    Federal prosecutors say most of the approximately 230 protesters arrested on Inauguration Day will be charged with felony rioting.

    The U.S. Attorney's Office says the offense is punishable by up to 10 years in prison and a fine of up to $250,000. The people who were arrested are appearing in court on Saturday in Washington.


    The office says most of those arrested will be released without having to post bail and must return to court in February.


    The arrests took place in a four-block stretch of downtown Washington around the time of President Donald Trump's swearing-in ceremony.

    Yes it's hard to believe how presumptious this latest generation is with their belief in expressing themselves. Besides the property damage there are the policing costs, too. Although this winter these protests will dissipate probably in the summer we will see it start up again. So more policing costs for the public to pay.

    Felony charges are a good start much better than fines it lasts a lot longer on their records. I agree there must be much more serious consequences for these rioters in the future to discourage this outrageous behavior and destruction of property.

    From 2014. There is a law already on the books concerning riots and had it been enforced, many people would not have been injured by rent a thugs or had property destroyed. Jeff Sessions as Attorney General will enforce ALL of our laws and he needs to be confirmed immediately.

    Additionally, it is a felony so all of the "DREAMERS" and other illegal foreign nationals that have crossed state lines to participate in riots or destructive demonstrations should not be eligible for any sort of amnesty.

    Inciting a riot is against the law. Crossing state lines to incite riots exacerbates the violation of the law breaking. Yet the President and the Attorney General don’t mention this law-breaking. We begin to see where exactly the allegiances of Obama and Holder really reside.

    To call for calm is not to say “We will arrest and prosecute if you break the law.” Instead we get the “let no crisis go to waste” lateral move that we must examine our criminal justice system.

    From the Federal Judicial Center, 2101. Riots

    (a) (1) Whoever travels in interstate or foreign commerce or uses any facility of interstate or foreign commerce or uses any facility of interstate or foreign commerce, including, but not limited to, the mail, telegraph, telephone, radio, or television, with intent –

    (A) to incite a riot; or (B) to organize, promote, encourage, participate in, or carry on a riot; or (C) to commit any act of violence in furtherance of a riot; or (D) to aid or abet any person in inciting or participating in or carrying on a riot or committing any act of violence in furtherance of a riot; and who either during the course of any such travel or use or thereafter performs or attempts to perform any other overt act for any purpose specified in subparagraph (A), (B), (C), or (D) of this paragraph shall be fined not more than $10,000, or imprisoned not more than five years, or both. (b) In any prosecution under this section, proof that a defendant engaged or attempted to engage in one or more of the overt acts described in subparagraph (A), (B), (C), or (D) of paragraph (1) of subsection (a) and (1) has traveled in interstate or foreign commerce, or (2) has use of or used any facility of interstate or foreign commerce, including but not limited to, mail, telegraph, telephone, radio, or television, to communicate with or broadcast to any person or group of persons prior to such overt acts, such travel or use shall be admissible proof to establish that such defendant traveled in or used such facility of interstate or foreign commerce.

    The proof is for all to see. The New Black Panthers once again are not prosecuted at the choice of federal authorities. (Recall Philadelphia polling incident.) Need we mention who those authorities are?

    Add in the “Revolution Club” of Chicago…yes Chicago, that makes the trip down to Ferguson. In their full regalia these inciters ply their trade unafraid of legal consequences.


    There are others as well.


    We may not be a lawless nation, but we are certainly in an era of selective law enforcement. And, isn’t that the first step to lawlessness? Illegal immigration, inciting riots in racial matters, and drug use all seem to get a pass from those in the Obama administration. The sympathies and prejudices of those in power are clear and unquestionable.

    Perhaps we should reexamine the oaths of office and the resolve of those who took those oaths to enforce the laws of the country.

    More than 200 people are being charged with felony rioting — a charge that carries a maximum sentence of 10 years in jail — after they were arrested during anti-Trump demonstrations on Inauguration Day in DC.

    WASHINGTON — As hundreds of thousands of demonstrators gathered on the National Mall to protest President Trump on Saturday, people arrested the day before during anti-Trump protests in downtown Washington, DC, made their first appearance in court.

    Prosecutors are pursuing charges against all of the 230 people arrested on Friday for rioting, according to the US attorney’s office in DC. Although anti-Trump demonstrations on inauguration day were largely peaceful, some turned violent, with participants breaking storefront windows, throwing bricks at police, and running through streets and parks downtown as they were chased by police.

    The arraignment hearing at DC Superior Court began on Saturday around 1 p.m. and was still going six hours later. As of 7 p.m., 80 people arrested and charged with felony rioting had come before a judge. The court was expected to continue the hearing through the night until everyone arrested on Friday came through.

    The defendants processed so far were released until their next court dates, with the condition that they not be arrested again in DC in the meantime.

    Felony rioting is a crime under DC law that carries a maximum penalty of 10 years in jail and a fine of up to $25,000. According to police, six officers were injured in confrontations with demonstrators on Jan. 20, and three of those officers sustained minor head injuries after objects were thrown at them. The DC law defines felony rioting as a group of at least five people who, “by tumultuous and violent conduct and the threat thereof,” cause “serious bodily harm” or property damage valued at more than $5,000.

    A 21-year-old Texas man was also charged with pointing a laser at at US Park Police helicopter during the protests on Friday. He was arraigned in Superior Court but the case is being moved to federal court.

    The individuals charged with rioting were generally brought in front of the judge in groups of 10 and were represented by a cadre of public defenders and other court-appointed lawyers. One exception came early in the hearing, when former White House counsel Kathryn Ruemmler entered an appearance for one of the defendants. Ruemmler said her client was a journalist on assignment filming the demonstrations who was swept up in the arrests.

    Ruemmler served as President Obama’s White House counsel for three years before going to the law firm Latham & Watkins. Ruemmler told reporters outside of the courtroom that her firm represents Vocativ, the media company that employed her client, which is how she got involved.

    Dozens of people came to the courthouse on Saturday to support the arrestees. They cheered as defendants left the courtroom; some of the defendants were walking slowly to keep their shoes on because they had to remove their shoelaces after being arrested. The defendants were held by police overnight.

    By Saturday night, a crowd had gathered outside the courthouse to greet the arrestees, cheering and applauding as they came out. A line of police formed in between the group and the courthouse entrance, and police were screening people trying to go inside.

    Several lawyers offered a preview of their defense strategy during the hearing, arguing that the rioting charge should be dismissed because prosecutors hadn’t shown that each defendant was specifically involved in the rioting described in charging documents. Although the defendants were brought out in groups before the judge, they’re individually charged.

    One lawyer argued that the US attorney’s office should recuse from prosecuting the cases because the defendants were charged with participating in anti-Trump riots and Trump was now in charge of the US Department of Justice.

    “I appreciate all the creative arguments,” Magistrate Judge Rainey Brandt said in response, but she said that at this early stage of the case she only had to find that the government had shown probable cause to move the cases forward.

    The defendants are due back in court on various dates in February and March.
