    t’s impossible to say that I’m shocked by the latest bombshell courtesy of the American Center for Law & Justice (ACLJ). According to a memo obtained by ACLJ via a FOIA lawsuit, several Obama administration officials held secret meetings with Iran during Trump’s presidency.

    Former Obama Secretary of State John Kerry’s efforts to undermine Trump by negotiating with Iran as Trump was working towards pulling out of the nuclear deal have been known for years. But the memo obtained by the ALCJ is from October 2018, titled “Notes From ‘Iran and the US: An Off-the-Record Conversation with Foreign Minister Mohamad Javad Zarif.” has never been seen before now, and shows that Kerry wasn’t the one working to undermine Trump.

    “According to this memo, the previously unreported ‘off-the-record meeting’ took place at the ‘Iranian Ambassador’s Residence, NYC,’ on October 4, 2018 – just days after major media coverage of Kerry’s admission of the secret efforts,” explains ACLJ Executive Director Jordan Sekulow. “The memo we unearthed contains notes on the former U.S. diplomats’ conversation with Zarif and his responses “to questions posed by a group of US former ambassadors and policy analysts.”

    “The newly obtained memo, regarding the secret meeting between [Foreign Minister Mohamad Javad] Zarif and these former U.S. officials, included discussions of nuclear weapons, potential prisoner swaps, Afghanistan withdrawal and negotiations with the Taliban, Houthi rebels, Syria, Suleimani’s popularity in Iran, and the ‘region in turmoil,'” Sekulow continues. “This is precisely why we sent this FOIA request: to uncover actions of then-former U.S. diplomats – those who worked for the Obama-Biden Administration but who then went to work undermining President Trump and the core policies he campaigned on and succeeded.”

    “[Former Secretary of State] Kerry himself admitted his part in this scheme,” Sekulow added. “And here we obtained a memo showing just that: an off-the-record meeting between Zarif and ‘former’ U.S. diplomats right in the middle of the Trump Administration and during the time President Trump was working through the aftermath of withdrawing the United States from the farce known as the Joint Comprehensive Plan of Action (JCPOA) – the Iran nuclear deal.”

    This is a clear violation of the Logan Act, which criminalizes unauthorized American citizens from negotiating with foreign governments regarding disputes between the two countries. This is what Democrats accused Lt. Gen. Mike Flynn of violating when he was Trump’s incoming National Security Advisor. Flynn did nothing wrong, but Kerry or any other former-Obama official without authority to be negotiating with Iran absolutely did. In fact, some would call it treason.

    ACLJ Obtains New Memo in State Department Lawsuit Unveiling Unreported Obama-Era Officials' Secret Meeting With Iran's Zarif During Trump Administration

    The Boston Globe put it this way: “Kerry is quietly seeking to salvage Iran deal he helped craft.”

    The ACLJ put it a bit more bluntly: “John Kerry tried to undermine President Trump in order to support Iran, putting our national security at risk.”
    Remember the stories that former Obama Secretary of State John Kerry – no longer in office as of January 20, 2017 – engaged in shadow diplomacy with Iran promoting foreign policy contrary to that of America’s sitting President, Donald Trump? As the story continued to unfold, and more information about the Left’s counter-diplomacy was revealed even just last year, the ACLJ went to work.

    We launched a Freedom of Information Act (FOIA) request to the State Department, seeking records of State Department awareness of or involvement with Obama-era U.S. officials – aka, the Deep State – employing undercover backchannels in an effort to undercut President Trump’s cornerstone foreign policy of withdrawing the United States from the disastrous Obama/Biden Iran Deal.

    In the FOIA lawsuit against the State Department that ensued, the ACLJ just obtained a never-before-seen “unclassified” October 2018 memo entitled, “Notes From ‘Iran and the US: An Off-the-Record Conversation with Foreign Minister Mohamad Javad Zarif.’”

    According to this memo, the previously unreported “off-the-record meeting” took place at the “Iranian Ambassador’s Residence, NYC,” on October 4, 2018 – just days after major media coverage of Kerry’s admission of the secret efforts. The memo we unearthed contains notes on the former U.S. diplomats’ conversation with Zarif and his responses “to questions posed by a group of US former ambassadors and policy analysts.”

    The key here is “former” – and the date, October 2018, right in the middle of the Trump Administration.

    The newly obtained memo, regarding the secret meeting between Zarif and these former U.S. officials, included discussions of nuclear weapons, potential prisoner swaps, Afghanistan withdrawal and negotiations with the Taliban, Houthi rebels, Syria, Suleimani’s popularity in Iran, and the “region in turmoil.”

    Former Secretary of State Mike Pompeo – now ACLJ Senior Counsel for Global Affairs – reviewed this memo and reacted by calling this discovery “a big deal for sure.” He continued: “This is exactly what we were fighting. . . . The arrogance. The indecency. The hatred of Israel.”

    This is precisely why we sent this FOIA request: to uncover actions of then-former U.S. diplomats – those who worked for the Obama-Biden Administration but who then went to work undermining President Trump and the core policies he campaigned on and succeeded. Kerry himself admitted his part in this scheme. And here we obtained a memo showing just that: an off-the-record meeting between Zarif and “former” U.S. diplomats right in the middle of the Trump Administration and during the time President Trump was working through the aftermath of withdrawing the United States from the farce known as the Joint Comprehensive Plan of Action (JCPOA) – the Iran nuclear deal.

    Further, this record was only responsive to our FOIA request if it involved former high level Obama officials John Kerry, Robert Malley (key Iran Deal negotiator and currently President Biden’s U.S. Special Representative to Iran), or Ernest Moniz (Obama’s Secretary of Energy) in some way. This in and of itself is a key piece of this shadow diplomacy puzzle.

    In the ACLJ’s FOIA request sent to the State Department last year, we sought records of these former high level Obama officials engaged in secret, “off the record” diplomacy with Iran, and particularly, with Mohammad Javad Zarif. To be specific, we sought:

    All records, communications or briefings created, generated, forwarded, transmitted, sent, shared, saved, received, or reviewed by any DOS official or employee that regard in any way John Kerry, Robert Malley, or Ernest Moniz, and Mohammad Javad Zarif or U.S. relations with Iran.

    When the State Department ignored our requests, failing to comply with the law, we took it to federal court in Washington, D.C., as we’ve done so many times before.

    There are many more documents to be produced in this case; and once the production is complete, we’ll have to litigate against the State Department to force it to reveal what it has redacted and withheld along the way.

    One question we will pursue: In whose custody was this memo? Another one is, what conversations did Obama-era holdovers still at the State Department have with the “former” U.S. diplomats who went to this meeting?

    The memo we uncovered shines a light, not just on the secret meeting itself, but also on Zarif’s rhetoric and unbelievable assertions as he attempts to persuade his listeners. For instance, he claims “Iran will never seek atomic weapons.” Well, I guess there’s no cause for concern here. And, “It is almost impossible to turn fuel rods into nuclear weapons.” Almost impossible. He goes on and on, spouting off his distorted pro-Iran view as if it’s fact.

    Interestingly, record productions we’ve received in this case also include a series of sensitive but unclassified (SBU) emails revealing that Kerry had State Department staff working to send correspondence to Zarif, described as a farewell letter, two weeks after Kerry had left office on January 20, 2017. It is clear from the emails that the State Department staff were struggling with how to send the letter, we presume because the United States had no official diplomatic relations with Iran.

    As of now, the State Department has withheld the contents of Kerry’s secret February 2017 letter to Zarif, so we will continue to litigate to gain access.

    Nuclear Nepotism: The Hushed Up Truth of Kerry’s Personal Iran Connection

    The debate over US President Barack Obama’s nuclear deal with Iran is undoubtedly the hottest issue today, with truly apocalyptic repercussions. One of the main overlooked details of the deal has to do with US Secretary of State John Kerry’s personal connection to Iran. Being the main negotiator, his personal judgement and integrity is an essential element, and there are reasons to question his judgement.

    Every minute aspect of the agreement is of vital importance and, unfortunately, many details have been hidden, even from the senators and congressmen who are expected to vote on the results of the negotiations. A hushed up fact concerning Kerry’s personal life, involves his younger daughter from his deceased first wife, Dr. Vanessa Bradford Kerry. Kerry’s daughter married Dr. Brian (Behrooz) Vala Nahid, an Iranian-American physician and the son of Nooshin and Reza Vala Nahid of Los Angeles, in October 2009.

    The marriage was even announced in the New York Times but oddly enough, no mention was made of the groom’s Iranian connection, an irregular occurrence for the paper. It should be noted that after the wedding, the couple went to Iran to visit those relatives.

    This past March, in the midst of tumultuous negotiations with Iran, the secretary made mention of his close Iranian connection when he greeted the Iranian people on the occasion of the traditional New Year (Nowruz) holiday.

    “I am proud of the Iranian-Americans in my own family, and grateful for how they have enriched my life,” Kerry said in the official statement. Kerry also said he was “strongly committed to resolving” the differences between the United States and the Islamic Republic of Iran, “to the mutual benefit of both of our people.”

    Kerry’s family connection to Iran is no secret, and in the melting pot that is the United States, it is not entirely surprising. What is significant is that as part of the wedding preparations, Kerry went to a dinner party hosted by George Soros at his Manhattan penthouse. He undoubtedly met the best man Mahdi Zarif, and also met his father, Mohammad Javad Zarif,current Iranian Foreign Minister, who acted as the chief negotiator during nuclear talks, across the table from Kerry. This revelation was made by former Congressman Allen West on his website on July 28.

    On Sunday, Iran’s Foreign Ministry “strongly rejected” the claim, calling it a “sheer lie and ‘news fabrication,” as reported by Fars News Agency . “Some media outlets that lack credit [sic] fabricate such news in pursuit of special objectives, including finding more viewer [sic],” the foreign ministry claimed.
    Though no formal accusations have been made, neither have any inquiries or investigations been conducted. The accusation and the refutation stand on their own merits. Kerry’s close family connection was not mentioned in his confirmation hearings before the Senate Foreign Relations Committee. The FBI vets US government officials involved in national security issues and generally will not grant clearances to individuals who are married to nationals of an enemy nation or having family members living in that country, for fear of divided loyalties.The lack of basic oversight and disclosure in this case is disturbing.

    While some may find Kerry’s close Iranian ties surprising and hushed up, the secretary has a track record of divided loyalties. It was revealed in a declaration of assets published on opensecrets.org that that the secretary held shares in Noble Energy that totaled an estimated $500,000 to $1 million. Noble Energy is one of the major gas exploration companies involved in the two major Israeli offshore natural gas fields.

    Kerry’s financial involvement raises serious concerns regarding his ties to the Israeli gas market as an American official. Approximately eight months ago, Israel’s antitrust commissioner called on the government to back out of the compromised deal with the energy firm, stating that the contractual agreement violated antitrust laws. This endangered the deal, and the gas companies, led by Noble, claimed the new arrangement would damage their expected profits.

    Given Kerry’s personal financial interest, it might have been better for him to recuse himself and delegate the task to another State Department official. Such a move would undoubtedly have been proper, also in the case of the Iran negotiations.

    Haaretz reported that Kerry contacted Israeli Prime Minister Benjamin Netanyahu, urging the Israeli leader to advance the deal with Noble and sidestep the antitrust difficulties. According to the report, Kerry said, “It is important for all countries to have a strong investment climate, including a consistent and predictable regulatory framework.” Netanyahu has pushed the legislation through, labelling the natural gas issue a security issue, thereby sidestepping antitrust laws.

    In yet another incident, it is somewhat ironic that Kerry led a committee investigating the Iran-Contra Affair, in which selling weapons to Iran was illegal because it was designated a state sponsor of terrorism and was the focus of an arms embargo by the US government. Yet today, Kerry is willing to allow Iran’s nuclear program to remain intact, lift sanctions and provide the Iranian terror regime with billions of dollars, despite their public declarations of threats of violence, terror and destruction against the US and Israel. It appears that Kerry, regardless of his previous views on Iran as a terror state, has no qualms conducting negotiations based entirely on good faith, as his response to the Senate Committee clearly showed.

    Kerry’s intimate Iranian connections and his interests in foreign matters are a matter of public record. Taken separately, each incident may be considered harmless. Viewed together as a pattern, it seems that Kerry has a history of operating in areas where he has a conflict of interest, putting aside his beliefs. This should raise questions about his judgement. To date, there have been no American or Israeli calls to investigate Kerry’s multiple conflict of interests, though investigations and inquiries have certainly been initiated on much less grounds.
