Nebraska - Driver’s licenses for ‘Dreamers’ gain support in Legislature
Posted: Monday, April 6, 2015 12:30 am
By Joe Duggan / World-Herald Bureau
LINCOLN — Support continues to build for legislation that would end Nebraska’s status as the only state that denies driver’s licenses to young immigrants brought to the country illegally as children.
Twenty-five of 49 state senators have now signed on as co-sponsors of a bill that would afford driving privileges to young immigrants whose advocates refer to them as “Dreamers.” Although they lack legal status, a federal program allows them to stay in the country on two-year, renewable deportation deferrals.
Before senators who support the legislation can make their case for the Dreamers, however, the bill first has to get out of the Transportation and Telecommunications Committee.
When the committee considered the bill several weeks ago it received only two of the five votes it needs to advance to the floor. One senator voted against the bill, three abstained and two were absent.
State Sen. Jim Smith of Papillion, chairman of the committee, said Friday that if he determines that the bill has the support, he will bring it up for another vote.
The 25 senators who have signed on in support would be enough to pass the bill, which was introduced by Sen. Jeremy Nordquist of Omaha. The measure also has been designated a priority by Sen. John McCollister of Omaha, which means it almost certainly will be scheduled for floor debate.
“I owe it to Sen. McCollister, since he prioritized it,” Smith said. “As committee chairman I feel I do owe it to him to see if the committee wants to revisit the bill.”
In the committee, Sens. Les Seiler of Hastings and Curt Friesen of Henderson voted for the bill. Sen. John Murante of Grenta voted against.
The two members who were absent when the committee voted are split over the bill. Sen. Al Davis of Hyannis supports it, and Sen. Beau McCoy of Omaha opposes it.
Sen. Lydia Brasch of Bancroft abstained, but she has said she would find it difficult to support a measure that benefits those who broke the law to come to the United States.
Smith and Sen. Tommy Garrett of Bellevue also abstained. Both said Friday that they remain undecided on the bill.
About 2,700 young immigrants in Nebraska have been accepted into the Deferred Action for Childhood Arrivals program, started in 2012 by an executive order from President Barack Obama. Nationally, close to 600,000 have been granted deferred action status.
Some of the immigrants who have been blocked from obtaining driver’s licenses testified in support of the bill at a hearing in March. So did groups representing the livestock and restaurant industries, which say it makes sense that immigrants who are legally permitted to attend college or hold jobs should also be allowed to drive.
Former Gov. Dave Heineman instituted Nebraska’s policy of not issuing driver’s licenses to people given deferred action status. The governor argued that doing so would violate a state law that prohibits public benefits from being provided to illegal immigrants.
The American Civil Liberties Union of Nebraska has sued the state over the policy. A civil trial on the lawsuit has been scheduled for April 29 in Lancaster County District Court.
McCollister said he is confident that more than 25 senators would back the bill if it got to the floor. Ultimately it would need 30 votes if it were vetoed by Gov. Pete Ricketts, who has said he does not support granting driver’s licenses to illegal immigrants.
Supporters also could stage a vote to pull the bill out of committee, a move that would take 25 votes. But McCollister said he has all but ruled that out, saying he would much prefer that the committee take it up again.
“We’re hopeful that we can get it out,” McCollister said.

Aliens testifying, no problem, I do not think local authorities have authority to arrest them, that is only a federal responsibility. ICE is surely not going to arrest them. We do not have wild west rangers, who is going to stop them, it is not prioritized even by a majority of American voters. So, who is going to arrest them?

Republicans/Conservatives in Omaha, NE are outraged with the Republican Mayor and Senators endorsement and support for this bill. WE NEED YOUR HELP getting the word out because local media is keeping a lid on the Mayor's endorsement of LB 623. Unfortunately she has one speech for us and one for illegal aliens in South Omaha so people who donated, volunteered, promoted and voted for her are seething....ONCE they hear what she did. This is my most recent postingear Republican Omaha Mayor Jean Stothert, Your legacy will be helping Republican/Democrat Nebraska State Legislators dilute and make a mockery of the integrity of our VOTING SYSTEM via your push of Drivers Licenses for Illegal Aliens LB 623. Be sure to invite me to your hand holding, KumBaYa celebration with your South Omaha HISPANIC VOTING BLOC.

How upsetting to find out Sen. Laura Ebke added her name as a Co-Sponsor ESPECIALLY SINCE during her campaign she answered NO to my question on benefits/services for illegal aliens. I placed a call to her office this afternoon asking why she changed her support for illegal aliens.
