    Obama Breaks the Law Once Again, Effectively Suspends Individual Mandate Without News Media Reporting It

    In case you haven’t noticed (which, if you’re like most of us, you haven’t), there has been yet another change to the Affordable Care Act, and this time it’s a big one. Last week, without any formal announcement or attention from the media, the Obama administration quietly gave millions of Americans a way to avoid the individual mandate without paying a penalty.
    Back in 2013, the government decided to grant a one-year insurance exemption to individuals under 30 who were dealing with hardships such as eviction or bankruptcy. Later, they extended it by two more years. Now, they’ve expanded the exemption to cover anyone who wants it, basically nullifying the individual mandate without even going through Congress. They achieved this by, essentially, extending the term “hardship” to apply to anyone who feels like they are going through a tough time:
    But amid the post-rollout political backlash, last week the agency created a new category: Now all you need to do is fill out a form attesting that your plan was cancelled and that you “believe that the plan options available in the [ObamaCare] Marketplace in your area are more expensive than your cancelled health insurance policy” or “youconsider other available policies unaffordable.”

    This lax standard—no formula or hard test beyond a person’s belief—at least ostensibly requires proof such as an insurer termination notice. But people can also qualify for hardships for the unspecified nonreason that “you experienced another hardship in obtaining health insurance,” which only requires “documentation if possible.” And yet another waiver is available to those who say they are merely unable to afford coverage, regardless of their prior insurance. In a word, these shifting legal benchmarks offer an exemption to everyone who conceivably wants one.
    This is the third major change to Obamacare in the past thirty days:
    On February 10th, the White House delayed the employer mandate for small businesses until 2016, and then, 10 days ago, it extended for two more years the rule allowing insurers to un-cancel plans for consumers who want their old, cheaper coverage back. Little did we know until now that, on the same day, they also all but suspended the individual mandate until 2016.
    This is a blatant example of the President’s commitment to unilaterally do away with the parts of Obamacare that make Democrats look bad. Not only is it highly illegal, but it is also hypocritical. Since the law’s creation, the Obama administration has insisted that the individual mandate was the cornerstone of the ACA and was essential to the overhaul’s success, even arguing that point to the highest level of the Supreme Court. And Obama repeatedly states that he will veto any efforts to repeal or delay it. Yet, now he is trying to quietly undo the “indispensable” individual mandate, right under our noses.
    So why is the once-championed foundation of Obamacare being snuck into oblivion? One word, which I’m sure you’ve guessed by now: Votes. By allowing basically anybody to avoid paying for health insurance without penalty through 2016, Dems up for reelection this fall will avoid a wave of backlash that was at one point inevitable.
    But illegally changing laws for the sake of politics is not okay: The Affordable Care Act was a result of a divisive President and a careless Congress. It was rushed into law because lawmakers didn’t want to have to work bipartisanly to create thoroughly discussed legislation that would actually make the healthcare system better. Now that it has made the system worse, the people who created it in the first place think it is perfectly fine to change whenever they fancy. They are trying to undo the very law they ran on, without even telling us and without following the legal path to do so.
    I don’t know about you, but I expect my leaders to do their research before they pass a law and, if there is a need to “undo” or correct it later, I expect them to own up to it, even if it hurts their party’s chances of getting elected in the future. This is not what we are seeing with Obama’s endless executive order changes to the Affordable Care Act. It was already bad, but this subtle killing of the individual mandate is (or should be) the final straw.
