    Rows and rows of our war dead are rolling over in their graves at the official proclamation that the flag they died for is a symbol of racism and oppression.

    Morgan Hill, California: Members of a local TEA Party gathered to wave American flags in front of Live Oak High School which has become the epicenter in a new American battle; the battle over the American flag.

    For a little bit of history, the school principal suspended 4 teens for wearing clothing with the American flag on it during the Cinco de Mayo celebrations in 2010. The boys claimed they had no Mexican heritage and if it was okay for those of Mexican descent to celebrate the Mexican flag, then they should be able to celebrate the American flag. Some Mexican teens threatened violence over the American flags, calling the teens "crackers" and other racist terms. Their suspension and concurrent court case caught the attention of millions. When the liberal 9th Circuit Court ruled last year that the school's administration had the right to ban the American flag millions were outraged.


    To any honest observer, one would wonder why the principal didn't suspend those who threatened violence rather than the ones who were wearing Constitutionally protected clothing, but I digress.

    Back to yesterday. School officials trying to alleviate concerns about the American flag stated that those students who chose to wear clothing with the American flag on it would not be kicked out. However, a planned protest in front of the school by the local TEA Party group sparked outrage among the local hispanic community.

    Twitchy caught Davey D blasting the patriots: “Shout out to the racist a– adults, so-called patriots who are posted up at Live Oak HS in Morgan Hill protesting Cinco de Mayo #idiots.”

    “The Gilroy Morgan Hill Patriots … what a bunch of racist d–k-heads!! I think they may be part owners of the LA Clippers. #racist,” wrote Jorge P. Gonzalez.

    “Hey folks in Morgan Hill. You have some racist neighbors. You need to check those tea party a–holes,” said Al_Bondigas.

    “F— your American flag. Racist as f—s. I’ll always have pride with my Mexican flag but not the American one,” wrote Ivan Mora.

    The most recent step was the 9th Circuit’s ruling that called the American flag a “symbol of racial animus.”

    “The court’s rationale behind this ruling was essentially that it’s not safe to display an American flag in an American public school, for fear of causing offense and disruption,” said John W. Whitehead, president of the Rutherford Institute and author of “A Government of Wolves: The Emerging American Police State.”

    “This case signifies so much of what is wrong with America today, where the populace is indoctrinated into a politically correct mindset, starting in the schools, while those who exercise their freedoms are punished for it,” he said.

    The full 9th Circuit has been asked to review the case, in an appeal filed by a number of legal teams, including attorneys with the American Freedom Law Center and the Thomas More Law Center.


    The case centers on a decision May 5, 2010, by Assistant Principal Miguel Rodriguez. During a break, Rodriguez told several school students they were not allowed to wear U.S. flag shirts. He allegedly told them that he had received complaints from some Hispanic students about the flag apparel, and the students were not allowed to wear clothing that would offend them.

    Later, Principal Nick Boden met with parents and students and affirmed Rodriguez’s order.

    The appeals court “acknowledged that other students were permitted to wear Mexican flag colors and symbols, [but] it ruled that the school was allowed to forbid the American flag apparel out of concerns that it would cause disruption, even though no disruption had occurred,” attorneys argued.

    Rutherford said school officials violated long-standing Supreme Court precedent forbidding suppression of protected expression on the basis of a “heckler’s veto.”

    The attorneys said the school’s actions constituted viewpoint discrimination against pro-American expression, violating the free speech clause in the First Amendment and the due process and equal rights clauses in the 14th Amendment.

    A three-judge panel of the court earlier had said: “The specific events of May 5, 2010, and the pattern of which those events were a part made it reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real. We hold that school officials … did not act unconstitutionally … in asking students to turn their shirts inside out, remove them, or leave school for the day with an excused absence in order to prevent substantial disruption or violence at school.”



    AFLC’s Robert Muise noted: “Not only is the panel decision wrong as a matter of Supreme Court precedent, the decision affirms a dangerous lesson by rewarding student[s] [who] resort to disruption rather than reason as the default means of resolving disputes. The school district’s proper response should be to educate the audience rather than silence the speaker.”

    It was pointed out that only violence from “Mexican” students was feared, not violence by those wearing the U.S. flag.

    David Yerushalmi, also of AFLC, said the panel “reasoned that because the ‘Mexican’ students were not ‘targeted for violence,’ they were permitted to express their message.”

    “Yet, because school officials perceived that the same ‘Mexican’ students might react adversely to the pro-America students, the latter group’s speech – wearing an American flag T-shirt for goodness sakes – should be silenced. This not only creates perverse incentives for student hecklers; it ultimately turns the First Amendment on its head,” he said.

    The attorneys noted: “The panel went so far as to compare the wearing of American flag images with the wearing of the Confederate flag – an arguable symbol of racism – and to liken relations between ‘American’ and ‘Mexican’ youth in an American school – a distinction not clearly apparent on this record in that it is unclear whether the students referred to as ‘Mexicans’ were citizens of Mexico or of the United States – with racial tensions between white and black students.

    “Of course, plaintiffs had a constitutional right to wear shirts bearing the American flag on their public school campus, even on Cinco de Mayo or any other holiday and regardless of the expression of ethnic pride asserted by people aligned with another culture. The obvious and odious premise underlying the panel’s opinion is that the American flag is a symbol of racial animus – an inherently flawed premise,” they argued.

    Do we really want to live in a topsy turvy nation where good is called evil and evil is called good? Or is it time to take a stand and take America back?

    Fire Chief Craig Bronaugh disciplined four firefighters in Maywood, Illinois, after they refused to remove American flags from their lockers and helmets


    A controversy that involves a new flag for a firehouse in Chicago, patriotic stickers on lockers and even the First Amendment has erupted, and officials now are trying to calm down the situation by saying several firefighters who had been sent home may return to work.

    The situation, according to a report in the Chicago Tribune, disturbed operations at the suburban Maywood fire department.

    Its chief, Craig Bronaugh Jr., told the newspaper that four firefighters who had been removed from their duties and sent home actually may return.

    But officials with the Service Employees International Union Local 73, which represents the suburb’s firefighters, said it had gone too far for only that, and they filed a complaint with the state Labor Relations Board, the Tribune reported.

    “It’s about freedom of speech, and there should be nothing wrong with them expressing their patriotism,” spokesman Adam Rosen said.

    He explained the department had simply refused to bargain with the union over the issue, creating a hostile work situation.

    A report from Chicago’s WGN TV explained what apparently happened.

    An order came down from Bronaugh that because of a culture of racism, firefighters had to remove all decals or stickers, including American flags and military stickers, from their city lockers.

    Showing a picture of a “monkey smoking a cigarette” that had been taped to one locker, he said, “As a fire chief here, I cannot afford nor tolerate [racism].”

    But several firefighters refused, and ultimately were sent home. They explained the monkey picture had been put on one firefighter’s locker years ago by a buddy who wanted to chide him about his smoking, and the actually tension started, according to the WGN report, when the chief ordered a new American flag be removed from Fire Station 2.

    The report said, “It was a new flag the firefighters had bought with their own money to replace the tattered one that had been there for three years. When they weren’t told why, firefighters put American flags on their lockers.”

    The Tribune subsequently reported that the chief said the issue was “blown out of proportion.”

    “After review, I made a decision to put a department-issued flag on every locker,” Bronaugh said. “I want everyone to be clear: There was never an issue of disposing of the flag.”

    He noted the four firefighters who were relieved of their duties for the shift they were working on were not docked any pay.

    But the rest of those involved weren’t ready to close the issue.

    “It’s very hurtful and disrespectful the way things turned out,” firefighter David Flowers told the Tribune. “Guys had 9/11 (stickers) … on their helmets. It means a lot to us. Mine has been on (my helmet) since 9/11.”

    He had been sent home for refusing to take a Marine Corps sticker off his locker. It had been put there by his father, a former firefighter who was a Marine in Vietnam.

    To the chief’s explanation that he was trying to address hints of racism, there was a report on an online blog that the four suspended firefighters – a native Cuban, two white men and a black man – reported there never was any such discord.

    “If it’s something offensive, I could see that and guys don’t have a problem with falling in line,” Flowers told WFLD, “but when you’re talking about the American flag, or as in my case a Marine Corps decal, I mean, people take pride in this – this is America, this is where we work.”

    People see racism everywhere if that's what they expect to see. It's like those folks whose minds are in the gutter as they find something sexual in any comment, only it's racism they are expecting.

    Four suburban Chicago firefighters were reinstated Wednesday after being sent homefor refusing to remove American flags and military stickers from their helmets and lockers.

    Maywood Fire Chief Craig Bronaugh had issued a mandate for the removal of the patriotic stickers, citing a culture of racism within the department, but said Wednesday that “after review, I made a decision to put department-issued flags on every locker and in every locker room,” the Chicago Tribune reported.

    Even so, union representatives are asking for the chief’s resignation. Service Employees International Union Local 73, which represents the Maywood firefighters, filed a complaint Wednesday with the Illinois Labor Relations Board.

    Union spokesman Adam Rosen said the complaint alleges that the department refused to bargain with the union over the mandate and created a hostile work environment, the Tribune reported.

    “It’s about freedom of speech, and there should be nothing wrong with them expressing their patriotism,” Mr. Rosen said.
    David Flowers Jr., the union president, said he was relieved of duty Tuesday after refusing to remove the Marine Corps decal from his locker that he inherited from his father.

    “My dad served here for 26 years, an ex-marine, ex-Vietnam vet,” he told a local NBC affiliate. “I took his locker… We are the first African-American father and son on the Maywood Fire Department.”

    “It’s very hurtful and disrespectful the way things turned out,” he said Wednesday. “Guys had 9/11 (stickers) … on their helmets. It means a lot to us. Mine has been on (my helmet) since 9/11.”

    It’s official: the U.S. Ninth Circuit Court of Appeals has issued an order declining a request for an en banc hearing in a case involving four students in at a California high school who were sent home for wearing American flag T-shirts on Cinco de Mayo.

    The full slate of Ninth Circuit judges has thus agreed with a lower district court and with a trio of appellate judges that officials at Live Oak High School in Morgan Hill, Calif. could censor students who wanted to wear flag-emblazoned shirts.

    The federal appeals court issued its denial of an en banc hearing on Sept. 17 — Constitution Day.

    “[N]o further petitions shall be permitted,” the court ordered.

    The trouble dates back to Cinco de Mayo (May 5) in 2010, when officials at Live Oak High — a school with a predominant Mexican-American student body — forced the students to remove their American flag-festooned shirts. Administrators called the shirts “incendiary” and worried that fighting would break out between white and Latino students if Latino students noticed the shirts. So, assistant principal Miguel Rodriguez told the students to turn their shirts inside out or leave school.     Students of Mexican heritage told local media that the students who wore American flag T-shirts should apologize. They said ethnically Mexican students wouldn’t wear a Mexican flag on the Fourth of July (not a school day, but never mind).

    The high school, located 20 miles south of San Jose, has experienced numerous gang problems. Nevertheless, the school seems to have organized impressive Cinco de Mayo celebrations in recent years.

    In the previous three-judge ruling, the Ninth Circuit held that school officials have wide latitude to limit freedom of expression.

    “Our role is not to second-guess the decision to have a Cinco de Mayo celebration or the precautions put in place to avoid violence,” the court modestly observed. “Here, both the specific events of May 5, 2010, and the pattern of which those events were a part made it reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real.”

    Consequently, the court proclaimed, Rodriguez acted constitutionally when he told students to turn their American flag shirts inside-out or hit the road with an excused absence because he was trying to prevent potential violence.

    In May 2013, tea party groups announced plans to protest outside the high school while wearing American flag T-shirts.

    The practice of limiting one group’s free speech rights because that speech might cause another group to react violently is known as a “heckler’s veto.” It is understood by free speech enthusiasts to have a chilling effect on First Amendment rights.

    "OUR COUNTRY IS IN MOURNING, A VETERAN DIED TODAY."
