    The death penality is legal and a viable option for those who commit the most heinous crimes in our society! It's an outrage (and unethical) for any DA to not to seek the death penality when warranted because he/she does not agree with it! You are representing the people of California! Not yourself! You only need to file the charges , the jury will decide if death is the appropriate sentence to be carried out.

    Further, I would suggest that anyone who is as strongly opposed to the death penality as Kamala Harris, probably should not be working as a DA, since she is allowing her personal feelings to interfere with her ability to carry out her job as she has sworn to do!

    Isn't it up to the jury to decide the punishment? Even if the DA doesn't want the death penalty, can't the jury override that?

    No in CA the DA can ask for the death penalty.

    Oh! I just thought of something. Since the DA is representing the Bologna family, MRS. BOLOGNA CAN PRESSURE HER TO ASK FOR THE DEATH PENALTY!! (I think my watching of all the Law&Order reruns is going to pay off. Hhahah)
