Congressman John Garamendi Plans to Reintroduce ‘No Fly, No Buy’ Bill

SACRAMENTO -- Congressman John Garamendi said he'll re-introduce his bill, which will prohibit those who are on a federal "no fly" list from buying guns. He's titled it the "No Fly, No Buy" bill, one which failed to pass on the floor last December.
"We're talking about suspected terrorist that are not allowed to fly," Garamendi told FOX40.
Garamendi represents California's 3rd Congressional District and said he knows his bill has an uphill battle.
"The current leadership says no, it will never be on the floor, but we're going to collect enough signatures to bring it to a vote," Garamendi said.
But if it did pass, some question if it will hold up in court, since flying on a plane is not a constitutional right like gun ownership.
"It's just another hurdle, another wall separating you from your Second Amendment rights, and it's going to face an uphill battle in the federal courts," said defense attorney Mark Reichel, who has handled several high-profile terrorism cases.
Reichel said the "no fly" list is already a flawed system that initially doesn't give those on it a day in court.
"You're not told you're on the "no fly" list until you try to get on the plane," Reichel said.
Reichel said the federal government has admitted in the past a large percent of the 16,000 people on it were put there mistakenly.
"With 35 percent of all those placed on the 'no fly' list being incorrectly placed there it doesn't bode well for future litigation for the don't buy list," Reichel said.
According to Reichel, appealing to have your name taken off the list is a lengthy process and costly.
"I think any lawyer is going to probably charge the
average person close to $75,000 in hourly fees even at $450 an hour to litigate something like that," Reichel told FOX40.
"Yes it's hard to get off it because it's hard to get on the 'no fly' list," Garamendi said.
Restricting those who can buy guns is nothing new, it's just laws needs to be updated, he said.
"In California if you have a court order about spousal abuse, you can't buy a gun. If you have a mental issue you can't buy a gun... But if you are on a 'no fly' terrorist list you can go out and buy an AR-15."
The Orlando shooter, Omar Mateen, was not on the "no fly" list.

I oppose this bill. The Orlando shooter wasn't on either a No Fly or a Terror Watch List at the time of his terrorist acts. There are many innocent Americans on the No Fly list and also on the Terror Watch List. As this terrorist act proves, terrorists are put on the list and removed while innocent Americans whose name resembles someone else's remain.
Gun rights have nothing to do with terrorism.
It should also be noted that this nightclub had a gun free zone policy, so the terrorist and possibly an accomplice were the only ones with the guns. If he couldn't buy them legally, he would have bought them illegally or used another method for his carnage such as bombs, arson or chemicals that would have resulted in even greater loss of life and more horrific injuries.
Should he have still been on the Terror Watch List? Obviously so.
Should the gun dealer who sold him the guns been able to observe that he was on a Terror Watch List and been prompted to contact authorities upon the sale of the first weapon for follow-up surveillance or investigation? Sure. I have no problem with that at all.
To the federal government I say this: You are the biggest bunch of stupid idiots I've ever seen. What is wrong with you? You persist in admitting people with beliefs and issues so contrary to the people of the United States, like the parents of this terrorist and the parents of many other terrorists. Yet you dare to call those of US who want this immigration stopped, ugly erroneous names like racists, bigots and xenophobes?

We had this discussion several months ago. The problem is that the government can indiscriminately put people on the no fly list. There do not seem to be any standards in place and anyone can be put on for any reason that a bureaucrat sees fit. Can they add people that do not agree with Obama? Owe the IRS money? etc., etc, etc

There was an off duty police officer there working for the club as security. He exchanged gunfire with the gunman.

Members of the Orlando Police Department who killed homophobic gunman Omar Mateen in the wake of the deadliest mass shooting in modern US history have been named.
They are: Adam Gruler, Scott Smith, Jeffrey Backhaus, Timothy Stanley, Kevin Easterling, Andrew Bishop, James Parker, Raul Rivas, Jonathan Bigelow, Ricardo Duenas, and Michael Napolitano.
Officer Gruler was off-duty when he exchanged gunfire in an attempt to stop Mateen outside the gay nightclub Pulse before the 29-year-old terrorist killed 49 people and injured 53 more inside.
Among the heroes are nine SWAT team members who stormed the club, along with Officer Michael Napolitano, whose kevlar helmet saved his life during the shoot out.

Mateen, who legally purchased two firearms in recent weeks, exchanged gunfire with Gruler outside the club around 2am before he made his way inside and opened fire with a handgun and AR-15 assault rifle.
Lieutenant Smith and Sergeant Backhaus arrived on the scene soon after and the firing continued.
Authorities said the shooting turned into a hostage situation once gunman Mateen made it into one of the bathrooms where club-goers were hiding.
Mateen called 911 and pledged allegiance to the Islamic State, before crisis negotiators stepped in and tried to talk to the gunman, Orlando Police Chief John Mina said Monday.
After Mateen mentioned explosives and bombs, the SWAT team stormed the club using a controlled explosive, along with an armored BearCat vehicle to create a hole in the exterior wall so hostages near the bathrooms could run out.
The SWAT team operation saved the lives of 'at least 30 possible victims,' according to Mina.
Mateen emerged from the same hole and exchanged gunfire with the SWAT team at 5am before he was shot dead, officials said.
It turned out there were no explosives.

It read: 'On the darkest day of my 25 years at the Orlando Police Department, I wanted to take a moment to tell all of you how proud I am of the work you have done today and will do over the next days and weeks.
'We have trained again and again for this type of situation. It’s unfortunate that we had to put those skills to use today.
'But because of that training and your professionalism, we saved dozens of lives this morning.'

2:02am - Sunday, June 12 - Suspect Omar Mateen tries to enter Pulse nightclub armed with assault rifle and and handgun and is spotted by a uniformed officer.
The two exchange fire outside the club - but Mateen manages to enter the nightclub holding 320 people while still firing.
The shooting then developed in a hostage situation.
2:09am - Pulse nightclub posts a message to their Facebook desperately telling those inside 'Everyone get out of pulse and keep running'.
5.05am - Three hours after the first shooting began, a SWAT team rushed inside to rescue hostages and confront Mateen.
Members of the SWAT team detonated a controlled explosion to confuse Mateen and then nine officers exchange gunfire with terrorist - shooting him dead.
SWAT officers manage to free 30 hostages who dashed to safety.
5:35am - Orlando police confirm that the shooter is dead.
8:00am - Officials with the FBI deem the incident to be 'domestic terrorism'.
9:40am - The shooter was officially identified as 29-year-old Omar Mateen of Port St. Lucie.
10:20am - At a press conference Mayor Buddy Dyer makes the announcement that 49 people have died and 53 injured in what is now the worst mass shooting in the history of the United States.
11.54am - US Senator Bill Nelson and California congressman Adam Schiff claimed Mateen had pledged his allegiance to ISIS
Some questioned why authorities chose to hold off, leaving Mateen inside the club for about three hours, where more than 100 people were shot.
But authorities explained the shooting turned into a hostage situation, and hostage negotiators tried to talk to Mateen.
Police Chief John Mina has also admitted that some of the victims may have been hit by officers' gun fire.
He said: 'I will say that is all part of the investigation. But I will say when our SWAT officers opened fire, their backdrop was a concrete wall. And they were being fired upon, so that is all part of the investigation.'

That doesn't have anything to do with the fact that none of the patrons were armed, they were all unarmed, disarmed at the door if they had weapons on them. To claim "hero cops" saved dozens after they got there has nothing to do with the issue of 320 unarmed patrons defenseless to defend themselves which is why 49 died and 53 were critically or gravely wounded because the terrorist was the only man in the room with a gun.
Your follow-up article proves my statement was right, since this last article clarifies that the off-duty policeman was OUTSIDE the Pulse, not inside. The need for Americans to be able to defend themselves has nothing to do with police officers who arrive once they are called in. Police did their job, there's no complaint about that, and yes, they were heroes protecting the remainder. But they can't get there in time to defend you from a shooter.
