The ‘Uber-Presidency’ of Barack Obama

Yesterday, the House Judiciary Committee held a hearing on the President’s Constitutional Duty to Faithfully Execute the Laws. It was a case study in how what is already known can become more sobering if enunciated in the right forum and acknowledged by Constitutional law experts.

Rep. King: Reacts to idea of “Uber-Presidency”.

The four witnesses at the hearing were Jonathan Turley, Professor at the George Washington University Law School; Nicholas Rosenkranz, Professor at Georgetown University Law Center; Simon Lazarus, Senior Counsel at Constitutional Accountability Center; and Michael Cannon, Director of Health Policy Studies at the CATO Institute.
In this exchange between Rep. Trey Gowdy (R-SC) – who looks good filling in for the chairman – and Lazarus (Gowdy later moves over to Turley), Gowdy carves up Lazarus, who is an obvious apologist for all things Obama. Turley, who is known to be a leftist professor, is refreshingly far more intellectually honest than is Lazarus when talking about matters like prosecutorial discretion.

At issue in this clip is the ability of the President of the United States to selectively enforce laws enacted by Congress. In particular, Gowdy begins by talking about mandatory minimum sentences for criminals. He then talks about Obamacare, Immigration laws, and other infractions by Obama.

Though compelling to watch Gowdy make Lazarus look utterly foolish, keep watching as Turley gives Committee members some very sobering realities to think about, saying that:

“…the President is outside the line… we have the most serious Constitutional crisis I view, in my lifetime… this body (Congress) is becoming less and less relevant.”

Quite alarming statements coming from a left-leaning professor. Then again, Democrats are known to have extremely thick firewalls right behind their foreheads

Rep. Steve King (R-IA), who also sits on the Committee, challenged Lazarus to explain how he thinks the President’s powers “are limited”, since Lazarus is obviously a kool-aid drinker. Lazarus fails. King then goes to Cannon and asks him about what recourse there would be to limit a president who has no regard for the Congressional check.

Pay close attention beginning at the 5:30 mark as Turley sounds the alarm again when he talks about having “great trepidation” with regard to where the country is headed and expresses grave concern that the “center of gravity is shifting” within the three co-equal branches of government. He then talks of an “uber-Presidency”, saying “there could be no greater danger for individual liberty”. Turley’s comments are so dire that King is visibly affected by what he’d just heard (6:00 mark), again, not because he didn’t know it already but having it said in a Congressional hearing by someone like Turley just seems to make it a bit more real.

Lazarus is perhaps at his most coherent and accurate, shortly after the 7:00 mark when talking about the power of Congress. While asserting that Congress “has lots of power” but that Congress isn’t “using” that power.

If you believe that Obama’s is an ‘Uber-Presidency’, as Turley seems to, it is important to factor in two relationships in Obama’s past. Both of these relationships were with individuals / ideologies that sought the overthrow of the U.S. Government:

1. The Cloward-Piven model, which seeks to overthrow the U.S. Government by overloading its welfare rolls. In essence, this model, formulated by Richard Cloward and Frances Fox Piven, seeks to bankrupt the nation into anarchy. There is ample evidence to suggest Obama is implementing this strategy as well as some evidence that he knows Piven personally. Cloward and Piven devised it in the 1960′s while at Columbia, a school Obama later attended.
2. His relationship with Weather Underground founder Bill Ayers. It is much closer than Americans were led to believe. These two men didn’t just sit on Boards together; they shared an office for at least three years. There is simply no way Obama was not affected by the far left-wing ideology of Ayers.

In both cases, the endgame is the overthrow of the U.S. Government. Ayers is an unrepentant terrorist to this day. In 1982, the recently deceased Larry Grathwohl – the only man to successfully infiltrate the Weather Underground for the FBI – explained the ultimate objective of the now unrepentant Ayers:

Expert warns Congress that Obama’s behavior could lead to armed rebellion

Barack Obama is so divorced from reality and surrounded by “yes men” inside his White House cocoon that he doesn’t seem to grasp the consequences of his Administration’s capricious and constant disregard for the laws of the United States.
Perhaps Michael Cannon’s testimony in front of a congressional committee today will be sufficiently jarring to make him realize his potentially precarious position… but I doubt it.

During a congressional committee hearing about the constitutional limits imposed on the presidency and the implications of President Barack Obama’s disregard for implementing the Affordable Care Act as written, one expert testified that the consequences of the president’s behavior were potentially grave. He said that the precedent set by Obama could eventually lead to an revolt against the federal government.
On Tuesday, Michael Cannon, Cato Institute’s Director of Health Policy Studies, testified before a congressional committee about the dangers of the president’s legal behavior.
“There is one last thing to which the people can resort if the government does not respect the restrains that the constitution places on the government,” Cannon said. “Abraham Lincoln talked about our right to alter our government or our revolutionary right to overthrow it.”

The Founder’s Constitution—found online at the University of Chicago where Obama wasn’t a law professor (he was a mere lecturer, and an undistinguished one at that)—speaks quite clearly about our Right of Revolution.

What others called the right of resistance or the right of revolution is at bottom the natural right of preservation. The supporting case was developed with bold thought and cautious speech by John Locke, whose Second Treatise (no. 2) rightly was regarded by many of the Founders as a fit and necessary text for a self-governing people. An executive’s use of force without right left a suffering people with no choice: “cry up their Gouvernours, as much as you will for Sons of Jupiter . . .; give them out for whom or what you please, the same will happen. The People generally ill treated, and contrary to right, will be ready upon any occasion to ease themselves of a burden that sits heavy upon them.” Far from instigating “Civil Wars, or Intestine Broils,” his doctrine (Locke insisted) would have an opposite effect. The mischiefs concocted by “a busie head, or turbulent spirit” would not succeed in the absence of a general sense of being wronged. In fact the people were, if anything, too slow to resent transgressions. Moreover, a people well instructed in their rights would reduce the likelihood of civil commotions by disabusing would-be tyrants of their wicked fancies.
The American experience shows the colonials to have been quicker learners of Locke’s lessons than the ministers of George III. The complex of grievances and restless stirrings that agitated the Americans in the 1760s and beyond had sent their ablest men to their libraries and their writing desks. But by the mid-seventies events had reached a point where entreaties were futile and researches “among old parchments, or musty records” superfluous. “When the first principles of civil society are violated, and the rights of a whole people are invaded, the common forms of municipal law are not to be regarded” (Hamilton, no. 5).

No one with the least understanding of the horrors of an armed rebellion has any desire to engage in one. That fact stated, Americans have not purchased tens of millions of firearms and an estimated 50-60 billion rounds of ammunition in recent years because they intend to submit quietly to creeping government tyranny.

It took the place of verifying any records regarding his past and was swallowed hook line and sinker by most of the media. Guilty white folks and blacks flocked to his brand of political theater.
  
  In this video, B. Hussein just comes right out and talks about how racist he is and was. He has white blood in him but wishes he didn’t.
  After being presented as the first “post-racial” president, his comments here, as well as his attendance of Jeremiah Wright’s racist church in Chicago, should have had white people at a minimum as well as not just a few non-racist blacks asking some serious questions about this guy’s eligibility to hold office.
  As it turned out, it was more fun to be part of a movement than it was to exercise judgment and integrity. Nobody wanted to give up that feel good fervor of the 2008 campaign. You zombies don’t feel so good anymore though, do you?
