Ron Paul 2012
Senators John McCain, Jon Kyl, Lindsey Graham and Kelly Ayotte have released a statement AGAINST the guarantee to US citizens of their Sixth Amendment Right to a jury trial under the US Constitution. They have urged their colleagues to vote against the Smith-Amash amendment, which repeals the unconstitutional portions of the NDAA.
The issue has been aired out, and the intent and effect of the NDAA's provision for indefinite detention of American citizens is well-understood. The House will be voting on the Smith-Amash amendment to the 2013 NDAA bill today, May 18, 2012. The amendment explicitly bans indefinite detention and military commissions from the US and repeals section 1022 from the 2012 NDAA.
Is there any reason loyal senators should not direct the Sargent-at-Arms of the US Senate to arrest this Gang of Four for violation of the Senate Rules? Common sense dictates that if senators can be arrested for lesser violations, such as violations of decorum, wouldn't the violation of the solemn oath of office be included as well? The Oath of Office is required by Article VI of the US Constitution. Although some parts of the Constitution are open to debate, one part which is not is the Sixth Amendment right to a jury trial in "all criminal prosecutions." According to the Senate rules, the Sgt.-at-Arms can even arrest the president of the United States.
From the US Senate Sgt-at-Arms website:
Quote:
The sergeant at arms also protects the members and can arrest and detain any person violating Senate rules. On the orders of the Senate, the sergeant at arms can even arrest the president of the United States.
The Sixth Amendment of the US Constitution, the Bill of Rights reads:
Quote:
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.
The intransigence of these senators in persisting to enact laws which cannot be enacted is an outrage to the American people. The will of the people to protect their birthrights has been made abundantly clear by action in many of the Great States. There is no middle ground. The time has come to take a stand for the rights bled for by our forefathers in so many wars both on American soil and abroad.
You senators who are loyal to the US Constitution, there is no leeway here. Your duty is to direct the Sgt.-at-Arms to arrest these treasonous senators who have beyond a shadow of a doubt expressed their intent to overthrow the US Constitution. They have done this in writing and signed in their own hand. This shall constitute Exhibit A of evidence at their treason trials, to be brought and judged by the US Senate. The penalty for treason against the United States is death, and the Oath of Office mandates, in full:
Quote:
I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.
Capitol switchboard: 202-224-3121 and tell them your zip code if you don't know who your senator is. Arrest the Gang of Four: McCain, Kyl, Graham, Ayotte.
