NJ immigrant advocates to hold detention protest

NEWARK, N.J. (AP) — Advocates opposed to mandatory detention for immigrants plan to protest today to mark 15 years since a law took effect expanding its use.

A 1996 federal law requires immigrants slated for deportation or facing other legal issues to be held in detention while awaiting court proceedings.

A coalition of groups calling itself New Jersey Advocates for Immigrant Detainees plans to gather in Newark to call for a cancellation of a recently approved contract expanding the number of immigrant detainees held in Essex County.

The group says the federal immigration detention system is inhumane and disruptive to families.

Immigration officials have said the Essex facility will meet new, stringent guidelines.

A contract to run the expanded facility was canceled after some questioned why a politically connected company was the sole bidder.

    =============================

This 'coalition' is made up of who, from what religious denominations, political action committees, or lawyers sucking more blood out of these illegal aliens?

Enforce the law. Take away tax exemptions for churches and political action committees (LaRaza, SPLC, ACLU) enabling and sponsoring illegal aliens.

WHY is it that our Federal Government is NOT enforcing the very laws passed by voters, the Congress, and the Senate that protect Americans from invasion?

Why is it that organized religion is EXEMPT?

Why is it that public education is EXEMPT?

Are federal government agencies failing to enforce immigration laws and protect Americans EXEMPT?

One thing is for certain, and that is that Americans are NOT EXEMPT from the social, economic, and criminal upheaval this invasion is wreaking on each and every corner of this nation.

The obvious REALLY IS the obvious!

    U.S. Immigration Law

The U.S. immigration laws require deportation of an illegal alien if the alien:

    1. has been convicted of an aggravated felony
    2. has not resided in the United States for a contiguous period of seven years
    3. was not a lawful permanent resident for a contiguous period of five years
    4. would not have been admissible to the United States on security grounds

This applies to the majority of illegal aliens found in gangs. In order to prove evidence of residence lawfully, they would need to show a visa or other federal document allowing their entry into the United States or an approved application for permanent residence in the United States. Few if any illegal aliens have such documents and only a handful of gang members.

Section 274 of the Immigration and Nationality Act, USC 1324 states:

A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:

    * assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or

    * encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or

    * knowingly assists illegal aliens due to personal convictions.

City Sanctuary regulations circumvent the law by adopting a don't ask, don't tell policy. A police officer who follows the city regulation to not question a person who he or she suspects is an illegal alien due to probable cause (as in was witness to a previous arrest and subsequent disclosure of illegal alien status or deportation) has placed the officer in violation of Federal Law, and thus that city regulation conflicts with U.S. Immigration law.

It is the responsibility of the U.S. Attorney General, when notified of an entity acting in contravention of U.S. law, to investigate and if necessary bring such organizations before a federal grand jury for possible indictment.

Failure of the U.S. Attorney General to do so, is in of itself, a felony.

Newark, NJ [April 29, 2010] – New Jersey Advocates for Immigrant Detainees, a coalition of community-based groups that support immigration and detention reform will deliver a comprehensive report,

“Locked Up But Not Forgotten – Opening Access to Family and Community in the Immigration Detention System

to Immigration and Customs Enforcement’s (ICE) Newark Field Office, Thursday, April 29 at 1pm. The report will also be provided to Assistant Secretary Morton to remind him of his promise to deliver detention reform. The report demonstrates how ICE has failed to meet its own detention standards through an examination of restrictions on family and community access at four New Jersey detention centers (the county jails in Essex, Monmouth and Hudson and the Elizabeth Detention Facility). It makes specific recommendations to improve family and community access for those in immigration detention. It also calls on Congress to restore due process and provide immigrant detainees with legal counsel. The problems outlined in the report highlight the need to end mandatory detention.

[b]“The more sunlight is shone on the conditions behind the walls of our detention centers, the more we can ensure that all of our fellow human beings are treated humanely. I commend these groups for taking the initiative to investigate and compile this important report.â€
