ICE Releases Zip Codes 'Associated With' Released Aliens Convicted of Homicide

Immigration and Customs Enforcement has released the zip codes associated with the Obama administration’s release of 169 immigrants convicted of “homicide-related” offenses who were awaiting deportation proceedings.
ICE released the new information about the 169 immigrant convicts to Iowa Republican Sen. Chuck Grassley. The senator pressed the Department of Homeland Security for answers in June following confirmed reports that, in 2013, ICE released 36,007 immigrants convicted of nearly 88,000 crimes (including murder, kidnapping, and sexual assault). All were awaiting the outcome of deportation proceedings.
Thursday, Grassley released the information provided to him from ICE about the 169 released immigrants convicted of homicide. Thomas Winkowski, ICE’s principal deputy assistant secretary wrote in a letter to Grassley:
Of the 169 detainees with a homicide-related conviction who were released from ICE custody in FY 2013, 131 have been issued final order of removal. Of the remaining 38 aliens who have not been issued a final order of removal, one was granted voluntary departure by an immigration judge and subsequently departed within the permitted timeframe. Further, 154 of the 169 were released pursuant to court order due to Zadvydas.
Winkowski subsequently listed the more than 130 zip codes, he wrote, were “associated with the detainees.”
“Ensuring that our enforcement policies and procedures are best suited to protect national security, and public safety is paramount,” he added. “To make certain we are doing everything we can in this regard, I am instituting new procedures requiring that an appropriate senior-level supervisor must approve before ICE releases potentially dangerous individuals.”
According to Grassley, Winkowski’s response reveals the government has not placed adequate protections to “ensure public safety and national security.”
“The public needs to know when a person is in the country illegally, and who has been convicted of a homicide, is released into their communities,” Grassley said in a statement. “We’ve introduced legislation that would reverse the court case that the Obama administration is relying on to excuse its irresponsible release of thousands of criminally convicted aliens.”
Grassley’s office noted that he has introduced legislation that would “close the legal loophole created by” the 2001 Supreme Court Case Zadvydas v. Davis, which requires the government to release aliens if they are not accepted for deportation by their home countries within six months.

The Obama administration says it had no choice but to release almost all of the 169 immigrants with homicide convictions that were let back onto the streets last year, claiming court decisions gave officials no choice in the matter — but it’s promising a new system to better screen who gets let out.
Of the 169 immigrants with homicide-related convictions released in fiscal year 2013, all but 15 were required to be let go because of specific court orders or because the immigrants had been held for too long under the rules established by a sweeping 2001 Supreme Court case, the Homeland Security Department said in an Aug. 15 letter to Sen. Chuck Grassley, Iowa Republican.

The state that has the largest number of illegal immigrants with homicide-related convictions was California. The Center for Immigration Studies says the city with the greatest concentration of criminal aliens was Miami, followed by Los Angeles and the Bronx. See the interactive map here.
But that’s just the tip of the iceberg.According to data compiled by the Center For Immigration Studies:
In 2013, ICE freed 36,007 convicted criminal aliens from detention who were awaiting the outcome of deportation proceedings, according to a document obtained by the Center for Immigration Studies. This group included aliens convicted of hundreds of violent and serious crimes, including homicide, sexual assault, kidnapping, and aggravated assault. The list of crimes also includes more than 16,000 drunk or drugged driving convictions. The vast majority of these releases from ICE custody were discretionary, not required by law (in fact, in some instances, apparently contrary to law), nor the result of local sanctuary policies.
The document reveals that the 36,007 convicted criminal aliens freed from ICE custody in many instances had multiple convictions. Among them, the 36,007 had nearly 88,000 convictions, including:
- 193 homicide convictions (including one willful killing of a public official with gun)
- 426 sexual assault convictions
- 303 kidnapping convictions
- 1,075 aggravated assault convictions
- 1,160 stolen vehicle convictions
- 9,187 dangerous drug convictions
- 16,070 drunk or drugged driving convictions
- 303 flight escape convictions

Sen. Charles Grassley (R-Iowa) this week released a letter from U.S. Immigration and Customs Reform that lists the zip codes where ICE has released dozens of illegal immigrants who have been convicted of a “homicide-related” offense.
Grassley asked ICE back in June for more information about where these immigrants were released. Earlier this month, Grassley got a letter back saying 169 immigrants with a “homicide-related conviction” were released in 2013, and 131 of them were issued a final order of removal.

The 169 immigrants were part of a larger group of 36,000 that were released from detention in 2013. ICE’s letter lists the zip codes that are “associated” with the former detainees with “homicide-related” convictions. Grassley had asked for the zip code of each convict’s last known address.
The letter from ICE’s Principal Deputy Assistant Secretary, Thomas Winkowski, said he is putting in place “new procedures” to require review by a superior before ICE releases “potentially dangerous individuals.”
But Grassley said that’s not enough, and that the public needs to know when and where these immigrants are released.
“The public needs to know when a person is in the country illegally, and who has been convicted of a homicide, is released into their communities,” he said. “We’ve introduced legislation that would reverse the court case that the Obama administration is relying on to excuse its irresponsible release of thousands of criminally convicted aliens.”
Sen. David Vitter (R-La.) responded Friday by saying two of the zip codes in ICE’s letter are in his home state, and said it shows the Obama administration is bent on easing immigration rules at any cost, even if that cost is public safety.
“This information proves that some of our deepest fears about the Obama administration’s amnesty policies are, in fact, true,” Vitter said. “It’s absolutely vital that the administration stops granting amnesty and starts enforcing our immigration laws – and it needs to happen before any more of these criminals are released into Louisiana.”
