    E-Verify Is A Failure and not a failure and Why?

    In my opinion as a small business owner in the Phoenix Arizona area the States mandatory E-verify system is a failure but not a failure.

    The reason I say it is a failure but not a failure is from two points of view having worked with this system for several years now and having run several hundred employees through the federal E-verify system.

    It is sucessful at ensuring the two documents usually presented by new employees for their I-9 Immigration form which are the US issued drivers license and the federal social security card match with the data maintained in the social security administration database.

    E-verify looks at three key things that you input to determine work authorization. It looks at the name, the date of birth, and the social security number to see if all three items match their records. If they match you recieve an instant verification message stating "employment authorized".

    Now on its face that sounds good and the employer has complied with all State and Federal hiring laws in that aspect. He has an authorization letter printed that he places in the new hire file.

    The problem is you still don't know that the person you just hired is in-fact the person that E-verify just approved. Why?

    Because the E-verify system only matches names and dates of birth and has no ability to determine if the documents presented are stolen documents that a new employee is using to pose as an authorized worker. Employers are not trained to recognize stolen documents so if it looks real then it will be accepted.

    What E-verify does is it catches illegal aliens who have false documents with social security numbers that are either fake or belong to somebody else from gaining employment because the E-verify system would catch documents that the name or date of birth or social security number don't match.

    So how does an illegal alien get around this E-verify system. It simple. They now purchase fake ID's and social security cards that used valid Names, dates of births, and correct matching social security numbers.

    What E-verify has done is created an even stronger market demand by criminal elements for stolen identities. There are many ways criminal organizations who traffic in false documents can get that info. We have all heard of Internet hackers, stolen data from various private and government organizations, ect.

    A Doctor office by mine was recently burgalized and what was the only thing the thieves stole? They stole all the computers that had the private information of their patients such as name, date of births, social security numbers, ect.

    Many businesses have very lax security protocols on their computers that even a novice computer hacker can break relatively easy.

    So, although E-verify has clamped down in one area they have exposed themselves and citizens to an even higher demand for stolen identities as illegal aliens and the criminal enterprises that support them have learned quickly how to outsmart the E-verify system.

    This means the illegal alien has your stolen identity and for all intent and purposes they are you in essence they can now use this info to make purchases via credit that you will be left to pay and your credit can be damaged.

    Then when you go to pay your federal taxes on your job the IRS is going to say according to our records from W-2's we recieved on your name and social security number you owe us for more income then you reported on your taxes. That can take months or years to clear up.

    This is scary that this can occur so easily and that fake ID's with your real info can be purchased easily by illegal aliens for less then $300 on the street.

    How do you protect yourself from that? Well, taking preventative measures such as using a cross shredder to shred all your documents that have your name, or date of birth, or social security number before throwing it in the garbage. Be careful about websites you visit that ask for this personal information.

    The answer in my opinion goes back to what always has been the most effective means of dealing with illegal workers/aliens and that is to enforce current federal laws and arrest all illegal aliens found to be anywhere in the US. Arizona new law adds reinforcement to the DHS by adding thousands more law enforment officers to the task of identifying and turning over to ICE for deportation suspected illegal aliens that police come across daily in the normal course of their duties. All at no additional cost to the Federal Government for the police officers help. This takes away their ability to say our lack of enforcement is because of limited resources.

    Arizona new law removes sanctuary city status from many cities such as Phoenix by prohibiting cities from having these types of policies and allowing for legal challenges by citizens.

    Bank robbery is a federal offense yet local police officers are typically the first responders to these calls and are able to lawfully arrest or detain a suspect of the robbery and turn them over to federal agents for prosecution. This happens all the time.

    The social security administration turns over a list each year to the Department of Homeland Security suspicious W-2 accounts they come across each year when they are processing each person work wage credits. When they are not able to match these W-2 records to valid master files this indicates very strongly to SSA that these are illegal workers/aliens. This list has each employer federal tax ID number so they are able to know exactly who is employing illegal workers and even how many.

    DHS should be focusing more attention to this list and focus more ICE agents to go to these employers and check these records and interview the employee whose W-2 and W-4 do not match and do not show legal work authorization.

    In my opinion W-2 info should be submiited quarterly instead of annually by employers so a whole year doesn't go by before SSA catches the W-2 as an illegal worker/alien. W-2 are submitted annually and are required to be received by SSA by March of each year for the previous years employee earnings. By the time DHS gets this annual report the info is around 14 months old. That is unacceptable.

    A two prong effort has to be done to make a significant dent in the amount of illegal aliens in the US and one prong has to be at the border and the other prong has to be on a national and local level such as what I described above and what Arizona is seeking to do. Otherwise, we will continue to see these numbers grow substantially and our fiscal resources used up and legal US Citizens quality of life decline to levels that we do not want to see.

    Another frustration is that in some professions the status is uncovered but either nothing can be done about it or the non-paid commission employee that aids in the discovery receives no remuneration. Who can afford to work for free?

    Welcome to Alipac, Arizonaman2008. Thank you for being a business owner that uses E Verify.

    We need the IRS and Social Security Administration to share information. We also need to be able to see if someone else is using our information or social security number for employment. Just as we can check our credit card statement to see if someone has used our credit card, we should be able to check our social security number anytime, to see if fraud or theft has taken place.

    If all businesses used E Verify, then there would be a greater result for squeezing out illegal aliens from the workforce. Americans should regularly check their own social security numbers, their credit, and the numbers of their children. An acquaintance of mine recently checked the numbers of her deceased parents.

    Thank you for pointing out the benefits and the pitfalls. Open borders groups and many businesses fight against E Verify because they know that it makes a dent in the problem of hiring illegal aliens. If our borders were secure, if enforcement of our immigration laws took place, if records of every illegal alien that crosses the border were kept, with photo ID and fingerprints, if positive actions were taken in many different areas, the problems would be less, the rewards would be greater.

    Isn't there another program, "Image" to check for validity of documents?
