Neighbor arrested in May 16 arson in Morristown
MORRISTOWN -- A 19-year-old illegal immigrant from Honduras, allegedly angry after being kept out of a party, has been arrested and charged with aggravated arson in the Sussex Avenue fire that injured a firefighter last week.
Fernando Inestroza, who had been living to next door to the house that caught fire, allegedly was barred from entering an upstairs apartment where a party had been going on much of the night before using a burning piece of paper to start the fire, according to an arrest affidavit. The fire began in a plastic garbage can on a second-floor wooden deck at the rear of the building, according to the affidavit.
Inestroza was arrested on Tuesday in East Orange, where he had been staying since the fire, Morris County Prosecutor spokesman Capt. Jeff Paul said in a prepared statement issued on Wednesday.
Meanwhile, town officials have issued a total of 35 summonses to the landlords and one tenant of the house at 50 Sussex Avenue for allegedly violating overcrowding and other ordinances. Town officials had said last week that they found as many as a dozen mattresses in the upstairs apartment where the party took place, and where the fire began.
Zofar Svirski, one of the landlords, told the Daily Record last week that he was unaware any of his apartments were overcrowded, saying he required his tenants to sign a no-stacking agreement.
Inestroza is an undocumented immigrant from Honduras and had a detainer placed on him by the U.S. Immigration and Customs Enforcement Services, according to Morris County jail records. That means even he was able to make bail, which had been set at $500,000, he would be handed over to ICE.
Det. Christopher Kimker of the Morris County Prosecutor’s Office said in an arrest affidavit signed on Tuesday that the suspect confessed he had been drinking, and was upset after being denied entrance to a party in an upstairs apartment. He allegedly ignited a piece of paper found in a garbage can with a disposable butane lighter. Residents of the apartment smelled smoke 10 minutes later, according to the affidavit.
