Judge: Trump’s anti-Mexico comments undercut DACA phaseout

Yet another federal judge has ruled that President Trump showed “clear cut indications of racial prejudice” against Mexicans during the campaign, and he used that in a new decision Friday to further dent the administration’s efforts to end the Obama-era DACA deportation amnesty.
Judge William Alsup, who earlier in the week had blocked the DACA phaseout and ordered the government to start accepting amnesty renewals again, issued a second order adding more reasons to his decision.
He said that the immigrant-rights advocates had proved Mr. Trump’s actions were unconstitutional because they targeted Mexicans, after the president during the campaign complained about the types of people coming into the U.S. from its southern neighbor.
While acknowledging a gap of two years between some of the comments and the president’s action, Judge Alsup said he was still able to draw a direct line between Mr. Trump’s complaint in June 2015 that Mexico sends rapists and criminals to the U.S. and his September 2017 decision to phase out DACA.
“Are clear cut indications of racial prejudice on the campaign trail to be forgotten altogether?” Judge Alsup, a Clinton appointee to the bench, said in his latest ruling.
He said the 9th U.S. Circuit Court of Appeals had itself used Mr. Trump’s campaign comments to rule his travel ban policies illegal. And while the Supreme Court has several times delivered spankings to the lower courts for their attempts to block the travel ban, Judge Alsup said he felt justified in using the campaign comments against Mr. Trump — at least for now.

DACA is not just illegal aliens from "Mexico"...it covers ALL illegals who applied for this unconstitutional EO that are from many other countries.
The majority of them happen to be from Mexico.
They were here illegally and subject to DEPORTATION before Obama gave them "Temporary Deferred Deportation Status" and they are STILL illegal.
DAPA WAS ILLEGAL AND SO IS DACA
This DACA does not dispute the fact they are still illegal aliens! Who brought them here "through no fault of their own" does not matter!
Send it to the court and TERMINATE DACA now!
YOU CANNOT GIVE BLANKET AMNESTY AND A PATH TO STAY FOR A CERTAIN GROUP OF PEOPLE!

NO PATH TO STAY

According to reports, U.S. President Donald Trump is going to scrap the Deferred Action for Childhood Arrivals (DACA) program, while giving Congress up to six months to find a legislative alternative. DACA was created through an executive order signed by Barack Obama in August 2012 and it protects hundreds of thousands of young unauthorized immigrants from deportation. Referred to as "Dreamers", unauthorized immigrants who came to the U.S. before the age of 16 were given a chance to study and work, provided they met certain conditions such as passing an FBI background check, not holding a serious criminal conviction as well as either being enrolled in or having recently graduated from high school.
The U.S. government defers any deportation action against those approved for the program for two years and these benefits can be renewed. Nearly 790,000 young "Dreamers" have enjoyed deportation relief under DACA and since 2012, approximately 800,000 renewals have been issued, according to the Pew Research Center. Even though "Dreamers" represent a fraction of the estimated 11 million illegal immigrants in the U.S., Trump vowed to deport all of them during his election campaign. Since then, support for DACA has increased and the six months given to Congress to find a replacement is being viewed as a compromise after Republican lawmakers and business leaders including Mark Zuckerberg and Tim Cook pressed the president to retain the program.
California has approved 222,795 DACA applications, the highest number in the U.S. by far. Texas came second with 124,300 and Illinois was third with 42,376. As can be seen from the following infographic, young immigrants from Mexico account for the vast majority of DACA applications with 618,342 approved to date. In fact, 78 percent of initial and approved applications have come from Mexico. El Salvador has the second highest number of approved applications with 28,371 while Guatemala comes third with 19,792.
