Outrage erupts over report DOJ will target affirmative action

Outrage erupts over report DOJ will target affirmative action

    08/02/17 12:05 PM EDT

Civil rights advocates are slamming the Trump administration over its reported plans to investigate affirmative action admission policies at universities that discriminate against white students.

The New York Times reported Tuesday night that it had obtained an internal announcement to the Department of Justice Civil Rights Division looking for lawyers interested in working for a new project on “investigations and possible litigation related to intentional race-based discrimination in college and university admissions.”

The memo could herald a new effort within DOJ to go after affirmative action policies, according to the Times.

The DOJ disputed the Times report.

“Press reports regarding the personnel posting in the Civil Rights Division have been inaccurate,”spokeswoman Sarah Isgur Flores said in a Wednesday evening statement.

The DOJ is not launching a new initiative, Flores said. Rather, “The posting sought volunteers to investigate one administrative complaint filed by a coalition of 64 Asian-American associations in May 2015 that the prior Administration left unresolved. The complaint alleges racial discrimination against Asian Americans in a university’s admissions policy and practices."

"This Department of Justice has not received or issued any directive, memorandum, initiative, or policy related to university admissions in general. The Department of Justice is committed to protecting all Americans from all forms of illegal race-based discrimination.”

But Lambda Legal, an LGBT civil rights group responding to the New York Times report, said there was a “new low” for the Department of Justice and Attorney General Jeff Sessions. “It’s repulsive and perverse that affirmative action has now found its main adversary in the very arm of DOJ meant to advance progress on civil rights: the Civil Rights Division,” Lambda

Legal’s CEO Rachel Tiven said in a statement.

“We are appalled but not surprised by this continued assault on civil rights, and Jeff Sessions' determination to sully the reputation of the Department of Justice."

In an email to The Hill sent before Flores' statement, a DOJ official said the document was a "personnel posting."

“It does not reflect a new policy or program or any changes to longstanding DOJ policy,” the official said. “Whenever there's a credible allegation of discrimination on the basis of race, the department will look into it.”

The New York Times noted in its story that the document does not explicitly identify whom the Justice Department considers at risk of discrimination, but said the phrasing of the letter “cuts to the heart of programs designed to bring more minority students to university campuses.”

The news sparked outrage among civil rights groups already frustrated with Sessions, who has cracked down on immigration, ordered federal prosecutors to charge criminal suspects with the most serious crimes possible, re-established a controversial civil asset forfeiture program and rescinded guidance that allowed transgender students to use the bathroom that correspond with their gender identity — all within his first six months in office.

“Instead of bolstering and strengthening education and opportunity, this administration has used education as a vehicle to advance discrimination — first by targeting transgender students through the Dept. of Education, and now by targeting People of Color through the Dept. of Justice,” Tiven said.

“Meanwhile, real problems — police brutality, government corruption, and rising hate violence — are being ignored, as the DOJ chases figments and myths.”

On Twitter, the Congressional Black Caucus accused Sessions of wanting to “put more people of color in jail and take away their educational opportunities."

Justice Dept. to Take On Affirmative Action in College Admissions

The Trump administration is preparing to redirect resources of the civil rights division toward investigating and
suing universities deemed to have discriminated against whites, a document says.
    nytimes.com

The Lawyers’ Committee for Civil Rights Under Law, meanwhile, condemned DOJ as planning to attack the use of race-conscious admission policies.

“We will not stand by idly as the administration continues to hijack and obstruct the civil rights division’s core mission to address discrimination faced by racial minority groups in our country,” Kristen Clarke, the group’s president and executive director, said in a statement.

The American Civil Liberties Union's Racial Justice Program said it plans to closely monitor DOJ's actions.

“The idea that the Justice Department would sue colleges over their inclusive policies is an affront to fairness and sends a dangerous signal that it will no longer work to protect the most vulnerable," Dennis Parker, the program's director, said in a statement.

"It would mark an alarming shift in direction that threatens the hard-fought progress made by civil rights advocates and the department itself over the past decades. The Supreme Court has made it clear that it is constitutional to appropriately consider race as one of many factors in college admissions. "

Last summer, the Supreme Court upheld an affirmative action policies at the University of Texas at Austin.

The court said the university could consider race when making its admissions decisions, but cautioned the school “to scrutinize the fairness of its admissions program, to assess whether changing demographics have undermined the need for race-conscious policy, and to identify the effects, both positive and negative, of the affirmative-action measures it deems necessary.”

    Affirmative Action is unconstitutional.

How have we arrived at a point we say we believe in equality, then have laws that makes us 'unequal'?

From animal Farm, 'Some animals are more equal than others."

How have we allowed a group of people (and multi-national corporations) to turn our country and our laws upside down?

We know it is wrong to deny rights to anyone - suddenly though, it's OK to deny rights to 'some'.

This is a time in history when the fight has come to us. The enemy of our country is already inside the gates. We need to all stand up, get organized, and begin a strong push back and stop this insanity.

We need to refuse to participate in our demise.

Actually, the illegals, the refugees, the tech workers, are not the enemy - they are the symptom or the result. While we need to 'treat' the symptoms, we need to get at the root of the problem.

The enemy are those who seek to destroy this country and confiscate workers earnings to do it. Those who spout the rhetoric, indoctrinate our children in schools, and young people in college. Those politicians, lawyers, judges, so called 'not-profits' who are working against this country. Those law enforcement people who refuse to enforce the law.

We need to write our congresscritters, our state lawmakers, our local governments. We need to know who they are, what they stand for and hold them to a standard that upholds the country's laws.

Why would we vote for someone who is who is importing workers in place of hiring our own people. If President Trump does have foreign workers,he needs to begin replacing them now and work rapidly to achieve that - no if's, and's, or but's.

Just because something is 'legal', doesn't mean it is right.

Why should we purchase the products/services of corporations that` sponsor these propaganda organs called the news media?

I am not now an active member of any church, so I don't want to offend with this statement. If you are a member of a church, check out what your church is doing. Are they involved in doing things that are detrimental to this country.
    Unfortuntely many are.

Easing suffering and helping the needy is one thing, but what is happening with some churches is not doing that at all.

We need to do these things, or as many as we can, without loosing our humanity, honor, and dignity.

Affirmative Action was right when it was passed to ensure against racism against black Americans. But unfortunately, the very people we were trying to protect black Americans from, used Affirmative Action as a vehicle to create unfair advantages for other people. Affirmative Action has helped many black Americans, but it has helped others to a greater degree. Because so many people are now covered by Affirmative Action, there are now lines that have been crossed into actual discrimination against those who weren't protected.

Affirmative Action in some form is still needed for black Americans, but not for other groups. It needs to be confined to the group it was designed to assist and executed in a fair and non-discriminatory manner. What caused it to go off the rails? Well, our number one issue here at ALIPAC, massive excess immigration most of which is oddly protected by Affirmative Action at the expense of black Americans and now many Americans including white Americans.

Hmm, so, according to civil right advocates, a person's skin color is the actual decider on whether a person has been discriminated against? Silly me, I always assumed "civil rights" applied to everyone, regardless of the color of their skin!

    Just my opinion ---

I am going to have to disagree - Affirmative Action was never right.

It wasn't designed to make sure blacks were not discriminated against. It was designed to force employers to hire them. There is a big difference there.

Personally, I think a person should have the right, and under the Constitution I think they do, to hire as they wish.

To deny a person a job based solely on their race, gender, age, looks, etc., is short sighted and is not Christian, but I do believe it is their right.

You can think it was put in place to help the blacks, and those doing it actually felt it was a good thing to do - I don't.
I think, like most all of these kinds of 'social justice' laws, it was designed to be used as a cudgel against the people, and to get more and more control over business and people.

It always works out that way.

Could be nntrixie, because that's how it worked out in the end, that's for sure. I think some behind it were well-intentioned and I hope and still believe it made some difference for black Americans, but to me, it didn't make enough difference for them for the other problems it caused.

It did make a difference for some black people - a positive difference.

I'm just naive enough to think these people would probably have made it anyway - maybe not so quickly - but it would have happened and been on a firmer and a legal footing.

Now we have people in jobs they can't do, going to college when they can't hack it and businesses being threatened.

I'm wondering why some of these organizations that are so concerned about the blacks, and others, don't sue over the employment of illegals over Americans - especially black Americans who have been the most impacted by the invasion?

The great "irony" of illegal immigration and the DemoQuack Party that claims they support civil rights and equal rights for black Americans. Clearly, they do not support black Americans, they exploit them.

    So true.

It seems all they have to offer black these days is money for rioting.
