North Carolina governor signs controversial transgender bill

By Tal Kopan and Eugene Scott, CNN

    Updated 11:12 AM ET, Thu
    March 24, 2016

Washington (CNN) North Carolina's governor on Wednesday signed a controversial bill blocking cities from allowing transgender individuals to use public bathrooms for the sex they identify as -- as well as restricting cities from passing nondiscrimination laws more broadly.

House Bill 2, the Public Facilities Privacy & Security Act, puts in place a statewide policy that bans individuals from using public bathrooms that do not correspond to their biological sex. The bill also reserves the right to pass nondiscrimination legislation to the state government, saying state laws preempt any local ordinances.

Pat McCrory, a Republican, signed the bill Wednesday night and tweeted, "Ordinance defied common sense, allowing men to use women's bathroom/locker room for instance. That's why I signed bipartisan bill to stop it."

The General Assembly went into special session earlier in the day to push through the legislation, a response to a nondiscrimination ordinance that the city of Charlotte enacted that, among other things, made it possible for transgender individuals to use the public bathroom of the sex they identify as.

The move enraged civil liberties groups and Democrats in the state. The bill passed the state House 82-26 and the state Senate 32-0, with Senate Democrats walking out and not voting in protest.

"Rather than expand nondiscrimination laws to protect all North Carolinians, the General Assembly instead spent $42,000 to rush through an extreme bill that undoes all local nondiscrimination laws and specifically excludes gay and transgender people from legal protections," said Sarah Preston, acting executive director of the American Civil Liberties Union of North Carolina.

ACLU and other groups criticized the General Assembly for spending the money on a special session to pass the legislation, which they called rushed through and undemocratic.

"Legislators have gone out of their way to stigmatize and marginalize transgender North Carolinians by pushing ugly and fundamentally untrue stereotypes that are based on fear and ignorance and not supported by the experiences of more than 200 cities with these protections," Preston said.

Chris Sgro, executive director of Equality NC, also decried the bill in a statement.

"Today's vote at the NCGA represents politics at its worst. Senator Berger and Speaker Moore should be ashamed of misleading their members to vote for the worst anti-LGBT legislation in the nation, which is sweeping beyond comprehension," Sgro said.

"Protections for LGBT people against discrimination are common sense. This special session, where Berger and Moore rammed through hastily-crafted legislation was a farce of public policy."

The bill also got criticized by Caitlyn Jenner, the Olympian and celebrity who was born a man and recently transitioned publicly.

"Another day, another time for us to stand together!! Tell @PatMcCroryNC to stop this bill with the link below #NCGA ," she tweeted.

But North Carolina House Speaker Tim Moore defended the bill.

"One of the biggest issues was about privacy," Moore said. "The way the ordinance was written by City Council in Charlotte, it would have allowed a man to go into a bathroom, locker or any changing facility, where women are -- even if he was a man. We were concerned. Obviously there is the security risk of a sexual predator, but there is the issue of privacy."

State Rep. Graig Meyer, a Democrat, said the "discriminatory law puts his health and safety at risk."

"When I arrived home tonight, my wife told me that one of her former students visited her at school today. The student told her that he now identifies as a transgender male," he posted on his Facebook page. "She loves this student. Today's discriminatory law puts his health and safety at risk. It's been a long time since I cried myself to sleep."

Charlotte Mayor Jennifer Roberts, a Democrat, released a statement saying she was appalled by the bill's passage.

"This legislation is literally the most anti-LGBT legislation in the country," she said Wednesday.

U.S. Rep. David Price, D-North Carolina, also chastised the Legislature for prioritizing passing the bill over other issues.

"The #NCGA won't hold a special session to raise teacher salaries, but they will come back to legislate discrimination? Enough is enough," he tweeted Wednesday.

N.C. Governor McCrory Takes Action to Ensure Privacy in Bathrooms and Locker Rooms

    Raleigh, N.C.
    Mar 23, 2016

Governor Pat McCrory released a statement following the signing of House Bill 2, the Public Facilities Privacy and Security Act:

“The basic expectation of privacy in the most personal of settings, a restroom or locker room, for each gender was violated by government overreach and intrusion by the mayor and city council of Charlotte. This radical breach of trust and security under the false argument of equal access not only impacts the citizens of Charlotte but people who come to Charlotte to work, visit or play. This new government regulation defies common sense and basic community norms by allowing, for example, a man to use a woman's bathroom, shower or locker room.

“While local municipalities have important priorities working to oversee police, fire, water and sewer, zoning, roads, and transit, the mayor and city council took action far out of its core responsibilities. As a result, I have signed legislation passed by a bipartisan majority to stop this breach of basic privacy and etiquette which was to go into effect April 1. Although other items included in this bill should have waited until regular session, this bill does not change existing rights under state or federal law.

“It is now time for the city of Charlotte elected officials and state elected officials to get back to working on the issues most important to our citizens.”

People supporting the state law are saying that about the Charlotte ordinance but it isn't true, it's only bathrooms. There was another ordinance introduced last year that failed that applied to locker rooms and other public facilities. The ordinance that passed is limited to bathrooms.

What exactly does the bill say about bathrooms?

The bill requires school boards and public agencies to establish “single-sex multiple occupancy bathroom and changing facilities.” Read: You have to have a men’s and women’s bathroom.
It further states that only people of the biological (birth certificate) sex stated on the facility be permitted to use it. Read: Transgender people are not allowed to use the bathroom of their gender identity.
The bill does have a provision that allows school boards and public agencies to create a single-occupancy bathroom/locker room or make other arrangements for “special circumstances” (read: transgender people).

That is the state bill, not the Charlotte ordinance, just so everyone is clear here since our public officials are either confused or deliberately misleading the public about the Charlotte ordinance that started this.

Donald Trump amends stance on North Carolina transgender bathroom law

Republican presidential candidate Donald Trump is tweaking his stance on North Carolina's transgender bathroom law less than a day after he voiced his opposition to the legislation and suggested the state should just "leave it the way it is."

"I love North Carolina, and they have a law, and it's a law that, you know, unfortunately is causing them some problems," Trump told Fox News host Sean Hannity in an interview Thursday night.

"And I fully understand that they want to go through, but they are losing business, and they are having people come out against."

"I think that local communities and states should make the decision," he went on to say. "And I feel very strongly about that. The federal government should not be involved."

"In other words, let the state decide," Hannity responded. "Kind of like your positions on education, give it back to the states."

"Yeah, let them decide," Trump said. "Absolutely."

Would John Kasich have signed N.C. transgender bathroom bill? "Probably not"

The statements on Fox News came shortly after Trump faced backlash over an NBC interview in which he said that before the state's controversial bathroom law, "there have been very few problems."

"Leave it the way it is," Trump said on NBC's "Today" show. "There have been very few complaints the way it is. People go. They use the bathroom they feel is appropriate. There has been so little trouble. And the problem with what happened in North Carolina is the strife and the economic -- I mean the economic punishment that they're taking."

Several celebrities and corporations, including PayPal, have pulled their business out of North Carolina over HB2, which stops local governments from passing anti-discrimination rules and requires transgender students to use bathrooms assigned to their biological sex at birth.

But some politicians, like Trump rival Ted Cruz, came out in support of the state's law and slammed Trump's stance on it.

"Donald agreed with Hillary Clinton and Barack Obama in attacking the state of North Carolina for passing their bathroom ordinance," Cruz said at a rally in Frederick, Maryland. "And Donald on television this morning said gosh he thought men should be able to go into the girls' bathroom if they want to. Now let me ask you: Have we gone stark raving nuts?"

In Trump's Thursday interview with Hannity, the Republican front-runner also looked forward to the general election campaign, foreseeing roles for current surrogates Ben Carson and New Jersey Gov. Chris Christie on his team.

"I can tell you that Ben Carson -- Dr. Ben Carson -- is a terrific guy," Trump said. "He endorsed me, and Chris Christie endorsed me, and he is a fantastic guy. These are two tremendous people. I'd like to have them."

Trump also said he would "love" to involve Florida Sen. Marco Rubio, a former 2016 rival who has yet to endorse a candidate in the GOP primary race.

"Frankly, Marco, I'd love to have involved," Trump said. "Honestly many of them -- almost all of them. I'm not saying all of them, but almost all of them. This party has to unite. If we unite, this party is going to have a huge party."
