Texas Republican Rep. Lamar Smith reacted harshly to a new report detailing the crimes committed by 36,007 criminal immigrants that Immigration and Customs Enforcement released last year.

“This would be considered the worst prison break in American history, except it was sanctioned by the President and perpetrated by our own immigration officials. These criminal immigrants should have been deported to ensure that they could never commit crimes on U.S. soil. But instead, ICE officials chose not to detain them and instead released them back onto American streets,” Smith said in a statement Monday.
An internal Department of Homeland Security document obtained by the Center for Immigration Studies, a limited immigration group, and shared with Breitbart News Monday revealed that last year ICE released 36,007 criminal immigrants who had nearly 88,000 convictions.
The document further broke down the crimes and number of convictions – including 193 homicide convictions, 426 sexual assault convictions, 303 kidnapping convictions, and 1,075 aggravated assault convictions.
CIS detailed the document’s findings in a report Monday morning, explaining that ICE prepared the document in response to congressional inquiries seeking additional information about the number of criminal aliens released into the United States and the crimes for which they were convicted.
Smith was one of the members of Congress who pressed DHS for these answers.
The congressman actually did receive a response from DHS earlier this year explaining that ICE did release 36,007 criminal aliens. DHS also included a breakdown of the kinds of offenses but did not include the number of offenses per type of crime.
“Obama administration officials want the American people to think these individuals were guilty of minor, petty offenses,” Smith said. “But the convictions tell a chilling story. Among those released were criminal immigrants convicted of murder, rape, kidnapping, drunk driving, and aggravated assault.”
The Texas congressman added that immigration reform should be off the table until laws currently on the books are enforced.
“There should be no discussion of reforming our nation’s immigration laws until the President enforces the laws currently on the books. The safety of the American people should be the President’s top priority. We need a President who follows the law and deports criminal immigrants who violate our laws and endanger our lives.”
ICE has not responded to the CIS report, but told Breitbart News Monday morning they are looking into it.

Immigration officials knowingly released dozens of murderers and thousands of drunken drivers back into the U.S. in 2013, according to Obama administration statistics that could undercut the president’s argument that he is trying to focus on the most serious criminals in his immigration enforcement.
Among the 36,000 immigrants whom U.S. Immigration and Customs Enforcement released from custody last year there were 116 with convictions for homicide, 43 for negligent manslaughter, 14 for voluntary manslaughter and one with a conviction classified by ICE as “homicide-willful kill-public official-gun.”

The immigrants were in deportation proceedings, meaning ICE was trying to remove them from the country and could have held them in detention but released them anyway, according to the Center for Immigration Studies, which published the numbers Monday. The Washington Times also obtained the data.
“This would be considered the worst prison break in American history, except it was sanctioned by the president and perpetrated by our own immigration officials,” said Rep. Lamar Smith, Texas Republican. “The administration’s actions are outrageous. They willfully and knowingly put the interests of criminal immigrants before the safety and security of the American people.”
The data raised thorny questions about how the government decides which immigrants to detain and which it will release as they await court hearings and final action on deportation.

Jessica Vaughan, policy studies director at the Center for Immigration Studies, said the numbers undercut the Obama administration’s argument that it is trying to keep its enforcement efforts targeted at dangerous criminals.
“We keep hearing from the administration that they are focused like a laser on enforcement against the worst of the worst, convicted criminals, as their top priority. On the other hand, they are releasing, at a rate of about 100 a day, aliens from their custody with criminal convictions, and many of them are serious criminal convictions,” she said.
In a statement, ICE said many of those it released were subject to electronic monitoring, posting bond or having to check in with officers.
In other cases, the agency was required to release immigrants because of court decisions, including a 2001 Supreme Court ruling that found immigrants whose home countries refused to take them back could not be held for more than six months.
ICE said 75 percent of the convicted murderers released in 2013 were considered “mandatory releases” in compliance with court decisions.
“Others, typically those with less serious offenses, were released as a discretionary matter after career law enforcement officers made a judgment regarding the priority of holding the individual, given ICE’s resources, and prioritizing the detention and removal of individuals who pose a risk to public safety or national security,” ICE said.
Rep. Bob Goodlatte, chairman of the House Judiciary Committee, said Homeland Security Secretary Jeh Johnson will have to answer questions.
Mr. Goodlatte and Mr. Smith asked ICE for the release numbers but said the agency never turned them over.
“These criminals should be locked up, not roaming our streets,” the lawmakers said.
ICE has told Congress it doesn’t need to hold as many immigrants in detention. In its budget request this year, ICE asked that Congress fund slightly more than 30,500 detention beds a day, down from the 34,000 set in current law.

The reported release last year of more than 36,000 criminal illegal aliens is part of a larger annual trend of thousands of such releases since 2009, according to the authors of a book documenting the case for impeaching President Obama.
The Obama administration’s release of the criminals, in numbers larger than what is publicly known, has generating crime waves and serves as a clear and present danger to the public, argue New York Times bestselling authors Aaron Klein and Brenda J. Elliott in their book “Impeachable Offenses: The Case to Remove Barack Obama from Office.”
On Monday, a Center for Immigration Studies report found that in 2013 the U.S. Immigration and Customs Enforcement agency, or ICE, released violent criminals, including murderers, rapists, kidnappers and drug dealers.
The offenders were among the 36,007 criminal illegal aliens released last year who committed 87,818 crimes, including
15,635 for driving while intoxicated.

The statistics shows ICE released illegals jailed for 9,187 dangerous drug infractions, 426 sexual assault convictions, 303 kidnapping convictions, 193 homicide convictions, 1,317 domestic violence convictions and 1,075 aggravated assault convictions.
Last year, it was widely reported ICE, a section of the Department of Homeland Security, freed from prison 622 criminal immigrants, including 32 with multiple felony convictions.
The Obama administration initially blamed the controversial move on the budget sequester cuts.
However, the releases were just the tip of the iceberg, documented Klein and Elliott in “Impeachable Offenses,” which was published last August.
The authors cited ICE documents that state more than 8,000 criminal illegal aliens were released between fiscal years 2009 and May 2011 alone.
A full chapter in the book documents other ways Obama circumvented Congress to enact immigration reform, possibly violating the U.S. Constitution and committing potentially impeachable acts.
ICE statistics show the agency released 3,847 convicted criminal aliens in 2009, 3,882 in 2010 and 1,012 through part of 2011.
A 2011 audit by the DHS inspector general further found 809 recidivist Level 1 illegal immigrant criminals eligible for deportation were released from California and Texas jails in 2009.
ICE defines Level 1 as the “most egregious criminal aliens, who pose a significant public safety risk.”
Offenses include homicide, kidnapping, sexual assault, robbery, aggravated assault, threats, extortion, sex offenses, cruelty toward family, resisting an officer, illegal weapon possession, hit and run, and drug offenses accompanied by sentences of more than a year.
Why were the criminal illegals released? The audit blamed the actions on “agent ‘staffing challenges,’” such as vacancies and “increasing workload levels.”
In most cases, the criminal illegals were automatically released after ICE failed to file the required “detainer” paperwork within 48 hours of the apprehension. The notice declares ICE’s intent to begin removal proceedings against the criminal illegal.
The government previously quietly conceded that released criminal illegals are responsible for new crime waves, report Klein and Elliott in the book.
An August 2012 Congressional Research Service report stated the “decision not to deport some arrested illegal immigrants enabled a crime wave.”
While no specific victims were publicly identified, the CRS reported illegal immigrants released from custody between 2008 and mid-2011 were “charged with 16,226 subsequent crimes, including 19 murders, 142 sex crimes and thousands of drunk-driving offenses, drug-crimes and felonies.”
“Impeachable Offenses” further documents ICE catch-and-release efforts in which large numbers of illegals, including criminals, are rounded up but only a tiny number are charged with crimes.
At the end of September 2011, for example, ICE arrested 2,900 illegal immigrants with criminal records coming from all 50 states and four territories.
All had at least one criminal conviction, and “at least 1,282 had been convicted of multiple charges, and more than 1,600 had felony convictions including manslaughter, attempted murder, kidnapping, armed robbery, drug trafficking, child abuse, sexual crimes against minors, and aggravated assault.”
More than 25 percent of those caught were immigration fugitives. Another 386 had re-entered the U.S. illegally after being removed “multiple times.”
However, only 146 of those arrested during the 2011 sweeps were turned over for prosecution. Of the total arrested, 42 were identified as gang members.
Book fuels national debate
MSNBC reported Klein and Elliott’s “Impeachable Offenses” fueled the national conversation to impeach Obama, while BuzzFeed.com reported the book “ushers in the Obama impeachment movement.”
The book lays out the blueprint for impeaching Obama, alleging high crimes, misdemeanors, bribery and other offenses committed against the U.S. Constitution and the limitations on the executive office.
The Daily Mail of London has called the “Impeachable Offenses” “explosive,” reporting the book contains a “systematic connect-the-dots exercise that the president’s defenders will find troublesome.”
“Consider this work to be the articles of impeachment against Barack Obama,” stated Klein.
“Every American, whether conservative or liberal, Democrat, Republican or independent, should be concerned about the nearly limitless seizure of power, the abuses of authority, the cronyism, corruption, lies and cover-ups documented in this news-making book,” Klein said.
The authors stress the book is not a collection of generalized gripes concerning Obama and his administration. Rather, it is a well-documented indictment based on major alleged violations.
Among the offenses enumerated in the book:
- Obamacare not only is unconstitutional but illegally bypasses Congress, infringes on states’ rights and marking an unprecedented and unauthorized expansion of IRS power.
- Sidestepping Congress, Obama already has granted largely unreported de facto amnesty to millions of illegal aliens using illicit interagency directives and executive orders.
- The Obama administration recklessly endangered the public by releasing from prison criminal illegal aliens at a rate far beyond what is publicly known.
- The president’s personal role in the Sept. 11, 2012, Benghazi attack, with new evidence regarding what was transpiring at the U.S. mission prior to the assault – arguably impeachable activities in and of themselves.
- Illicit edicts on gun control in addition to the deadly “Fast and Furious” gun-running operation intended, the book shows, to collect fraudulent gun data.
- From “fusion centers” to data mining to drones to alarming Department of Homeland Security power grabs, how U.S. citizens are fast arriving at the stage of living under a virtual surveillance regime.
- New evidence of rank corruption, cronyism and impeachable offenses related to Obama’s first-term “green” funding adventures.
- The illegality of leading a U.S.-NATO military campaign without congressional approval.
- Obama has weakened America both domestically and abroad by emboldening enemies, tacitly supporting a Muslim Brotherhood revolution, spurning allies and minimizing the threat of Islamic fundamentalism. The White House is hitting back, calling the book’s impeachment effort “foolhardy.”

I'm glad someone is calling it what it is, an orchestrated, planned, and aided and abetted prison break perpetrated by all accused by Rep. smith. For this alone if Republicans expect to win any favor this coming Nov. they should begin impeachment. If they do NOT then Americans should acknowledge that Americans do NOT have a party to vote for!!

While Democrats clamor for “immigration reform” that they hope would produce new Democratic party voters, the American people continue to see that this administration cannot be trusted to enforce any law they do not like, and cannot be trusted to honor any commitments made to reduce or shut of the flow of future illegal immigration.
The Center for Immigration Studies reported that ICE freed 36,007 convicted criminal aliens from detention who were awaiting the outcome of deportation proceedings. Illegal aliens really hate waiting for legal processes, such as immigration. They surely like waiting for deportation even less. Lucky for them, their presidente’, B. Hussein Obama, just saved a very large group of criminal aliens all of the trouble of going back home to commit more crimes. They can just stay here and repeat offend. It’s much quicker, more efficient and “more humane” just to release them into the American population.
In 2013, Immigration and Customs “Enforcement” released a total of 36,007 illegal aliens who were being held in detention, pending the outcome of deportation hearings. Rather than allow the process to run its course, and remove an undesirable and potentially dangerous squatter from our society, the Obama regime just let them go. You can’t get more humane than that.
The offenses for which they were convicted, not just accused, but convicted, ranged from drunk or drugged driving to aggravated assault, flight escape, dangerous drug offenses and vehicle theft, as well as violent predatory crimes involving kidnapping, sexual assault and homicide.
Not only were the criminal illegals released into American society, but the method by which many of the releases were conducted was in itself, a violation of the law.
The Center for Immigration Studies found that the vast majority of the “get out of jail free/welcome to America” cards were discretionary, not required by law nor the result of local regulations. These were decisions made at the federal level based upon an unknown criterion.
As John Boehner searches feverishly for evidence that Hussein Obama will enforce immigration law in return for a giveaway of American jobs, the House Speaker might want to keep the following list in his vest pocket as a reminder of who he’s climbing into bed with.
The CIS listed the convictions of the illegal aliens Obama just made our neighbors as:
- 193 homicide convictions (including one willful killing of a public official with gun)
- 426 sexual assault convictions
- 303 kidnapping convictions
- 1,075 aggravated assault convictions
- 1,160 stolen vehicle convictions
- 9,187 dangerous drug convictions

In the spirit of fairness, we can hope that a substantial amount of what Joe Biden would term as the new “Already Citizens” have taken up residence in the Washington DC area, where they can “just try to support their families,” assimilating into the population with their fellow DC criminals.
