Watchdog Warns SEIU Contract for Nevada Voting Machines Poses 'Fraud' Concern

A conservative watchdog group is calling on Nevada officials to intervene to ensure SEIU workers who operate one county's voting machines don't skew the results to boost their endorsed candidate, Senate Majority Leader Harry Reid.

A contract between SEIU Local 1107 and Clark County -- where voting glitches were reported Tuesday -- makes the SEIU the sole union representative for, among other professions, voting machine technicians.

Nevada SEIU spokesman Nick Di Archangel called the suggestion that SEIU or its technicians would manipulate voting machines "absolutely false."

But Americans for Limited Government called the union agreement "positively outrageous" considering SEIU's political stake in the race. ALG has urged the U.S. Marshals, the state attorney general and the U.S. attorney's office to step in to uphold the integrity of the election.

"For all intents and purposes, the SEIU has control over those ballots boxes, because they're the people who work on them ... which puts us into a new realm of potential fraud," ALG spokesman Richard Manning told FoxNews.com.

Manning said it is "suspicious" that glitches were just reported in that county's machines, referring to complaints from voters in Boulder City that Reid's name was already checked when they went to cast their ballots for his opponent, Republican Sharron Angle. Fox5Vegas.com reported that several voters in the Clark County jurisdiction experienced the same problem.

Registrar of Voters Larry Lomax explained that highly sensitive touch-screens may be to blame and fraud is not the issue. He told Fox5Vegas.com that nobody reported the problem to his officials and that it would be impossible for the machines to pick a candidate without the voter's consent.

He also said in a statement that the supervisors are not part of the union, even if the technicians are, and that the technicians are not involved in programming. He said "extensive security measures are in place" to prevent tampering, adding that SEIU-eligible employees have worked in the Election Department for years without incident.

Di Archangel said Lomax "ensures both the security and reliability" of the machines. "The machines cannot be compromised," he said in an e-mail to FoxNews.com. He added that despite the county contract, all workers are free to stay out of the union if they wish.
"The agreement does not mandate in any way that only union members be assigned to specific jobs," he said.

Secretary of State Ross Miller's office said in a statement that despite wide-ranging "rumor and speculation" about suspicious voting activity, no formal complaints have been lodged with Nevada's Election Integrity Task Force.

"I will not tolerate any attempt by an individual, organization or campaign, to deny any Nevadan the right to freely cast their vote in a safe, secure and private manner. But neither will I stand by and allow the public's confidence in the electoral system (to) be undermined by unsubstantiated rumors and allegations," Miller said.

But Manning said SEIU's involvement in the process raises concern about the integrity of the election.

The union is putting big money into the Nevada Senate race to support Reid and recently went up with an ad that described Angle as "too dangerous" to have power in Congress.

Though the Clark County/SEIU contract is dated March 2007 to June 2010, it is still in effect.

The SEIU said that voters, to ensure the accuracy of their selections, should use the machines' "fail-safe system" to review their picks before leaving the polling station.

Complaint Filed over Illegal Alien Voters

A group fighting against illegal immigration has filed a series of formal complaints with federal, state, and local agencies following a report by the Las Vegas Journal Review that uncovered a number of cases of illegal immigrants voting in this election.

Americans for Legal Immigration Political Action Committee (ALIPAC) filed a formal complaint with the Federal Election Committee (FEC), the Nevada Secretary of State’s Office, and the Clark County Board of Elections. In their complaint, ALIPAC charges that numerous illegal immigrants and non-citizens are registering and voting in federal elections that will decide which presidential candidate or political party controls the White House and US Senate.

The complaint follows a story written by Glenn Cook of the Las Vegas Journal Review (LVJR). In that story, Cook interviewed two illegal immigrants who said to him that they were voting illegally.

“Last week, I met with two immigrant noncitizens who are not eligible to vote, but who nonetheless are active registered voters for Tuesday’s election. They said they were signed up by Culinary Local 226.

“They speak and understand enough English to get by. But they don’t read English especially well. They say the Culinary official who registered them to vote didn’t tell them what they were signing and didn’t ask whether they were citizens. The immigrants said they trusted that the union official’s request was routine, thought nothing of it and went about their work,” read the pertinent part of the story.

William Gheen, President of AlIPAC, said that the LVJR investigation is evidence that voting by illegal immigrants isn’t merely a conspiracy but a real problem.

“Illegal alien voters are not a conspiracy theory,” said Gheen. He continued, “The information we have shows mass illegal immigrant voting in Clark County.” Clark County includes the City of Las Vegas.

Gheen also pointed out that Las Vegas wasn’t the only place where the media highlighted incidents of illegal immigrants voting. A Fox 25 in Boston investigation also found a number of illegal aliens on the voter rolls.

“But FOX Undercover found out something else about Santiago-Vazquez. He’s been registered to vote from his home address in Lawrence since 2010.

“Our investigation shows he’s not the only registered voter in Lawrence who is not a citizen. By cross-checking Lawrence voter records with criminal records that included records indicating lack of citizenship, we found three others.”

Gheen said that he believes that tens of thousands of illegal aliens are voting in Nevada and he even stated that at least one high-profile election was swayed by illegal immigrants. Gheen said that he believes that Harry Reid beat Sharron Angle because thousands of illegal aliens voted for Harry Reid in 2010.

“He [Reid in 2010] lost every County but Clark County,” said Gheen of why he believes that Reid was helped by illegal aliens.
In that race, Angle filed a complaint citing voter intimidation by management at Harrah’s Casino. Gheen said that a number of illegal immigrants work at that Harrah’s.

Gheen also said that an ALIPAC supporter from Nevada who worked as a poll worker in this cycle was dismissed from that job after complaining about illegal immigrants voting.

Gheen said that the issue of illegal immigrants voting is an issue all Americans should be concerned about because it robs citizens of their own vote.

“Every illegal immigrant is skewing a legal vote.”

Voter registration fraud is not a groundless conspiracy. It is not a hypothetical threat to election integrity.

In Nevada, a battleground state that could decide the presidency and control of the U.S. Senate, it is real.

Last week, I met with two immigrant noncitizens who are not eligible to vote, but who nonetheless are active registered voters for Tuesday's election. They said they were signed up by Culinary Local 226.

They speak and understand enough English to get by. But they don't read English especially well. They say the Culinary official who registered them to vote didn't tell them what they were signing and didn't ask whether they were citizens. The immigrants said they trusted that the union official's request was routine, thought nothing of it and went about their work.

Then the election drew closer. Then the Culinary canvassers started seeking them out and ordering them to go vote.

One of the immigrants was visited at home by a Culinary representative and said the operative made threats of deportation if no ballot was cast.

They didn't understand how, as noncitizens, they could be registered to vote if it's illegal for them to vote in a U.S. election. They didn't understand that, upon being signed up, not only is their registration public record, but the record of whether they've voted is public as well.

After a few days of early voting, the union knew the immigrants still hadn't voted. So union canvassers kept visiting.

One day, when a Culinary representative was told the immigrant wasn't a citizen and wouldn't vote, things got testy. The immigrant was "in so much trouble," the Culinary operative said, according to Brenda Moraine, a local immigrant advocate who was there.

The immigrants spoke with me on the condition that I provide no identifying information about them beyond their membership in the Culinary. They're afraid of reprisals from the union, they're afraid of losing their jobs, and they're concerned that their signatures are on a government document that says, in part, "I swear or affirm I am a U.S. citizen. I declare under penalty of perjury that the foregoing is true and correct."

I verified their identities, their lack of citizenship and their status as active registered voters in Clark County.

One of the immigrants validated my worst fears about Nevada's weak voter registration standards and voting safeguards.
"There are others," the immigrant said.

Other noncitizen Culinary workers are registered to vote?

"Yes."

The question, now that early voting is over and Election Day is just two days away, is how many of these ineligible voters have done the Culinary's bidding and submitted ballots, whether out of ignorance or fear, and how many have the knowledge and courage to follow the law and stay away from the polls.

In Nevada you never have to prove you're a citizen to register to vote or cast a ballot. Forget about showing government-issued photo identification at the polls, as several states now require. You don't have to show a photo ID at any point in the process. The immigrants I met could vote Tuesday just by showing a Culinary health insurance card and a power bill.

"One would establish identity and one would establish residence," Clark County Registrar of Voters Larry Lomax said of state standards. "Just like every other voter in Nevada, they will not be asked to prove citizenship."

You can't cash a check in this town with such flimsy identification.

How serious is this issue? What I've detailed above constitutes multiple Category E felonies.

I spoke with Yvanna Cancela, political director for the Culinary Local 226, on Friday about what these immigrants have experienced.

"This is very, very serious," she said. "No one would train anyone to register noncitizens or threaten registered voters in any way."

She said if a noncitizen were registered to vote by accident, and if they told a Culinary canvasser they weren't eligible to vote, canvassers are trained to have the person fill out a form to revoke their registration with the county. That form is immediately submitted to the county.

Cancela theorized that the canvasser who said the immigrant was "in so much trouble" actually was pointing out that it was wrong the immigrant had been registered to vote in the first place and that the immigrant needed to be taken off the registration rolls.

One of the immigrants had filled out the paperwork to do just that. As of Friday afternoon, the immigrant was still registered to vote. On Friday, at my request, Clark County election staff sorted through every registration cancellation form they had received in the past month. The immigrant's form wasn't among them.

"How many don't have an advocate who'll say, 'Don't do this'?" Moraine asked. "How many have no one to tell them they're breaking the law if they vote?"

Cancela asked me to identify the workers so the union might be able to learn which Culinary canvassers had made contact with them and who had registered them to vote. When I said I couldn't under the terms of my interview with the immigrants, she added that if they came forward, the union would take corrective action against those canvassers to make sure they understood the law.

Cancela did not know how many noncitizens are represented by the Culinary Local 226.

I've written extensively about voter registration through the final weeks of this campaign. In my Sept. 30 and Oct. 14 columns, I detailed how the state, at taxpayer expense, mailed post cards to an undetermined number of noncitizens, felons and deceased Nevadans inviting them to register to vote online. I reported that more than 2 percent of Clark County's registered voters are "ID-required" - information on the applications from these first-time voters did not match state Department of Motor Vehicles records and Social Security data, thus requiring the voter to present minimal identification to be able to vote.

We should ask every voter, upon registration, to prove citizenship, but we don't. Instead, we have an honor system that's exceedingly easy to cheat and gives political parties and politically active groups a powerful incentive to break the law without much risk of being caught.

Perhaps a few votes won't swing Tuesday's election in any race.

But what if they do?
