    You can hear in the conversation recorded by the Albuquerque Police Department that James Boyd, the soon to be dead “illegal camper” was complying with the officer’s demands that he come down off the mountain. He had put his backpack on, and picked up what looks like a water bottle, and something else in preparation to hike down.
    He clearly states that he is walking out and admonishes the cops not to change the deal on him. They clearly changed the deal.
    For some reason, a flash grenade is set off and the dog released. You see Mr. Boyd drop his backpack and he appears to be trying to defend himself from the dog. Police say he had two knives in his hands when he was shot, but again, he was breaking camp. Knives are hardly a match for a half dozen armed officers, though technically enough for them to claim the shooting was justifiable.



    The white spot conveniently covers the critical few seconds when Mr. Boyd was killed, but this certainly appears to be an unjustifiable shooting. Whoever discharged the grenade escalated a situation which seemed to be defused.
    The police chief naturally defended the shooting, as is customary, and tried to put as much of the blame on the “crazy homeless guy” as he could. Whether he was mentally disturbed or not, he was complying and walking out when he was killed.
    This homicide is justifiable only because the ones who pulled the trigger are wearing a badge, the same badge of those who make the determination.



    New Mexico is in the news a lot these days for questionable acts by their various branches of “law enforcement.” The attention doesn’t seem to have deterred them in the least.
    The first video show the action without the pause, the second has a pause but also contains an accompanying newscast and police press conference. Both have the unfortunate white blur.

    APD Justifies Fatal Shooting of Homeless Camper Armed With a Knife Turning Away

    ALBUQUERQUE (KRQE) – Critics of the Albuquerque Police Department are raising serious questions about the fatal shooting of a homeless camper in the foothills, one even calling it murder.

    In the department’s first news conference since the shooting took place, APD did something they normally don’t do, releasing the entire video of the incident.

    Police say 38-year-old James M. Boyd is the man who was killed in the shooting last Sunday. So far, they’ve been unable to contact any of Boyd’s family members.


    New Albuquerque Police’s chief Gorden Eden said Friday that the video shows that the latest officer involved shooting is justified.

    Boyd was arguing with police for more three hours last Sunday in the foothills after officers went to talk to him about illegally camping in open space.

    At the press conference Friday, Chief Eden released video of the moment officers first contacted Boyd. When one officer went to frisk Boyd, the homeless camper could then be heard refusing to comply saying he was a government agent. The video shows that Boyd continued to refuse officer commands and began threatening them.

    “I’m almost going to kill you right now. Don’t give me another directive. Don’t attempt to give me, the Department of Defense, another directive,” said Boyd at the beginning of the incident.

    As the hours passed, Chief Eden said an APD Crisis Intervention Team officer and a State Police liaison were called to the scene. Both attempted to speak with Boyd, however, Chief Eden says Boyd continued to threaten officers. Police also discovered that Boyd had a violent 20-year criminal history that included multiple incidents of violence against officers.

    Around 7:30 p.m., video shows when officers moved in. At the beginning of incident, Boyd can be heard saying, “In a private world, if you were down at a bar or a bus stop, I would have the right to kill you right now because you’re trying to take me over. Don’t get stupid with me!”

    Video shows Boyd grab his bags and attempt to leave when officers began to use non-lethal force.

    As Boyd is moving, officers then threw a flash bang and released a K9 which appears to bite Boyd in the hand. Chief Eden said officers also used a taser gun and bean bag rounds. Two officers, Dominque Perez and Keith Sandy then both fired three shots each from their department issued rifles, causing Boyd to fall to the ground.

    It’s unclear how many shots hit Boyd. APD says it is waiting on a report from the Office of the Medical Investigators to determine a cause of death.

    But the video is already raising some questions because of how Boyd appears to be turning away from the officers when bullets were fired.

    Chief Eden called the shooting justified at the news conference, saying officers used non-lethal force first and that there was a direct threat made at an unarmed K9 officer. According to Chief Eden, Boyd was less than eight feet from the unarmed canine officer.

    “Actually if you watch the video tape, all the less than lethal devices were in fact deployed. It was when the canine officer was down directing the canine dog that the suspect pulled out the two knives and directed a threat to the canine officer who had no weapons drawn. He was handling the dog,” Chief Eden said.

    News 13 asked Chief Eden directly, “do you believe this was a justified shooting?”

    Chief Eden responded, “Yes, if you follow case law, ‘Gardner versus Tennessee’, there was directed threat to an officer.”

    In the video recording, officer Keith Sandy’s gun can be heard firing around the same time as a beanbag gun. Officer Dominque Perez can be seen firing second after several pops.

    The press conference ended abruptly Friday without reports being able to ask all of the questions they wanted. After taking questions for four minutes, an APD spokeswoman attempted to stop the press conference but Chief Eden took questions for two more minutes. After that, Chief Eden walked off, thanking reporters and saying “we’re good.”

    News 13 wanted to ask why the officers didn’t try to use a taser on Boyd again before moving in and why they didn’t have shields.

    APD says the two officers who fired shots remain on leave.

    One of the officers who was involved, Keith Sandy has a notable history with the department. APD hired Sandy in 2007 after he was fired by New Mexico State Police over the Wackenhut scandal. Sandy was accused of fraud for making money doing private security work while on the clock for State Police.

    When Sandy was hired by APD, the department said he would be a civilian employee and he wouldn’t have a gun or a badge. However, Sandy quickly rose through the department, landing on the ROPE Team, which goes after repeat offenders or some of the city’s most dangerous criminals.

    There is a huge controversy over the police shooting death of a homeless and mentally ill man, James Boyd, who was illegally camping. The victim refused orders to surrender by police officers. The stand-off lasted for 3 hours until he was shot by the police. Boyd died soon after.

    Protesters took to the streets in Albuquerque saying excessive force was used against Boyd and that Boyd appeared to be turning away from officers when they fired six rounds at him. The police chief said that the shooting was justified because Boyd was threatening the canine office with his knife. However, with this public outcry since that statement he made a week ago, he has actually back tracked on his statement although police have admitted to no wrong doing.

    More than 1000 people marched to the Albuquerque police headquarters not only in protest of Boyd’s death, but the police killings of 23 people in Albuquerque in the last four years. That is far above the national average for a city of Albuquerque’s size.

    America is quickly becoming a tyrannical police state with trigger happy cops.

    On March 16, APD officers executed James Boyd, a homeless man who was camping in the Sandia Foothills in the outskirts of Albuquerque.On March 25, citizens marched through the streets of downtown Albuquerque to APD headquarters to protest the shooting of Boyd and others shot by APD officers. At least 1,000 people attended, including a number of elected officials, including State Rep. Moe Maestas, D-Albuquerque, and City Councilor Rey Garduno.KRQE reported from the rally:
    A few hours after that protest, APD officers shot and killed another person.
    The victim, Alfred Redwine, was killed outside a public housing complex after officers received a 911 call from a woman who said Redwine had pointed a gun at two young girls. Police arrived on the scene and tried to get Alfred to come outside. When he did, he was shot by police.
    Police say Redwine had a gun and that he fired shots at them first.
    But witnesses are contradicting that story.
    Tammy Redwine is Alfred’s sister. She and her boyfriend are two of the witnesses who told reporters what they saw that night:
    Ernie Garcia, 43, Tammy Redwine’s boyfriend, said that before police arrived, the 30-year-old had gotten into a dispute with neighbors who were partying next to his mother’s vehicle. When police arrived, Redwine didn’t come out “because he was scared of police,” Garcia said.
    Tammy told KOB.com that her brother didn’t have a gun, and that she tried to get him to come out of the house to talk to the police:

    “He did not have a gun. He only had a cellphone. I know because I was talking to him and telling him to come out and talk to the police.”
    She was standing outside of his house, on the phone with him. Also there, Albuquerque police. “He’s all no sister. He’s all they’re going to shoot me. He’s like, I know they’re going to shoot me sister. I told him, no they’re not. The lieutenant promised me that they will not shoot you. He’s not here for that. He just wants you to come out,” said Tammy.

    The Albuquerque Police Department has been under investigation by the Department of Justice since November 2012 over several high-profile abuse cases and three dozen shootings since 2010. In spite of that, the man who designs the department’s training programs has been teaching officers to use MORE deadly force.
    The loosely organized internet hacker group known as Anonymous released a video on Wednesday, in which they refer to APD officers as “militarized thugs” and warn them of possible retribution for the police shooting of Boyd.
    The video states “We drastically need to address the growing police state that has occupied our country,” the figure says. “… Let them know that your city is not a place for war games against the homeless and the less fortunate.”
    The group urged the people of Albuquerque to “occupy” APD headquarters on Sunday, and warned of a cyberattack on the department’s websites:

    An Albuquerque police officer who killed a mentally ill homeless man last March expressed his desire to shoot him in the penis, new dash cam footage reveals.

    The video, obtained by KOB4 News, details a conversation between APD Officer Keith Sandy and another officer shortly before the fateful shooting of James Boyd.
    During the conversation, Sandy can be heard discussing his desire to shoot Boyd, who he refers to as a “f*cking lunatic,” in the penis with a shot gun.

    “For this f***ing lunatic? I’m going to shoot him in the penis with a shotgun here in a second,” Sandy said.
    Only two hours later, Sandy would do just that, taking Boyd’s life in the process.
    According to civil rights attorney Shannon Kennedy, Sandy’s statement reveals a premeditated decision to violently engage Boyd.
    “Two hours later he’s escalating the situation so he can do just that,” Kennedy told KOB4. “It’s chilling evidence and stunning that he has not been criminally indicted… It’s crystal clear and he says it with contempt in his voice.’”
    According to KOB4, internal investigators asked Sandy about his comment only one month after the shooting.
    Interestingly, Sandy claimed the comment was never made only moments after telling investigators that the statement was nothing more than “locker room banter.”
    Sandy attempted to belittle the incident by arguing that officers regularly make crude and cruel jokes, so much that a group of officers had to create a safe word to signal when inappropriate jokes have gone too far.
    “Of course it’s not a joke because he went forward and actually shot him,” Kennedy said. “Clearly he has complete disregard for people suffering from mental disabilities.”
    “What is so mortifying about this shooting, and thank goodness we have a tape to show exactly what he did– which is instead of shooting him in the penis, he shoots him in the lower back. So had James Boyd not turned around at that moment to set down his bags, he would have been shot in the penis.”
    Although currently on administrative leave, Sandy continues to carry his gun and badge according to an APD spokeswoman. Boyd’s death sparked international outrage earlier this year and has continued to fuel the debate over appropriate uses of force by law enforcement.
