Despite receiving tremendous support from nearby residents who say he was justified in his actions, the Texas dad who beat his 4-year-old daughter’s alleged molester to death near Shiner, Texas is remorseful for taking a man’s life, KRIV-TV in Houston reports.

“He told me that it wasn’t his intent for this individual to lose his life; he was just protecting his daughter,” Lavaca County Sheriff Micah Harmon said, recalling his conversation with the father after the incident on Saturday. The Sheriff doesn’t anticipate charges against the dad, but following an investigation the case will go to a grand jury.

KRIV-TV reports it was the father who initially called 9-1-1.

Yesterday, The Blaze brought you the story about the aforementioned father who after hearing his young daughter‘s screams coming from the family’s horse barn, found a man reportedly sexually assaulting her. He yanked the attacker off of her and punched him in the head repeatedly and ultimately killed him.
Now, a Texas civil rights leader has come out and questioned the father’s choice to “summarily execute” the alleged attacker without due process.
James Harrington, director of the Texas Civil Rights Project in Austin, said the dad had the right to “defend” his daughter but suggests he may have gone to far due to “anger.”

“Assuming it’s true that this guy was molesting the daughter, and we don’t know what exactly happened at this point, he would then have the right to defend [her], and hit him enough to have him stop,” Harrington told FoxNews.com. “But you cannot summarily execute him, even though I can understand the anger he would have.”





Harrington reportedly went on to say that, without specific knowledge of the case, he was “surprised” that the girl’s dad had not been charged yet.“The question is: When does it move beyond self-defense?” he asked.But as Hot Air points out, the Texas penal code is pretty clear and it appears that the Texas father was not only morally justified but legally as well.
According to the penal code:

(a) A person is justified in using deadly force against another:
(1) if the actor would be justified in using force against the other under Section 9.31; and
(2) when and to the degree the actor reasonably believes the deadly force is immediately necessary:
(A) to protect the actor against the other’s use or attempted use of unlawful deadly force; or
(B) to prevent the other’s imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.
(b) The actor’s belief under Subsection (a)(2) that the deadly force was immediately necessary as described by that subdivision is presumed to be reasonable if the actor:
(1) knew or had reason to believe that the person against whom the deadly force was used:
(A) unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment;
(B) unlawfully and with force removed, or was attempting to remove unlawfully and with force, the actor from the actor’s habitation, vehicle, or place of business or employment; or
(2) did not provoke the person against whom the force was used; and
(3) was not otherwise engaged in criminal activity, other than a Class C misdemeanor that is a violation of a law or ordinance regulating traffic at the time the force was used.
(c) A person who has a right to be present at the location where the deadly force is used, who has not provoked the person against whom the deadly force is used, and who is not engaged in criminal activity at the time the deadly force is used is not required to retreat before using deadly force as described by this section.

Further, in another unsettling development in the case, authorities have revealed that the deceased 47-year-old alleged predator apparently has family ties to Mexico, where investigators are currently attempting to notify his next of kin. His identity still hasn’t been revealed other than he is from Gonzales, Texas.

District Attorney Heather McMinn told FoxNews.com that the case is still being investigated and the Texas Rangers are now involved.“My understanding is that they are looking for family members in Mexico,” McMinn said.

Police have not confirmed whether or not the man was an illegal alien or a U.S. citizen with family in Mexico.



The name of the father has not been made public either in a bid to shield the 4-year-old little girl from any further trauma.

We certainly get a lot of articles here at ALIPAC about illegal aliens raping little children on American soil. Many illegal aliens have a rape and pillage mentality that manifest against innocent women and children. The illegals are shown that America is weak and will not enforce border and immigration laws because of the traitors that are manipulating our Executive Branch to assure our Republic is disrupted for their goals of throwing America into demographic chaos or transformation.

So the illegals fear no boundaries.

Rape is a boundary violation just like violating a border or an immigration law.

I would venture to say that most, if not all of us, might react the same way if we were faced with the same situation that this man faced. I know that I would.

I read an AP story on this yesterday. The Sheriff stated that he did not intend to file any charges, as other than Dad's statement, no other evidense had been discovered. The Sheriff also stated that he would present the case to a Grand Jury. I expect no indictment forthcoming unless more evidence is discovered.

Sheriff: Father caught Jose Mora sexually assaulting 5-year-old daughter

SHINER, Texas - Investigators have released the name of a man who was beaten to death when a father allegedly caught him trying to molest his 5-year-old daughter.

Lavaca County Sheriff Micah Harmon said the 23-year-old father, whose name has not been released, is unlikely to be arrested for Saturday's killing and that no evidence so far has led investigators to doubt his story.

"There doesn't appear to be any reason other than what he told us," Harmon said.

Lavaca County Sheriff Micah Harmon said the 23-year-old father killed Jesus Mora Flores, 47, from Gonzales, Texas.

Flores was an "acquaintance" of the father who had come to help care for some horses, Harmon said. He did not know how long the two men may have known each other. The girl was taken to a hospital to be examined and has since been released, Harmon said.

The father called deputies late Saturday afternoon and told them he attacked a man caught trying to sexually assault his daughter, Harmon said. The father was distraught and asked for medical care for Flores, investigators said.

The incident happened near a barn in Mt. Olive where some horses were being kept. The adults were shoeing a horse and the girl and her brother had been sent to feed chickens.

The children's grandfather said the boy later came back and said his sister had been taken away by a man. Her father then went out to look for her, the grandfather said.

Investigators said the father went to look for his daughter and called out her name. He then heard her screaming for help, officials said.

The father found both his daughter and Flores partially naked, investigators said.
"In the course of trying to get her away from him, and protect her, he struck the subject several times in the head and the subject died," Harmon said.

Detectives said Flores' pants and underwear were down when paramedics arrived.

Harmon said that all the evidence supported what the father told them happened. He said the father was very remorseful and did not intend to kill Flores.

"Despite the other factors involved, this is still a homicide investigation," he said.
Harmon said a grand jury will decide what, if any, charges the father will face.

"Sheriff Harmon made the right decision in not arresting the father at the time of the incident," Lavaca County District Attorney Heather McMinn said.

The ranch, which is near Shiner, is about 130 miles west of Houston. Killings are rare in rural Lavaca County. Harmon said his office has only investigated six in his eight years as sheriff.

A Texas rancher who beat his daughter's accused molester to death moments after he discovered the man raping the 5-year-old girl, will not be charged with his homicide, officials said, as they released chilling 911 tapes of the father calling for help as the other man died.

A grand jury Tuesday decided not to indict the 24-year-old father who beat ranch hand Jesus Mora Flores to death with his bare hands, after finding the man abusing his daughter behind a barn.

"I need an ambulance. This guy was raping my daughter and I don't know what to do," the father is heard telling dispatchers in a frantic call to 911.

The attack happened on June 9 at an isolated ranch near Shiner, Texas. A witness saw Flores "forcibly carrying" the girl into a secluded area and ran to find the father, according to court documents. Running towards his daughter's screams, the father found Flores and the girl, both with their underwear removed, according to police reports.

He pulled Flores off the little girl and "inflicted several blows to the man's head and neck area," according to documents.

Authorities who examined the girl and Flores' body confirmed a sexual assault had occurred.

ABC News does not identify the victims of sexual assault, and is not identifying the father in an effort to protect the minor girl's identity.

The father called 911 from a cell phone and did not immediately know his exact whereabouts, making it difficult for emergency personell to find him.

"Come on! This guy is going to die on me!" the man yelled at the 911 dispatcher. "I don't know what to do."

The father was never arrested, but Flores' death was investigated as a homicide.

"Under the law in the state of Texas deadly force is authorized and justified in order to stop an aggravated sexual assault or sexual assault," District Attorney Heather McMinn told reporters.

"All the evidence provided by the sheriff's department and the Texas Rangers indicated that's what was occurring when the victim's father arrived at the scene," she said.
