    Judge orders DPS to end policy of tying driver's licenses to immigration status

    AUSTIN - A state district court judge in Austin today ordered the Texas Department of Public Safety to temporarily halt the implementation of new driver's license rules.

    Judge Orlinda Naranjo issued a temporary injunction against DPS, deciding it had acted outside of its authority by implementing the rule.

    The new driver's license rule, adopted in October, has had adverse consequences for legal immigrants. People whose visas expire in fewer than six months have been denied licenses to drive and identification cards.

    The intent of the rule, DPS administrators said, was to stop undocumented immigrants from obtaining identification.

    Under another facet of the policy, different-looking licenses are issued to noncitizens who are in the country legally.

    Naranjo's ruling is in response to a lawsuit by the Mexican American Legal and Educational Defense Fund that argued only lawmakers have the power to decide whether to restrict the availability of driver's licenses based on immigration status.

    They asked the judge to issue an injunction, stopping the DPS from implementing the policy until the court could hear additional evidence and render a final decision.

    "The Texas Department of Public Safety in an overreaching action exceeded its authority by systematically denying full licenses to people who reside legally here in Texas," MALDEF lawyer Nina Perales, said in a statement. "We are pleased that the Court has concluded that the plaintiffs are entitled to an injunction pending a full trial."

    OK, Can DPS then keep track of those people and see which ones were not able to renew their visas? Then if they are ever pulled over, it should show up on the database and they can be deported.

    I gather this was new. Is there anyone here, who has delt with the government and had mistakes happen? Is there anyone here who hasn't at one time or another had to go through the grief of sending yet another copy or going down in person with mounds of papers to clarify things and camp out for the day? And it was their mistake. Where this idea came from that we can't enforce our laws because someone got lost in the shuffle is insane. NOTHING is 100% perfect. Did they follow up this story to find that if once those who were denied got to the proper people had it remedied or not? I mean with just our new government officials they have found way to many are not paying their taxes.....should we just say forget taxes all together because the IRS screws up and doesn't do their job right? The Police doesn't catch every single criminal, speeder, jay walker etc. so forget enforcing the law until it's perfect? I mean please. Everyone gets jerked around at one time or another........

    Logically instead of being totally unable to get a license they should get licenses that expire just before their visas.
