Aerosmith frontman asks Trump campaign to stop using song

LOS ANGELES – Aerosmith frontman Steven Tyler is asking Republican presidential candidate Donald Trump to stop using the power ballad "Dream On" at campaign events.

Attorneys for Tyler sent a second cease-and-desist letter to Trump's campaign committee on Saturday.

The letter says that Trump does "not have our client's permission to use 'Dream On'" or any of Tyler's other songs and that it "gives the false impression that he is connected with or endorses Mr. Trump's presidential bid."

Tyler, who is a registered Republican, attended the GOP contenders' first debate in August.

Attorney Dina LaPolt said in a statement that the letter is not a "political" or "personal issue with Mr. Trump," but it's one of permission and copyright.

Representatives for Trump did not immediately respond to request for comment.

Oh, well, of course, then the entity that arranged the music and the rally needs to make sure they've made arrangements to use the song at the events. Personally, I don't care for that song and wish they'd choose another one. But in any event, these arrangement need to be made, and they probably have been, someone tried to nail Trump on this some time ago for using some song at a rally but when it was investigated they had requested and paid for use of the song through a proper medium.

But I think if it wasn't "political", they would have just called the campaign and asked the question to be sure proper arrangements had been made and if they hadn't, seen that they were. I'll be looking forward to the Trump response.

You know you would think this would be good advertisement for the artists. Not sure why they get so bent out of shape for a piddling fee. There's no sales involved, no profit involved for the campaign, so it's not use for money, so I'm not even sure any of it applies. But whatever applies should be followed, of course, maybe a licensing issue for the entities that do the set up for the campaigns, which they probably have and Tyler doesn't know it. That's what it turned out to be in the Neil Young fiasco.

But please find a better song. "DREAM ON" is like oh yeah, right, dream on, loser. Wrong song all the way around.

You know what? Screw all these spoiled punks. TRUMP go find Jackie Wilson's heirs and purchase an exclusive agreement to play Higher and Higher at ALL your campaign rallies. You know some REAL MUSIC with some SOUL and BEAT that'll get them on their feet and keep them there with some lyrics that actually apply to your gratitude to all the people who showed up for your rallies!!

"Your love keeps lifting me HIGHER and HIGHER"

YES! That's the song for your rallies. And what a great tribute to all those wonderful black songwriters and performers who were all totally screwed by their music companies compared to these spoiled punks in the business today.

    JUST DO IT!!

Unless you've seen something I haven't, this may not have anything to do with a fee. Perhaps Tyler just doesn't like Trump. Additionally, I read he had also threatened to sue him if he didn't cease and desist immediately. For the record, I don't much care for the song either.

Yeah, there are mediums, not directly through the songwriter or performer, but agencies that handle all these use and license fees. They're small fees and with that you have use of the song for special events. Neil Young did the same thing to Trump several months ago and Trump showed them that they had a license fee to use the song and had paid the small fee or whatever was required and did in fact have legal permission to use the song. Trump stopped using it figuring why promote the song if they don't appreciate it, and went to this Dream On song by Aerosmith, so I would imagine they've used the same license/fee procedure they always use. Hopefully someone at Trump will take the time to look it up, verify or whatever and take care of producing the license agreement or pay the fee or whatever is required if for some reason it hasn't been done, then change the song. The song is a lousy choice and I wouldn't use a song that someone was whining about. Why pay them to use their song at events like this that result in so much free publicity for their product?

Especially when the song stinks to begin with? It would be worth it just to not have to look at Tyler's face on the new whining about it.

    Excerpt:

Tyler’s attorney Dina LaPolt told the gossip website that the star is concerned about copyright.
She said: “[Tyler’s] position has always been consistent regarding copyright and intellectual property. Simply, one must get permission from the music creators.
“Steven wrote 100 per cent of Dream On, and this is about the un-authorized use of his property.”

Seems Tyler wrote the song and he gets to decide who does and doesn't get to use it.

Trump vs. R.E.M.: Why do politicians keep using songs without permission?

Members of the rock band R.E.M. are protesting Donald Trump's use of 'It's the End of the World as We Know It' at a Republican rally this week.

By Jessica Mendoza, Staff writer SEPTEMBER 10, 2015

    • Jonathan Ernst/Reuter

Donald Trump has earned the ire of another musical act peeved at his use of their song for his purposes.

At a "Stop the Iran Deal" rally in Washington, D.C. on Wednesday, Mr. Trump took the stage to the sounds of R.E.M.’s 1987 smash hit, “It’s the End of the World As We Know It (And I Feel Fine)” – a move that band members Mike Mills and Michael Stipe condemned harshly on Twitter:

They later released a more diplomatic statement on their Facebook page: "While we do not authorize or condone the use of our music at this political event, and do ask that these candidates cease and desist from doing so, let us remember that there are things of greater importance at stake here."

The band is right that candidates' musical choices say little about the strength of their political positions, which matter most in a presidential race. Yet flouting copyright law seems unwise for anyone running for public office.

So why do politicians keep doing it?

One reason may be simple negligence. "Nine times out of 10, it's a young advance person who thinks it's a cool song to play when the guy's walking in and the candidate hasn't a clue what was playing," Joe Trippi, campaign manager for Howard Dean during the former Vermont governor’s 2004 presidential bid, told Rolling Stone.

Others chalk it up to arrogance.

Candidates "want to use music in order to associate [with] fans of the artists whose music they're using, and they think they can't get permission," said intellectual property lawyer Lawrence Iser to the magazine. "What's that expression? 'It's better to beg forgiveness than to ask [only] to get turned down.' "

Still others say politicians may be out for publicity. "It’s a way to get attention," Andrew Stroud, a Sacramento attorney who has represented both musicians and political campaigns, told The Washington Post. Some candidates consider it good for business to "fight with liberal Hollywood," he added.

Under copyright law, politicians can use any song they want in a political campaign as long as they either obtain a public performance license from a performing rights group such as the American Society of Composers, Authors, and Publishers (ASCAP), or restrict playing the song to venues that already have such a license.

But even if the campaign secures the appropriate license, artists can still object to or sue against the use of their song to protect their brand, legally known as their "right of publicity," which "prevents the unauthorized commercial use of an individual's name, likeness, or other recognizable aspects of their brand or image."

R.E.M.’s Mr. Stipe invoked that right when he asked Trump – and presumably Texas Senator Ted Cruz, who also spoke at the Iran deal rally – to refrain from using his voice and music for what he called their "charade of a campaign."

Survivor frontman Frankie Sullivan did the same on Tuesday, when he protested former Arkansas governor and GOP presidential hopeful Mike Huckabee’s use of "Eye of the Tiger" to celebrate the release of Kentucky county clerk Kim Davis from jail.

"NO! We did not grant Kim Davis any rights to use 'My Tune – The Eye Of The Tiger,' " Mr. Sullivan posted on Facebook.

Another legal issue is false endorsement. In June, musician Neil Young – a self-described libertarian – denounced Trump’s use of his 1989 hit "Rockin’ in the Free World" during Trump's campaign kickoff. Mr. Young’s manager, Elliot Roberts, noted in a statement that the musician is a supporter of US senator and Democratic candidate Bernie Sanders.

"Donald Trump was not authorized to use 'Rockin’ in the Free World,' " Mr. Roberts said.

Other artists who have recently protested the political use of their music include Tom Petty, John Mellencamp, the rock duo Heart, and the Dropkick Murphys.

The best way to stay out of trouble? "Ask the artist,” Mr. Stroud advised.
