    Gov. Jan Brewer has signed a bill creating a state militia that she could deploy at any time, and for any reason.

    The bill, SB1495, creates a volunteer state militia, separate and apart from the National Guard.

    Rep. Jack Harper, R-Surprise, who sponsored a near identical House bill, said this type of legislation couldn’t have come at a better time.

    Harper, who has previously said the governor would not be required to establish a state militia and who called the new state guard a “safety net” for the governor, said he thinks Gov. Brewer should call a militia to action right away.

    “I’m very excited that she signed it, of course,” he said. “With the national funding for the National Guard on the border expiring in June, I would like to see the governor sign an executive order that immediately establishes the guard.”

    Harper said he consulted several times with Maj. Gen. Hugo Salazar, the Arizona National Guard’s adjutant general, about how he would be able to utilize a volunteer militia if it were to be established and deployed to the U.S.-Mexico border. He called those conversations encouraging.

    The new state militia does not have a command structure defined, and Harper said the governor could put anyone in charge of the group.

    “That’s not spelled out in the legislation,” Harper said.

    Aside from potentially being deployed to the border, Harper said the new state guard could be used in the case of nuclear, biological or chemical attacks, or if there were a radiological leak at a nuclear power plant.

    “Decontamination is vital in that scenario,” Harper said. “And the volunteer force could augment first responders in that case.”

    Arizona Gov. Jan Brewer recently signed a bill, SB1495, allowing her, as governor of the state, to establish a state guard separate from the National Guard, to be used at any time which she (or any standing AZ governor) deems necessary.

    From SB1495:


    If the national guard of Arizona or a major portion thereof is called into active federal service, or if the national guard or a major portion thereof is alerted for federal service OR FOR ANY OTHER REASON THE GOVERNOR CONSIDERS TO BE NECESSARY, the governor may establish an armed force for the safety and protection of the lives and property of the citizens of the state which shall be known as the Arizona state guard.


    The Arizona state guard could be established and utilized for a whole plethora of situations, but most likely would include helping to secure the United States-Mexico border, or situations such as nuclear, biological or chemical attacks or accidents. In such instances, the state guard would be of great benefit to first responders, who lack a population of trained support staff.

    With a heavy National Guard presence at the United States-Mexico border in Arizona and National Guard funding for the border due to expire in June, Rep. Jack Harper, who sponsored a similar bill, said the measure couldn’t have come at a better time.

    According to a local newspaper, Harper, who has also previously spoken with the Arizona National Guard’s adjutant general about how to use a volunteer militia to secure the borders, states that he is “very excited that she [Gov. Jan Brewer] signed it.” He also expressed that he would like to see her sign an executive order to immediately establish the guard to help with securing the border.

    While the National Guard is not allowed to engage in direct hands-on law enforcement, they are an asset to the Border Patrol, helping to secure the border through surveillance, among other operations. But it’s not just about keeping illegal migrants out of the country either as drug smuggling operations are also a major concern with border security.

    In the past, there were some complaints about the heavy military presence in the area, though some local residents have expressed support for volunteer groups stating they they are helpful in deterring drugs and other illegal activities. Indeed, the influence of military tactics into homeland security measures have been something popping up more and more lately.

    AZ Gets State Defense Force Law; Now It’s Time to Act

    It sat on her desk for over a week, but yesterday Governor Jan Brewer (R–AZ) finally signed S.B. 1495 into law. The new law takes an important step and allows the governor to mobilize the Arizona State Defense Force (SDF) “for any reason” she sees fit.

    Arizona’s constitution has long allowed for the creation of an SDF. This latest law, however, removes many of the restrictions on mobilizing this force. No longer is the governor required to wait for the Arizona National Guard to be physically located out of state before calling up the SDF. Whenever the need exists, the governor may act.

    Brewer should certainly be applauded for not adding S.B. 1495 to the stack of vetoed bills yesterday afternoon. However, according to the Associated Press, it appears that while “Brewer believed it was prudent to sign the bill … [she] has no immediate plans to actually create the force.” The passage of S.B. 1495 does no good if it is not followed by action.

    Arizona must now “Put Up [Its] Guard!” and create an SDF. With little to no cost to the state or its taxpayers, an SDF would be an invaluable force multiplier and homeland security resourcefor the state of Arizona. In today’s age of strained financial resources and budget cuts, states like Arizona can ill afford to ignore the capabilities of these forces.

    To date, 23 states and territories have an SDF. It’s time that Brewer jump on board and make Arizona number 24.

    This Email went out to all Texas sheriffs this morning by Sheriff Elliott of Edwards county Texas in behalf of the Texas State Militia!

    Hello to all our Sheriffs in Texas.

    Dear Sheriffs of Texas, we at the Texas State Militia would love to invite all of you to a very special meeting here in Edwards County Texas At the Sheriffs dept. in Rocksprings May the 11th at 10:00 am to announce a very exciting and historical event, The revival of the Citizens Militia according to Subsection E of the Texas State Constitution.

    This event is being hosted by Sheriff Elliott of Edwards County. This meeting on the 11th is to introduce the Commanders of the Texas State Militia, to give you their contacts and to familiarize you all with the TSM intent and structured layout of the Citizen Militia here in Texas under the TSM.

    As we all know there has been a growing of interest in the Militia within the state of Texas and across the nation as well! This is a very good thing to see citizens wanting to be involved to help within their states to serve their communities, it is their right to do so legaly and safely with the Sheriffs supervision working with the Sheriffs Deputies in any event of the sheriffs’ choosing, whether the event is a disaster or a man made event!

    This is the Texas State Militia’s stance on these things! 1.Professionalism, 2. Safe unit Structures, 3. Serving the community.

    We also realize that there can be a danger to the call of Militia if we do not organize the Citizens Militia in a productive safe way involving our county Sheriffs so security and quality of militia members are to be maintained. The Texas State Militia is structured in such a way.

    We are excited to the prospect of having our Sheriffs ear and their hearts and we are seeking an endorsement from the Texas Sheriffs across the State.
