Rep. Jose Serrano (D-NY) asked Associate Justice Clarence Thomas about the Supreme Court hearing Obama eligibility cases. Justice Thomas, a conservative who is NO fan of Mr. Obama, said, "We're evading that one. We're giving you another option." Presumably, he was referring to the House possibly impeaching Mr. Obama if the 2010 elections bring about a tide change.
If Associate Justice Samuel Alito signs on now with the other three conservatives on the Supreme Court, Atty. Orly Taitz and Atty. Mario Apuzzo et al might still be defeated 5-4. If such a decision were to include - God forbid - an ill-begotten ruling in favor of Mr. Obama's eligibility, there would be no further opportunity for another trial.
But, after Nov. 2nd, if Justice Alito wisely waits for Associate Justice Anthony Kennedy to show some indication that he is willing to truly consider an eligibility case, Kerchner, for example, on the merits, the time will be right for it to be brought for a hearing before the full Supreme Court.
If there is a more plausible reason for Justice Alito's tarrying and delaying a call for an oral hearing, I'd like to hear it.
