Thank her for stopping Schumer from breaking Senate rules twice already and ask her to stop his third 'Plan C,' which is to insert some form of 'Parole' for illegals into the budget bill, which will only need 50 instead of 60 votes to pass the Senate.

When sending emails to the Senate Parliamentarian use some of the arguments that I posted on a previous post called "The Parliamentarian Path to Victory - Take Action Now!" at https://www.alipac.us/f12/parliament...on-now-388295/

The article at https://www.rstreet.org/2021/07/21/i...the-byrd-rule/ shows that there is no precedent for amnesty in the reconciliation bill.

Lastly, here is a link to entire text of the Parliamentarian's ruling against Plan A. It seems to me that Plan C violates the same provision that Plan A violated. What better way to try to convince the Parliamentarian to rule against Plan C than to use the text of her arguments that she used to strike down Plan A. For example, when the Parliamentarian struck down Plan A she wrote that the nonbudgetary changes are things that "cannot be measured in federal dollars" and "things for which there is no federal fiscal equivalent. Changing the law to clear the way to LPR status is tremendous and enduring policy change that dwarfs its budgetary impact." https://www.pbs.org/newshour/politic...form-in-budget

In other words the nonbudgetary impact dwarfs the budgetary impact making the budgetary impact incidental or minor to the nonbudgetary impact. And that violates the provision of the Byrd rule which says that "a provision shall be considered extraneous if it produces changes in outlays or revenues which are merely incidental to the non-budgetary components of the provision".

Also not being mentioned in the Fake News media is the social security provision of the Byrd rule which says that "a provision shall be considered extraneous if it violates section 641(g) of this title." https://www.law.cornell.edu/uscode/text/2/644

Section 641 states: "Notwithstanding any other provision of law, it shall not be in order in the Senate or the House of Representatives to consider any reconciliation bill or reconciliation resolution reported pursuant to a concurrent resolution on the budget agreed to under section 632 or 635 of this title, or a joint resolution pursuant to section 907d of this title, or any amendment thereto or conference report thereon, that contains recommendations with respect to the old-age, survivors, and disability insurance program established under title II of the Social Security Act [42 U.S.C. 401 et seq.]."

In other words any legislation that would allow illegal aliens to get social security either through a pathway to citizenship or some other form of legal status is a violation of the Byrd rule in reconciliation. This is a second argument that should be included in emails that might not have even been brought to the attention of the parliamentarian. The only place it has been mentioned is under the section "Problem 3: Changes to Social Security" of the Federalist article at https://thefederalist.com/2021/07/12...-mass-amnesty/

The Center for American Progress claimed that "both of the pathway to citizenship options previously put before the parliamentarian passed the first part of the Byrd rule test."

This is why I think we need to include these arguments in our emails to the parliamentarian.
