This is how the Obama administration rolls. Get in a confrontation with the president, and some IRS branch patent office makes trouble for you. That’s how “community organizers” do business. That’s the Chicago Way.
The latest example? After Washington Redskins owner Dan Snyder made it painfully, abundantly clear that he believes their team name is a tribute to their historic legacy and an honorable reflection of the spirit they aim to incorporate, a lowly patent office clerk just went ahead and cancelled their trademarks.
Mashable reports on this strange, politically vindictive, and probably illegal turn-of-events:

The decision from the U.S. administrator read, “…these registrations must be cancelled because they were disparaging to Native Americans at the respective times they were registered…”
.
The move affects six registrations and was brought about by a petition from five Native Americans. The office found that “a substantial composite of Native Americans found the term REDSKINS to be disparaging in connection with respondent’s services during the relevant time frame of 1967-1990.”

As for radical activists feigning to speak for all Native Americans (check out this photo essay response to a recent anti-Redskins ad) as well as for the American people, Dan Snyder’s attorney Lanny J. Davis put it well:

“As a supporter of President Obama, I am sure the president is not aware that in the highly respected Annenberg Institute poll (taken 2004) with a national sample of Native Americans, 9 out of 10 Native Americans said they were not bothered by the name the ‘Washington Redskins.’

“The president made these comments to the Associated Press, but he was apparently unaware that an April 2013 AP poll showed that eight out of ten of all Americans in a national sample don’t think the Washington Redskins name should be changed.
.
“We at the Redskins respect everyone. But like devoted fans of the Atlanta Braves, the Cleveland Indians and the Chicago Blackhawks (from President Obama’s hometown ), we love our team and its name and, like those fans, we do not intend to disparage or disrespect a racial or ethnic group.

“The name ‘Washington Redskins’ is 80 years old – it’s our history and legacy and tradition. We Redskins fans sing ‘hail to the Redskins’ every Sunday as a word of honor not disparagement.”

The timing of this move is pretty convenient for the president and is a classic example of both the distraction politics this administration is good for and the lack of seriousness of his administration.
This is clearly petty revenge served up by a president who has little regard for the law or respect for free speech. Just because you are “offended” by something, doesn’t mean you get to violate other people’s rights. This move is obviously less about the Redskins than it is about the president’s thin skin.

The United States Patent and Trademark Office has canceled the Washington Redskins trademark registration, calling the football team’s name “disparaging to Native Americans.”
The landmark case, which appeared before the Trademark Trial and Appeal Board, was filed on behalf of five Native Americans. It was the second time such a case was filed.
“This victory was a long time coming and reflects the hard work of many attorneys at our firm,” said lead attorney Jesse Witten, of Drinker Biddle & Reath.
Federal trademark law does not permit registration of trademarks that “may disparage” individuals or groups or “bring them into contempt or disrepute.” The ruling pertains to six different trademarks associated with the team, each containing the word “Redskin.”

The ruling does not mean that the Redskins have to change the name of the team. It does affect whether the team and the NFL can make money from merchandising because it limits the team’s legal options when others use the logos and the name on T shirts, sweatshirts, beer glasses and license plate holders.
In addition, Native Americans have won at this stage before, in 1999. But the team and the NFL won an appeal to federal court in 2009. The court did not rule on the merits of the case, however, but threw it out, saying that the plaintiffs didn’t have standing to file it. The team is likely to make the same appeal this time. Team officials are expected to make a statement this morning.

I've often said that political correctness is a barrier to truth and a door to tyranny. The latest proof of this comes by way of the Obama Administration's US Patent and Trademark office. If you can't bully, intimidate and strong arm 'em into agreeing with you, then circumvent the U.S. Constitution altogether and force them into compliance.

It's the "progressive" way.
The Washington Post reports:

The United States Patent and Trademark Office has canceled the Washington Redskins trademark registration, calling the football team's name "disparaging to Native Americans."

The landmark case, which appeared before the Trademark Trial and Appeal Board, was filed on behalf of five Native Americans. It was the second time such a case was filed.

"This victory was a long time coming and reflects the hard work of many attorneys at our firm," said lead attorney Jesse Witten, of Drinker Biddle & Reath.

Federal trademark law does not permit registration of trademarks that "may disparage" individuals or groups or "bring them into contempt or disrepute." The ruling pertains to six different trademarks associated with the team, each containing the word "Redskin."

"We are extraordinarily gratified to have prevailed in this case," Alfred Putnam Jr., the chairman of Drinker Biddle & Reath, said. "The dedication and professionalism of our attorneys and the determination of our clients have resulted in a milestone victory that will serve as an historic precedent."


The ruling does not mean that the Redskins have to change the name of the team. It does affect whether the team and the NFL can make money from merchandising because it limits the team's legal options when others use the logos and the name on T shirts, sweatshirts, beer glasses and license plate holders.

In addition, Native Americans have won at this stage before, in 1999. But the team and the NFL won an appeal to U.S. District Court in 2003. The court did not rule on the merits of the case, however, but threw it out, saying that the plaintiffs didn't have standing to file it. The team is likely to make the same appeal this time. Whether or not you believe the Redskins should change its team name, you should be concerned by this troubling development. It's a harbinger of things to come. The American free market and private enterprise are no longer free nor private. Liberty is under threat as never before.

Redskins trademark revoked by Obama’s US Patent Office in outrageous show of power

The Obama administration’s five-year assault on the rule of law advanced on a new front Wednesday when the U.S. Patent and Trademark Office revoked six trademarks of the Washington Redskins because Harry Reid doesn’t want to lose his majority leader office.
In a ruling that came almost a year after the board heard arguments in a case where the trademarks were challenged by American Indian advocates who claimed the name “Redskins” is a recognized racial slur that didn’t deserve trademark status, according to USA Today.
The team and its owner, Daniel Snyder, are virtually certain to appeal it in federal court, just as it appealed a similar ruling the board issued in 1999 (during Bill Clinton’s second term) and won in 2003 (in George W. Bush’s first term.)
The latest ruling came after months of increasing political pressure by Reid, who in late May organized a letter signed by 50 Senate Democrats urging the team to change its name because it is supposedly offensive to Native Americans.
To give an idea of the depth of Reid’s sincerity, the letter was not circulated among Senate Republicans, according to the New York Times, meaning the whole exercise is a transparent game of politics.
In short, because the Obama administration has presided over a moribund economy, thanks in no small part to Reid’s assistance and the passage of the American albatross known as Obamacare, Reid’s Democrats are in serious danger of losing the Senate this year – which means Reid loses his powerful post.
So he’s pulling out every stop to ensure that doesn’t happen, including incessant pandering to minority groups with gambits like his sudden loathing for the name of a team that has been there since Reid first arrived in Washington almost three decades ago.
According to USA Today, the decision was made by the ostensibly independent Trademark Trial and Appeal Board, an ostensibly independent administrative group within the U.S. Patent Office.
But if the IRS scandal proves anything, it’s that there’s no such thing as a non-political arm of the administrative state in the Age of Obama.
Reid’s statements after the ruling’s announcement have the air of the gloating despot he’s spent years becoming – with the help of millions of deluded Democratic voters who don’t know what they’re asking for.
“The writing’s on the wall,” Reid said, according to the Washington Times.
“Dan Snyder may be the last person in the world to realize this but it’s just a matter of time until he’s forced to change and do the right thing.”
Here’s the problem, as always for liberals. When they dismantle the rule of law, when the Redskins can be “forced” to do the right thing, the next Senate majority leader might have different ideas of what the right thing is.
Will the United Negro College Fund lose its trademark under a different regime? Is the NAACP’s trademark secure?
Only Harry Reid knows for sure – this year.

Senator Maria Cantwell of Washington state, recently circulated a letter among her fellow Democrats demanding that the Washington Redskins change their name for being offensive and disrespectful to Native Americans.
The letter has gained a fair amount of publicity.
The issue of the Redskin’s name drew the attention of President Obama last year who urged team owner Daniel Snyder to reconsider it.
However, Snyder has vowed not to change the team’s name.
Cantwell told the Washington Post she was appalled during a 2013 playoff game between the Redskins and her home state’s Seattle Seahawks. According to the Post she said the presentation of Washington’s team was “just so shocking to me,” and that the Redskins were offering “a caricature of a team that is not just respected by Indian Country,” she told the paper.
Cantwell might have been shocked earlier in life. Growing up in Indianapolis, Cantwell attended Emmerich Manual High School. Perhaps not surprisingly, in a state called Indiana, in a city called Indianapolis, the school’s mascot is Indian themed. In fact, its mascot is the “Redskins.”
Cantwell later attended Miami University of Ohio, graduating in 1980. Interestingly enough, Miami University used a “Redskins” mascot at the time.
It’s not clear whether Cantwell ever raised any objections while attending either school. Miami University dropped the logo in 1997, after a tribe that had sanctioned its use withdrew support.
At least several dozen high schools around the country still use “Redskins” as their team mascot, based on data compiled on Wikipedia. More than a dozen use the term “Braves,” as does Atlanta’s major league baseball team. The team name “Indians,” used by Cleveland’s baseball team, remains especially popular with high schools as well, with several hundred using it.

The Washington Redskins have responded to the Trademark Trial and Appeal Board’s decision to revoke the trademark for their team’s name and expressed confidence that the ruling will be overturned.

The Redskin’s attorney Bob Raskopf released a statement:

We are confident we will prevail once again, and that the Trademark Trial and Appeal Board’s divided ruling will be overturned on appeal. This case is no different than an earlier case, where the Board cancelled the Redskins’ trademark registrations, and where a federal district court disagreed and reversed the Board.
As today’s dissenting opinion correctly states, ‘the same evidence previously found insufficient to support cancellation’ here ‘remains insufficient’ and does not support cancellation.
This ruling – which of course we will appeal – simply addresses the team’s federal trademark registrations, and the team will continue to own and be able to protect its marks without the registrations. The registrations will remain effective while the case is on appeal.
When the case first arose more than 20 years ago, a federal judge in the District of Columbia ruled on appeal in favor of the Washington Redskins and their trademark registrations.
Why?
As the district court’s ruling made clear in 2003, the evidence ‘is insufficient to conclude that during the relevant time periods the trademark at issue disparaged Native Americans…’ The court continued, ‘The Court concludes that the [Board’s] finding that the marks at issue ‘may disparage’ Native Americans is unsupported by substantial evidence, is logically flawed, and fails to apply the correct legal standard to its own findings of fact.’ Those aren’t my words. That was the court’s conclusion. We are confident that when a district court review’s today’s split decision, it will reach a similar conclusion.

Mark Levin corrects the record today on all the misinformation he’s heard on the news today regarding the cancellation of the federally registered trademark ‘Redskins.’

Levin argues that despite the Obama administration ruling, the Redskins still own their name and logo and still own the use of their name and logo because of Common Law. And if you try and use their name and logo, Levin says the Redskins will sue you and will win because there is not a court in the land that won’t uphold Common Law.

Unbelievable! Political correctness truly run wild. The federal government, under the guise of protecting American Indians from racial insults perpetrated by an NFL team, has launched an all-out regulatory attack on the Washington Redskins.

After the U.S. Patent and Trademark Office cancelled trademark protections for the NFL’s Washington Redskins franchise, deciding that the team name and logo were “disparaging,” the Redskins once again provided a reality check for the Obama administration.
The Washington Redskins’ attorney Bob Raskopf replied to the ruling in a statement (via the Washington Post):

“We’ve seen this story before. And just like last time, today’s ruling will have no effect at all on the team’s ownership of and right to use the Redskins name and logo.

In today’s ruling, the Board’s Marc Bergsman agreed, concluding in his dissenting opinion:

It is astounding that the petitioners did not submit any evidence regarding the Native American population during the relevant time frame, nor did they introduce any evidence or argument as to what comprises a substantial composite of that population thereby leaving it to the majority to make petitioner’s case have some semblance of meaning.

The evidence in the current claim is virtually identical to the evidence a federal judge decided was insufficient more than ten years ago. We expect the same ultimate outcome here.”

U.S. attorney and conservative radio host Mark Levin pointed out that Common Law legally prevents other parties from commercially using the Redskins’ team name and logo. The Washington football team’s name has not been “cancelled” and they are not being forced to use a different name and logo.
No team picks a name & logo that they find to be insulting or demeaning – that simply defies credulity. The Washington Redskins’ history bears this out and the team has stated repeatedly that its name is a tribute, not a “slur.”
Former team owner George Marshall, the man who changed the team name from the Boston Braves to the “Redskins” in the 1930s, is now buried on Indian Mound Cemetery in Romney, West Virginia. Indeed, the team fight song is “Hail to the Redskins” – so much for its name being “disparaging”!
Of course, the selective way in that the Obama administration chooses whose rights to protect and whose rights not to protect raises serious questions. In no way does the perceived offense of any group overrule the equal rights of all Americans to free speech and intellectual property rights.

While the ruling by the Trademark Trial and Appeal Board’s decision to revoke the trademark for the Washington Redskins name would seem to be a relatively small issue, given what going on around us, it should scare us all. It’s a really big deal, and here’s why.

This ruling happened precisely because the campaign against the Redskins has failed in the court of public opinion. The issue has become the hobby horse of a small group of lefty commentators and politicians in DC, while regular Washingtonians, the people who make up the team’s base of fans and customers, are largely indifferent. So the left resorted to one of its favorite fallbacks. If the people can’t be persuaded, use the bureaucracy—in this case, two political appointees on the Trademark Trial and Appeal Board.
That’s what is disturbing about this ruling. Our system of government depends on the impartial administration of the laws by the executive. In this case, executive officials declared that a private company doesn’t deserve the protection of the law: if the ruling survives an appeal in the courts, the federal government will stop prosecuting violations of the team’s intellectual property rights, potentially costing it millions of dollars.
This ruling isn’t a slippery slope. It’s a slope we’ve already slid down: bureaucrats in Washington are now empowered to make subjective decrees about what is offensive and what will be tolerated, based on pressure from a small clique of Washington insiders. Anyone who runs afoul of these decrees, anyone branded as regressive and politically incorrect, is declared outside the protection of the federal government.

Patent/Trademark Office Says Redskins is Insulting to Indians, But How Are These Other Registered Names Not Disparaging to Women?

The U.S. Patent & Trademark Office was likely just doing what someone above their pay grade wanted them to do when it came to their politically fueled decision to strip the Washington Redskins of their trademark brand. The decision, however, very well may open up a huge can of worms in that new scrutiny will start bubbling on other registered brands that are far more blatantly disparaging to a certain group of people.

In this case… women.

The patent and trademark office says that the name “Redskins” is disparaging to a race of people because it potentially offends 30% of the American population. What about women, though?
According to the census last taken in the United States, women account for 50.8% of the population in America. So what now? Should all of the women in America who feel aggrieved by businesses using the word “Whore” or “Slut” file complaints too?

Our “Imperial President” Obama and his control-freak elite comrades in DC are once again abusing their positions, interfering with the rights of private individuals in the name of the collective.
They have long sought to position themselves as the advocate for the “little-guy” through a false public persona while simultaneously destroying them just far enough out of sight to be beyond the most casual observer. So it is with the fabricated offense of the Washington Redskins.
Under pressure from Hussein Obama, Harry Reid and other progressive operatives, the United States Patent and Trademark Office canceled six federal trademark registrations for the name of the Washington Redskins. The determined the name to be “disparaging to Native Americans,” making it ineligible for the trademarks which it already held.
The order came in a case brought against the team by a Native American “thinskin” named Amanda Blackhorse.
The ruling said, “We decide, based on the evidence properly before us, that these registrations must be cancelled because they were disparaging to Native Americans at the respective times they were registered.”
The team plans an appeal, stating, that the ruling would have “no effect at all” on its trademark rights while the case is on appeal.
A Redskins press release stated “We are confident we will prevail once again, and that the Trademark Trial and Appeal Board’s divided ruling will be overturned on appeal. This case is no different than an earlier case, where the Board cancelled the Redskins’ trademark registrations, and where a federal district court disagreed and reversed the Board.”
Maybe it is time for the owner, Daniel Snyder to rethink the name of the team, to bring it more in line with today’s Washington, DC. Under the present administration and given the direction our nation is heading, maybe the name Redskins has become totally irrelevant.
The Washington Tyrants does have a sort of nice ring to it, and it is unfortunately, very appropriate.

Amanda Blackhorse, a Navajo who successfully moved a federal agency to withdraw trademark protections from the Washington Redskins because it considers the team’s name derogatory, lives on a reservation where Navajos root for the Red Mesa High School Redskins. She opposes this name; the Native Americans who picked and retain it evidently do not.
The U.S. Patent and Trademark Office acted on a 1946 law banning trademarks that “may disparage” persons. “May” gives the agency latitude to disregard evidence regarding how many people actually feel disparaged or feel that others should feel disparaged. Blackhorse speaks of “the majority of Native American people who have spoken out on this.” This would seem implausible even if a 2004 poll had not found that 90 percent of Native Americans were not offended by the Redskins’ name. A 2013 AP-GfK poll showed that 79 percent of Americans of all ethnicities opposed changing it, and just 18 percent of “nonwhite football fans” favored changing it.
The federal agency acted in the absence of general or Native American revulsion about “Redskins,” and probably because of this absence. Are the Americans who are paying attention to this controversy comfortable with government saying, in effect, that if people are not offended, they should be, so government must decide what uses of language should be punished?
In today’s regulatory state, agencies often do pretty much as they please, exercising discretion unconstrained by law.
George Washington University law professor Jonathan Turley notes that in 2004 the Federal Election Commission held that the anti-George W. Bush movie “Fahrenheit 9/11” did not need to be regulated as an “electioneering communication” but in 2008 held that the hostile “Hillary: The Movie” was such a communication. In the regulatory state, the rule of law is the rule that law barely limits regulators’ discretion.
Although the death penalty clearly was not considered a “cruel and unusual” punishment when the Eighth Amendment proscription of such punishments was adopted, perhaps society’s “evolving standards of decency” have brought this punishment under the proscription. Standards of decency do evolve: No sports team launched today would select the name “Redskins.” Although Thomas Sowell is correct that “some people are in the business of being offended, just as Campbell is in the business of making soup,” the fact that some people are professionally indignant does not mean offense may be given promiscuously to others.
The name “Redskins” is more problematic than, say, that of the Chicago Blackhawks or Cleveland Indians presumably because “Redskins” refers to skin pigmentation. People offended by this might be similarly distressed if they knew that “Oklahoma” is a compound of two Choctaw words meaning “red” and “people.” Blackhorse, however, has two larger objections.
She says “someone” once told her that teams’ mascots “are meant to be ridiculed,” “to be toyed with,” “to be pushed around and disrespected” and “have stuff thrown at them.” She should supplement the opinion of that someone with information from persons more knowledgeable. But she considers “any team name that references Native Americans” an injurious “appropriation of our culture.” Has an “appropriation” been committed by the University of Utah and Florida State University even though they have the approval of the respective tribes for their teams’ nicknames, the Utes and Seminoles?
William Voegeli, a senior editor of the Claremont Review of Books, writes that the kerfuffle over an NFL team’s name involves serious matters. They include comity in a diverse nation, civil discourse, and “not only how we make decisions, but how we decide what needs to be decided, and who will do the deciding.”
Time was, Voegeli writes, a tolerant society was one with “a mutual non-aggression pact”: If your beliefs and practices offend but do not otherwise affect me, I will not interfere with them if you will reciprocate regarding my beliefs and practices. Now, however, tolerance supposedly requires compulsory acknowledgment that certain people’s beliefs and practices deserve, Voegeli says, “to be honored, respected, affirmed and validated” lest they suffer irreparable injury to their sense of worth. And it requires compelling conformity for the good of the compelled.
When two Oregon bakers chose, for religious reasons, not to provide a cake for a same-sex wedding, an Oregon government official explained why tolerance meant coercing the bakers: “The goal is to rehabilitate.” Tolerance required declaring the bakers’ beliefs and practices intolerable. We are going to discover whether a society can be congenial while its government is being coercive regarding wedding cakes and team names.
