A Judge Just Ordered Trump To Keep DACA

A federal judge in California ordered the Trump administration to maintain the Deferred Action for Childhood Arrivals (DACA) program late Tuesday, an Obama-era amnesty policy that extends legal status to 700,000 illegal aliens who arrived in the U.S. as children.

The ruling could ensures DACA’s security as President Donald Trump attempts to reach an immigration deal with Democratic lawmakers. The program was scheduled to phase out in March.

Judge William Alsup, a Bill Clinton appointee, issued the ruling.

The administration justified DACA’s termination on separation of powers grounds, arguing only Congress could authorize such a program.

Alsup strongly rejected this view, pointing to a 2014 Justice Department memo purporting to show that DACA’s features are rooted in Supreme Court case law or related powers granted by Congress.

Since the program’s rescission was based on a flawed legal premise, Alsup concluded the action was “arbitrary, capricious, an abuse of discretion, [and] otherwise not in accordance with law.”

Alsup further noted that Trump himself has determined DACA serves the public interest, citing two Sept. 2017 tweets in which the president expressed support for so-called “Dreamers.”


“We seem to be in the unusual position wherein the ultimate authority over the agency, the chief executive, publicly favors the very program the agency has ended,” the judge wrote.

The order does not require the administration to process new DACA applications, and allows law enforcement to remove any DACA recipient believed to pose a threat to national security or public safety.

The Trump administration can ask the 9th U.S. Circuit Court of Appeals to review Alsup’s decision.

The University of California system brought the suit challenging DACA’s termination. The system is led by Janet Napolitano, the former secretary of Homeland Security who presided over DACA’s original promulgation during the Obama administration.

More DACA drama.

Yes, exactly. The ruling came out after Trump's meeting today, so none of the talk shows knew about it in time to incorporate into their stories, only the late night Shannon Bream, Night Court, covered it which is where I learned about it from Fox News, then looked it up and posted an article on the Illegal Immigration forum. Anyway, I'm sure it will be the big news tomorrow for all the shows to discuss the impact on the DACA DEAL. Be interesting to see what happens since there is now no more immediate "urgency" for the Democrats to push DACA DEAL before passing the budget and taking care of our own citizens, military, government and country.

“Let me be VERY clear: this ruling last night in no way diminishes the urgency of resolving the DACA issue,” Schumer said. “On this, we agree with @WhiteHouse, who says the ruling doesn’t do anything to reduce Congress’ obligation.”

LOL!! He made the statement to counter the fact that it does remove the urgency. The White House if he said that is right, it doesn't change Congress obligations, it changes the false claim of Democrats of "urgency".

A judge’s ruling blocking the Trump administration from deporting hundreds of thousands of younger undocumented immigrants added to the urgency on lawmakers to craft a fast solution to a political quagmire.

The White House, which plans to appeal Tuesday’s decision, said Congress must act quickly on immigration reform or risk that the Supreme Court will overturn the ruling and end the Deferred Action for Childhood Arrivals program, legislative director Marc Short said on National Public Radio.

Many lawmakers also want a quick fix after a ruling that injected “additional uncertainty into the mix,” the second-ranking Senate Republican, John Cornyn of Texas, told reporters on Capitol Hill.

“We’re plowing ahead like we discussed yesterday at the White House.”

The decision may give Democrats and DACA supporters a stronger hand in their push for legislation to protect the DACA participants, known as Dreamers, as part of a broader immigration reform bill, said Lori Nessel, a professor at Seton Hall University School of Law in Newark, New Jersey.

Immigration Agenda

But that leverage could disappear if the legal battle quickly escalates to the nation’s top court. The Supreme Court already has come to President Donald Trump’s rescue on another piece of his immigration agenda, keeping his travel ban alive even after lower courts declared it unconstitutional. The justices also let stand a ruling that killed an Obama-era policy related to DACA -- which may give the Justice Department confidence that it will prevail using similar legal arguments.

Hans von Spakovsky, with the conservative think tank Heritage Foundation, said Trump will win in the end. He compared Tuesday’s ruling by a San Francisco federal judge to what he said were flawed decisions by other jurists against Trump’s travel restrictions targeting several Muslim-majority countries.

“This is another political decision by another biased judge that is not based on the law," von Spakovsky said. "It will be reversed when it gets to the Supreme Court in the same way that the politically motivated decisions against the president’s travel orders were reversed."

Trump on Wednesday took to twitter to express his dissatisfaction with the ruling by U.S. District Judge William Alsup, who was appointed by President Bill Clinton, calling it an example of "how unfair and broken our court system is."

Some legal experts said the administration has only itself to blame that it didn’t win the opening round of the court fight.

Broad Discretion

Presidents have broad discretion in creating guidelines for the handling of immigration cases, including which groups to protect or target, but they still need to cite valid reasons for their actions, according to Denise Gilman, an immigration professor at University of Texas School of Law in Austin.

"The decision by the administration to terminate DACA relied on the flawed legal premise that DACA, as an administrative program, was not legal, when in fact there has been no determination by any court that the program is not legal," Gilman said in a phone call.

Trump and Attorney General Jeff Sessions, a passionate critic of immigration, both legal and illegal, would have fared better in the DACA litigation if they’d crafted legitimate policy reasons for ending the program, said Shoba Sivaprasad Wadhia, a clinical professor of law at Penn State Law.

‘Empty’ Argument

"The administration has long -- and dishonestly -- relied on an empty legal argument to justify why it ‘had’ to rescind DACA," Wadhia said in an email. "A decision to rescind for policy reasons may have stronger legs than the false premise that DACA is not lawful."

The next step in the legal fight will almost surely be before a court that hasn’t shown a lot of love for Trump. The San Francisco-based Ninth Circuit Court of Appeals previously ruled against multiple versions of Trump’s travel ban and is now weighing a lower court’s ruling against the administration’s plan to withhold federal funds from so-called sanctuary cities that refuse to cooperate with federal immigration authorities.

But just as certainly, the Ninth Circuit won’t have the last word.
Despite the San Francisco judge’s solid reasoning, Trump’s foes will have less luck at the nation’s highest court, where the strong emotions surrounding the case will have less impact, said Peter Spiro, an immigration law professor at Temple University.

"I think the Supreme Court looks at these questions more broadly and looks at the administrative law more generally, and it’s less likely to be affected by atmospherics," he said.

In October 2016, the Supreme Court rejected a last-ditch bid by President Barack Obama’s administration to revive his plan to shield millions of unauthorized immigrants from deportation -- a policy that was separate from but similar to DACA.

That decision was on a 4-4 vote -- with the tie effectively rejecting Obama’s request for reconsideration. This time around, the court is fully staffed with Trump’s appointment of Justice Neil Gorsuch.

When it says the "White House" it's referring to President Trump ..... he is Mr. White House. So not only does the sense of urgency continue for the Democrats, it's also apparent the same urgency continues to exist for our dear president. He does not want to be undermined by the U.S. Supreme Court. Trump's amnesty support has become very clear over the last 48 hours!

This is all about separation of powers. There's no way an honest US Supreme Court can rule against Trump ending the program. Trump has all the authority to end the program he needs, yes, he needs to follow some protocol because of the issue of the contract, "let it expire", the people paid money in good faith to get their work permits, and it seems to me that Trump and the DOJ ended it properly and fairly, too much so in my opinion.

How about the Trump admin grow a spine and do what Obama did which is to ignore the courts when they come down with these ridiculously unconstitutional rulings. The courts are full of leftists and RINO's and need to be held accountable for their blatant judicial activism. The federal courts have no jurisdiction here and can't rule on something that isn't even law to begin with. DACA was enacted via Obozo's executive overreach and was never made law by Congress. It was illegal to begin with. Now they are saying the president can't exercise his constitutional powers and repeal an executive order that was illegal to begin with? Why do we even have elections at all if some rogue judge can override the will of millions in favor of those who have no legal right to be here? Trump needs to stop complying with these unconstitutional rulings, take it to the SCOTUS if he has to. The courts did nothing to Obama when he ignored them, doubtful they would do anything here.
