In a victory for the Los Angeles Police Department, a judge this morning threw out a lawsuit filed against the city by the mother of a 19-month-old toddler killed by a bullet fired by SWAT officers during an attempted hostage rescue in 2005.

The case before L.A. Superior Court Judge Rolf M. Treu was set to go to the jury this week after SWAT officers and police experts completed their testimony.

But Treu this morning granted the city's motion to dismiss the case, saying a jury could reach only one conclusion: that the officers acted reasonably.

Attorneys for Lorena Lopez, mother of 1 1/2-year-old Suzie Pena, argued in the trial that officers should have retreated and negotiated further with Raul Pena, who was delirious on alcohol and cocaine and holding his daughter hostage in the office of his car dealership on July 10, 2005.

The city contended that officers attempted the rescue in the best tactical way possible, and that the baby's father was the only one to blame for her death because he repeatedly held her as a shield during the hours-long standoff.

[Updated at 11:22 a.m. City Atty. Carmen Trutanich, who was being interviewed by The Times when a deputy city attorney came into his office announce the news, jumped from his chair with a cheer and high-fived the lawyer. Millions of city dollars had been in jeopardy, he said.

“This is a case where nobody wins except the citizens, because no one should have been sued in this case,â€

Absolutely amazing.

Only in this country could half-assed politicians set up a situation whereby illegal aliens are opening businesses in a country where they have abolutely no right to be in the first place and undermining the American business owner in the process.

I'm glad the judge dismissed the suit. It's tragic that this happened to a child but she wasn't a victim of the police.

She was the victim of her own parents. No one else. Let them......especially her neglectful mother who continued to expose her to a criminal father with a substance abuse problem......live with the reality of what THEY did to that child without having several million in taxpayer dollars in their pocket to "ease the pain".

As sad as the death of any child the Police Officers are not to be blamed. The death of the child is the result of her ILLEGAL parents and they are the only ones to blame. The ILLEGAL parents knew what they were doing! They intentionally entered the U.S. as ILLEGALS; if they had not entered the U.S. as ILLEGALS the child would not have been accidently killed by the LAPD.

We do not hear the same concern from the News media when U.S. Citizens are actually MURDERED by ILLEGALS!

It doesn’t seem to matter if it is Police Officer in Houston attempting to safe guard his city, a high school student in Los Angeles standing in front of his home while his mother is half way around the world defending her/our country, or a father and his sons in San Francisco driving home all became targets of ILLEGALS and were murdered because of the greed of "our" Elitist Politicians and their Elitist Contributors in search of "cheap labor" to help their "bottom line"!

Our FAMILIES are at the mercy of ILLEGALS and their Anchors being murdered, raped, infected with disease, or robbed. We can see the results of the ILLEGAL invasion in our courts every day! But NOT to worry the Chamber of Commerce will get their cheap labor increasing their privatized PROFITS while socializing the benefits for their ILLEGALS on the back of U. S. Citizens, thanks to our past and current Presidents, the Congressional Leadership(?), and local elected and appointed officials!

P.S. Houston, Los Angeles, and San Francisco are all SANCTUARY cities!

Why doesn't Lorena Lopez file suit against the dirt bag baby's father? But for his actions, this never would have happened.

Oh that's right... he has no money and this woman is looking for her multi- million dollar pay day from the tax payers of Los Angeles!

Another great start would be to deport these illegal invaders before they start taking babies as hostages while drunk and high, putting us all at risk !

The father was also killed in the gun battle with police.

That mother can't be all that since she laid down and procreated with a dopehead illegal alien. Birds of a feather flock together.
