Supreme Court Refuses to Block Texas Voter ID Law

Supreme Court Refuses to Block Texas Voter ID Law

    • By MARK SHERMAN, ASSOCIATED PRESS
    • WASHINGTON — Apr 29, 2016, 12:00 PM ET

The Supreme Court on Friday rejected an emergency appeal to stop Texas from enforcing its challenged voter ID law. But the court said it could revisit the issue as the November elections approach.

The law has been in effect for recent elections, even after a trial judge struck it down in 2014 and an appellate panel found last year that the law had a discriminatory effect on minority voters.

The challengers in the ongoing lawsuit argue there is no reason to allow the requirement to show picture identification at the polls to remain in place.

But justices rejected the plea in a brief order Friday.

The full New Orleans-based appeals court will hold a new hearing on the Texas law in May.

The high court said that it is aware of "the time constraints the parties confront in light of the scheduled elections." If the full appeals court has not issued a ruling by July 20, the court said, it would entertain a renewed emergency appeal over the voter ID law.

Friday's order was the second time the justices have refused to block the voter ID law in Texas. In 2014, the court allowed the law to be used in the then-imminent general election. The order two years ago was issued two days before the start of early voter in Texas and without explanation, but appeared to be based on the court's view that changing the rules so close to an election would be confusing.

Three justices dissented in 2014: Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor.

Ginsburg, writing for the dissenters, said the ID requirement created the potential for "racially discriminatory voter disenfranchisement."

Other Republican-controlled states, including Wisconsin and North Carolina, have passed similar voter ID measures that also are being fought in the courts. But the Texas law is widely viewed as one of the nation's toughest. It requires one of seven forms of approved identification, but unlike other states with voter ID restrictions, Texas doesn't recognize university IDs from college students. It does, however, accept concealed handgun licenses as proof of identity.

Free voting IDs are available from the state, but opponents have said getting those cards still puts underlying financial costs on voters, such as paying for birth certificate copies and travel.

While there have been anecdotal reports of confusion in the Texas elections held while the law is in force, there haven't been widespread issues with people being unable to cast ballots because they lacked proper identification.

It's a real shame that illegal aliens caused this problem for Americans. Ironic that the Democrats support the problem of illegal immigration that in turn causes Republicans to pass laws that restrict the rights of Americans to prevent the invasion of illegal voters in our elections.

    What a mess!

Trump will straighten it out by getting them out.

We need a National ID with fingerprint. To vote, get government or taxpayer benefits, social security, food stamps, get a job, etc. and renewable every 5 years to cut the fraud! We need to know who is in this country and who is illegally in our country. No more fraud, no more voter fraud!

I've been against a national ID other than a passport and I'm comfortable with state id's or state driver's licenses as sufficient ID. If we move to a national ID that inconveniences Americans and can often strip them of their rights they otherwise have, then we have allowed illegal invaders to change our country. The only reason people feel we need this, and understandably so, is because of the same government that would issue the national ID. How can we trust a national government with respect to our own citizenship when they are the ones who have sold out and threatened our citizenship to begin with?

Instead, we need to demand a stop to illegal immigration, a major reduction if not a pause/moratorium for legal immigration, and government leaders who care about our country and our citizens. And in my opinion after working on this problem now for over 11 years, and I know many others have been after it much much longer than that, we have ONE SHOT to turn this around and set it straight, we have ONE MAN who has the will and skill, the loyalty and courage, to make this right and stop this disaster. It's not something he says he wants to do to become President, it's not a punch-line to win an office, Donald Trump has been on this trade/immigration problem for 30 years.

This is our chance my fellow Americans. We put so much faith and effort into our members of Congress to solve this problem, the reality is they're impotent. Immigration enforcement is an Executive function. We have all the laws we need to stop this on a dime now, if only we had an Executive committed to enforcing the law and correcting the problem.

And since Dwight Eisenhower, Donald Trump is the only person who even wants to talk about it, let alone tackle the problem and solve it. He is the ONLY ONE.

Americans must unite, elect this man President of the United States and he will take US to the promised land of a nation free of illegal immigration. That is the current law, that is the right thing to do, that is the absolutely necessary thing to do, and he can and will do it. No doubt about it.

The United States right now is like a beautiful Elephant, tied to a tree in a jungle, being devoured by the hungry lions of the world. It must stop before we pass the point of no return when there's no life in our Elephant left to save.
