    “This is the law. And every two years — let me tell you something. Every two years I come to the Congress, just like my good friend, Mr. Labrador, we put up our hands to swear to uphold the Constitution and the laws of this country. It is the law.”

    That’s what Democrat Rep. Elijah Cummings told Anderson Cooper last October. What was he talking about you may wonder. Was it the disastrous Fast and Furious scandal and the cover-up that followed? No, Rep. Cummings dismissed questions over the DOJ Attorney General Eric Hold’s role in the affair as “an election-year witch hunt”.

    Was it about the unanswered questions about the Benghazi terrorist attack? No, you see Rep. Cummings already explained that “death is a part of life“, so that’s the end of that.

    Could it have possibly been about the IRS targeting of conservative groups requesting non-profit status? Of course not, that case is solved apparently.
    So what could that statement be about? It should be obvious, by now, you see Rep. Elijah Cummings was talking about the Affordable Care Act known in my circle as “Obama-don’t-care”. However, it’s a good thing that the esteemed and honorable gentleman pointed out that he has sworn to uphold the Constitution and the laws of the land, because it should make an excellent defense against potential charges against him for obstructing Oversight investigations.

    Whoever, with intent to avoid, evade, prevent, or obstruct compliance, in whole or in part, with any civil investigative demand duly and properly made under the Antitrust Civil Process Act, willfully withholds, misrepresents, removes from any place, conceals, covers up, destroys, mutilates, alters, or by other means falsifies any documentary material, answers to written interrogatories, or oral testimony, which is the subject of such demand; or attempts to do so or solicits another to do so; or

    Whoever corruptly, or by threats or force, or by any threatening letter or communication influences, obstructs, or impedes or endeavors to influence, obstruct, or impede the due and proper administration of the law under which any pending proceeding is being had before any department or agency of the United States, or the due and proper exercise of the power of inquiry under which any inquiry or investigation is being had by either House, or any committee of either House or any joint committee of the Congress—

    Shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both.

    In a letter directed to Rep. Cummings questions about breaking this exact law were asked by Rep. Darrell Issa. It’s been known since 2012 that True the Vote had been receiving intimidating letters by the Democrat Rep.

    Representative Elijah Cummings (D–MD) is using his position as the ranking member of the House Committee on Oversight and Government Reform to threaten True the Vote, a nonpartisan tea party organization that reports voter roll inaccuracies and potential criminal violations of federal election laws around the country.

    Cummings claims in his letter that True the Vote’s efforts to assure the accuracy and reliability of voter registration lists amount to “voter suppression.”

    On October 4, Cummings sent True the Vote a letter (which his office released as a press release) accusing the group of engaging in a “criminal conspiracy” supposedly intended to “deny legitimate voters their constitutional rights.” But True the Vote’s efforts to identify the registrations of illegal aliens, dead voters, and individuals registered in more than one state have no such intent and can’t have any such effect.

    In truth, True the Vote stands accused of doing the work that election officials ought to be doing themselves but all too often don’t.

    Just a week ago, True the Vote released its latest report, which found 6,390 individuals registered in both Florida and Ohio, 534 of whom appear to have voted twice in the same federal election. They also discovered 19,000 individuals registered in both New York and Florida.

    I’ve pointed out before the real reason that Democrats like Rep. Cummings want to put a stop to election scrutiny and it has nothing to do with upholding the Constitution or the laws of the land. It would be nice if we could trust our own elected officials to uphold the Constitution and enforce the law, however at this point it might be enough if we could expect them not to break any while playing their political games.

    Seriously though, Rep. Cummings must think we’re pretty stupid to think the same organization capable of this sort of behavior wouldn’t be capable of targeting political enemies.
    Even as the IRS faces growing heat over Lois G. Lerner and the tea party targeting scandal, a government watchdog said Wednesday it’s pursuing cases against three other tax agency employees and offices suspected of illegal political activity in support of President Obama and fellow Democrats.

    In one case the Office of Special Counsel, which investigates federal employees who conduct politics on government time, said it was “commonplace” in a Dallas IRS office for employees to have pro-Obama screensavers on their computers, and to have campaign-style buttons and stickers at their office.
    There really seems to be a there there. We’ll know sooner or later if Rep. Cummings stops obstructing congress from finding it.

    BREAKING: Emails Show Lois Lerner Fed True the Vote Tax Information to Democrat Elijah Cummings

    New IRS emails released by the House Oversight Committee show staff working for Democratic Ranking Member Elijah Cummings communicated with the IRS multiple times between 2012 and 2013 about voter fraud prevention group True the Vote. True the Vote was targeted by the IRS after applying for tax exempt status more than two years ago. Further, information shows the IRS and Cummings' staff asked for nearly identical information from True the Vote President Catherine Engelbrecht about her organization, indicating coordination and improper sharing of confidential taxpayer information.

    Chairman of the House Oversight Committee Darrell Issa, along with five Subcommittee Chairmen are demanding Cummings provide an explanation for the staff inquiries to the IRS about True the Vote and for his denial that his staff ever contacted the IRS about the group.

    “Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials – which you did not disclose to Majority Members or staff – indicates otherwise,” the letter to Cummings states. “As the Committee is scheduled to consider a resolution holding Ms. Lerner, a participant in responding to your communications that you failed to disclose, in contempt of Congress, you have an obligation to fully explain your staff’s undisclosed contacts with the IRS.”

    The first contact between the IRS and Cummings' staffers about True the Vote happened in August 2012. In January 2013, staff asked for more information from the IRS about the group. Former head of tax exempt groups at the IRS Lois Lerner went out of her way to try and get information to Cummings' office.The information Cummings received was not shared with Majority Members on the Committee.

    On January 28, three days after staffers requested more information, Lerner wrote an email to her deputy Holly Paz, who has since been put on administrative leave, asking, “Did we find anything?” Paz responded immediately by saying information had not been found yet, to which Lerner replied, “Thanks, check tomorrow please.”


    On January 31, Paz sent True the Vote's 990 forms to Cumming's staff.
    Up until this point, Rep. Cummings has denied his staff ever contacted the IRS about True the Vote and their activities during Oversight hearings. In fact, on February 6, 2014 during a Subcommittee hearing where Engelbrecht testified, Cummings vehemently denied having any contact or coordination in targeting True the Vote when attorney Cleta Mitchell, who is representing the group, indicated staff on the Committee had been involved in communication with the IRS. This was the exchange:
    Ms. Mitchell: We want to get to the bottom of how these coincidences happened, and we’re going to try to figure out whether any – if there was any staff of this committee that might have been involved in putting True the Vote on the radar screen of some of these Federal agencies. We don’t know that, but we – we’re going to do everything we can do to try to get to the bottom of how did this all happen.

    Mr. Cummings. Will the gentleman yield?

    Mr. Meadows. Yes.

    Mr. Cummings. I want to thank the gentleman for his courtesy. What she just said is absolutely incorrect and not true.

    After the hearing, Engelbrecht filed an ethics complaint against Cummings for his targeting and intimidation of her organization.

    Rep. Cummings has described the investigation into IRS targeting of conservative groups as a "witch hunt," and has tried multiple times to put the investigation on hold.

    "These documents, indicating involvement of IRS officials at the center of the targeting scandal responding to your requests, raise serious questions about your actions and motivations for trying to bring this investigation to a premature end. If the Committee, as you publicly suggested in June 2013,'wrap[ped] this case up and moved on' at that time, the Committee may have never seen documents raising questions about your possible coordination with the IRS in communications that excluded the Committee Majority," the letter sent by Issa and the Chairmen further states. "As the Committee continues to investigate the IRS's wrongdoing and to gather all relevant testimonial and documentary evidence, the American people deserve to know the full truth.

    They deserve to know why the Ranking Member and Minority staff of the House Committee on Oversight and Government Reform surreptitiously contacted the IRS about an individual organization without informing the Majority Staff and even failed to disclose the contact after it became an issue during a subcommittee proceeding...We ask that you explain the full extent of you and your staff's communications with the IRS and why you chose to keep communications with the IRS from Majority Members and staff even after it became a subject of controversy."

    The House Oversight Committee will vote tomorrow about whether to hold Lerner in contempt of Congress.

    House Oversight GOP: Cummings Behind IRS Probe of True the Vote

    Republicans on the House Oversight and Government Reform Committee accused the panel's senior Democrat on Wednesday of spurring the IRS investigation of True the Vote after the group filed its application for tax-exempt status in 2010.

    Rep. Darrell Issa, the panel's chairman, released emails showing that staff working for the ranking member, Rep. Elijah Cummings of Maryland, had communicated multiple times with the Houston-based group between August 2012 and last year.

    Issa also charged that information obtained by Cummings' staff was shared with the IRS and its embattled former supervisor, Lois Lerner, and that the Democrat did not disclose any of those dealings with committee Republicans.

    "Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials — which you did not disclose to majority members or staff — indicates otherwise," Issa said in a letter sent to Cummings.

    The letter, also signed by the five Republicans who chair oversight subcommittees, referenced the committee's planned vote on Thursday to hold Lerner in contempt for her twice refusing to testify before the panel in its investigation.

    "You have an obligation to fully explain your staff’s undisclosed contacts with the IRS," the letter says.

    Cummings, who has been in the House since 1996, has contended that he was conducting appropriate oversight of True the Vote. A staffer told Newsmax on Wednesday that a statement from the congressman was forthcoming.

    Catherine Engelbrecht, True the Vote's president, said Wednesday that the organization filed an ethics complaint against Cummings in February. She criticized the Democrat for his information requests at a committee hearing that month.

    "Today's committee action reveals what we knew all along: partisan politics and the weaponization of government against opponents of this administration is real and continues," Englebrecht said. "Elijah Cummings has blocked the IRS abuse investigation all along. We now see clearly that two branches of government have colluded to target and silence private citizens."

    She said the organization was amending its complaint against Cummings to include the latest information.

    "America has come to a tipping point," Engelbrecht said. "No more lies. No more cover-ups. No more collusion. Enough is enough."

    The new emails came as the House Ways and Means Committee voted to recommend that Lerner, who retired from the IRS last year, be investigated for criminal violations by the Justice Department.

    That panel found in its investigation that Lerner engaged in an "aggressive and improper pursuit" of Crossroads Grassroots Policy Strategies, a nonprofit political group co-founded by Republican strategist Karl Rove.

    Ways and Means is calling for a criminal inquiry because it found that Lerner treated conservative groups unfairly.

    A vote-monitoring organization founded in 2009, True the Vote was among dozens of tea party, conservative, and religious groups singled out for special scrutiny by the Internal Revenue Service in their applications for tax-exempt status starting in 2010 and through the presidential election.

    The organization was granted its tax-exempt status last September after three years and a lawsuit against the agency. The lawsuit is pending. The status that True the Vote received, 501(c)(4), allows the organization to keep its donors private.

    According to the emails released on Wednesday, members of Cummings' staff first contacted the IRS about True the Vote in August 2012.

    The next January, staffers sought more information from the agency about the group. The emails showed that Lerner made special efforts to obtain information from Cummings' office.

    For instance, a Jan. 28 email — sent three days after staffers requested more True the Vote information — Lerner wrote to her deputy, Holly Paz, asked, "Did we find anything?"

    Paz, who is now on administrative leave in light of the scandal, responded immediately, saying that no information had yet been found.

    Lerner then replied, according to the emails, "Thanks, check tomorrow please."

    In Feburary, Engelbrecht charged in an Oversight Committee hearing that Cummings “sent letters to True the Vote, demanding much of the same information the IRS had requested” after the group filed its application.

    She added that Cummings then “would appear on cable news and publicly defame me and my organization.”

    Engelbrecht added that her organization and her manufacturing company received IRS audits and six separate inquiries from the FBI regarding “domestic terrorism” after the group filed its application.

    In addition, her business was inspected and fined by the Occupational Safety & Health Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives, Politico reports.

    “For decades I went unnoticed, but now find myself on the receiving end of interagency coordination into and against all facets of my life,” she said at the hearing.

    In response, Cummings said: "There is no one that I know of that cares more about the rights of our citizens than I do. I don’t care if you’re tea party or Democrat or Republican — I want to make sure no one is blocked from voting."

    Lerner, who headed the agency that evaluated applications for tax-exempt status, ignited the controversy last May when she disclosed the scandal in response to a question asked at a conference in Chicago.

    Her response came just before the Treasury Department's inspector general released a report disclosing the IRS targeting.

    President Barack Obama fired Steven Miller, head of the IRS, who apologized in testimony to Ways and Means Committee, calling it "horrible customer service," and at least three other IRS workers have been placed on put on administrative leave.

    In testimony before the oversight committee, Lerner has twice invoked her Fifth Amendment, though she has denied wrongdoing.

    Lerner's attorney, William Taylor, has charged Republicans with trying to "vilify Ms. Lerner for political gain.”

    He also disclosed last month that Lerner has discussed the IRS targeting with the Justice Department. Taylor did not disclose the date of the private session but indicated that his client was not under oath.

    It doesn’t get more pathetic than this. Cummings attempts to make some deep and thoughtful speech that he thinks will be taught to the generations of children long after he’s dead. He’s basically arguing that he’s standing up for Lois Lerner’s right to plead the 5th and in doing so accuses Republicans of McCarthyism or something.

    Congressman Elijah Cummings, the ranking Democrat on the House Oversight and Government Reform Committee, could be facing an ethics investigation if Cleta Mitchell has her way.

    Mitchell — a partner at Foley & Lardner and the legal counsel for True the Vote in its case against the IRS for its targeting of conservative groups — is pursuing Cummings over his conduct in the wider investigation.

    “[Cummings] announced within 30 days after the IRS scandal that “Whoops, all this investigation is over, and we don’t need to be doing anything more on that,’ and he has done everything he can do to thwart and obstruct this investigation,” Mitchell said. “And has just been adamant that the investigation needs to end, that this is just a witch hunt, that there’s nothing there, that nobody did anything wrong.”

    Mitchell believes that Cummings’s actions, including what he described as ”his investigation of True the Vote” is outside of his jurisdiction and that it is a gross abuse of power to investigate private citizens.

    “In the fall of 2012, True the Vote received a series of letters — eight, nine, 10 page letters from Elijah Cummings out of the blue, conducting what he claimed was ‘his investigation of True the Vote,’” she continued. “Now mind you, the jurisdiction of the House Oversight & Government Reform Committee is federal agencies. It is not private citizens’ groups in Houston, Texas.

    “Congressman Cummings sent this series of letters demanding all this material and information from True the Vote. This went on for several months, and then he would get on national TV, MSNBC of course, and before the letters had been received by True the Vote he’d be waving these letters around and that he’s conducting an investigation, which of course he has no authority under the House rules to do.”

    Mitchell believes that Cummings actions are nothing more than the latest step in a wider attempt by Democratic left to stifle discussion and opposition by the conservatives.

    “On behalf of True the Vote, we filed a complaint against Rep. Cummings on February 6 with the Office of Congressional Ethics asking the Office of Congressional Ethics to investigate whether Rep. Cummings or any member of his staff had played any role in getting any of the agencies that went after Catherine Engelbrecht and her family after she became involved with True the Vote. Two IRS audits about the business, her personal tax returns, two visits from the Bureau of Alcohol, Tobacco and Firearms, a surprise visit from OSHA, seven visits from the FBI. I mean, these are not coincidences. And so we wanted to know what role Rep. Cummings or any of his staff had played in any of that and why Rep. Cummings undertook to misrepresent that he was conducting an investigation of True the Vote, which we think was in violation of House rules.”

    Cummings has vociferously defended his actions, often calling the investigation by Republican Oversight Committee chairman Darrell Issa as disingenuous and painting any criticism of his actions as unfairly partisan. This has included taking shots at Mitchell herself. However, the release of Lois Lerner’s emails have cast significant doubt on the honesty and transparency of Cummings’s intentions and motivations.

    “[Cummings] of course denied that he said this is what we’re asking, he said that’s not true, that never happened, she’s absolutely incorrect (talking about me),” Mitchell said. “Well, guess what? Now the House Oversight and Government Reform Committee obtains, for the first time in the last three or four weeks — receives some of Lois Lerner’s emails, and guess what? It shows that she is in fact directing responses from the IRS to Rep. Cummings office because they had advised Lois Lerner and IRS that… he is conducting an investigation of True the Vote.”

    For Mitchell, the actions of Cummings speak volumes and despite his protestations that the entire investigation is a partisan inspired witch hunt, for Mitchell the facts are beginning to prove a very different narrative.

    “Interestingly, the questions in some of these letters from Rep. Cummings to True the Vote are almost identical to the questions the IRS had sent to True the Vote six to eight months earlier. Those are not documents that are supposed to have been shared outside the IRS. We want to know, and we have asked OCE who supplemented our complaint, and we have asked the Office of Congressional Ethics to look at what were the documents, what were the emails received by Rep. Cummings and his staff. We want to know the rest of the story. We want to know what Cummings did and his staff because they have now. We say, well, maybe that’s why he wanted to shut down the investigation.”

    The continuing emergence of crucial and highly controversial evidence is reason enough for Mitchell to pursue the truth.

    “[Cummings] didn’t want any of this to ever become known,” she said. “And if Congressman Issa had done what Cummings had suggested last summer, we never would have known about this.”

    True The Vote Takes On Oversight Member Elijah Cummings For Allegedly Colluding With Lerner’s IRS

    Not long ago, on the same day the House of Representatives voted to hold Lois Lerner in contempt of Congress, House Oversight Committee Chairman Darrell Issa (R-Calif.) accused fellow Oversight member Elijah Cummings (D-Md.) of taking an inappropriate, meddlesome interest in True the Vote, a conservative nonprofit group Lerner’s Internal Revenue Service division eventually targeted for discrimination.
    Now True the Vote has taken up the fight, suggesting it may have sufficient grounds to convince the Oversight Committee to widen its IRS investigation to include one of the committee’s own members: Cummings himself.
    The organization’s attorney, Cleta Mitchell, told The Daily Caller over the weekend that True the Vote has had a pending complaint against Cummings before the Office of Congressional Ethics since February. Her extensive interview on the topic, along with comments to the media last week, may indicate that True the Vote is ready to play its hand against Cummings and the role he allegedly played in directing the IRS’s attention to the Texas-based nonprofit during President Barack Obama’s re-election campaign.
    Mitchell told The Daily Caller:
    On behalf of True the Vote, we filed a complaint against Rep. Cummings on February 6 with the Office of Congressional Ethics asking the Office of Congressional Ethics to investigate whether Rep.     But Mitchell and True the Vote now maintain that Cummings was, the whole time, attempting to defuse the investigation before Oversight members realized Cumming’s alleged involvement in the broader scandal. And Mitchell should know — she was the one who got a straight (or at least unequivocal) answer out of Cummings when she asked him about it during a Feb. 6 Oversight hearing:
    Ms. Mitchell: We want to get to the bottom of how these coincidences happened, and we’re going to try to figure out whether any — if there was any staff of this committee that might have been involved in putting True the Vote on the radar screen of some of these Federal agencies. We don’t know that, but we — we’re going to do everything we can do to try to get to the bottom of how did this all happen.
    Mr. Cummings: Will the gentleman yield?

    Judge Nap on Lerner Emails: Looks Like IRS Has Willfully Destroyed Evidence

    Judge Andrew Napolitano was on “The Kelly File” tonight to discuss two years of Lois Lerner’s emails, which the IRS says it has lost.

    Napolitano said the FBI can recover almost anything, and there needs to be a way for it to look for the emails.
    “The American public is entitled to confidence in the government,” he said.

    ‘A High Crime, Not a Triviality’: Krauthammer Slams Admin for Lost Lerner Emails

    To the average American, Napolitano said it “looks like the IRS has willfully destroyed evidence […] in order to avoid revealing embarrassing violations of the law.”
    In a civil case, Napolitano said he would tell a jury, “If the IRS has not produced evidence during the time period when the plaintiff said they were being harassed, you may infer from the IRS’s silence that if they did speak, their words would incriminate them.”
    If the White House doesn’t have those emails, Napolitano said that the NSA has every email that has ever been sent or received in the United States since 2009.
