President Trump has no immediate plans to use his executive powers to undo the Obama administration’s order that protects some young illegal immigrants known as “dreamers,” White House Chief of Staff Reince Priebus made clear Sunday, in previewing the new administration’s first full week.

“I think we’re going to work with the House and Senate leadership, as well as to get a long-term solution on that issue,” Priebus told “Fox News Sunday.” “I'm not going to make any commitments to you, but … I'm obviously foreshadowed there a little bit.”

Immigration advocates had warned since essentially the start of the 2016 presidential race that Trump, if elected, would crack down on illegal immigration.

To be sure, Trump won the race on a platform that included vows to build a wall along the U.S.-Mexico border to keep out illegal immigrants.

But many already in the country and others have expressed greater concerns about Trump undoing President Obama's 2012 Deferred Action for Childhood Arrivals executive action that defers deportation for an estimated 700,000 illegal immigrants brought to the U.S. illegally by their parents -- and known as "dreamers."

Those concerns recently surfaced during retired Marine Corps Gen. John Kelly’s confirmation hearing on become Homeland Security secretary when California Sen. Kamal Harris pressed him on whether Trump would roll back DACA.

“I don’t know what the incoming administration is doing with that,” Kelly responded. “But I promise you, I will be involved in the process.”

Priebus nevertheless said Sunday that Trump could as earlier as this week sign executive orders related to trade, national security and other aspects of U.S. immigration policy.

He also said that Defense Secretary James Mattis would “obviously” be a part of the conversations about national security, considering the Senate on Friday confirmed him and Kelly to their respective posts.

Priebus said that Trump plans to travel to Philadelphia on Thursday to speak with congressional Republican leaders at their annual legislative retreat and that tax reforms remain a top, early priority.

We have tax reform that we finally can get through,” he said. “And we’re working with Paul Ryan and leadership and the team that President Trump has put together. It's given us a formula to finally get big things done in this country.”

If true, this is not putting " America First." This is putting foreign governments and their foreign citizens ahead of the American people in jobs, security, education, etc. It is allowing for more criminal activity within this population. It is not the fault of the American people that our lawmakers have refused to enforce laws and that they betrayed us for decades.

This is not acceptable to craft any type of amnesty for DACA receipients now or those to be included. Who knows how many millions it would cover with fraud, etc. Is it 5 million, 10 million and who believes Congress under Speaker Paul Ryan will settle for anything short of an amnesty that allows millions more to be included or to fake their way through. How would we ever process them?

Trump needs to rescind it on Monday, day 3 of his Administration. I believe this "DACA" represents at least 5,000,000 illegal aliens.

We're talking about two different animals here. The 4-5 million they're talking about are the DACA illegal's parents. The one Trump is talking about letting expire is the DACA program. Trump is giving the Congress time to produce a legislative fix (amnesty) for the DACA illegals.

The way obama worded daca, it INCLUDES all young sneakers = no parents, no baby age involved - therein lies the great deceit that is being passed off as helpless babies - no they sneakered across and there are @5 million of them. That was the plan to deceive Americans and mish mash them with those 20+ yrs old brought here as infants. Does the one that expires in 6 months cover the 700,000 to 900,000 or the 4 million to 5 million? The US Supreme Court ruled against one or both and I'm not clear at this point what it covered. The court actually tied and allowed the lower court ruling to prevail and I thought it ruled both of them illegal and unconstitutional, which means DACA should be rescinded immediately, because it's unconstitutional.

There is apparently some confusion about this, so I'm trying to clear it up if we can.

If DACA is unconstitutional, Trump said it would be rescinded Day One. If it is constitiutional for some unknown reason, then he will probably just let it expire in 6 months and veto anything Congress tries to do.

And yes, Priebus "Superstar" needs to sit down and wait for orders, not be blabbing about programs his pal Ryan wants but instead speak directly and concisely about what his boss wants or be quiet, probably the latter is preferable. Trump wants them out. He's been as clear as one could be on that, while still acknowledging it's a tough situation for some of these people. But they still gotta go, tough as it may seem to them, they gotta go, they don't belong here, they aren't supposed to be here, we've got our own people to worry with and take care of.

How would you give DACA to one but not to a brother or sister or allow parents to stay with you. Splitting up families while deporting some and not all.

It is a Pandora's box and there is no way to make it anything else. You will split families up if DACA individuals can stay and not relatives who could receive DACA or their families.

What guarantees that those who would receive amnesty now could not under another President get to bring relatives back.

DACA is unconstitutional.

Currently, there are around 800,000 illegal aliens who have been approved, who have received DACA. They applied for it and received it. That is the number that Senators Durbin and Graham and others are using right now. The numbers of illegal aliens who would be eligible for DACA is in the millions but they have not applied. There are those who have been afraid to apply but the door was open for them. They may have been reluctant to supply information, too.

When the lawsuit happened it was supposed to stop for now. I am unsure about the renewals. What impact the lawsuit has on those. I think renewals for those approved can go forward.


What has been happening too is the ability to leave the country with permission, approval (Advanced Parole) and to re-enter and apply for permanent residency, a green card, legally. This is for some but I am not certain of the numbers. I read about it on a "dreamer" website as many were doing this. You must meet one of three criteria.

Exactly, GeorgiaPeach. DACA people have to go with everyone else. They aren't kids any more. They're grown ups, and it's time they acted like it. Yes, I think that is correct, GeorgiaPeach. The wonderful Governors of the 20 plus states stopped the expansion of DACA and initiation of DAPA, but the judge ruled those who already had DACA permits could stay until the card they had expired, but they would not be renewed and no more would be handed out. I believe that is right.

SOOOOO, Senators are actually LYING to the American People, because if DACA stands with legislation, then of course it will be the 5 million x 2, you know they're lying about the 5 million, it's much more than that, because at this point, they're all inter-related or "connected" to someone in the US. They're all here tied by a common bond called illegally invading the US to run drugs and haul our money out and operate other criminal enterprises, including illegal labor networks. You can tell by the language they used "connected to", that all these Senators, Representatives and other state and local officials behind this disaster are on the take with the drug cartels behind illegal immigration. It's just so obvious "connected to", yeah, their DRUG LORD.

They all gotta go! There is no situation that I can think of on any basis that would justify a legal status for anyone in this country illegally. Sure breaking the law is a tough situation. DAPA, Expanded DACA, and the Court Injunction

The U.S. Citizenship and Immigration Service (USCIS) had planned to begin accepting applications for the expanded Deferred Action for Childhood Arrivals (DACA) program on February 18, 2015. Unfortunately, DHS has temporarily delayed the launch of expanded DACA due to a federal court decision temporarily halting its implementation. The court’s injunction also temporarily blocked implementation of the new Deferred Action for Parents of Americans (DAPA) program that was slated to begin this May. While the federal government has announced it will challenge the court’s ruling before the Fifth Circuit Court of Appeals, we do not yet know what form this challenge will take or how long we will have to wait for a decision. The Department of Justice, legal scholars, and immigration experts believe that the federal government had the legal authority to expand DACA and create DAPA through executive action and anticipate that the courts will ultimately uphold the legality of both programs. In the meantime, what does this mean for your clients who were gearing up to apply for expanded DACA or DAPA and what can you tell them?





What is the lawsuit about?


The lawsuit, State of Texas, et al v. United States, was filed in December 2014 by 26 states and challenged two aspects of the immigration initiatives that President Obama announced on November 20, 2014. Specifically, the states alleged that the expanded DACA and DAPA programs were created in violation of the law and will cause economic injury to the states that must finance the education, protection, and issuance of driver’s licenses to future recipients of deferred action under these programs.





What was the federal court’s decision?


On February 16, 2014, the federal district court in Brownsville, Texas issued a preliminary injunction temporarily blocking the expansion of DACA and the implementation of DAPA. The ruling did not find that these programs may be unconstitutional. Rather, the judge’s narrow holding found that the federal government might have violated procedural requirements under the Administrative Procedure Act by not using formal rulemaking procedures in creating these initiatives.





How did the Department of Homeland Security respond to the injunction?


On February 17, 2015, Department of Homeland Security (DHS) Secretary Jeh Johnson issued a statement [1] expressing his disagreement with the temporary injunction and confirming the Department of Justice’s intention to challenge the decision. In the meantime, in order to comply with the injunction, DHS announced that it would not begin accepting applications for expanded DACA on February 18, as originally planned. DHS also indicated that it would temporarily suspend plans to accept DAPA requests until a court confirms that these programs are within the legal authority of the federal government.





Does the injunction impact all executive actions on immigration announced by the President on November 20, 2014?


No, the injunction only impacts DAPA and expanded DACA. It does not block any other changes to immigration policies announced by the President last November and laid out through various DHS memoranda [2]. For example, plans to expand the use of provisional waivers of unlawful presence and the existing “parole in place” program for family members of the U.S. Armed Forces, issue guidance clarifying advance parole, and replace Secure Communities with the Prioritized Enforcement Program are unaffected by the court case. Likewise, the lawsuit does not impact the new immigration enforcement priorities that went into effect on January 5, 2015.





How soon can we expect a court to reverse the injunction and permit DHS to launch expanded DACA and resume preparations for DAPA?


This will depend on whether the federal government files an emergency motion with the Fifth Circuit to stay the temporary injunction or decides to file an appeal instead. If the Department of Justice (DOJ) files an emergency motion to stay, a decision could be issued within a few weeks. That would allow the expanded DACA and DAPA programs to move ahead while the district court decides the case on its merits. If DOJ decides to await a district court decision on the merits and then appeal the decision to the Fifth Circuit, it could take several months for a decision.





How does the injunction impact clients who want to apply for DACA?


The temporary injunction does not affect the original DACA program that was created in 2012. Anyone who meets the program’s criteria established in 2012 may continue to apply – both first-time applicants as well as DACA recipients who seek to renew their deferred action and employment authorization. However, clients who were hoping to apply for DACA under the expanded criteria announced on November 20, 2014 are not yet eligible to apply. However, USCIS has stated its intention to begin accepting applications for expanded DACA as soon as the courts issue a favorable decision allowing for the program’s implementation. How should I advise clients who already have DACA and want to renew?


Clients granted DACA under the program’s 2012 criteria may continue to renew their deferred action and employment authorization using Form I-821D [5]. Beginning November 20, 2014, USCIS began granting DACA and work permits to initial and renewal applicants in three-year increments. DACA recipients already granted three-year work permits may continue to use them. However, following the injunction, USCIS will revert to issuing two-year grants of deferred action and work authorization until a court overturns the decision.





What should I advise clients who want to apply for expanded DACA?


Clients who qualify for expanded DACAshould continue to gather documents necessary to show they meet the DACA criteria and save money for the $465 application fee. As soon as a court decision permits USCIS to launch the expanded DACA program, clients may apply. Remember that USCIS will be releasing a new Form I-821D that reflects the November 20, 2014 changes to DACA eligibility. While there will likely be a grace period during which the old I-821D will be accepted, you may want to hold off on completing the application form until USCIS releases the new one. You may have heard that USCIS published revised Frequently Asked Questions and updated I-821D instructions on February 11, 2015 in anticipation of its plans to begin accepting applications for expanded DACA on February 18. Following issuance of the injunction this week, these two sets of guidance were removed from the USCIS website. For now, the previous FAQs [6] and instructions [7] remain in effect.


It is also important to understand that the injunction did not affect the November 20, 2014 DHS Memorandum entitled Policies for the Apprehension, Detention and Removal of Undocumented Immigrants that reflects which groups of individuals U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), and USCIS considers to be priorities for immigration enforcement. The new Enforcement Priorities Memo went into effect on January 5, 2015 and remains in full force. If any DHS official seeks to detain, place into removal proceedings, deport, or take any other enforcement action against a prospective DACA client who does not fall into one of these priorities, you should request an appropriate exercise of prosecutorial discretion in your client’s favor. ICE and CBP should continue to identify individuals who might qualify for expanded DACA and refrain from taking enforcement actions against them. Also, remember that clients may still request deferred action, more generally, under the process that has existed before DACA was created by submitting a request to the local USCIS office.





What should I advise clients who want to apply for DAPA?


Clients who may be eligible for DAPA should continue to gather documents necessary to show they meet the DAPA criteria and save money for the $465 application fee. The federal government anticipates that the court will ultimately uphold the legality of the DAPA program and DHS will continue to prepare for a timely implementation of DAPA as soon as that happens. Depending on how long it takes for the injunction to be overturned by the district court or a higher court, DAPA may or may not be able to launch in May of 2015 as originally planned. However, clients should be prepared to file their applications as soon as the time comes. As discussed above, individuals who appear to be eligible for DAPA remain non-priorities for immigration enforcement, and should not be detained, placed into removal proceedings, or deported by DHS. Make sure that your clients understand the new enforcement priorities and are prepared to request prosecutorial discretion from ICE or CBP if they are apprehended.

Young immigrants currently protected from deportation will be quickly removed from the country by President Donald Trump’s plan to boost deportations, even if the new president doesn’t target them directly, according to a former senior immigration official in the Obama administration.


Democratic leaders and advocates within the immigration community are bracing for Trump on Monday to eliminate several of Obama’s executive actions on immigration, including the deferred action program, known as DACA, that protects an estimated 750,000 immigrants brought here illegally as children.



Trump is not expected to immediately launch raids targeting the students, but fears among so-called Dreamers could grow as Trump executes plans to deport more than 2 million immigrants with any form of criminal records. In the process he’s inevitably going to sweep up many DACA students who will unlikely have the safeguards to protect themselves.

Leon Fresco, who headed the U.S. Department of Justice’s Office of Immigration, said even if Trump doesn’t terminate the program or promises not to directly pursue the young immigrants – as he has implied – more than a thousand will likely be targeted in deportation raids, including those with orders of removal and minor criminal records.




“DACA kids will in the very near future, in a matter of weeks, be apprehended as part of these sweeps of unexecuted orders of removal,” said Fresco, a former deputy assistant attorney general for the department’s civil division.


Because the Deferred Action for Childhood Arrivals program is a form of prosecutorial discretion, it’s not a real status and can be revoked at any time.


The U.S. Department of Homeland Security told DACA recipients that their personal information would not be used for enforcement purposes, but that doesn’t mean that they won’t be swept up in other enforcement actions, Fresco warned.

U.S. Immigration and Customs Enforcement already has a list of thousands of people and families with existing orders of removal that have not been executed. Many of those are DACA recipients who missed a court date and were ordered removed in absentia. Others may have parents who applied for asylum and lost their cases.


The Obama administration did not keep an exact figure of DACA recipients who had previous orders of removal, Fresco said, but it’s understood that more than 1,000 DACA recipients fall in the category.


Trump campaigned hard against illegal immigration, promising to build a wall, boost deportations and eliminate the youth program.


He has since said he wants to “work something out” for the so-called Dreamers, but is still expected to cancel the program to send a message to supporters who feel Obama wrongly granted amnesty to hundreds of thousands of immigrants here illegally.


The young immigrants are already protesting at many colleges and demanding legal aid in case Trump takes action. Fresco, who now represents universities, sees a potential nightmare scenario for a school if one or several of its students are swept up in a raid. It would immediately create ripples of fear throughout the foreign student body who won’t know why one of their classmates was apprehended.

THANK YOU GEOGIAPEACH!! This makes it absolutely clear in my mind that DACA and DAPA in all forms and phases need to be rescinded immediately and all applications in process rejected, all applications not in process returned, and all websites pertaining to DACA, DAPA, DREAMERS, etc. shut down.

Note that the DOJ has a role here according to the your website you posted from. DOJ needs to be clear when Sessions is sworn in that it will not support any executive order from any prior President that allows illegal aliens to remain in the US in violation of US immigration statutes, with work permits or any other type of permit.

Our dear President Trump, you were right, as always, when you said they've all gotta go and you could do it within 18 months. That was the right position then and remains so to this day. As President and as an enforcer, you do not need to explain to the CORRUPT MEDIA how or when you are carrying through on this. I believe quickly and quietly is the best way to manage the deportations. But it must be done, no exceptions, no mercy. We have millions and millions of Americans with criminal records, broken families, lost jobs and who are in poverty and whose families are in poverty because they broke a law, mostly non-violent drug offenses that caused less harm to our fellow citizens than the brutal ravages of our citizens lives, schools, neighborhoods, hospitals and work places caused by illegal aliens, not to mention the soaring budget cost and debt limits paying for illegal aliens in this country.

Trump needs to make copies of his Inauguration Speech so each of them have a full written transcript. That should be the first thing he does after shaking hands and greetings, is hand this out to them. Give them a few minutes to read it. While they all heard it, I'm sure they were in their "stunned" mode and their brains stopped working. This will refresh them.

Then he can say, and what are your questions again? Hopefully, it will be short meeting and they'll get up, go back to their offices, wait for orders, and when they come, do their jobs.

I wrote in earlier post that DACA was unconstitutional because it exceeded Obama's authority so we have been told. Obama said that at one time, too. His view seemed to change, though. Also, I read in the information above on DACA ruling that the judge did not rule DACA unconstitutional. I suppose it is how you see it. We have many people with differing opinions citing the Constitution or ignoring it.

Yes, I believe DACA cards that have already been issued are judicially considered legal, those that have not been are not protected. DAPA is unconstitutional, more DACA can be considered unconstitutional based on the lower court's ruling of the procedural violations.

So, I suppose in the technical sense, it's not such a terrible thing legally to let the existing DACA cards expire, and then not renew them. In the meantime, they need to shut down the whole DREAMer fraud scam, SHUT IT DOWN, and focus on the DREAMS of US Citizens, American Workers and American Families.

Trump also needs to make it clear he has his pen ready to VETO any nonsense legislation that hits his desk from Congress, like any bill that grants legal status to any illegal alien, just as he will VETO any bill that messes with Social Security or Medicare benefits. He needs to be very clear and firm on this. And for those who don't know, no this does not make him a liberal or a Democrat. Republicans supported Social Security and Medicare with tremendous support and in the votes in Congress supported with far higher % than Democrats when Social Security Administration was created. Same with the US Civil Rights Bill in 1964. Much higher % of support among Republicans in Congress than Democrats. Conversely, almost no Republican voted for the Federal Revenue Act of 1913, almost all Republicans in Congress voted against the bill that created the Federal Income Tax and simultaneously in the same bill lowered tariffs on imports that began the trek of Globalism, putting foreign interests above our own. That's why so many Republicans support the FairTax, because we know the evil of the income tax and free trade, like our Founders, and know the harm they have done to our country, economy and citizens.

Time for Republicans to get straight again and be Real Original Republicans. You will be amazed at the benefits, rewards and blessings of liberty that ensue, naturally in due course without conflict or confrontation.

Also, the US Senate led by Republicans needs to confirm Trump's nominees, all of them, immediately so these Departments and Agencies have their leaders and the hard work of solving all of our problems can be fixed. This falls on Republicans, so don't blow it. You're already looking bad to the people of our party, looking controversial, playing games, all talk, no action.

Advance Parole for DACA Recipients

Introduction


On June 15, 2012, the Secretary of the United States Department of Homeland Security (DHS) issued a memorandum allowing individuals who entered the United States before turning sixteen and who meet certain guidelines to pursue Deferred Action for Childhood Arrivals (DACA). One of the benefits of DACA is that the recipient may seek permission to travel abroad temporarily for humanitarian, educational, or employment purposes. A DACA recipient who seeks to temporarily leave and re-enter the United States must apply for advance parole.


Parole is “the authorization to allow an otherwise inadmissible person to physically proceed into the United States under certain safeguards and controls.” Section 212(d)(5) of the Immigration and Nationality Act (INA) provides DHS with the discretionary authority to parole an individual into the United States “for urgent humanitarian reasons” or “significant public benefit.” Note that parole is not an “admission” into the United States; an individual who has been paroled has not been “admitted.” Instead, the parolee is considered an “applicant for admission” and, as such, is subject to removal proceedings based upon grounds of inadmissibility, notwithstanding the grant of parole.


Advance parole, an administrative practice derived from the general parole authority in INA § 212(d)(5), gives an individual who is in the United States advance authorization to enter the United States after temporary travel abroad. U.S. Citizenship and Immigration Services (USCIS) has the authority to grant advance parole and issue a Form I-512L, an advance parole authorization document. This document allows a Customs and Border Protection (CBP) or other immigration inspector at a U.S. port-of-entry to parole an individual into the United States. Advance parole does not guarantee subsequent parole into the United States, however; the inspecting immigration official may, in his or her discretion, deny parole at the port-of-entry.


This practice advisory provides guidance on advance parole eligibility for DACA recipients; applying for advance parole; legal issues, including any potential risks to the client, to consider prior to traveling; and the post-travel impact on future immigration benefits. It is not designed to be a substitute for legal advice on an individual basis from an attorney or Board of Immigration Appeals (BIA or Board) accredited representative.


Advance Parole Eligibility for DACA Recipients


Prior to applying for advance parole, an individual must apply for and receive a DACA approval. Indeed, an individual is disqualified from DACA if he or she departs the United States at any time after August 15, 2012 unless he or she is first granted both DACA and advance parole. In order to receive advance parole, a DACA recipient generally must show that s/he is traveling abroad for humanitarian, employment, or educational purposes.


The USCIS Frequently Asked Questions (FAQs) on DACA provide examples of situations that fall under the categories of humanitarian, employment, and educational purposes. Humanitarian purposes relate to “travel for emergent, compelling, or sympathetic circumstances.” This category includes obtaining medical assistance, attending a funeral service for a family member, visiting a sick relative, or other urgent family-related purposes. Educational purposes include study abroad programs and academic research. Employment purposes include overseas assignments or client meetings, interviews, conferences, trainings in other countries, and travel needed to pursue a job with a foreign employer in the United States. The FAQs expressly provide that travel abroad for vacation is not a valid purpose for advance parole.


USCIS guidance states that “USCIS will determine whether [the requester’s] purpose for international travel is justifiable based on the circumstances describe[d] in [the] request.” This language appears to allow USCIS to decide DACA requests on a case-by-case basis and not to limit reasons for travel to the examples provided in the DACA FAQs. The USCIS DACA National Standard Operating Procedures Manual also provides that the humanitarian, educational, and employment categories “are to be construed broadly.” In addition, the instructions for the USCIS Application for Travel Document (Form I-131), used to apply for advance parole, state that the humanitarian, employment, and educational purposes “include, but are not limited to” the examples listed in the instructions. As such, advocates may make the case for advance parole when DACA recipients seek to travel for humanitarian, educational, or employment purposes that USCIS has not specifically listed.


Applying for Advance Parole


To apply for advance parole, a DACA recipient must submit Form I-131 to USCIS. The advance parole applicant must submit proof of DACA status – either a copy of the USCIS Notice of Action (Form I-797) showing a DACA approval or a copy of an approval order, notice or letter from U.S. Immigration and Customs Enforcement (ICE). The filing fee is $360. In Part 4 of Form I-131, the DACA recipient must explain the purpose of the trip and the countries the applicant plans to visit. In addition, the requester must submit evidence of the purpose of the trip, the intended date(s) of travel, and the duration of the trip(s).


DACA recipients must provide as much evidence as possible to explain the purpose of intended travel abroad. For a trip involving a humanitarian purpose, proper evidence includes but is not limited to the following:


A letter from a medical professional explaining the reason for the need to travel abroad to obtain medical treatment;
A letter from a hospital or treating medical professional explaining the relative’s ill condition; and/or
A death certificate for a deceased relative
For a trip involving an educational purpose, evidence includes but is not limited to the following:


A letter from an educational institution explaining the purpose of travel abroad; or
A document showing enrollment in a program or class and documents showing the applicant is required to travel for a program or class or will benefit from such travel.
For a trip involving an employment purpose, appropriate evidence includes but is not limited to the following:


A letter from an employer explaining the need to travel abroad; and/or
A document showing an employment need, such as a conference or training program, and showing the applicant’s participation.
A single Form I-131 may be used to request that the DACA recipient be allowed to leave and re-enter the United States multiple times. However, the recipient must show that each trip is intended to serve a humanitarian, employment, or educational purpose and explain why the DACA recipient needs to travel multiple times.


Generally, USCIS does not grant expedited requests for advance parole for DACA recipients. However, in a dire emergency, USCIS is willing to consider an expedited request at a local USCIS office.


Travel Logistics


A DACA recipient who is granted advance parole receives an Authorization for Parole of an Alien into the United States (Form I-512L). The I-512L authorizes an immigration inspector at a port-of-entry to parole the individual into the United States. The document contains a date by which the individual must present the document to an inspector at a port-of-entry to seek parole. USCIS issues an I-512L that is valid for the duration of the intended trip.


If the expected dates of travel are relatively soon after the date the advance parole application is submitted and approved, the individual needs to be ready to travel promptly after receiving the authorization document. The travel itinerary needs to be clear and well-organized to ensure that the individual returns to the United States within the time allotted in the document.


The advance parole authorization document makes clear that advance parole does not guarantee entry into the United States. DHS reserves the right to revoke or terminate the advance parole document. The individual is also subject to inspection by an immigration inspector at the time of seeking parole into the United States. DACA recipients should be aware of these facts – and of any risks presented in their cases – prior to traveling abroad.


Legal Issues to Consider Prior to Traveling Abroad


Prior Removal Orders


Prior to traveling abroad, it is important to determine whether the DACA recipient has an unexecuted deportation or removal order. If such an order exists, and if the DACA recipient were to depart the United States on advance parole, he or she likely would be found to have executed the deportation/removal order and would face harsh future immigration consequences, such as the inability to re-enter the United States for a given period of time.


To avoid this, a DACA recipient with an unexecuted removal order can submit a motion to reopen removal proceedings with the Immigration Court or the BIA. Once removal proceedings are reopened, the removal order no longer exists. The DACA recipient then can move to administratively close or terminate the reopened proceedings. If either termination of proceedings or administrative closure is granted, the DACA recipient can travel on advance parole without risking the consequences of an executed removal order.


A motion to reopen asks the court to reopen proceedings for consideration of new evidence, which in this case would be the grant of DACA and the recipient’s need to travel on advance parole. A motion to reopen a final removal order of an Immigration Judge must be filed with the Immigration Court having administrative control over the Record of Proceedings. Where an appeal has been decided by the BIA and no case is currently pending, a motion to reopen is to be filed with the Board. Generally, a party may file only one motion to reopen in a case and must do so within 90 days of the date of the final removal order. However, these number and time limitations do not apply to jointly filed motions. Thus, regardless of whether the DACA recipient’s case was decided by the Immigration Court or the Board, counsel may wish to contact the relevant ICE Office of the Chief Council (OCC) to request that the parties jointly move to reopen and then administratively close or terminate the DACA recipient’s removal proceedings. Should OCC not agree, and assuming a motion to reopen is barred by the time or number limitations, both immigration judges and the BIA have the sua sponte authority to reopen cases on their own motions. Consequently, as a last resort, a DACA recipient can request that the immigration judge or BIA reopen proceedings sua sponte.


Unlawful Presence Bars


Any decisions regarding travel outside of the United States should include an analysis of a DACA recipient’s unlawful presence in the United States to determine whether the recipient is subject to inadmissibility bars of INA § 212(a)(9)(B) (sometimes referred to as the three- and ten-year bars). Individuals under the age of 18 do not accrue unlawful presence for purposes of these bars and DACA recipients are considered to be lawfully present in the U.S. during the DACA grant period. However, DACA recipients who applied for DACA after turning 18 as well as DACA recipients who departed the United States and reentered or attempted to reenter the United States without being admitted – including those who are under the age of 18 – will have likely accrued unlawful presence prior to obtaining DACA.


If the individual accrued unlawful presence under INA § 212(a)(9)(B) prior to obtaining DACA and subsequently travels with advance parole, does the individual become subject to the unlawful presence ground of inadmissibility upon departure from the United States? According to a recent BIA precedent decision, the answer should be no. In Matter of Arrabally and Yerrabelly, the Board held that travel on advance parole does not constitute a “departure” for purposes of the 10-year-bar for unlawful presence under INA § 212(a)(9)(B)(i)(II). While Matter of Arrabally and Yerrabelly addressed advance parole in the context of adjustment applications, the USCIS Administrative Appeals Office (AAO) has since applied this analysis in at least several cases involving individuals holding Temporary Protected Status (TPS), each of whom left temporarily following the accumulation of more than one year of unlawful presence and then returned to the United States under advance parole. Based on Matter of Arrabally and Yerrabelly, the AAO found that these applicants were not inadmissible and that waivers of inadmissibility were not necessary.


Although there has been no formal written guidance on this issue yet, it appears likely that USCIS views Matter of Arrabally and Yerrabelly as applicable to DACA recipients traveling on advance parole. Indeed, some DACA recipients have received advance parole authorizations (Form I-512L) explicitly stating that traveling abroad under advance parole is not a departure within the context of INA § 212(a)(9)(B), pursuant to Matter of Arrabally and Yerrabelly. While this is a promising development, an I-512L issued more recently by the USCIS Nebraska Service Center does not include a reference to Matter of Arrabally and Yerrabelly or an explanation of the case’s impact on DACA recipients. Regardless of the presence or absence of a warning on the I-512L, counsel should be prepared to argue that Matter of Arrabally and Yerrabelly’s holding precludes an inspecting immigration officer’s application of INA § 212(a)(9)(B) to a DACA recipient returning to the United States pursuant to grant of advance parole. Though Matter of Arrabally and Yerrabelly is a precedent decision, attorneys may want to continue to monitor developments in this area before advising clients on the impact of travel.


It is also important to note that a DACA recipient who has already triggered the unlawful presence bars under INA § 212(a)(9)(B) or the permanent bar under INA § 212(a)(9)(C) (by previously leaving and re-entering without advance parole) will still be subject to these bars. Future travel under advance parole will not cure previously incurred bars.


Other Inadmissibility Considerations


A DACA recipient granted advance parole who returns to the United States shall be considered an applicant for admission. As such, the inspecting immigration officer may deny entry into the United States if the officer finds that any of the inadmissibility grounds apply. Thus, prior to departing the United States, DACA recipients with advance parole must consider not only whether they run afoul of the unlawful presence bars discussed above, but also all other inadmissibility grounds except for INA § 212(a)(7) (documentation requirements). Counsel should pay particular attention to the criminal inadmissibility grounds identified at INA § 212(a)(2), which are much broader than the crime disqualifications for DACA. Counsel should also be mindful that immigration-related fraud or misrepresentation and false claims to U.S. citizenship can bar admission.


Post-Travel Impact on Future Immigration Benefits


Advance parole may make some DACA recipients pursuing lawful permanent residency through immigrant visa petitions eligible for adjustment of status. If a DACA recipient travels abroad and returns under a grant of advance parole, then s/he is “paroled” into the United States within the meaning of INA §245(a), and may qualify for adjustment of status.


It's important to note, however, that eligibility for adjustment of status will most likely only apply to those DACA recipients who qualify to apply as "immediate relatives", i.e. the spouse or child of a U.S. citizen or the parent of an adult U.S. citizen. DACA recipients waiting to immigrate in a preference category who have previously worked without authorization or been in the U.S. without lawful status are ineligible to adjust status under INA §245(a). But for those DACA recipients who are married to a U.S citizen, or qualify as children of U.S. citizens, travel on advance parole may have the dual benefits of eliminating exposure to the unlawful presence ground of inadmissibility and creating eligibility to adjust status in the United States.


At least one practitioner has shared that a DACA recipient successfully adjusted after traveling abroad on advance parole. Similarly, TPS recipients who originally entered without inspection, and thus – like DACA recipients – were unable to adjust, reportedly have been able to adjust after returning on advance parole. In these cases, their status as parolees upon their return rendered them eligible for adjustment.

HAS THE “GANG OF EIGHT” RETURNED?

(Jan. 17, 2017) — The Federation for American Immigration Reform (FAIR) reported on Tuesday that Sen. Lindsey Graham (R-SC) has proposed legislation to protect certain illegal aliens from deportation ahead of the inauguration of Donald J. Trump as the nation’s 45th president on Friday.


While a summary of the proposed bill, S. 128, is not yet available at Congress.gov, the legislation, dubbed the “Bridge Act,” is intended to allow a cohort of young illegal aliens to remain in the country similar to the group positively affected by an executive action signed by Barack Hussein Obama in June 2012.


Graham’s move was heralded early last month by The Daily Caller when Graham recontacted members of what came to be known as the Senate’s “Gang of Eight” which supported “immigration reform” in 2013, a bill Obama advocated.


Disappointed that Congress failed to pass the DREAM Act or the “immigration reform,” Obama’s June 2012 executive action encompassed certain applicants age 30 and under who were brought to the United States when they were children and remain “undocumented.” The first applicants were processed two months later for a two-year period which was renewable for another two-year period if the applicant continued to qualify.


The executive action, DACA (Deferred Action for Childhood Arrivals), is administered by the United States Citizenship and Immigration Services (USCIS) agency, a division of the Department of Homeland Security (DHS).


More than a dozen of those approved under the program were later found to have committed serious crimes.


DACA was not challenged on constitutional grounds nor defunded by Congress with Republican majorities in both chambers.


However, executive actions Obama announced in a speech on November 20, 2014 which would have permitted approximately 5 million relatives of DACA recipients to remain in the country were challenged by 26 states up to the U.S. Supreme Court, which declined to overturn a lower court’s ruling contending that the executive actions were unconstitutional.


Trump campaigned on a platform of building a wall along the United States’ border with Mexico and deporting all illegal aliens convicted of crimes within the country. The incoming administration has not articulated how it might handle the tens of millions of illegal aliens residing in the U.S. presently without a criminal history other than their illegal entry.


Early in the 2016 presidential campaign season, Graham made it clear that he was not a Trump supporter.


Since Trump’s election, congressional Democrats have sought ways to shield DACA recipients or those deemed eligible from deportation in the event that Trump rescinds the executive action, including asking Obama to issue “pardons” to them.


Thus far, Obama has not taken that step with slightly more than 2.5 days left in office as of press time.

Yes MW, as you wrote, they were referring to family members in the 4-5 million number. If the expansion had gone forward for DACA who knows the real number of millions with DAPA added.


It appears that Comprehensive Immigration Reform will be tried again to include amnesty. The Bridge Act is to protect the current DACA people till they get their next amnesty.

I really hope Trump rescinds the executive action on DACA tomorrow. He may not and choose instead to let it run out, but I hope he rescinds it. Most of his followers are expecting him to rescind, absent the details, that's what they want and believe he promised, so he should just go ahead and do it. They need to all pack and start heading home to their nation of citizenship immediately.
