Broken Promise? Trump Still Hasn’t Ended DACA

Broken Promise? Trump Still Hasn’t Ended DACA

    By: Federal Government Relations

Throughout the 2016 campaign, President Donald Trump vowed to roll back President Obama's unconstitutional Deferred Action for Childhood Arrivals (DACA) amnesty on his very first day. During a notable prime-time campaign speech in Arizona that focused exclusively on his immigration positions, President Trump said he would “immediately terminate President Obama’s illegal executive amnesty in which he defied federal law and the Constitution.” (Transcript of Trump Immigration Speech) Yet, more than two months into the Trump administration, the unlawful DACA program remains in effect as if President Obama was still in office.

Each day that the program is not ended sends a welcoming message to illegal aliens and signals to the American people that our government is not serious about enforcing our immigration laws. The DACA program—instituted in 2012— grants approximately 750,000 illegal aliens a reprieve from deportation, provides work authorization for two years, and makes certain illegal alien minors eligible for some taxpayer benefits. (See FAIR Legislative update, Jan, 24, 2017) According to the U.S. Citizenship and Immigration Services (USCIS), it is still accepting and processing DACA requests under the existing policy. In 2016, USCIS processed about 750 DACA applications and renewals each day. (See USCIS DACA Numbers, 2016)

Despite his firm commitment to repeal DACA during the campaign, President Trump and his administration have hesitated to revoke it. In January, White House Chief of Staff Reince Priebus, a long-time advocate for amnesty, said that President Trump will work with Congress to find a “solution” for illegal aliens who benefited from DACA, rather than immediately rescinding the unconstitutional amnesty program. (Fox News, Feb. 16, 2017) At his first presidential press conference, Trump sounded a different tune from the campaign, saying he was going to deal with DACA in a manner that “show[s] great heart” and that it was a “very, very difficult subject.” (Id.) Recently, in a closed-door meeting with Senate Democrats, Department of Homeland Security (DHS) Secretary John Kelly said, “I’m the best thing that happened to DACA – it is still on the books” and “I can guarantee you we’re not going after kids that are fully DACA qualified.” (Politico, Mar. 17, 2017) He reiterated this sentiment later, “We have not picked up — I don’t care what you read or people say — we have not in my time picked up someone who was covered by DACA.” (Congressional Quarterly, Mar. 29, 2017)

President Trump’s failure to end DACA is disappointing because it was a focal point of his campaign and a position that resonates with Americans. A Pulse Opinion Research poll commissioned by the Center for Immigration Studies just ahead of the election found that voters overwhelmingly want our immigration laws enforced. (See FAIR Legislative Update, Nov. 15, 2016) Specifically, the poll found that 56 percent of likely voters supported “causing illegal aliens to return to their home countries by penalizing employers, getting cooperation from local law enforcement, and denying welfare benefits” and 54 percent believed that there has been “too little effort placed on enforcing our immigration laws.” (Id.) A Zogby Analytics exit poll conducted on behalf of FAIR similarly found that American voters, including Hispanic Americans, want our immigration laws enforced. (See FAIR Legislative Update, Nov. 22, 2016)

While a draft executive order to repeal DACA has already been prepared, the administration has other tools at its disposal as well. (See President Trump’s Executive Actions, Jan. 26, 2017) DHS Secretary Kelly can end the program simply by instructing USCIS to stop issuing work permits. (LA Times, Feb. 16, 2017) Another option is for Attorney General Jeff Sessions to direct Department of Justice (DOJ) lawyers to review the program. If the DOJ attorneys determine that DACA is not legal or that it is not a “responsible use of prosecutorial discretion” then DHS would be directed to stop issuing and renewing work permits. (Id.) Finally, the states could file a lawsuit against the Obama administration’s expanded deportation priorities which the Trump administration could decide not to defend. (Id.)

FAIR President Dan Stein said, “However much people might empathize with the situation of DACA recipients, we must make it clear that the responsibility for their circumstances rests with the parents who knowingly violates our laws and put their children in this situation. In every other area of the law, we hold lawbreakers accountable for any negative consequences to family members, and immigration law should not be the exception.” (See Dan Stein’s Op-Ed Let the DACA Program Lapse, Feb. 21, 2017)

No one feels sorry for these people. They're all grown adults now, most of them with anchor babies bleeding US dry as a bone. They're the adults committing crimes, stealing jobs, sucking on welfare. GET THEM OUT.

END DACA NOW. Wake Up. We've got our own children to worry about, our own grown young adults who need jobs, our own people who can not afford to pay to support our own people and them too. GET REAL. Get them out of here. NOW.

The White House needs to be having discussions about getting rid of Reince Priebus, not Bannon!

priebus is best friends with ryan & we know his statements of open borders beliefs. It really seems that the deal was struck, trump acquiesces with ryan, priebus programs giving directions; therefore no campaign promises kept by trump. We might have a more secure border in the future and more enforcement of immigration laws due to jeff sessions as AG but future windfalls fall way short of promises made. This is the ultimate ego trip & money maker for trump. How much money do these people need? Pockets are empty in the afterlife.

Good to see FAIR following ALIPAC's lead on calling Trump out on his promise to end DACA. As folks have seen many times before, what begins here at ALIPAC often begins to reverberate among other national and local groups.

ALIPAC Extends Deadline for Trump To Stop Giving DACA Amnesty To illegals

    For National Release

    April 18, 2017

Americans for Legal Immigration PAC (ALIPAC) is extending their deadline for President Trump to stop reneging on his campaign promise to end Obama's DACA Amnesty for illegal aliens to the new date of April 30.

Trump is breaking his campaign promise to end Obama's DACA Amnesty on his first day in office. DACA, or Deferred Action for Childhood Arrivals, was created by Obama memos instructing federal agencies and employees to violate their oaths of office and U.S. laws by giving jobs, ID, and immunity from existing laws to illegal aliens claiming to be under 35 years old.

The original ALIPAC deadline for Trump was Tax Day of 2017, and while a recent poll of ALIPAC donors and volunteers revealed more than 90% support rescinding the national organization's endorsement of Donald Trump originally issued during the GOP Primary on Feb 29, 2016, some ALIPAC backers would like to give Trump more time.

Therefore ALIPAC will hold off on rescinding the PAC's endorsement of Trump to April 30th, which would be the end of Trump's first 100 days in office.

ALIPAC also plans to try a new tactic of lobbying Attorney General Jeff Sessions to instruct the White House that they must honor Trump's campaign promise to end DACA Amnesty on his first day in office by simply issuing a memo that cancels Obama's DACA memos, because Trump's continuation of the program violates numerous existing US immigration laws and the US Constitution.

"We are finding that there is still a lot of confusion out there about Obama's DACA Amnesty for illegal aliens that was created by mere memos. A lot of people do not understand or want to face what Trump's continuation of these law- and Constitution-violating memos mean for our nation," explained William Gheen, President of ALIPAC. "We are also finding that Donald Trump no longer appears to be listening to Americans who led the fight against illegal immigration before his recent entry on the issue. Therefore, we will now appeal to Attorney General Jeff Sessions because it is his job to ensure that our laws and Constitution are honored by all elected officials including President Trump!"

ALIPAC will now rescind the organization's endorsement of Donald Trump on April 30 if Trump continues to break his promise to end Obama's DACA Amnesty for illegals through his first 100 days in office.

This is more than enough time because Donald Trump could end Obama's DACA Amnesty by merely filing a memo to affected federal agencies simply nullifying the unconstitutional memos Obama sent out years back.

Democrats would be powerless to stop Trump from ending DACA and unable to sue in court because DACA is not a law, it is not an Executive Order, and is clearly a violation of US laws and the Constitution.

ALIPAC is asking the organization's 50,000 e-mail recipients, and 800,000 social media supporters (who rarely receive word of ALIPAC's releases due to censorship from organizations like Google and Facebook) to begin contacting Attorney General Jeff Sessions at 202-514-2000 and @JeffSessions to say:

"I'm calling to ask Attorney General Jeff Sessions to honor his oath of office by instructing President Trump and his White House staff to immediately end the Deferred Action for Childhood Arrivals (DACA) amnesty directives issued by Obama's memos. These DACA memos give amnesty, immunity, ID, and jobs to illegal aliens even though such actions violate numerous existing immigration laws. DACA also sends a message around the world that illegally immigrating to the United States will be rewarded. Trump's DACA Amnesty uses uncontrolled executive power to deprive all Americans of a constitutionally governed republic and a voice in national policies by implementing illegal immigrant amnesty legislation that had been defeated in Congress by the American public several times since 2005! Attorney General Jeff Sessions must insist that DACA be repealed by President Trump before April 30, 2017!"

All Americans who want President Trump to succeed with his campaign promises and want to see all illegal immigrants held accountable equally under our existing laws should take a few minutes to contact President Trump at 202-456-1414 and AG Jeff Sessions at 202-514-2000 to let them know continuing Obama's DACA Amnesty threatens to undermine the credibility and public support levels for Trump's presidency.

You know I'm not feeling good about any solution to the illegal problem. Not any good solution.

I am not a fan of Pres. Bush I, and I don't think he wrote the statement, but his answer, when he was asked about whether he would try to change the law on abortion made sense. He answered, ''Nothing will change about abortion until and unless we change the hearts and minds of the American people."

I think that is a good statement to apply to any problem we have.

Unless we have the hearts and minds of the American people, nothing will be done about illegal immigration.

Yes, we have millions who want it changed, but there are plenty who don't - for their own reasons. Truly a few are due to their own real beliefs (wrongheaded though they be), some are against it because they are against anything conservative, some because they are making a fortune off it.
Then there is the group with the power, connections and money who truly want this country, as we know/knew it destroyed. They have the money, they have the power, they have the media to do their bidding.

This is more a war of 'stories' than anything else. it is a war for the hearts and minds of this country.

While illegal aliens are certainly being used to help bring this country down - the problem is much bigger.

It strikes me, again, President Trump just didn't fully comprehend the strength of the opposition and the strength of the media's help in this. I think he is trying to placate them and I think that is the wrong idea.

While I can see why he might wait on some things that could end up in court with a decision we won't like, I think there is plenty he could do otherwise.
