    Firing Illegals?

    Greetings fellow patriots,

    I have a question: A co-worker, who I am trying to convert from the darkside and who I hope is slowly turning, told me something infuriating. He told me that he was directed by some governmental agency that he is precluded from firing illegal immigrants. He fearfully asked me to look in to this and to not tell anyone at work. Is there any legitamacy to this?

    You know, I don't have a clue. It would not surprise me at all if true, however.

    We don't any of us know what our government is doing.

    If you find out anything I hope you will let us know.

    Welcome to the group Jamie!

    It would be helpful to know the name of the agency in question in order to address your inquiry. Generally speaking I wouldn't be surprised to learn there is a mandate against it in one agency or another to shield against ACLU and other groups lawsuits, but it certainly would have to be policy rather than law. Pay particular attention to the section titled "Hiring Illegal Aliens" and share what you learn with your friend.

    If you can find out which agency was supposed to have that policy we'd all love to know who they are. If you'd prefer not to post it on the Forum feel free to PM me and I'll help you investigate it.

    Fire them anyway. Call the media if someone gives you a hard time.

    And if you know anyone that employs illegals, turn them in too.

    There is no "law" prohibiting the firing of illegal aliens. Such a law, would by DOL definition, be "discriminatory." Furthermore, how could there be a law prohibiting firing of a group that "by law" should not be employed? However, there may be a directive (albeit illegal) from a particular government agency that is pandering to illegals.

    Question: How would one know that an employee is in fact an illegal alien, given the fact that our government "claims" illegals are living in the shadows and has no idea who they are?

    Well, let me take a shot at your question(s) here.

    First of all, if you're in any doubt at all, CONSULT A LAWYER FIRST!
    We really are not in a position to lend specific legal advice to suit a particular situation.

    Second, remember that about 2/3 of states in the US, are 'at will' states (eg. any worker can be fired at any time, not for ANY REASON, but for NO REASON). If your email/IP information truly indicates your location, then I did check to see that your state does have very strong state laws in protecting employers in this regard.

    If I were in such a position as yourself, I would only do so using a viable and verifiable reason for such a forced departure. Outright firing someone for being illegal is tricky - if the employee doesn't try to turn around and sue you, you can bet that ACLU, labor unions, any groups known to pander to illegal aliens will - if they are aware or become privy to such thing.

    I think you'd be in a much better position, by simply reporting the illegal worker to ICE and let them follow up on the situation. You can report anonymously, and chances are, there will be other illegal workers nearby or known to where this one is.

    Just my 0.02 cents. I am not an attorney, and please take (or leave) this advice or knowledge at your own risk.

    depending on the state you live in i believe there could be a mandate like that. here in illinois we are a sanctuary, i could see it.

    Immigration Reform and Control Act

    Under IRCA, employers may hire only persons who may legally work in the U.S., i.e., citizens and nationals of the U.S. and aliens authorized to work in the U.S. The employer must verify the identity and employment eligibility of anyone to be hired, which includes completing the Employment Eligibility Verification Form (I-9). Employers must keep each I-9 on file for at least three years, or one year after employment ends, whichever is longer.

    As such, U.S. employment laws pertain to those who have a "legal" right to work in this country. However, I agree with PhredE, consult an attorney.

    I agree with Phred,I would call ICE,talk to an agent and get advice straight from the horses mouth.Then you would know exactly what to do.

    I don't think there is a law that states that -

    I don't doubt there are 'suggestions' that come down the pike in this.

    Think about it - this situation could not have evolved without a lot of government help and intereference.

    Could it be some government official or politician 'suggested' that particular company not fire illegals - or the government might find something wrong with their company????

    There are lots of ways of getting things done without laws - I mean do we need more of a lesson than a country full of illegals???
