    Mississippi Forestry Company Hires More Than 1,000 Foreign Workers, Without Seriously Looking for American Workers

    A forestry company in Northeast Mississippi hired more than 1,000 foreign workers through the H-2B program in 2017. More than 700 of them landed at the company’s headquarters in Corinth, near the Tennessee border.

    The H-2B program allows nonagricultural employers to hire foreign labor if enough workers can’t be found locally. Faith Forestry Services has several sites located in at least seven states and hires H-2B workers for many of them. However, sending the largest bulk of foreign workers to the Magnolia State appears to be an odd choice.

    Mississippi suffers from a U-6 unemployment rate of 8.8 percent, which is higher than the national average. The U-6 unemployment rate includes those who are only employed part time because of economic factors, as well as those who have given up pursuing employment because they believe there are no opportunities for them. Mississippi’s unemployment rate has been increasing so far in 2018. According to a job posting from one of the company’s Alabama locations, there is no educational requirement for its nursery jobs. It’s hard to believe that Faith Forestry Services is struggling to find local employees with so many looking for work, yet the company has remained one of the top employers of H-2B workers in the United States since at least 2014.
    It also appears as if Faith Forestry Services desired to pay its H-2B workers less than what was already agreed upon last year. Employers who use the H-2B program must pay its employees at least the prevailing wage rate given by the Department of Labor (DOL). The company applied for H-2B visas in April 2017, but the workers would not arrive until October. For some Alabama-specific sites, the prevailing wage rates ranged from $19.71 to $26.08 per hour. The DOL updates its wage data on July 1 every year, and it lowered the wage rate for these locations to $15 per hour on July 1, 2017. However, because the company applied in April, it had to pay the higher original wages.
    Faith Forestry Services decided to take the DOL to court on the issue claiming that it should only have to pay $15 per hour since its employees would not be coming until October. A district judge from Mississippi dismissed the case due to the company’s lack of standing. The DOL has full authority to set the rules regarding the pay of guest workers in the United States.

    In addition to the company’s bizarre actions in Mississippi and Alabama, Faith Forestry Services has almost no online presence, other than a few scattered job postings. It has an unofficial Facebook page, and that’s it. The company doesn’t even have a public website for potential employees to visit. All evidence indicated that it is putting very little effort into finding American labor.

    In an area where unemployment is above the national average, Faith Forestry Services should not have so much trouble finding employees that it resorts to foreign labor. And if the company is having trouble, it could be due to its desire to pay lower wages, as well as its nonexistent online presence.

    I know lots of American lumber-jacks looking for work, lumber-jacks used to make great money, because it's hard and very dangerous work, so they should earn big pay. Stop hiring foreign workers and hire American workers. Sure, it's been so long, you will have to train some of them, but that is your job as an employer and there are training funds available to help you. You can't tell me these foreign workers are waltzing in with "skills".

    Faith Forestry Services, Inc. is looking to fill 650 Forestry Worker positions

    Work site(s): Begin; Corinth, Alcorn County, MS 38834 @ $15.00/hr. Provided daily transportation to and from the worksite.

    This is a temporary, full-time seasonal position from 10/01/2018 to 05/15/2019.

    Duties: Plant seedlings/trees to reforest timberland: plant bare-root or containerized trees without J OR U root. Raise, transport, and sort seedlings to then select optimum planting location to meet shade/soil requirements.


    Use: shovel, hoe-dad, dibblebar, hoe, or powered auger. Check equipment to ensure that it is operating properly and reduce competing vegetation.

    Incidental driving possible. & other related Forestry Worker activities as per SOC/OES 45-4011 (onetonline.org).

    Requirements: Must be 18 due to travel. Must show proof of legal authority to work in the U.S. Drug/Alcohol/Tobacco free work zone.

    Perform physical activities: such as lift, balance, walk, stoop, handle, position, move, manipulate materials use static strength to exert maximum muscle force to lift. push, pull, carry objects up to 501bs.

    No min. edu. reqmt. OJT All applicants must be able, willing, qualified to perform work described and must be available for the entire period specified and work throughout all areas of intended employment.

    Based on Employer's discretion/cost: Wrkr may have random drug/alcohol testing during employment: positive test/ refusal to abide= dismissal.

    Possible background check post hire at employer's expense.

    Terms & Conditions of Employment: $10.12/hr up to possible $20.53/hr OT $15.18/hr up to possible $30.80/hr.
    Wage may vary. DOE. The wage(s) offered equal(s) or exceed(s) the highest of the prevailing wage or the Federal, State, or local minimum wage.

    Possible Raises/bonuses/draws at employers discretion (draws deducted from worker's paycheck). Piece rate may apply: worker will never make less than Prevailing Wage/Federal/state/local minimum wage.H& W benefits may apply. Cash advances may apply at employer's discretion.

    Possible daily/weekly hours: 8:00AM-4:00PM. 35hrs/wk to 35+ (plus) to include lunch break M-F. Possible weekend/holiday work. (OT possible, but not required or guaranteed. If OT is worked, wage is paid at a rate of time and a half per hour worked beyond 40 hours each week.)

    Outdoors, exposed to weather; must be capable of doing physically strenuous labor for long hours, occasionally in extreme heat or cold. Variable weather conditions apply; hours may fluctuate (+/-), possible downtime and/or OT. OT not required.

    This employer will also comply with all applicable federal, state and local laws pertaining to overtime hours.

    Transportation: Transportation and subsistence will be reimbursed (by check in 1st work week) for cost from the place from which the worker has come to work for the employer, whether in the U.S. or abroad, to the place of employment.

    Upon completion of the work contract or where the worker is dismissed earlier, employer will provide or pay for worker's reasonable costs of return transportation and subsistence back home or to the place the worker originally departed to work, except where the worker will not return due to subsequent employment with another employer.

    The amount of transportation payment or reimbursement will be equal to the most economical and reasonable common carrier for the distances involved.

    Daily subsistence will be provided at a rate of $12.26 per day during travel to a maximum of $51 per day with receipts. 3/4s Guarantee:

    The worker is guaranteed employment for a total number of work hours equal to at least three-fourths of the workdays of each 12-week period.

    Tools, equipment & supplies : All work will be done with employer provided tools, supplies and equipment without charge or deposit.

    Miscellaneous: Will use a single workweek as its standard for computing wages due. Wage paid every two weeks.

    I don't think they are looking for lumberjacks.
    Their ad says they are looking to people to plant seedlings, etc. And they are advertising on internet employment sites for American workers.

    dig a hole and plant them in the forest.
    That makes them Forestry Workers.

    Well, apparently they use both. Your first link calls them Nursery Worker jobs. Your second one calls them Forestry Worker. Apparently they have both types of jobs. They probably raise the seedlings in their own nurseries.

    Whatever. Nothing illegal about it. More Americans in Mississippi and Alabama should apply for the jobs. GET OUT THERE AND APPLY AMERICANS, these are pretty good jobs for Mississippi and Alabama citizens, seems to me. They even offer transportation expense for some of the jobs.
