Report: Trump asked Sessions to consider dropping Arpaio prosecution

Report: Trump asked Sessions to consider dropping Arpaio prosecution

    By Tom LoBianco, CNN
Updated 2:31 AM ET, Sun August 27, 2017

(CNN)President Donald Trump asked Attorney General Jeff Sessions this past spring whether he would drop the federal case against Arizona Sheriff Joe Arpaio, but was rebuffed at the time, according to The Washington Post.

Sessions told Trump it would be inappropriate for him to interfere in the federal case against Arpaio, one of Trump's most ardent allies, according to three people with knowledge of the conversation who spoke with the Post.

Trump eventually decided to let the case go to trial with the plan of pardoning Arpaio if he was convicted, according to the report.

When asked about Trump's conversation with Sessions, White House press secretary Sarah Huckabee Sanders told the Post: "It's only natural the president would have a discussion with administration lawyers about legal matters. This case would be no different."

The Justice Department declined to comment to the newspaper. It also declined to comment to CNN when asked about the Post's story.

The White House did not immediately return CNN's request for comment.

CNN has not independently verified the Post's story.

Trump quietly pardoned Arpaio late Friday as the national focus turned toward Hurricane Harvey as it was about to hit Texas. Trump hinted at the pardon earlier in the week during his rally in Phoenix, but the White House was circumspect about what would happen.

Arpaio was found guilty last month of contempt of court for refusing to comply with a federal judge's orders that he stop racially profiling Latinos. Arpaio was scheduled to be sentenced in October.

Trump's pardon of Arpaio enraged Democrats across the board and divided Republicans. Many in the GOP, including House Speaker Paul Ryan and Sen. John McCain, denounced the pardon, while others, including Arizona Rep. Trent Franks, praised the move.

Unlike almost all presidential pardons, this one did not involve any role for the Justice Department, according to a source with knowledge of the process. Typically an office at the Justice Department reviews clemency applications and gives a recommendation to the President.

"This is the President's pardon," the source said.

It's a shame the DOJ didn't review and dismiss the charges and end this. Very disappointing to put our dear Sheriff Joe and his family through all this, but very glad to see Trump has been on this from the beginning and has now ended it himself with the pardon.

I don't really see that Sessions had a choice in the matter. Dismissing the case would have seriously jeopardized the integrity of his office. Such a move would have come off extremely political and the liberal media would have absolutely lambasted Trump and Sessions for such a move.

I think the way things went down was probably for the best for Trump, Sessions, and the integrity of our judicial system.

How is Trump asking Sessions to dismiss a case that was already in the prosecution phase any different than Bill Clinton meeting AG Loretta Lynch on the tarmac to dissuade her not to seek prosecution of Hillary Clinton?

Well, it's different because Hillary was guilty and Sheriff Joe wasn't. Hillary's situation was a normal prosecution whereas Sheriff Joe's was a Witch Hunt.

It was a witch hunt, but I don't see how he could have dropped it.

I doubt he asked Sessions to drop it. The President probably discussed the case and the news media made up whatever they wanted to put out there.

Whether I agree or not, that is a matter of opinion that many don't share with us.

Man, wouldn't the political world be so simple if all judicial system operatives just agreed with my and your opinion on everything involving the law and acted accordingly.

Trump probably did discuss it. Trump is actually the head of DOJ. People seem to forget that. A President of the United States is head of every federal cabinet agency.
