House Republican: Tax Refund Money Illegally Funding Obamacare Program

House Republican: Tax Refund Money Illegally Funding Obamacare Program

    1:15 PM, JUN 12, 2015 •
    BY MICHAEL WARREN

The Obama administration is funding a provision of the Affordable Care Act unconstitutionally and against the decision of Congress, a Republican House member says. Peter Roskam of Illinois joined Fox News's Greta van Susteren Thursday to talk about the details of his findings in an oversight investigation by the House Ways and Means committee.

"We've just learned that the administration is paying out of a tax refund account, not appropriated money, into something called the Basic Health Program, which was authorized by Obamacare to subsidize various health insurance programs, but Congress never authorized any money for it," Roskam said. "And we've just learned over the last couple of weeks that the administration has paid out $60 million to the state of Minnesota, and that's just for one month."

    Watch Roskam's appearance below:

    The Washington Examiner has more:
Minnesota is the only state that has set up the basic health program, although New York is taking steps in that direction. If states opt in, the federal government would cover 95 percent of the subsidies that enrollees would have otherwise collected in the marketplaces, although it's not allowed to cover administrative costs.

Aides said they only recently discovered how the administration was funding Minnesota's program, through looking at the state's first-quarter payment this year.

Prodded by Roskam at a hearing Wednesday, Burwell acknowledged the basic health program payments are coming out of the IRS fund but said "tax credits for programs" aren't part of the discretionary funding that must be approved by Congress.

Republicans launch new attack on Obamacare funding

    BY PAIGE WINFIELD CUNNINGHAM | JUNE 11, 2015 | 4:21 PM
The Obama administration is funding the basic health program illegally by using a pot of IRS money used for tax refunds, says Rep. Peter Roskam, R-Ill. (AP Photo)

Leading Republicans are charging that the Obama administration is illegally funding yet another part of Obamacare, in addition to the part of the healthcare law over which House Republicans are already suing.

Their latest criticism centers on the Affordable Care Act's basic health program, an optional program for states that started this year, in which low-income residents can get subsidized, state-contracted health plans instead of buying them through the new online marketplaces.

The administration is funding the program illegally by using a pot of IRS money used for tax refunds, says Rep. Peter Roskam, R-Ill., who leads oversight efforts on the House Ways and Means Committee.

The law authorizes that money can be used for the law's insurance premium subsidies but not for the basic health program, he argues. He says using that funding would require approval from Congress since it is not authorized within the text of the law itself.

House Republicans have already targeted that same pot of money in their Obamacare lawsuit, saying it's being used illegally to pay for the law's insurance cost-sharing subsidies. That case is currently being litigated.

Now Roskam and other leading Republicans are trying to attack the administration on the basic health program funding, saying it's another example of the same tactic.

"It appears the administration is creating a pattern of taking funds from a permanent appropriation for purposes contrary to Congress' intent," Roskam wrote Wednesday to Health and Human Services Secretary Sylvia Mathews Burwell in a letter provided to the Washington Examiner, also signed by Reps. Kevin Brady, Tim Murphy and Joe Pitts.

"What extra-constitutional authority are you invoking that allows you to spend money that has not been appropriated?" Roskam asked her.

Federal Judge Rosemary Collyer is deliberating over whether the House GOP case can move forward on the merits. The administration has asked for it to be dismissed, saying the House doesn't have grounds to sue over how the executive branch is implementing a law Congress passed.

Minnesota has turned into refugee central.

    Affordable Care Act

    Affordable Care Act

Refugee status is a form of protection that may be granted to people who meet the definition of refugee, are of special humanitarian concern to the U.S., and are typically outside of their country and unable or unwilling to return home because they fear serious harm. Refugees come to the U.S. to start a new life. They work hard to find jobs and provide for their families. Today, many refugees lack health insurance, making it hard for them to get the care they need.

Healthcare.gov, a website managed by the U.S. Department of Health & Human Services, provides resources that describe the Affordable Care Act and how it will improve Americans’ access to health care. Refugees, as lawfully present immigrants, are eligible for the same protections and benefits under the Affordable Care Act as U.S. citizens. Refugees will remain exempt from the five-year waiting period to receive Medicaid and Children’s Health Insurance Program (CHIP), and will receive many new benefits thanks to health reform.

The benefits and protections in the Affordable Care Act are particularly important for refugees, who often arrive to the U.S. after years without access to proper medical care, and in many cases work for employers who do not provide health insurance. As outlined below, the new law will give refugees access to affordable health coverage and protection against insurance practices that can deny coverage to individuals with pre-existing conditions or those who become ill.

Quality affordable healthcare for refugees – under the new law, refugees enjoy:

    • The same protections and benefits in the insurance market as U.S. citizens, such as prohibiting lifetime benefit limits and rescissions.
    • Eligibility to purchase health insurance in Health Insurance Exchanges beginning in 2014 if they otherwise qualify (i.e., they purchase their own insurance or work for a small employer with fewer than 50 workers).
    • New public and private health insurance coverage options beginning in 2014. Many refugees will qualify for premium tax credits to purchase coverage.
    • Continued access to their current private health insurance plan and physician if they are satisfied with their current care.

Insurance security – beginning in 2014

    • Refugees whose incomes are above 133% of the poverty line but who lack employer-based or private health insurance will be able to purchase affordable coverage through Health Insurance Exchanges. Premium and cost-sharing tax credits will be available for refugees and others with incomes between 133% and 400% of the federal poverty level to make the purchase of quality insurance affordable.
    • Medicaid coverage will be available to anyone under 65 with incomes up to 133% of the federal poverty level, including refugees. Because even poor adults often are ineligible for Medicaid, many adult refugees become uninsured after their eight months of Refugee Medical Assistance is exhausted. Starting in 2014, Medicaid will be available to anyone – including parents and childless adults – who meets the income criteria.

Children’s Health Insurance Program (CHIP) extended

    • The law increases federal funding for CHIP from 2015 to 2019. CHIP will continue to provide affordable, quality coverage to many children in refugee families.

An end to discrimination by insurance companies

    • For health insurance plan years beginning on or after September 23, 2010, all new insurance plans and existing group health plans are prohibited from denying coverage to children under age 19, including refugee children, on the basis of pre-existing conditions.
    • In 2010, the law establishes a temporary high-risk pool program to provide affordable coverage to individuals who have been uninsured for at least six months and have a pre-existing medical condition.
    • For plan years beginning on or after September 23, 2010, insurance plans cannot impose lifetime dollar limits on coverage, and all group health plans must limit the waiting period for health insurance coverage to a maximum of 90 days.
    • Beginning in 2014, insurance companies will be banned from denying coverage or charging higher premiums based on underlying health status.

Coverage for children aging out of foster care

    • Effective 2014, states must extend Medicaid coverage up to age 26 for young adults who have aged out of the foster care system, including those aging out of the Unaccompanied Refugee Minors program.
