Rhode Island education leaders approved a policy that allows undocumented students to pay in-state tuition rates at public colleges and universities if they qualify, the first time a state legislature has not weighed in or voted on the issue.
The state’s Board of Governors unanimously supported the proposal in September. The governor had supported the provision and earlier in the week released a statement encouraging the Board of Governors to approve the policy.
The decision marks the state as the first to make the decision as a policy decision. In other states, including California, in-state tuition has been a legislative matter and has been voted on by state legislatures. California allows undocumented students access to in-state tuition rates and recently the governor signed legislation allowing qualified undocumented students to apply for financial aid.
Critics of the decision say the decision was unfairly removed from the legislative process. Every year for the last seven years the Rhode Island state legislature has rejected various proposals.
In Rhode Island about 140 undocumented students graduate annually from high school, and about half of them are in the process of attaining legal status, according to advocates and Providence news reports.

Policy = The cloak behind which politicians hide to circumvent The Rule of Law.
Policy allows politicians to claim to have passed laws that We the People wanted, all the while never intending to enforce such laws.
