    Nevada Governor Brian Sandoval has gone on the record regarding the BLM taking over portions of his state, and their implementation of unconstitutional “free-speech zones” in areas adjacent to the active confiscation of Bundy cattle near Bunkerville, NV.
    Sandoval said, “Due to the roundup by the BLM, my office has received numerous complaints of BLM conduct, road closures and other disturbances. I have recently met with state legislators, county officials and concerned citizens to listen to their concerns.”
    I have expressed those concerns directly to the BLM. Most disturbing to me is the BLM’s establishment of a ‘First Amendment Area’ that tramples upon Nevadans’ fundamental rights under the U.S. Constitution.
    To that end, I have advised the BLM that such conduct is offensive to me and countless others and that the ‘First Amendment Area’ should be dismantled immediately.
    No cow justifies the atmosphere of intimidation which currently exists nor the limitation of constitutional rights that are sacred to all Nevadans.
    The BLM needs to reconsider its approach to this matter and act accordingly.”
    The Bundy family’s reaction to the statement was less than enthusiastic, although they did recognize it as a positive development. Ryan Bundy, Cliven’s son expressed that they would have liked to have seen a more affirmative stance in support of their position against the Federal Bureau of Land Management.
    Sandoval’s statement particularly addressed two “First Amendment Areas” set up in order to control media access and minimize public awareness of what was going on.
    It would seem that trampling upon our rights has only brought more attention to the issue, not blackout they had hoped for.
    On the subject of “First Amendment Areas,” Ryan Bundy said, “Whenever you designate an area, then you’re restricting it everywhere else. When you designate an area like that for first amendment rights, you [don't] give the people any rights. You [take them] away, and every other location.”
    BLM officials announced that they will be providing a statement of Wednesday afternoon. None has yet been forthcoming.

    The feds have gone way too far again this time! First Amendment Area? Listen up traitors, my First Amendment Area is any place I'm standing inside the United States ya chuckle heads and my second amendment rights back up all my other rights along side about 200 million Americans that feel the same way! Take a close look at this new picture out of Nevada. Any of you care to step into this ''First Amendment Area' ? Anyone got a lighter?

    "The First Amendment is Not an Area"

    As SteynOnline readers well know, in the wake of Seal Team Six, America has also acquired a Bunny Team Six and a Deer Team Six. Now comes news from Nevada of Cattle Team Six. It's a long-running story of rights to graze on "federal land" vs protection of the "desert tortoise", but, like so many disputes with American bureaucrats these days, it ends with paramilitary commandos training their weapons on civilians:

    Whoa, hold that thought! "Federal snipers with the Bureau of Land Management". As I wrote only last week, if someone wants to stroll in to Fort Hood and shoot as many people as he's minded to, the fellows on the receiving end have to call 911 and wait for the county sheriff to send a couple of deputies - because "the only government department without a military force at its disposal is the military". But the Bureau of Land Management has snipers.

    That aside, this was the passage in the Las Vegas Review-Journal story that caught my eye:

    A few miles up the road, a "First Amendment Area" the BLM set up for rallies like this stood empty, save for a few signs attached to the outside of the orange plastic pen.
    One of them read: "1st Amendment is not an area."

    Indeed. The "First Amendment Area" is supposed to be something called "the United States". If the Bureau of Land Management gets to determine which sliver of turf you can exercise your right to freedom of expression in, then it isn't freedom of expression at all, is it? I'm less impressed by the First Amendment then I used to be, mainly because I'm having to spend a half-decade in court and a seven-figure sum for the privilege of hearing some judge years down the line inform me that my 270-word blog post is, in fact, permitted under the US constitution. (If you'd like to help lessen the toll of that seven-figure sum, I'd be awfully grateful.) But even so it's extraordinary that even twerp bureaucrats from the Department of Compliance feel comfortable setting up an "orange plastic pen" labeled "First Amendment Area". If an anonymous pen-pusher in the permanent bureaucracy can confine the Bill of Rights to tiny enclaves where it will be entirely ineffectual, then there is no Bill of Rights.

    By the way, what's depressing about this is, if the issue worked its way in front of a judges or judges, the genius jurists would undoubtedly rule that, while an 11-foot wide free-speech zone is too narrow an interpretation of the First Amendment, it would be acceptable if you widened it to 17 or 18 feet.

    ~I was on The John Oakley Show in Toronto yesterday, and, noting my reference to Magna Carta, a handful of American listeners emailed to ask why I only mention laws eight centuries old. Yeah, I've noticed that, too - not just Magna Carta, but the Assize of Clarendon and the Charter of the Forest:

    In 1217, King Henry III signed the Charter of the Forest, which despite various amendments and replacement statutes remained in force in Britain for some three-quarters of a millennium, until the early Seventies. If Magna Carta is a landmark in its concept of individual rights, the Forest Charter played an equivalent role in advancing the concept of the commons, the public space. Repealing various restrictions by his predecessors, Henry III opened the royal forests to the freemen of England, granted extensive grazing and hunting rights, and eliminated the somewhat severe penalty of death for taking the king's venison. The [National Park Service] have not yet fried anyone for taking King Barack's deer, but it is somewhat sobering to reflect that an English peasant enjoyed more freedom on the sovereign's land in the 13th century than a freeborn American does on "the people's land" in the 21st century.

    And so, as happened to Japanese and European tourists at Yellowstone, you can be arrested for photographing the King's deer. That's why I quote this stuff: if a 13th century peasant enjoyed rights a 21st century American doesn't, something's gone badly wrong.

    Cows and Illegal Aliens

    This is classic federal establishment run wild, out of control and deadly to the rights of citizens. Can you think of a federal agency that isn’t, right now? Soldiers deprived of the Second and Fourth Amendment rights as guaranteed by the Constitution. The IRS? TSA? Homeland Security? It’s a big, big list.

    The contrast to this developing debacle over range land must be seen through the lens of the southern border of the United States which is almost all range land. Where our Border Patrol struggles with a constant flood of human beings crossing into America across our unprotected border and making themselves at home. Even as it’s been revealed Obama set free thousands of illegal alien criminals and the Border Patrol chief says his agency is battling another influx of illegal children, our men in uniform at the border are vilified as thugs and killers. And lest you forget, Obama’s administration has decided our Constitution does not exist within a 100 mile perimeter inside our borders.

    Federal snipers with the Bureau of Land Management (BLM) trained guns on members of a family yesterday after they dared to stop and take video footage of cattle outside the bounds of a designated “First Amendment Area,” before arresting one of the men for non-compliance.

    The cattle were being rounded up by BLM officers as part of a crackdown on Nevada rancher Cliven Bundy, who has refused to pay “grazing fees” demanded by the feds as a result of a re-classification of 600,000 acres of federal land in northeastern Clark County which Bundy claims has been in his family for generations.

    Some fear the dispute could turn into a Ruby Ridge-style violent standoff because Bundy has said he is prepared to become a martyr for what he perceives as a constitutional stance against tyranny.

    As we reported earlier, the feds have now started rounding up Bundy’s cattle in the name of protecting a supposedly endangered species, the desert tortoise, forbidding Bundy from interfering or even entering the vast area. The case is quickly turning into another iconic battle between big government and a besieged family.

    Fears that the confrontation may turn violent and concerns that Bundy is drawing increased support from liberty activists and the local community prompted the feds to tape off two ridiculous “First Amendment Areas,” outside of which free speech in support of Bundy is banned. A sign placed inside the area reads “Welcome to Amerika – Wake Up” alongside a hammer and sickle logo.

    When Bundy’s family members violated that rule yesterday in an attempt to peacefully document the cattle roundup, they were met with a barrage of loudspeaker warnings and four BLM snipers with their guns trained on the dissenters.
    “Several members of the family had gone out for a drive in several vehicles to try to monitor the ongoing federal action to remove their father’s cattle from the range,” reports the Moapa Valley Progress. “They were not travelling on recently restricted federal land, but were travelling along the state highway looking north across the valley for signs of cattle, Ryan Bundy said.”

    “He was doing nothing but standing there and filming the landscape,” Bundy said of his brother Dave. “We were on the state highway, not even off of the right-of-way. Even if they want to call [the area that we were filming] federal land; which it’s not; we weren’t even on it. We were on the road.”

    None of the family members were armed, but as soon as Dave Bundy began filming the cattle in the distance, 11 BLM vehicles each with two agents arrived and surrounded him.

    “They also had four snipers on the hill above us all trained on us. We were doing nothing besides filming the area,” said Ryan Bundy.

    The family were told to leave the area via loudspeaker because they had violated the crudely established “First Amendment Area”.

    “They said that we had no first amendment rights except for up by the bridge where they had established an area for that,” Bundy said.

    When Dave Bundy didn’t immediately heed the warning and return to his vehicle, a dog was set on him and he was subsequently arrested.

    “He was filming and talking on the phone, I don’t know to whom,” Ryan Bundy said. “It happened pretty fast. They came down on him hard and had a German Shepherd on him. And then they took him.”

    When Dave Bundy’s father Cliven attempted to contact emergency response in both Mesquite and for Metro in an attempt to discover the whereabouts of his son, he was told to, “get off the phone or he would be arrested,” according to Ryan Bundy.

    Should the Bundy case escalate any further, what has up to this point remained a largely local news story threatens to explode into a national controversy – re-igniting resentment over big government and a federal bureaucracy increasingly trampling on the rights of the American people to be left alone.
