    Fifty-ninth Legislature Second Regular Session - 2008



    IN THE SENATE

    SENATE JOINT MEMORIAL NO. 111

    BY STATE AFFAIRS COMMITTEE

    1 A JOINT MEMORIAL
    2 TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CONGRESS
    3 ASSEMBLED, AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
    4 IDAHO IN THE CONGRESS OF THE UNITED STATES.

    5 We, your Memorialists, the Senate and the House of Representatives of the
    6 State of Idaho assembled in the Second Regular Session of the Fifty-ninth
    7 Idaho Legislature, do hereby respectfully represent that:

    8 WHEREAS, Section 4, Article 4 of the United States Constitution declares:
    9 "The United States shall guarantee to every state in this Union a republican
    10 form of government, and shall protect each of them against invasion; and on
    11 application of the legislature, or of the executive (when the legislature can
    12 not be convened) against domestic violence."; and
    13 WHEREAS, even conservative estimates of the number of illegal immigrants
    14 residing in the United States range from twelve million to twenty million,
    15 with some estimates as high as thirty million; and
    16 WHEREAS, the illegal entry into the United States by tens of millions of
    17 illegal immigrants approaches ten percent of this nation's population and
    18 should be considered an invasion; and
    19 WHEREAS, the federal government has allowed this illegal immigration inva-
    20 sion to occur at an accelerating pace for the last several decades; and
    21 WHEREAS, the North American Free Trade Agreement (NAFTA) and the Security
    22 and Prosperity Partnership of North America (SPP) are being used to nullify
    23 the Declaration of Independence and the United States Constitution.
    24 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-
    25 sion of the Fifty-ninth Idaho Legislature, the Senate and the House of Repre-
    26 sentatives concurring therein, that we emphatically urge and petition the
    27 President of the United States and the Congress of the United States and par-
    28 ticularly the congressional delegation representing the state of Idaho to
    29 honor their oath of office to "support and defend the Constitution of the
    30 United States" by passing the necessary and appropriate legislation to resolve
    31 the illegal immigration crisis by:
    32 (1) Securing our national borders;
    33 (2) Stopping illegal immigration, including the ending of government
    34 incentives for illegal immigration; and
    35 (3) Immediately implementing a guest-worker program that requires guest-
    36 workers to apply for work visas and that establishes compliance and
    37 enforcement standards.
    38 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is
    39 hereby authorized and directed to forward a copy of this Memorial to the Pres-
    40 ident of the United States, the President of the Senate and the Speaker of the
    41 House of Representatives of Congress, and the congressional delegation repre-
    42 senting the State of Idaho in the Congress of the United States.

    Statement of Purpose / Fiscal Impact


    STATEMENT OF PURPOSE

    The purpose of this legislation is to send the message to the
    Congress of the United States, and particularly the congressional
    delegation representing the State of Idaho that the Second Regular
    Session of the Fifty-ninth Idaho Legislature, the Senate and the
    House of Representatives concurring therein, that the Congress of
    the United States, and particularly the congressional delegation
    representing the State of Idaho, are hereby urged and petitioned to
    honor their oath of office to "support and defend the Constitution
    of the United States" by:

    (1) Securing our national borders;

    (2) Stopping illegal immigration, including the ending of
    government incentives for illegal immigration; and

    (3) Immediately implementing a guest-worker program that
    requires guest-workers to apply for work visas and that
    establishes compliance and enforcement standards.

    Yes, but notice provision #35, about the guestworkers, unless I am mistaken.

    Yes but these are really guest workers they come for the season and go home, they are not allowed to bring their family(no anchor babies) .

    We do need guest workers as we have lots of potatoes in Idaho but they don't need to be permanent...One season in the U.S. an illegal can live on the whole year in Mexico or other countries down there!!

    Yeah, I'm with TheOstrich on this one too. Guestworker program should be taken off, then it is perfect!

    This is what number 35 says:

    If they have a compliance standard and enforcement I'm all for it. In the past we had the Bracero Program and it worked until Ted Kennedy killed it, but then he likes to kill.

    We have a lot of agriculture here in Idaho. I don't mind them using a temporary work program as long as they apply from outside the country and are monitored to make sure they go home afterwards. Our Congress in Idaho is working on other things in this state that I will share with you all soon, but I can tell you that the majority of our elected officials here are totally against illegal immigration.

    When constituents contact Idaho Congress, the members respond personally. I've had three Representatives contact me by phone. One of them was on the House floor at time. These elected officials listen to the people, and they're not long implementing bills, even if they have to work week-ends to do it. They are a no-nonsense bunch and get the jobs done for the people here.
