Senate takes up U.S. Supreme Court nominee Sotomayor's confirmation

WASHINGTON - The Senate opened debate Tuesday on Sonia Sotomayor's Supreme Court nomination - with a slam-dunk vote elevating her to the nation's top court coming as soon as Thursday.
Six Republicans and most Democrats - who enjoy a 60-seat majority - have said they'll approve the Bronx-born federal appeals court judge. Sotomayor, whose parents immigrated from Puerto Rico, is poised to become the nation's first Hispanic justice.
Republican Senate leaders assailed Sotomayor as a so-called activist judge.
Top GOP Sen. Mitch McConnell of Kentucky said, "A judge must be able to check his or her personal or political agenda at the courtroom door and do justice evenhandedly. ... It's a test Judge Sotomayor does not pass."
But Democratic supporters fired back. "That is not the kind of judge she has been for the last 17 years" on the federal bench, argued Vermont Democrat Patrick Leahy.
"Instead, she has applied the law to the facts in the cases she has considered," added the top Dem on the Senate Judiciary Committee.
The Senate is expected to approve Sotomayor before starting a summer vacation at the end of the week. President Obama picked Sotomayor to replace retiring Associate Justice David Souter.
