Mug Shot: Jesus Oscar Dominguez


CLOVIS -- Jesus Oscar Dominguez was re-sentenced today to serve 27-years in prison, the maximum sentence, for the 2010 kidnapping and rape of a Clovis woman.

A Curry County jury found Dominguez guilty of these crimes in September 2011.

The charges stem from February 21, 2010 when authorities received a frantic 911 call reporting a rape had just occurred.

The victim told police that Dominguez knocked on her door and deceived her by saying he was friends with her father and that his car ran out of gas and asked to use the restroom and borrow a gas can.

Dominguez used the restroom and came out with a gun and forced himself on the victim.

The victim was unable to positively identify Dominguez, as he masked his face with a hooded sweater.

A rape kit was conducted where semen was collected and sent to the New Mexico Crime Lab for DNA examination. At the Crime Lab, the DNA specimen was entered into the Combined DNA Index System (CODIS).

The DNA collected at the scene matched with Jesus Oscar Dominquez, an illegal citizen from Mexico that was arrested for prior offenses and has an extensive history of being deported and illegal reentry. Dominguez happened to be in jail on separate charges of aggravated assault when the match occurred and authorities were able to serve him with an arrest warrant on charges of Criminal Sexual Penetration and Kidnapping.

On January 6, 2012, the Court sentenced Dominguez to serve 18 years in prison, making a finding that the Kidnapping charge was a second degree felony. The State filed an appeal on this issue and the Honorable Judge Quinn was reversed.

The case was remanded back to District Court for a resentencing hearing. Specifically, the Court of Appeals ruled that the Kidnapping charge was a 1st degree felony and Dominguez should be resentenced accordingly.
