record of losses record on its abortion pill mandate.”
Legal grounds against Obamacare's abortion pill mandate do exist and they are being acknowledged in courtrooms across the nation.

Obama Regime Reeling From Hits Against ObamaCare, Even Media Beginning To Be Called Out, Poor Record In Court

Posted on 2 January, 2014 by sophia

    Downtrend.com

As we move forward into 2014, the Obama Regime is reeling from losses and hits taken to the president and his signature healthcare law. It seems that even the lamestream media is finding it more and more difficult to find any true ObamaCare success stories. In turn, they are also being called out for making things up.
For starters, we have just seen a Wednesday report on NBC News that was so blatantly false it is funny. This was aimed at highlighted a number of ObamaCare ‘success’ stories. Apparently, they either could not find any on their own or just did not want to work too hard looking. One of the examples they choose as an ‘average citizen’ is actually a Democratic political candidate and an Obama campaign worker. Whatever, but the fact that NBC News did not even bother to disclose these facts is a bit troubling.
This story focused on someone named Joyce Moore who lives in Pennsylvania. She said that her former healthcare plan was awful and she expected it would be canceled. With her new and ‘wonderful’ ObamaCare insurance plan she is supposedly saving $100 a month in her premiums and very happy. Strangely enough, she is also a longstanding Democratic advocate who ran in November 2013 as a candidate for the Upper Milford Township Supervisor office. It was also discovered that she worked 20-30 hour weeks on the Obama campaign as well.
This just goes alongside with a number of other stories we have recently seen coming from the media, trying to affirm how ObamaCare is turning into a success for a number of people. The group Organizing For Action has also been behind a number of other stories. Sadly, these are even harder to affirm than the NBC Report, since many of theirs do not even bother to list last names. In fact, at least four of their so-called ‘success’ stories are OFA volunteers or Democratic Party operatives. OFA is a group that essential reconstituted itself from the highly partisan Obama for America group just weeks after Obama was re-elected president in 2012.
The Regime is also taking its hits in the courts. The chief area for this has been the abortion pill mandate. Those businesses and groups that have chosen to fight the administration on these cases tend to focus on the religious freedom violations that this mandate forces into place. The current record is 53 losses for the Regime against only 7 wins. That is a pretty dramatic 88 percent loss ratio.
This abortion pill mandate forces employers to provide abortion inducing drugs and contraceptives to their employees. Some of the groups and people that have chosen to file court cases against this are nuns, private Christian colleges, and religiously run businesses like Hobby Lobby. Within these cases, we find that families doing business have won 35 out of their 41 cases and non-profit religious entities have won an amazing 18 out of 19 cases.
Hopefully, these trends can continue into 2014, when we expect to see even more legal challenges to the abortion pill mandate and other aspects of ObamaCare.
What do YOU think? Are these organizations like OFA being disingenuous about their support for finding ObamaCare success stories? Should the trend of court losses continue for the Regime in regards to abortion pill mandate cases?
