    Exclusive: Does Cliven Bundy Have Something Called “Prescriptive Rights”, Why The BLM May Be Afraid To Go To Court

    In this ongoing story surrounding cattle rancher Cliven Bundy, there are a series of questions media has ignored. For instance, in the 20 years Bundy hasn’t been paying his fees, why hasn’t he been taken to court? Why this year, spend nearly $1,000,000 of taxpayer money to round up 400 cattle that ultimately have to be returned? Why didn’t the BLM just place a lien on the cattle rather than attempting to take them by force and then auction them off? The Bureau of Land Management has suffered a huge black eye this week because of their response to the Bundy situation. Perhaps though, there is a reason the BLM chose force over the courts.

    In an exclusive interview with Benswann.com, Montana cattle rancher Todd Devlin says the BLM is now considering new ways of dealing with the Cliven Bundy situation. Devlin, is not just Montana cattle rancher but is also a County Commissioner in Prairie County Montana and he has worked with the Department of Interior, having taught workshops for the agency in the past. Monday, Devlin reached out to his contacts in the Department of the Interior to find out why the Bureau of Land Management has refused to work with Bundy rather than simply attempting to run over him.

    Among the questions Devlin asked of the BLM, “Is it possible that this guy (Cliven Bundy) has prescriptive rights?” The response from top officials at the BLM, “We are worried that he might and he might use that defense.”

    So what exactly are prescriptive rights? Prescriptive right to property is an easement that gives some one the right to use land owned by someone else for a particular purpose. An example is using a path through Party A’s land to get to your land, a prescriptive easement is allowed which gives the user the right to get to his land through A’s property.

    In most states, if a trespass or use of land occurs regularly for at least 5 years without the “owner” of the land taking legal action, prescriptive rights come into play. Because Bundy stopped paying his grazing fees to the BLM in 1993 but continued to use the land for over 20 years, it is possible he now has prescriptive rights to the land. That might explain why the BLM has not taken this issue to court and never bothered to file a lien against the cattle.

    Granted, there have been court actions over the years. In 1998 a federal judge issued a permanent injunction against Bundy, ordering him to remove his cattle from the federal lands. He lost an appeal to the San Francisco 9th Circuit Court of Appeals. Yet, the “trespass cattle” remained on the BLM land. In fact, it took until August of 2013 for a court order to be issued saying Bundy had 45 days to remove his cattle from federal land. 15 years went by from the time of the last court case over the cattle until the BLM attempted to remove the livestock.

    Of course, Bundy has not made the claim that he will not pay the fees, he simply says he will not pay those fees to the BLM because he doesn’t recognize federal authority over the land. Bundy has said that in the past, that he would pay fees to Clarke County, Nevada, though Clarke County has refused to accept them. The BLM has insisted that Bundy owes $1.1 million dollars in grazing fees for his trespass cattle.

    “The actual number is probably around $200,000. The $1.1 million claimed by the BLM is probably mostly interest and penalties for trespass cattle.” says Devlin, who goes on to say that it is unlikely that Clarke County would be able to collect those penalties.
    When Devlin reached out to the BLM, he suggested that the federal agency just allow Bundy to pay the fees to the county rather than continuing with these aggressive tactics to confiscate his cattle.

    “Why don’t you just let him pay them there (Clarke County)? I got a call back from the liaison saying ‘Yes, pursue it.’” Devlin reached out to contacts in Nevada to get that process moving forward. If that were to happen, Clarke County could collect the grazing fees and if it desired to do so could hand those fees over to the BLM.

    Finally, Devlin says instead of allowing the situation with Bundy’s cattle to grow completely out of control, the BLM could have simply placed a lien on the cattle in the first place. Of course, that lien might have been rejected in court if Bundy were able to demonstrate those prescriptive rights. Then again, the courts so far have sided with the government, therefore it is even more baffling why the lien wasn’t placed on the livestock.

    Days after the BLM has claimed they will stand down, they are now reportedly considering a lien on the cattle,
    “I asked why you didn’t put a lien against the cattle?” Devlin asked the BLM. “They hadn’t thought about that but they are considering it now”

    Sgt Daniel Love, U.S. Army Airborne – “Green Beret,” was among the BLM agents in the Bundy Ranch Confrontation. In 2010, he was with the 7th Special Forces Group. Sgt Love, part of Special Operations Detachment A (ODA), served in Afghanistan, Iraq and Pakistan. Several Special Forces Members were among the BLM agents during the standoff, according to information received by USMC. They were likely sent by President Obama. Why do we think that? Let’s look at it. An “A-Team” Daniel Love is part of an “A-Team.” ODA teams have 12 members. They are “self-sustaining and autonomous,” which means that they take orders directly from the White House. They are experts at insertion, and can survive in the middle of nowhere for extended periods of time. Let’s ask the question: why were they part of the action against the Bundy Ranch? Generally, Special Forces teams are deployed in other nations, not in the United States. But apparently, the White House felt the need to deploy extreme soldiers against a patriotic family in Nevada.     It appears that that the Special Forces members at the Bundy Ranch confrontation function not by oath, but by orders. Once you are a member of Special Ops, you remain a member until you retire or die. You work for the government, period. It’s all about the orders. And it appears that some of them, rather than follow their oath to the Constitution, have violated its most basic premise: that the fundamental principle of governmental power is derived through the consent of the governed. The “I’m right, you’re wrong” approach to the Constitution The following exchange was recorded between Daniel Love and Pete Santilli of the Guerilla News Network: Dan Love: “Yeah, don’t do that. That’s not gonna end well for ya. That doesn’t happen. And again, I’ve seen your numbers right now, you’d better hope that 10,000 show up…“

    Dan Love: “You’re telling me you’re gonna show up and arrest officers? That’s not gonna happen, Mr. Santilli.”

    Santilli: “If anyone is unconstitutional, is not following to abide by their oath to the U.S. Constitution, they are going to be arrested including the Sheriff of this county.” Dan Love: “I’m telling you right now I’m putting YOU on warning as the messenger, if you violate, if you impede, if you interfere with two lawful court orders, you will be prosecuted, you will be arrested.” Santilli: “They are unlawful court orders…. I did not come here to do anything but to give you the opportunity to prevent a scenario where you’re going to make a decision to cause harm to people.”

    Dan Love: “We’re lawfully here! Do you see all these signs? You’re in an enclosed area, you’re on federal land…”

    Santilli: “It’s not federal land.”

    Dan Love: “It is federal land. I am positive.”

    Santilli: “I’ll bet you lunch.”

    “Because of this standoff, I have looked into BLM’s authority to conduct such paramilitary raids against American citizens, and it appears that BLM is acting in a lawless manner in Nevada.” Steve Stockton, R-TX
    Congressman Stockton, in a letter, accused Obama of violating 43 U.S.C. Section 1733 Subsection C , citing the limited powers of the federal government. The Special Forces mandate In an article in the Washington Post last year, Admiral William McRaven, in charge of SOCOM,or Special Operations Command, said this before a Senate panel:
    “I can provide a global view of the problem [of extremists and terrorists] and help link and synchronize global effects across geographic boundaries.”
    Emphasizing that he works only with the approval of the president, defense secretary, geographic combatant commanders and U.S. ambassadors in countries involved, McRaven said he is developing a plan to network his “U.S. interagency counterparts and our foreign allies and partners around the world.”
    The President is responsible. All Army Special Ops personnel take their orders from the President. And they are hell bent to get “terrorists,” even though they may be innocent ranchers and “trespass” cattle. Who told the BLM to stand down? Was it really some magnanimous gesture on the part of their on-the-ground people, or faced with the amount of people against them, did someone from behind the scenes tell them to back off? What was the real purpose of having Green Berets at the standoff? Think about it.

    We know that the BLM wants this land bad, for whatever reason, and we cannot assume that it has nothing to do with solar power. One deal, with the Chinese, that fell through does not negate the fact that the BLM mentions the impact of Bundy's cattle in relation to the Dry Lake Solar Energy Zone. This is a screen shot from a document that has since been deleted from BLM.gov. Look at the last bullet point:



    So how do we make sense of all this? We probably won't for some time. The single Reid land deal that fell through was too easy. It seems to run much deeper than that.

    Senate Majority Leader Harry Reid (D-Nev.), who was exposed last Friday as the mastermind behind the Bureau of Land Management’s persecution of Nevada rancher Cliven Bundy, can be seen in this March 2014 photo breaking ground for a new solar farm near the Bundy Ranch, emphasizing that the senator’s plan for solar projects in Nevada wasn’t just limited to the shelved solar farm near Laughlin.

    Signaling the first day of construction of the Moapa Southern Paiute Solar Project, which is about 35 miles from the Bundy homestead in Bunkerville, Nevada, Sen. Reid joined representatives from the Moapa Band of Paiutes, executives from First Solar, Inc. and the Los Angeles Department of Water and Power for the groundbreaking ceremony on March 21.

    “First Solar is thrilled to celebrate this important milestone with Sen. Reid and distinguished guests, and honored to work with the Moapa Band of Paiutes on this landmark project,” Jim Hughes, the CEO of First Solar, said at the time.

    The development of solar farms just like this one is exactly why Sen. Reid was using the BLM, whose director is Reid’s former senior advisor, to push Bundy out of the Gold Butte area his family has worked for over 140 years.

    As we revealed last Friday in an article that became the #1 news story in the world for 24 hours, the BLM specifically stated that it wanted Bundy and his cattle out of the area as part of the agency’s “regional mitigation strategy for the Dry Lake Solar Energy Zone.”

    The BLM attempted a cover-up by deleting documents exposing the plan from its web site, but fortunately contributors at the Free Republic were able to save them for posterity.
    Other news outlets have attempted to whitewash the situation by suggesting that the solar farm development was only limited to the shelved 2012 deal between Sen. Reid and Chinese-owned ENN Energy Group in Laughlin, Nev., but by reading the BLM’s own documents it is quite obvious that this is not the case.

    “The BLM’s current action builds on the Western Solar Energy Plan, a two-year planning effort conducted on behalf of the Secretary of the Interior and the Secretary of Energy to expand domestic energy production and spur development of solar energy on public lands in six western states,” the BLM announced in a March 14 press release. “The Western Solar Energy Plan provides a blueprint for utility-scale solar energy permitting in Arizona, California, Colorado, Nevada, New Mexico and Utah by establishing Solar Energy Zones with access to existing or planned transmission, incentives for development within those Solar Energy Zones, and a process through which to consider additional Solar Energy Zones and solar projects.”

    “The Regional Mitigation Strategy for the Dry Lake Solar Energy Zone is the first of several pilot plans to be developed by the BLM,” the press release added.

    In summary, the BLM, acting under Sen. Reid’s corrupt interests, wants Cliven Bundy out of the 600,000 acre Gold Butte area so the agency can use the land for future solar projects and de facto buffer zones surrounding the solar farms.

    This is crony capitalism at its finest and Bundy’s supporters, who numbered in the thousands, knew it.

    Appearing on a local news program, Nevada Sen. Harry Reid once again weighed in on the continuing saga between federal agents and the Bundy family in Clark County. After Bureau of Land Management forces left the area earlier this month, Reid declared the ordeal was “not over” for the Bundys.

    Not only did he condemn patriarch Cliven Bundy, accused of withholding federal grazing taxes for the past two decades; he also referred to the hundreds of men and women who stood alongside the family as “domestic terrorists.”

    Reid doubled down on his rhetoric during the recent television appearance. He explained that he has been in contact with local Sheriff Doug Gillespie, Attorney General Eric Holder, FBI Director James Comey, and other high-profile figures in an effort to determine what the government’s next step will be.
    Responding to a question regarding the assembly of a federal taskforce, Reid proclaimed, “I assume that’s what they’re going to do.”

    He concluded that the parties involved “can’t just walk away from this,” predicting some abstract force that will compel the Bundys to comply with federal demands.

    “I don’t think it’s going to be tomorrow that something’s going to happen,” he said, “but something’s going to happen.”

    He concluded America is “a nation of laws, not of men and women.”
    That proclamation, however, seems to stand in stark contrast to Reid’s predilection toward excusing the criminal acts of illegal immigrants.

    Reid’s appearance was balanced by the state’s other senator, Republican Dean Heller.

    He said he was far more concerned about the excessive force used by BLM officers than the presence of protesters. Heller called the demonstrators “patriots,” contrasting Reid’s accusation that the group was made up of “domestic violent terrorist wannabes.”

    Heller said he wants to get to the bottom of the federal action in Clark County, explaining he is pursuing congressional hearings regarding the situation.

    “I want to find out who’s accountable for this,” he said. “I hope someone at the BLM feels some accountability on exactly what happened; and I fear that there will be no answer to that question.”

    The federal government owns 85 percent of the land in Nevada, he added, noting that is a major contributing factor in the ongoing overreach in his state.

    He concluded the outrage across America stemmed from the basic fact that “to have your own government with sniper lenses on you made a lot of people very uncomfortable.”
