In short, illegal aliens can no longer cross into the United States and request asylum.
Acting Attorney General Matthew Whitaker and Department of Homeland Security Secretary Kirstjen Nielsen today announced an Interim Final Rule declaring that those aliens who contravene a presidential suspension or limitation on entry into the United States through the southern border with Mexico issued under section 212(f) or 215(a)(1) of the Immigration and Nationality Act (INA) will be rendered ineligible for asylum.
The Acting Attorney General and the Secretary issued the following joint statement:
“Consistent with our immigration laws, the President has the broad authority to suspend or restrict the entry of aliens into the United States if he determines it to be in the national interest to do so. Today’s rule applies this important principle to aliens who violate such a suspension or restriction regarding the southern border imposed by the President by invoking an express authority provided by Congress to restrict eligibility for asylum. Our asylum system is overwhelmed with too many meritless asylum claims from aliens who place a tremendous burden on our resources, preventing us from being able to expeditiously grant asylum to those who truly deserve it. Today, we are using the authority granted to us by Congress to bar aliens who violate a Presidential suspension of entry or other restriction from asylum eligibility.”
Section 212(f) of the Immigration and INA states that “[w]henever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate.”
Further, Section 215(a) of the INA states that it is “unlawful…for any alien to depart from or enter or attempt to depart from or enter the United States except under such reasonable rules, regulations, and orders, and subject to such limitations and exceptions as the President may prescribe.”
In Section 208(d)(5)(B) of the INA, Congress specified that the Attorney General “may provide by regulation for any other conditions or limitations on the consideration of an application for asylum.”
Today’s new rule applies to prospective presidential proclamations, and is not retroactive.
Asylum is a discretionary form of relief granted by the Executive Branch on a discretionary basis to those fleeing persecution on the basis of their race, religion, nationality, membership in a particular social group, or political opinion. The rule does not render such aliens ineligible for withholding of removal under the INA or protection from removal under the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

The story title is misleading. All Whitaker and Nielsen did was execute a plan that was designed, planned, and signed by former Attorney General Jeff Sessions. Sessions carried the water, but if Trump wants others to get the credit, so be it. Trump has consistently disrespected Sessions, no need for him to change now. :roll:
The first 75 pages of the 78 page rule are issued by the US Department of Homeland Security and approved by Kirsten Nielsen on November 5, 2018, only the last 3 pages of the 78 page rule pertain to US Department of Justice and approved by Jeff Sessions.

The first 75 pages of the 78 page new rule applies to DHS and is approved on page 75 by Secretary Kirsten Nielsen. The last 3 pages applies to DOJ and is approved by Jeff Sessions. This is a Kirsten Nielsen deal, not a Jeff Sessions deal. Just a simple fact. You made a simple mistake because you didn't read the document. No big deal.

Whitaker was Jeff Sessions Chief of Staff, of course he was involved in the 3 pages of the 78 pages of the new rule, he probably wrote it, he's a former US Attorney, confirmed by the Senate. This new rule is Kirsten's deal, not Jeff Sessions or Matt Whitakers, its hers, something she's been pounding for since at least March. She was even running ads down in Central America telling them not to cross the border, only try to enter at the Ports of Entry. I don't know how much difference it will make, but hopefully it will make a difference of some kind, hopefully a big difference. We'll see how it goes.
According to Mark Kirkorian, this does not accomplish much. Asylum is still being granted. This is an end run around coming illegally. Asylum is being used as a ruse for people to gain entry and be released. These people will be released. More caravans are coming. Only Congress can stop it per Mr. Krikorian.
Not an encouraging message with a democrat House and the republican Senate gains possible slipping away.
That's right it doesn't, at least not in stopping it. It redirects them to the Ports of Entry which could deter them somewhat, it also saves BP some travel time, and slows down the entry because it's controlled. But it's not the suspension of all asylum claims that we want, I guess they feel we can't go that far without Congress. Maybe it make some difference, discourage some, hasten deportations a little, make it more orderly, but to me that's about it. Until we change the asylum laws and possibly even withdraw from some of those UN agreements that seem to dictate what we can do, this is the new Tsunami and we have no defense to it, legally, except to redirect it or reorganize it or expedite it, but it looks like we can't shut it down.Quote:

Poor NumbersUSA is sending out fund-raising emails bragging about having "sent a message" to Republicans who didn't vote the exact way they wanted, like "boy, did voters show them or what?" So pathetic when these activist groups show so clearly, that they don't even know what they've done to themselves or our country and citizens. The candidates who were defeated go on with their lives, return to private life, make lots of money, and actually improve their lot. The only people who suffer from these stupid "hold their feet to the fire" campaigns are the Americans who were betrayed by bad lobbying strategies that resulted in disastrous political outcomes for the American Worker and ordinary Americans.
I don't think the reality of what happened on Tuesday has sunk in. Either that or Mark, Roy, Ira and some others live in a bubble.
I guess they'll realize what has happened and what it means eventually.
