ACLU of California Drops Videos and Hotline to Report ICE �Intimidating� Voters at Polls, Essentially Admitting Illegal Aliens Will Be Voting (VIDEO)

The American Civil Liberties Union of California has rolled out a new campaign of videos and a hotline aimed at stopping what it calls �voter intimidation� by Immigration and Customs Enforcement agents at polling places, just days before voting begins.

The organization insists that the presence of immigration officers may scare people away from voting.

However, the entire effort only makes sense if large numbers of noncitizens are showing up to vote, the very thing the ACLU and its allies have spent years denying happens at any meaningful scale.

Report sightings of ICE agents in your neighborhood to one of the rapid response networks operating across the Bay Area, Central Valley, Santa Cruz, Sacramento, and counties farther north.

These groups send volunteers who document immigration enforcement actions and help people assert their constitutional rights. The networks also verify reports of ICE activity and debunk rumors that can spread fear in immigrant communities.

If you do see ICE, take photos or video to share with the rapid response teams.

ACLU of California posted the materials on social media, including short videos warning that ICE agents cannot enter polling places or intimidate voters.

The popular X account Wall Street Apes posted a screengrab of one of the videos and pointed out, �their very next post on Facebook is telling people to vote against Voter ID� you can�t make this up.�

The organization set up a hotline for people to report any sightings of immigration officers near election sites and urged the public to document what they see.

The hotline number is 866-OUR-VOTE.

The campaign fails to explain that federal law makes it a crime for noncitizens to vote in federal elections.

American citizens are the only ones eligible and have no reason to be �intimidated� by ICE.

Noncitizen voting is illegal. Period.

The ACLU treating the possible presence of ICE agents as an emergency that requires a special hotline heavily indicates that the group expects noncitizens to be at the polls and wants to make sure federal agents cannot approach them.

California has some of the loosest election rules in the country, including widespread mail-in voting, same-day registration, and limited verification of citizenship at the point of registration in many counties.

Federal agents have arrested 10 foreign nationals in North Carolina this month, accusing them of illegally voting in several of the nation�s elections in recent years, Breitbart News has learned.

According to the Department of Homeland Security (DHS), nine green card holders and one illegal alien were arrested on October 14 and 15 and charged with illegally voting in federal elections.

�These aliens have been arrested and charged with illegally voting in multiple elections,� DHS Secretary Markwayne Mullin said in a statement. �They knowingly violated our laws. Now, thanks to the devoted patriots of HSI and our partners at the Department of Justice, these aliens will have to answer for violating the sacred right of Americans to elect their own leadership.�

Those foreign nationals arrested and charged are:

Edduard Omar Majano-Sosa, an illegal alien from El Salvador, charged with false claim to citizenship for illegally registering to vote in 2024 and voting by an alien. He illegally voted in the 2024 general election. He illegally entered the United States in July 2022 near El Paso, Texas, and was RELEASED into the country by the Biden Administration. He was arrested by HSI on October 15, 2026. He is facing an additional charge of prohibited person with a firearm for a pistol that was found in his vehicle during the arrest.

Karl Paul Fout, an alien from Germany, charged with false claim to citizenship for illegally registering to vote in 2008 and voting by an alien. He illegally voted in SEVEN general elections from 2008 to 2024. Fout�s criminal history includes prior convictions for TWO counts of possession of marijuana and cocaine with intent to sell and deliver and possession of cocaine.

He was arrested by HSI Cary on October 15, 2026. He was lawfully admitted to the United States in February 1960.

Lawton Caswell Broomfield E McKenzie, an alien from Jamaica, charged with false claim to citizenship for registering to vote in 2007 and 2012 and voting by an alien. He illegally voted in THREE general elections between 2012 and 2024. McKenzie�s criminal history also includes convictions for manufacturing, possession, or distribution of controlled substances and arrests for disorderly conduct while intoxicated by alcohol or drugs, battery, disturbing the peace, trespassing, communicating threats, assault, and driving while impaired. He was arrested by ICE on October 15, 2026. He was lawfully admitted to the United States in November 1986.

Lionel Paul, an alien from Haiti, charged with false claim to citizenship for registering to vote in 2024 and voting by an alien. He illegally voted in the 2024 general election. He was arrested by HSI Cary on October 15, 2026. Paul�s criminal history also includes arrests for fleeing/eluding arrest with a motor vehicle and assault. He became an LPR in October 2018.

James Edward Herrmann, an alien from Germany, charged with false claim to citizenship for registering to vote in 2018 and voting by an alien. He illegally voted in TWO general elections between 2018 and 2024. Herrmann�s criminal history also includes a conviction for larceny. He was arrested by the FBI on October 14, 2026. He was lawfully admitted to the United States in December 1983.

Ramona Abreu-Exia, an alien from Germany, charged with false claim to citizenship for illegally registering to vote in 2004 and voting by an alien. She illegally voted in EIGHT general elections from 2004 to 2024, as well as in the 2008 primary election. She was arrested by the FBI on October 14, 2026. She was lawfully admitted to the United States in October 1977.

Mervin Sylvester Bogle, an alien from Jamaica, charged with falsely claiming citizenship to vote.

He illegally registered to vote in 2024, and illegally voted in THREE general elections between 2008 and 2024. He was arrested by the FBI on October 15, 2026. He was lawfully admitted to the United States in February 1981.

Robert Harold Corbett, an alien from Canada, charged with false claim to citizenship for registering to vote in 1998 and voting by an alien. He illegally voted in SIX general elections between 1998 and 2024. He was arrested by the FBI on October 14, 2026. He was lawfully admitted to the United States in December 1963.

Ludgardys Olena Matthews, an alien from Panama, charged with false claim to citizenship for registering to vote in 2009 and voting by an alien. She illegally voted in THREE general elections between 2018 and 2024, as well as in the 2020 primary election. She was arrested by HSI Cary on October 15, 2026. She was lawfully admitted to the United States in October 1986 and was granted LPR status in September 2015 under the Obama Administration.

Gjina Gojcaj McDonald, an alien from Montenegro, charged with false claim to citizenship for illegally registering to vote in 2008 and voting by an alien. She illegally voted in SEVEN general elections from 2008 to 2024, as well as in the 2012 primary election and the 2019 special election. She was arrested by the FBI on October 14, 2026. She was lawfully admitted to the United States in February 1969.

Acting Immigration and Customs Enforcement (ICE) Director David Venturella said the arrests send a message that �election laws are not optional, and those who violate them will be held accountable.�

The arrests are part of a broader Trump administration initiative to weed out noncitizen voting in the nation�s elections.

Last week, for instance, ICE agents arrested Mukeshkumar Somabhai Chaudhari, a foreign national, in Minnesota after he was charged with knowingly making a false claim of American citizenship to vote in the 2024 election.

�Let this be a message to any non-citizens out there who are thinking about voting in our elections: If you illegally vote, we will arrest you, and you will be charged,� Mullin said. �Only American citizens should be electing American leaders.�

Muckraker caught multiple Democrat organizations allowing blatant voter fraud.

These suspect groups were caught attempting to register noncitizens to vote and mobilizing noncitizens and felons to vote in the upcoming election.

When Katie Hobbs was confronted with the findings, she ran away from questions.

Here�s what we found:

Stand Indivisible Arizona (endorsed Gov. Hobbs in their 2026 ballot guide) � Our journalist posed as a Canadian citizen and asked to register to vote. The canvasser not only agreed to help the alleged non-citizen register, but when asked whether other Canadians could register too, she said, �Tell them to do it online.�

Worker Power (working to re-elect Gov. Hobbs) � Our journalist told a canvasser they were not a U.S. citizen. Despite this, at our journalist�s request, the canvasser marked �yes� on the citizenship question of the voter registration form.

When We Count (the DNC�s own registration program) � Our journalist posed as a felon on probation and asked to register to vote. The canvassers looked up the law and saw that a felon on probation is ineligible. Even so, they encouraged our journalist to register: �You should just do it.�

AFL-CIO (phone bank mobilizing voters for Gov. Hobbs) � Our undercover journalist asked a phone bank trainer whether to ask the people being called if they�re citizens. The trainer�s answer: �We don�t care.�

First, Muckraker caught a volunteer for Stand Indivisible Arizona, a liberal nonprofit group backing Hobbs and other Democrats� campaigns, attempting to register a journalist posing as a Canadian citizen, as well as his Canadian friends at a voter registration drive at Paradise Valley Community College in Phoenix.

�We�re with, like, the county, Maricopa County, and Indivisible,� the woman said before telling Muckraker�s Anthony Rubin �all you need� is a driver�s license to vote in the state. When he purported to be a Canadian citizen here in the US on an F-1 student visa, the woman said she didn�t think he could legally vote, but she wouldn�t report him if he tried.

�Only if they�re voting on my side. I mean, I could not know. You have a driver�s license� That�s all I have to ask. Do you have a driver�s license?� she said. �The other thing you could do is you could go online, but I�d rather do it with you. But you can go online and register by this QR code.�

Many volunteers in Arizona are actually paid to register voters, with payments often being per voter.

When asked whether his �Canadian friends� could illegally register to vote, the woman told him, �take this and tell them to do it online,� and handed him a card with a QR code. �I mean it sounds like the better thing to do because you�re just again attesting to you have a driver�s license,� she said.

When later confronted, the woman fled and tried to deny ever saying what she was caught on camera saying.

In another encounter at the Phoenix Public Library, a Muckraker journalist posed as a noncitizen again while attempting to register with a volunteer from Worker Power, another nonprofit backing Hobbs� campaign.

The woman informed the journalist that he could not vote as a noncitizen but still allowed him to try.

When confronted, she fled and did not answer any questions. At the office of Worker Power, Rubin was evaded by an employee who claimed she was not with the nonprofit before she walked into their office.

The shady activity was also discovered at the Democratic National Committee�s national voter registration program, When We Count, where Anthony Rubin posed as a felon on probation. It is illegal in Arizona for felons to vote if their rights have not been restored. Under Arizona law, it is a felony when one �knowingly causes or procures another person to be registered as an elector� knowing that such other person is not entitled to such registration.�

Volunteers at Mesa Community College initially were unsure but still willing to register Rubin to vote. �If I can do it, I will register Dem right now,� Rubin said. �I don�t know for sure,� the woman said before double-checking the law and confirming that he could not register until �probation has been completed� and rights are restored. Still, one of the women said, �You should just do it� They�ll check.�

�So f*ck it, just send it through, and let�s see what happens?� Rubin asked, and she said, �Yeah.� They also refused to answer questions, denying that they endorsed the illegal registration.

Finally, they infiltrated a phone-banking operation at AFL-CIO, the state labor federation, which represents 100,000 union members across Arizona and backs Democratic candidates. While posing as a volunteer, a man who was training the journalist said �we don�t care� if the voters aren�t citizens. �Not our issue,� he added. �It�s none of our business.�

When asked about these findings at a recent get-out-the-vote and labor rally in Phoenix, Arizona, Katie Hobbs was rushed out of the room as staffers attempted to silence Anthony Rubin�s questions and reporting.

�What do you think about noncitizens getting registered to vote in this upcoming election? We�ve caught multiple organizations that are working to reelect Katie Hobbs that are willing to register noncitizens and felons. Katie, do you have any comment?� Rubin asked Hobbs as she was quickly shuffled out of the room.

�So Katie Hobbs has no comment on the situation where there are noncitizens getting registered to vote. It�s the most incredible thing,� Rubin said as the Democratic attendees began screaming and chanting �Katie.� �

These lemmings certainly don�t care. This is the situation out here in Arizona,� he added.

Democrats sue Trump administration over efforts to clean illegal registrants off voter rolls

Senate Minority Leader Chuck Schumer (D-NY) and other Democrats sued President Donald Trump and senior administration officials on Tuesday over the federal effort to identify noncitizens and other illegal registrants on state voter rolls, setting up a court fight as the administration steps up enforcement in California.

The 44-page complaint filed in Washington, D.C., federal court said the effort relies on �shoddily compiled lists of supposed noncitizens � target lists that have crumbled upon the barest inspection.� It argues that in Nevada, the Department of Homeland Security initially said it identified nearly 16,000 noncitizens registered to vote, then narrowed the figure to 185. Nevada officials told the federal government that all 185 appeared to be citizens, the suit said.
The Democrats argue the administration has no authority to direct state voter list maintenance or decide which voters receive ballots. �None of this is lawful,� the complaint states, adding that Congress left voter list maintenance to the states, subject to a limited federal enforcement power. The suit asks a federal judge to block Trump and other officials from threatening states that decline to remove registered voters.

The administration says it is acting to protect elections and enforce federal law. White House spokeswoman Lauren Bis told the Los Angeles Times it is �taking decisive lawful action to protect our elections,� including prosecuting election crimes and protecting voters from fraud and coercion.

U.S. District Judge James Boasberg, the chief judge of the D.C. federal court, was assigned to the case. Boasberg is an appointee of former President Barack Obama.
The lawsuit lands amid a mounting confrontation with officials in California.
On Oct. 15, the Justice Department sued California election officials, asking a judge to bar the state from counting mail ballots cast by people federal agencies identified as �likely� noncitizens until their citizenship could be verified. The department said it had sent the state a list of more than 20,000 names and faulted officials for not reviewing it in a timely manner. A subsequent letter was sent later in the week, telling officials that they could be held legally liable if they knowingly allowed any ineligible people to vote in the election.

California officials have characterized the information as unverified and declined to set aside ballots based on the list.
Four days later, federal authorities announced charges against 28 people in California as part of "Operation Protect the Vote." Prosecutors allege the suspects, all lawful permanent residents, illegally registered or voted in U.S. elections; at least 11 were arrested. The DOJ said each appeared on its list of likely noncitizen registrants.
The cases add urgency to the administration�s argument that states should cooperate with voter-eligibility checks. California Democratic Attorney General Rob Bonta has called the alleged instances �a drop in the bucket� compared with the state�s 23 million registered voters, while federal officials argue even a small number of unlawful votes can matter in close contests.

Department of Homeland Security (DHS) agents have reportedly been executing an operation in several states to root out potential noncitizen voters ahead of the midterm elections.

DHS agents have been knocking on doors in various states asking residents about their immigration status and if they have registered to vote or cast votes in past elections, CBS News reported.

The home visits dialed up in September, a few months from Election Day. On Monday, the Department of Justice announced that DHS agents in California arrested more than 20 green card holders for allegedly illegally registering to vote or casting votes, per the report.

As part of that investigation, dozens of agents reportedly responded to the residence of a 72-year-old man from Belize. The man was arrested �in his pajamas� and is accused of illegally voting in the past four elections, according to the report.

�HSI is actively rooting out and investigating election fraud wherever it can be found,� a DHS spokesperson told the outlet. �Under President Trump, HSI is committed to restoring integrity to our election systems and ensuring that American citizens and only American citizens are electing American leaders.�

Left-wing critics of the effort claim cracking down on noncitizen voting and sending armed federal agents to the doors of U.S. residents could be intimidating for legal voters.

�What we�re seeing now is the federal government is inserting itself into the state process for verifying their voter rolls in an unprecedented way,� said Jessica Marsden, a lawyer for Protect Democracy, a left-leaning advocacy group that is suing the DHS over the operation. �And they are doing it in a way that seems maximally designed to scare lawful voters from participating.�

A DHS spokesperson countered that claim, saying the effort is specifically aimed at �preventing the dilution of the votes of U.S. citizens.�

�Those who are here legally and are not breaking other laws have nothing to fear,� the spokesperson added.

Republicans on the House Judiciary Committee and House Committee on Administration issued a subpoena to Gov. Mikie Sherrill’s (D-NJ) acting secretary of state on Wednesday, seeking more information about the state’s noncitizen voter registration scandal.

The subpoena is the latest development in the saga over the 6,600 noncitizens who were placed on New Jersey’s voter rolls in what Sherrill called a “software error” that occurred under her predecessor, former Democratic Gov. Phil Murphy.

House Judiciary Republicans requested information from New Jersey’s secretary of state’s office over the incident in August, but on Wednesday said the response from Sherrill’s administration has been “inadequate.”

“The Department has produced only 12 total documents, and it has not produced any documents that explain how the alleged software error resulting in the registration of noncitizens was discovered or why noncitizens remained on the voter rolls until 2026—two topics about which the Committees specifically inquired,” the House Republicans wrote in the subpoena.

Reps. Jim Jordan (R-OH), Bryan Steil (R-WI), Jeff Van Drew (R-NJ), and Laurel Lee (R-OH), who each signed the letter, said the Sherrill administration’s response has “impeded the Committees’ ability to conduct oversight and consider legislative reforms.”

“These ineligible voter registrations raise concerns about the application of federal law in New Jersey as it pertains to accurate voter registration, as well as the effect that New Jersey’s failure to identify and remove noncitizens from its voter rolls has on the civil liberties of American voters and their ability to elect their representative,” the House Republicans wrote in the subpoena.

They are requesting that acting Secretary of State Shirley Emehelu produce all of the documents the committees have requested by Nov. 16.

Sherrill slammed the Republican-led subpoena as “political theater” on Wednesday, saying, “I’m focused on governing effectively. Republicans in Congress clearly aren’t.”

“I promised that when we discover a problem, we communicate the facts and fix it – and I meant it,” Sherrill said in a statement. “From the moment we discovered the [Motor Vehicle Commission] registration issue from 2023, we took action immediately, went above and beyond in making agency-wide reforms, and have been transparent every step of the way. We did this so that New Jerseyans can feel confident that we are running the strongest and fairest election in our country.”

“This stands in stark contrast to [President Donald] Trump and his enablers, like Jeff Van Drew and Jim Jordan, who are using their congressional committee not to do the work of the people, but for political theater,” Sherrill said. “That is what this subpoena is, plain and simple.”

The subpoena comes less than three weeks out from the crucial midterm elections, in which there are several swing districts to watch in New Jersey. Republicans have raised concerns about the security of the state’s voting systems in the lead-up to the election, given the noncitizen registration gaffe, while Sherrill has insisted her administration has quickly handled the “software error.”

Another layer to this saga is the fact that Republicans initially sent the August request for documents to then-Secretary of State Dale Caldwell, who resigned in September over sexual harassment allegations. Sherrill had called for Caldwell’s resignation and tapped Emehelu to the acting role at the end of September.

On Monday, Shah felt particularly dizzy and unwell as he came to the realization he was the subject of federal prosecution and at the red-hot center of an increasingly tense debate between California and federal officials over the security of the state�s elections.
�I can hardly walk and talk,� Shah, who is 68, said. �Now I have to face these charges.�
In November 2024, inspired by the presidential campaign of former Vice President Kamala Harris, decided to see whether a new driver�s license and his ongoing application for citizenship meant he could cast a vote for the first time in his three-decades of living in the United States. He visited a Sacramento County polling place and handed over his identification. An election worker gave him the OK and a ballot, Shah told The Sacramento Bee.
So he cast a vote. He has not cast one since. A ballot, the one California sends to all its registered voters, sat unopened in his apartment on Monday.

He knew he wasn�t supposed to vote and yet still went to the polls to vote, and the idiot poll worker illegally gave him a ballot and then he voted. And the People�s Republik of California considers him registered and send him ballots, which puts the notion that California is doing what it is supposed to do to keep non-citizens from voting. Again, what these Democrat paradises do is allow alien (that�s both legal and illegal people) voting for state, county, and local politicians and issues, which means they get ballots which include federal politicians, often with an admonition that they cannot mark those positions wink wink.

On Nov. 15, U.S. Department of Homeland Security agents visited Shah, he said, and asked him about voting in that election. They told him the federal government was going to seek to cancel his application for citizenship, because he�d voted illegally.
On Friday, he received a notice to appear in the U.S. District Court in Sacramento on Nov. 6. He was charged with voting as an alien in a federal election, a misdemeanor charge that carries penalties of as much as a year in prison or a fine as high as $100,000. Shah falsely declared himself a U.S. citizen on Nov. 5 when he cast his ballot, according to the complaint against him. (snip)

After a grand jury indicted a handful of voters in North Carolina on federal charges of illegally voting as a noncitizen, some of the defendants, who are longtime legal residents of the country, had strong words to share in response.
�It�s just jacked up,� Lawton McKenzie, a Wayne County resident originally from Jamaica, told reporters outside the courthouse on Thursday.

McKenzie said he voted after receiving an invitation in the mail to register.
�If y�all mail stuff out to people and y�all send people out to come and sign up � that�s entrapment,� he said, noting that he showed his permanent resident card as identification when he registered to vote.

As a permanent resident he 100% knew he was not eligible to vote, it�s right there in the law, regardless of being sent anything.

A foreign national is accused of illegally voting in the 2024 presidential election in Minnesota, Department of Homeland Security (DHS) officials revealed on Friday.

Immigration and Customs Enforcement (ICE) agents arrested Mukeshkumar Somabhai Chaudhari, a foreign national, after he was charged with knowingly making a false claim of American citizenship to vote in the 2024 election.

�Our message to aliens who vote in American elections is clear: we will find you, arrest you, and you will face the consequences, including criminal charges and deportation,� DHS Secretary Markwayne Mullin said in a statement: �Under President Trump�s leadership, this administration will never allow the votes of American citizens to be cancelled out by non-citizens illegally voting in our elections. Only American citizens should be electing American leaders.� [Emphasis added]

Last month, a federal grand jury in Minnesota indicted Chaudhari on two counts of making a false claim of citizenship to vote.

Federal prosecutors allege that in November 2024, Chaudhari signed a voter signature certificate, swearing that he was an American citizen. Chaudhari, prosecutors allege, is not an American citizen and knew he was not when he signed the document.

�Voting is reserved for U.S. citizens, and falsely claiming citizenship to cast a ballot is a serious crime,� ICE�s Travis Pickard said. �[Homeland Security Investigations] has the experience and authority to investigate these cases, and we take that responsibility seriously. We will continue working with our law enforcement partners to protect the integrity of our election systems.�

Chaudhari is facing up to ten years in prison if convicted of both counts.

Feds arrest alleged noncitizen voters in California amid broader election fight with state

Federal authorities have charged 28 people from across California with illegally registering to vote or casting ballots in federal elections despite not being U.S. citizens � again escalating an election battle between the state and the Trump administration just weeks before the Nov. 3 midterms.

Authorities said 11 of the 28 were arrested as of Monday morning and that the 17 others �will be in custody in the near future.� Some of the 28, all of whom are lawful permanent residents of the U.S., are charged with lying about registering or voting on their naturalization paperwork, officials said; 21 of them are suspected of casting votes, some in multiple elections. None are undocumented immigrants, a favorite target of President Trump and a group he has accused of infiltrating U.S. elections in the past.
Those charged represent a tiny fraction of the 20,000 �likely noncitizens� that the Justice Department alleged are on California rolls just last week, and an even tinier fraction of the more than 190,000 noncitizens the Trump administration alleged were on state rolls as recently as July.
State officials have previously warned, along with independent elections experts, that the Trump administration has badly overstated voter fraud claims in other states. In Nevada, for example, officials recently found that all 185 people the Justice Department flagged as potential noncitizens were in fact citizens. The administration has repeatedly revised downward its estimate for how many �likely noncitizens� are on California�s rolls.

Acting Deputy Atty. Gen. Trent McCotter cast the arrests during a Monday news conference as proof that California voter rolls are corrupted and need to be purged to prevent noncitizens from negating the legitimate votes of U.S. citizens, and that California officials who have rebuffed recent Trump administration efforts to purge the state�s rolls are willfully obstructing justice.
�This Department of Justice will not look the other way while non-citizens vote in federal elections,� McCotter said. �Unfortunately, the same can�t be said for California and L.A. County.�
State and local officials � some of whom are being sued by the Justice Department over their handling of the broader claims � said voter fraud should be taken seriously, but that isolated cases are not evidence of widespread problems and that any voting allegations from the Trump administration must be viewed with skepticism.

Los Angeles County Supervisor Janice Hahn referred to Monday�s arrests as �voter intimidation and a blatant attempt to undermine trust in our midterm elections.�
�These arrests are being used to paint a picture of widespread voter fraud when we know that is not the case,� Hahn said. �California has laws in place to protect the integrity of our elections, and L.A. County is fully abiding by them.�
California Atty. Gen. Rob Bonta�s office said the 28 individuals charged Monday �represent a tiny fraction� of California�s 23 million registered voters, and that the Trump administration has not shown �evidence of widespread voter fraud, even if the allegations are true.�
Shifting claims

For months, federal prosecutors have been issuing grand jury subpoenas for voter records in California � suggesting a sweeping criminal investigation was underway.
In July, Homeland Security Secretary Markwayne Mullin asserted in a letter to California Secretary of State Shirley Weber that California may have more than 190,000 noncitizen voters on its rolls. Last week, McCotter wrote letters to Weber and Dean Logan, head of the L.A. County Registrar-Recorder/County Clerk�s office, giving them 48 hours to set aside the ballots of about 20,000 voters the Justice Department said were �likely noncitizens.�

When Weber and Logan balked at the demand � arguing the Justice Department had provided no proof the voters were ineligible, had presented similar and inaccurate claims in other states and had made the request too close to the upcoming election � the Justice Department sued Thursday, asking a court to immediately intervene and force the state and L.A. County to comply with McCotter�s demands.
In a filing in that case Monday, federal authorities cited the latest charges as more reason for the court to intervene, and before the election, to segregate out the flagged ballots until those voters� citizenship can be verified � again raising uncertainty as to their citizenship status despite alleging during their news conference Monday that all were permanent residents.
�This Court should order California to set aside vote-by-mail ballots from likely noncitizens in the federal election � including any ballots cast by the individuals charged with [federal election] crimes this morning � until the voter�s citizenship status can be determined,� federal attorneys wrote.

The Trump administration�s apparent uncertainty about the citizenship of the voters it has flagged � and even those it�s charged � has been a focus of state and local officials. Bonta and others have questioned the drop from 190,000 to 20,000 and repeatedly pointed to what occurred in Nevada, where federal officials initially flagged more than 15,000 potential noncitizen voters. Independent election experts have also highlighted those discrepancies.
Rick Hasen, director of the Safeguarding Democracy Project at UCLA School of Law, wrote online Monday that the data the federal government relies on to find purported noncitizens are �unreliable.� He wrote that the Justice Department�s demands on California risk �disenfranchising thousands of voters, and from DOJ�s track record, the lion�s share will be eligible voters.�
David Becker, executive director of the nonpartisan Center for Election Innovation & Research, said the 28 alleged noncitizens charged represent �.0001% of California voters,� and that the Trump administration charging 28 people days after flagging 20,000 �raises serious questions as to whether DOJ has any evidence at all supporting their claims on the other 19,972 on their list.�

McCotter said the original 190,000 figure was �the ceiling,� while �20,000 is the floor� � with the larger figure representing individuals the administration had low, medium or high levels of confidence were noncitizens, and the smaller figure representing only those it has high confidence are noncitizens.
�So there�s not inconsistency between those numbers. They�re just looking at different levels of confidence,� he said.
McCotter also said the notion that a federal list of more than 15,000 alleged noncitizens in Nevada had resulted in zero noncitizens being found was a �false storyline,� in part because the larger group was never vetted by the state. However, he also acknowledged that the 185 that were vetted � and found to be citizens � were those the federal government had held �high confidence� in being noncitizens.
How the Justice Department further zeroed in on the 28 charged individuals also was not entirely clear.

U.S. Atty. Craig Missakian, the top federal prosecutor in Northern California, said prosecutors compared information from Homeland Security with voter information they subpoenaed from Weber�s office and various county election offices. Some of the criminal complaints said Homeland Security Investigations received investigative referrals from its Identity and Benefit Fraud Unit, which provided �relevant information regarding alleged voter fraud or related identity-based fraud indicators.�
Kevin Murphy, special agent in charge of Homeland Security Investigations in San Diego, said the underlying investigations were not �based on assumptions or a single piece of information,� but required �thorough investigative work, coordination, and a commitment to ensuring that enforcement action is supported by the facts.�
Those charged include 13 people from the Central District of California, who live in Los Angeles, Long Beach, Rancho Palos Verdes, Anaheim, West Covina and other cities. They hail from a mix of nations, including Belize, Canada, El Salvador, Guatemala, Honduras, India and Mexico. Five others were charged in the Northern District of California, with one from San Francisco and others from the wider Bay Area; four in the Southern District and six in the Eastern District.

First Assistant U.S. Atty. Bill Essayli, the top federal prosecutor in L.A., dismissed the idea that such fraud is rare or that Trump officials are overstating the threat. �This is not a conspiracy theory,� Essayli said. �This is not made-up stuff.�
Essayli specifically highlighted the case of 72-year-old Omar Mu�oz from Belize, who was arrested in a pre-dawn raid Monday at his home in Commerce. Federal authorities allege that he fraudulently registered to vote in 2019 and voted in 2020, twice in 2022 and again in 2024. He is also accused of lying on his naturalization application.
In federal court downtown late Monday, Mu�oz�s daughter Lliani Orantes, a nurse born in the U.S., said the family was trying to figure out what happened, after federal officials swarmed their block and took her father, who is recovering from a recent surgery.
She said her brother, a registered voter, shares her father�s name, as does a nephew, and the family is wondering if it is all a mix-up. �Did the names get misconstrued?� she wondered.

McCotter said in the last seven weeks, the Trump administration has charged 113 people across 20 states with voting-related crimes. More than 154 million people voted nationally in the 2024 presidential election.
What�s ahead

Federal officials said their work � dubbed �Operation Protect the Vote� � would continue through the election and beyond.
Essayli said California�s own process for verifying voters� citizenship, including requiring that they attest to being a citizen when they register, is insufficient. He said California election officials have �no idea who is a citizen,� but also know �they have noncitizens who are getting ballots as we speak� and several years ago admitted in an audit that noncitizens were being registered at the DMV.
�When we submit a list of 20,000 noncitizens to California that we are pretty sure are not citizens, it is outrageous that the response from the state is, �We don�t believe you and we�re not even going to look at it,�� he said. �That is not good faith actors. They are being complicit.�

McCotter said there �may be some names� on the list of 20,000 flagged voters �who, it turns out, ultimately are citizens.� He said federal authorities are �not perfect,� which is why they�ve asked California officials to work with them. �We could knock through most of these names pretty quickly, probably in a day or two, if California would work with us.�
He said the timeline � amid an ongoing election � was due to state officials refusing to cooperate sooner. �It�s an emergency of their own creation.�

The Justice Department on Monday morning charged 28 non-citizens for registering to vote in California.

11 of the defendants have been arrested so far.

Federal law enforcement throughout California today arrested 11 foreign nationals living in the United States who are charged in criminal complaints with federal crimes, including that they fraudulently registered to vote in U.S. elections, electoral contests in which most of them cast illegal and fraudulently obtained ballots.

Today�s arrests are part of �Operation Protect the Vote� � a coordinated effort among all four California-based United States Attorney�s Offices to combat and root out fraud in U.S. elections and protect electoral integrity.

All 28 foreign nationals charged are lawful permanent residents (LPRs), or �green card� holders.

Although LPRs have legal immigration status in the United States, they are not U.S. citizens and are not permitted to vote in U.S. elections.

The criminal charges include making false statements in a naturalization application and some of the defendants also are charged with fraudulent voter registration. Both charges are felonies that carry a statutory maximum sentence of five years in federal prison.

First Assistant US Attorney Bill Essayli announced the arrests and charges on Monday during a press conference.

�Today�s arrests prove what we have been saying,� said Essayli.

�California is mailing ballots to noncitizens, and they are refusing to comply with federal law, which makes it a crime for noncitizens to vote. The voting rights of American citizens must be protected,� Essayli added.

�Every illegal vote cancels out the vote of a lawful American citizen,� said Acting Deputy Attorney General Trent McCotter.

�Each of the 28 defendants charged today appears on the list of more than 20,000 likely noncitizen registrants we provided to California election officials last week. California refused to look at that list.

Today�s charges show exactly what that refusal puts at risk. California must verify the citizenship of those more than 20,000 registrants before mail-in ballots are counted,� McCotter said.

�These are not isolated instances,� Essayli said.

California's Automatic Voter Registration and Mail Ballot Process

Under California law, every registered voter is mailed a ballot, according to the Justice Department press release [1][2]. That combination, universal mail balloting layered on top of the state's automatic voter registration system, is at the center of the federal complaint.
In California, eligible voters who apply for a driver's license, ID card, or change of address are automatically registered unless they opt out, according to state procedures. Justice Department officials argue that this system creates conditions for fraud, a concern echoed by federal prosecutors who have accused California of denying them access to voter registration records [3].
The lawsuit follows an investigation by Homeland Security Investigations (HSI) in which the agency reviewed voter registration data for possible foreigners registered to vote [4]. HSI said it analyzed publicly available voter registration records to identify likely noncitizens who could receive election-related mail. The complaint alleges thousands fit that category [4].
The Justice Department's lawsuit says the federal government sought to "work collaboratively" with California to identify noncitizens registered to vote in the state, and that California made no effort to do so [5].
Judicial Watch has previously argued that California and some of its counties, including Los Angeles County, have registration rates exceeding 100% of the age-eligible citizenry [6]. According to data provided to and published by the Election Assistance Commission, Los Angeles County has more voter registrations on its voter rolls than it has citizens who are old enough to register [6].
Eleven of California's 58 counties have registration rates exceeding 100% of the age-eligible citizenry, according to the same analysis [6].
Federal Complaint and Emergency Request

The Justice Department asked the court for an emergency order requiring California to sequester ballots returned by the suspected noncitizens and verify their citizenship status, Essayli said [1].
The complaint seeks to prevent California from tabulating vote-by-mail ballots from suspected noncitizens in the upcoming midterm elections until citizenship is verified, according to the filing [7]. According to reports, the Justice Department seeks to stop tabulation of more than 20,000 California mail ballots until immigration status is verified [7].
This is not the first time the Justice Department has moved to force California to release voter registration records [3]. Back in June, Essayli announced that his office was partnering with the FBI on multiple election-related investigations, accusing California of blocking a voter roll audit [3].
The Justice Department has also warned state officials they can be prosecuted if they let noncitizens vote, with Assistant Attorney General for Civil Rights Harmeet Dhillon sending letters to all 50 states after the U.S. government conducted reviews that found tens of thousands of noncitizens have made it onto state voter rolls [8].
A Clinton-appointed federal judge previously dismissed the Justice Department's bid to access California's voter registration databases, ruling in January 2026 that the demand for voter data from California Secretary of State Shirley Weber was "unprecedented and illegal" [9]. U.S. District Judge David O. Carter sided with California in a 33-page decision [9]. That prior ruling underscores the legal hurdles the DOJ faces in its latest action.
The Justice Department earlier dropped off a thumb drive with a list of people it believes could be noncitizens who registered to vote with the office of Los Angeles County Registrar-Recorder Dean Logan [10].
Federal authorities have recently announced arrests of people alleged to have voted illegally as noncitizens.
On Aug. 28, federal officials arrested a foreign national living in California who they say illegally registered to vote and made false statements [14]. Darwin Jonathan Rivera Flores, 30, was a Honduran national and lawful permanent resident living in Southern California, and is accused by prosecutors of making felony false claims of being an American citizen on voter forms [15]. He faces two charges: making a false claim to U.S. citizenship and fraudulent voter registration [15].
No court ruling had been issued as of the reports, leaving the status of the 20,000 flagged registrations and any related ballots unresolved. The Justice Department has previously sued Orange County in California for allegedly concealing records that could expose noncitizens illegally registered to vote [16].
The Justice Department has also expanded its crackdown, suing Utah, Oklahoma, West Virginia, Kentucky, and New Jersey for hiding inaccurate voter rolls [16]. That broader campaign indicates the California action is part of a greater federal effort.

California's voter registration system relies on applicants attesting to their own citizenship, and county officials argued that the system obligates them to count ballots from registered voters. The Trump administration disagrees.
"They will all go to jail for a long period of time!!!" Trump wrote on Truth Social on Oct. 16. He attached a copy of a Justice Department letter to Los Angeles County that promised "significant" consequences for "facilitating or ignoring" noncitizens voting in a federal election.
"The legal consequences for either facilitating or ignoring a federal crime are significant," the letter reads. "Noncitizen voting in a federal election is a federal crime-and knowingly facilitating such conduct is equally unlawful. Under 18 U.S.C. � 611(a), noncitizens are prohibited from voting in any election involving federal offices."
The letter continued:

Under 18 U.S.C. � 2, anyone who aids, abets, counsels, induces, or procures the commission of a federal offense is equally liable. If persons knowingly tabulate ballots cast by individuals identified by federal agencies as noncitizens, they risk becoming aiders and abettors to a federal crime. Your assertion that ballots must be counted simply because California's registration system relies on self-attestation does not relieve election officials of their obligations under federal law when they are on actual notice of noncitizen voting. Nor can state procedures supersede federal criminal statutes.

Trump's post followed a week of escalating federal action. Earlier in the week, the DOJ mailed California election officials a USB drive containing voter roll citizenship data, then sent a separate letter with the password needed to open it. According to a report from The Hill, the state had 48 hours to compare 20,000 names that the Department of Homeland Security (DHS) identified as non-U.S. citizens against its own voter rolls.
On Thursday, the DOJ sued California. "If California was unable to independently confirm the citizenship of people on that list, the Federal Government asked that California set aside ballots received from them until the person's citizenship was confirmed," the lawsuit reads.
Under this approach, the state would hold the ballots in question until officials verified the voters' citizenship. The lawsuit does not ask California to discard the ballots outright.
Earlier this year, Trump said California and three other states together had 250,000 noncitizens on their voter rolls. His opponents dispute that number.
California Democratic Gov. Gavin Newsom called the lawsuit a "sad, desperate attempt by Trump to use his politicized Justice Department to try to suppress California voters just three weeks before Election Day."

"The courts have made clear that the federal government has no role in how a state carries out its election process, and now, in the middle of Californians voting, they have asked local officials - who do a damn good job defending democracy - to violate federal law," Newsom said, but did not specify which federal law he claims the DOJ's request would require local officials to break.
Outside groups have also moved against the administration. In September, the UCLA Voting Rights Project sued the DOJ and DHS, challenging the method the administration used to count noncitizens registered to vote. The group plans to seek a temporary restraining order if the administration does not drop its plans for a criminal crackdown on state officials.
"Your clients' actions in compiling the list violates established law; your efforts to employ this list to systematically purge voters, less than a month before the election, further violates the National Voter Registration Act, among other laws," attorneys for the group claimed in their latest letter to the DOJ.

Another alarming election-integrity report is raising serious questions about who has been voting in American elections and how thousands of allegedly ineligible ballots could have slipped through the cracks in the red state of Florida.

A new investigation by a coalition of Florida election-integrity organizations claims that 1,827 noncitizens who were removed from the state�s voter rolls cast a staggering 7,035 ballots between 2020 and the second quarter of 2026.

The findings, first reported by The Daily Signal on Wednesday, October 14, come as the Trump administration continues its efforts to tighten voter registration requirements and prevent noncitizens from participating in American elections.

According to the report, a Joint Task Force of Florida election integrity groups examined voter registration and voting histories across all 67 Florida counties.

The coalition reported the following figures:

5,612 noncitizens removed from Florida�s voter rolls during the period examined.
1,827 of those individuals allegedly cast a combined 7,035 ballots.
Approximately 600 individuals were referred to Florida�s Office of Election Crimes and Security.

The report warns that the number of ballots attributed to individuals subsequently removed from the rolls could be significant in tightly contested elections.

Consider Florida�s November 2021 Democratic special primary election for the state�s 20th Congressional District, where the winning margin was just five votes.

The report also cited a 2018 Baker County School Board race decided by only three votes.

The coalition argued that the ballots it identified were numerous enough to potentially influence closely contested races.

The latest findings follow a major election fraud crackdown announced by Florida Governor Ron DeSantis and Attorney General James Uthmeier last month.

As The Gateway Pundit previously reported, Florida officials announced on September 24 that 20 individuals faced charges in an election fraud investigation.

Sixteen defendants were noncitizens accused of falsely declaring themselves U.S. citizens before casting ballots. The remaining four were convicted felons accused of voting while still on probation.

Uthmeier declared:

Florida will not allow anyone to steal the vote of Americans at the ballot box.

The cases brought Florida�s total election fraud prosecutions above 100 since DeSantis established the Office of Election Crimes and Security in 2022.

The Gateway Pundit has extensively documented the Trump administration�s election integrity investigations.

In March, The Gateway Pundit reported that Assistant Attorney General Harmeet Dhillon disclosed troubling findings from a federal examination of voter registration records.

That review raised concerns about noncitizens, deceased voters, and duplicate registrations in state election databases.

In July, The Gateway Pundit reported that Dhillon�s Civil Rights Division warned election officials across all 50 states and Washington, D.C., about their obligations to maintain accurate voter rolls and prevent unlawful voting.

The administration�s aggressive approach has also encountered legal setbacks.

On October 9, U.S. District Judge Sparkle Sooknanan ruled against a Justice Department voter-data collection initiative, finding that the federal government�s approach exceeded its authority and violated legal protections.

According to The Daily Signal, officials in several Florida counties declined to validate the coalition�s conclusions without examining the underlying data.

Palm Beach County Supervisor of Elections official Alison Novoa said her office could not independently verify the numbers or conclusions presented by outside organizations.

The Trump Justice Department is forcing Gov. Gavin Newsom�s (D) California to review a list of possible noncitizens on the state�s voter rolls or face legal action.

California Secretary of State Shirley Weber received the letter, alleging that the state may have mailed ballots to noncitizens ahead of the pivotal midterm election November 3. In the letter, acting deputy U.S. attorney general Trent McCotter asks the state to review a list of names of individuals who received ballots that may be for noncitizens and gives them 48 hours to do so.

Notably, California mails ballots to all voters.

�On July 16, Secretary [Markwayne] Mullin made you aware that there are likely numerous noncitizens registered to vote in the federal election in California,� the letter reads, noting Department of Homeland Security Secretary Markwayne Mullin asked for cooperation in addressing the issue.

�Your response the following week did to refute that noncitizens are registered to vote in California,� the letter continued, adding that the answer did not contest that �noncitizens receive ballots through California�s vote-by-mail regime, which automatically sends voting materials to �every registered voter.'�

The letter explained that it provided a password-protected thumb drive with a list of names to the Los Angeles County Registrar-Recorder/County Clerk and would provide the office with a list as well if given a secure email address. It gave them 48 hours to review the list and take appropriate actions or face legal trouble.

�For individuals whom you cannot independently confirm citizenship status, we request that you immediately instruct the appropriate elections office to segregate � not cancel � those individuals� vote-by-mail ballots until their citizenship status can be determined,� it continues.

�The United States hopes that you share our commitment to ensure that only American citizens participate in our federal elections,� the letter reads. �Allowing noncitizens to vote cancels citizen votes.�

�States are responsible for voter registration, and the Federal Government is responsible for maintaining immigration records to enable verification of citizenship,� it adds. �Working together, we can more effectively protect against voter dilution and promote election integrity.�

�If you cannot implement this process by then, given the ongoing federal election, the United States will have no choice but to seek emergency relief,� the letter states.

Weber�s office, however, released a statement on Wednesday, acknowledging it did not directly receive any kind of list to review to their office, specifically. Rather, a thumb drive was provided to the Los Angeles Registrar-Recorder County/Clerk�s office, as detailed in the Department of Justice (DOJ) letter. Weber�s office also claimed Mullin�s claims of noncitizens on the voting rolls are �unsubstantiated.�

�The U.S. DOJ�s relentless efforts to unlawfully gain access to states� protected voter data and purge voter rolls serve only to cause chaos and fuel public distrust in our elections,� Weber said in a statement. �California has robust state law requirements that only U.S. citizens can register to vote and that any non-eligible registrants are removed from the State�s voter rolls. My office and California election officials remain committed � as always � to ensuring a fair and smooth 2026 General Election.�

A foreign national was arrested and charged last week after allegedly illegally voting in the 2024 presidential election in the swing state of Pennsylvania, Breitbart News has learned.

Paulo Jorge Silva, a green card-holder from Portugal, was arrested by Immigration and Customs Enforcement�s (ICE) Homeland Security Investigations (HSI) agents on October 5 in Philadelphia.

Silva, federal prosecutors allege, was illegally registered to vote and illegally voted in the 2024 election.

Following his arrest by HSI agents, Silva was turned over to the United States Marshals Service.

�This alien from Portugal has been charged with illegally voting in the 2024 election in Pennsylvania,� Department of Homeland Security (DHS) Secretary Markwayne Mullin said:

When even one non-citizen votes in our elections, it steals the vote of an honest, hardworking American citizen. It�s also against the law. If we catch an alien illegally voting in our elections, we will hunt you down and arrest you. You�ve been warned. WASHINGTON — Former Englewood Cliffs Mayor Mario Kranjac is urging the Trump administration to dispatch federal election monitors to New Jersey in response to revelations about hundreds of non-citizens casting votes.
Kranjac penned a missive to Attorney General Todd Blanche and U.S. Attorney for the District of New Jersey Robert Frazer arguing that the Garden State’s voter roll issues “warrant further federal scrutiny.”

“The state has not disclosed the magnitude of the problem or the identity of non-citizen registered voters, which likely results from our Governor’s continuation of unlawful sanctuary state policies that provide certain protections and services to noncitizens at taxpayer expense,” Kranjac wrote in the letter.

In July, New Jersey Gov. Mikie Sherrill announced that 6,600 people who answered “no” to a question about whether they had US citizenship were added to the voter rolls and about 400 of them cast ballots in elections dating back to 2023.
She blamed it on a “serious software error” in the state’s Motor Vehicle System involving a vendor, French tech company IDEMIA. But IDEMIA disputed her characterizations of that.
Instead, the firm, which said it wasn’t tasked with putting those voters on the rolls, insisted that the state had access to data indicating those individuals weren’t US citizens. It is against the law for noncitizens to vote in federal elections.

All of that came against the backdrop of the Department of Homeland Security suggesting that over 35,000 non-citizens may be on the voter rolls. Sherrill publicly claimed over the summer that her team wasn’t given adequate information about that.
“She just says what people want to hear, but she didn’t actually give names,” Kranjac told The Post. “It’s all still anonymous. I don’t think the Department of Justice has been able to get it out of her. Quite frankly, she should be brought in front of Congress and made to testify.”
In his letter, Kranjac further stressed that “[e]very eligible citizen has an interest in knowing that lawful votes are not diluted by ballots cast by those who are ineligible to participate.”

Kranjac pointed out that New Jersey typically has one of the highest percentages of foreign-born residents who aren’t eligible to run for election of any state in the country, according to the Census.

In addition to wanting more federal election monitors, he also wants the Trump administration to investigate potential illegal voting, ensure that the voter rolls are cleaned up, and get clarity on the Department of Homeland Security’s suggestion that there are over 35,000 non-citizens on the voting rolls.
Blanche has defended the Trump administration’s plans to conduct federal oversight of elections during the midterm cycle.
“Since the ’60s, the Department of Justice has monitored elections. Every single election has been monitored,” Blanche told “Fox News Sunday.” “President Trump is doing the same thing that every single administration has done in our generation.”

The Justice Department has charged 16 illegal immigrants with illegal voting, fraudulent voter registration, and other election-related federal crimes as the Trump administration cracks down on illegal voting ahead of the midterm elections.
The DOJ said on Monday morning that it arrested and charged more than a dozen people illegally residing in the United States who voted in federal elections, made false claims of U.S. citizenship to register to vote, or made false statements on citizenship applications.

The effort is part of the White House's broader plan to purge illegal immigrants from state voter rolls. Illegal immigrants are allowed to vote in local elections in some cities, but not in federal elections, which include those for the House, Senate, and presidency.
Federal law enforcement arrested 10 people across Minnesota for election-related crimes, including Liberian national Bhator Konah Bryant; Lithuanian national Edvile Vaidoto Edmunds; Ghanaian national Joshua Frederick Kofi Edzie; Liberian national Alan Barbu Kargbo; German national Paul Kras; Bosnian national Fadil Rasim Ozegovic; Brazilian national Aparecido Donizetti Padovan; Liberian national Chris Adam Pettiquoi; Canadian national Christian Liam Schenk; and South African national Hester Sophia Weihmann.

Andrea Catanese of Italy and Terrance Patrick Evans of the Bahamas were each charged with voting in the 2024 election. Catanese was additionally charged with attempting to procure naturalization unlawfully and making a false statement related to naturalization. Both individuals were arrested in Central Florida.
DOJ charged three illegal immigrants from Cuba, Mexico, and Nicaragua in the Eastern District of Louisiana with illegally voting in elections.
In September, the DOJ announced illegal voting and election-related charges against 16 illegal immigrants, primarily residing in Texas.
President Donald Trump's focus on voting comes six years after he lost the 2020 presidential election to former President Joe Biden. Trump has alleged that the election was "stolen." Dozens of judges nationwide have struck down lawsuits brought by Trump-aligned groups related to the matter.

In his second term, the Trump administration has touted the need to remove illegal immigrants from voter lists, stating that Democrats intend to use this population illegally to their benefit.
The Washington-based Brennan Center for Justice, a left-leaning law and policy group, suggested in a report published last year that the Trump administration intends to "undermine" forthcoming elections.
"Since day one of his second term, the Trump administration has attempted to rewrite election rules to burden voters and usurp control of election systems, targeted and threatened election officials and others who keep elections free and fair, supported people who undermine election administration, and retreated from the federal government�s role of protecting voters and the electoral process," the Brennan Center for Justice report stated.

White House border czar Tom Homan and Homeland Security Secretary Markwayne Mullin have floated sending federal immigration officers to polling sites for what they say are security purposes. The Department of Justice (DOJ) announced charges on Monday against 16 foreign nationals across the United States for election crimes, including illegally voting and fraudulently registering to vote.

Federal prosecutors said they have charged more than a dozen foreign nationals in Florida, Louisiana, Wisconsin, and Minnesota with election crimes.

Among those charged with illegally voting in the 2024 presidential election are 60-year-old Italian national Andrea Catanese, 37-year-old Bahamian national Terrance Patrick Evans, 68-year-old Cuban national Pedro Pablo Ruiz, 34-year-old Mexican national Zianya Yllaly Zamorano, 56-year-old Nicaraguan national Dudley Francisco Zeledon, and 30-year-old North Macedonian national Sara Luma.

Prosecutors similarly announced charges against 10 foreign nationals in Minnesota for crimes such as falsely claiming to be American citizens and illegally voting.

Those charged in Minnesota are:

Bhator Konah Bryant, 61, a Liberian national, on one count of making a false claim of citizenship in order to vote. She is alleged to have falsely claimed United States citizenship when registering to vote on October 18, 2024. The defendant had her initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

Edvile Vaidoto Edmunds, 59, a Lithuanian national, on one count of voting by alien. She is alleged to have voted illegally as an alien in Minnesota on November 8, 2022. The defendant had her initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

Joshua Frederick Kofi Edzie, 63, a Ghanaian national, on two counts of making a false claim of citizenship in order to vote and one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota on August 11, 2026, and falsely claimed United States citizenship in order to vote on October 23, 2024, and August 11, 2026. The defendant had his initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 28, 2026.

Alan Barbu Kargbo, 48, a Liberian national, on one count of making a false claim of citizenship in order to vote and one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota and falsely claimed United States citizenship in order to vote on November 5, 2024. The defendant had his initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 28, 2026.

Paul Kras, 78, a German national, on one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota on November 5, 2024. The defendant had his initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

Fadil Rasim Ozegovic, 58, a Bosnian national, on one count of making a false claim of citizenship in order to vote and one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota and falsely claimed United States citizenship in order to vote on November 5, 2024. The defendant had his initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

Chris Adam Pettiquoi, 43, a Liberian national, on one count of making a false claim of citizenship in order to vote and one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota and falsely claimed United States citizenship in order to vote on November 5, 2024. Christian Liam Schenk, 47, a Canadian national, on one count of making a false claim of citizenship in order to vote and one count of voting by alien. He is alleged to have voted illegally as an alien in Minnesota and falsely claimed United States citizenship in order to vote on November 5, 2024. The defendant had his initial appearance in the District of Massachusetts on September 29, 2026.

Hester Sophia Weihmann, 69, a South African national, on one count of making a false claim of citizenship in order to vote and one count of voting by alien. She is alleged to have voted illegally as an alien in Minnesota and falsely claimed United States citizenship in order to vote on November 5, 2024. The defendant had her initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

As Breitbart News reported, 10 foreign nationals were charged with similar crimes last month, including illegally voting in the 2024 presidential election, the 2022 midterm elections, and the 2022 primary elections. Prosecutors said those election crimes occurred in Florida, Kansas, New Jersey, Pennsylvania, Texas, Hawaii, and Utah.

A US judge dismissed a federal case on Thursday that accused a Jamaican national of illegally voting, finding the law criminalizing noncitizen voting was unconstitutional and delivering a blow to the Trump administration�s campaign against alleged election fraud.
The ruling by Miami-based US District Judge David Leibowitz applies only to the case of Florida resident Chelsea Cox, who was charged in October 2025 with illegally voting in the 2020 election.
It is not binding for judges in other cases.

It marks a setback for President Donald Trump�s administration on noncitizen voting, a cornerstone of its push to highlight alleged election fraud ahead of November�s midterm elections.
Republicans are fighting to retain majorities in both houses of Congress.
The Justice Department has charged at least 60 people with noncitizen voting since Trump returned to office in January 2025.

The ruling by Leibowitz, who was nominated by Democratic President Joe Biden, appears to be the first time a federal court has found the 1996 law a violation of the US Constitution.

Leibowitz wrote that under the US Constitution only states can set voter qualifications, not Congress. Every state requires US citizenship to vote, and Leibowitz said it was up to Florida, not the Department of Justice, to prosecute her for violating that requirement.
�Can the State of Florida prohibit and punish the exact conduct Defendant Cox allegedly engaged in here? This has already been decided elsewhere and is not addressed here: Florida can and does,� Leibowitz wrote.

Trump, who falsely claims that fraud cost him the 2020 election, has said stricter enforcement of documented citizenship is needed for election integrity.
His critics say the administration�s highly publicized crackdown on noncitizen voting exaggerates a rare problem and could undermine confidence in election results.
Neither the White House nor the Justice Department immediately responded to requests for comment.
In a court filing, the Justice Department had said Congress, not the states, was best-equipped to handle immigration and foreign affairs.

�Foreign interference in elections is clearly within the purview of Congress,� federal prosecutors wrote.
Other defendants have challenged law
Cox�s attorney Bruce Udolf welcomed the ruling. �This is a situation that cries out for discretion by government officials, and they�d be well-advised to walk away from this without further reprisal against her,� he said.

Cox entered the United States as a tourist in 1999 and remained after her visa expired the next year, according to a court filing by the government.
She used a fraudulent US Virgin Islands birth certificate to obtain a Florida driver�s license and used those documents to register to vote in 2012.

Records show she voted in federal elections from 2012 to 2020, but only the 2020 election was within the statute of limitations.
There are about 45 pending noncitizen voting cases around the country and at least four other defendants have challenged the law on similar grounds.
Judges in those cases may find Leibowitz�s reasoning persuasive, but they are not bound by his decision.

Trump has portrayed noncitizen voting as part of a broad Democratic Party conspiracy to dilute Republican power.
But Cox was one of just 129 people charged with violating the law known as �voting by an alien,� according to a Reuters investigation published in July.
The investigation, published on July 19, found no defendant accused of conspiring to sway an election, backing a candidate or taking payment for a vote.
The Reuters investigation also showed that most of the people accused of noncitizen voting were lawful permanent residents who either registered by mistake or were encouraged to sign up to vote based on the misguided advice of an election worker or government clerk.

Illegal voting is grounds for deportation, and as Reuters has reported, the Trump administration has been investigating noncitizen voting and deporting defendants, sometimes years after their criminal cases were closed. Cox�s attorney Udolf said he hoped the government would not move to deport her, citing her declining health.

On July 16, Trump said without evidence that 278,000 noncitizens were registered to vote in California, Nevada, New Jersey and Pennsylvania.
Five days later, New Jersey Governor Mikie Sherrill, a Democrat, said about 400 noncitizens in her state voted after a software error mistakenly registered about 6,600 people in 2023-24.
The Justice Department has demanded their names, nationalities and addresses.

Biden Judge Leibowitz held that the Constitution assigns the power to set voter qualifications to the states, not Congress.

He wrote that Florida already prohibits and can punish the conduct at issue under state law, and that it is for Florida�not the Department of Justice�to enforce that requirement.

The opinion states: �Can the State of Florida prohibit and punish the exact conduct Defendant Cox allegedly engaged in here? This has already been decided elsewhere and is not addressed here:

Florida can and does.� He concluded that �the Constitution does not authorize Congress to legislate voter qualifications for federal elections.�

Cox�s attorney welcomed the dismissal. Of course.

Leibowitz should be immediately disbarred. Are there any Republicans with a spine? Anyone?

The Justice Department on Wednesday indicted 10 aliens for illegally voting in Minnesota.

AG Blanche, US Attorney Daniel Rosen and DHS Chief Markwayne Mullin announced a federal grand jury indicted 10 defendants for voter fraud.

�The charge of false claim of citizenship in order to vote is a violation of 18 U.S.C. � 1015(f) and carries a maximum term of imprisonment of five years, a maximum term of supervised release of three years, and a maximum fine of $250,000. Voting by aliens is a violation of 18 U.S.C. � 611 and is a class A misdemeanor and carries a maximum term of imprisonment of one year, a maximum term of supervised release of one year, and a maximum fine of $100,000,� the DOJ said.

The 10 non-citizens named in the indictments per the DOJ:

The defendant had her initial appearance before U.S. Magistrate Judge Elsa M. Bullard on September 29, 2026.

Blanche announced the indictments on Wednesday morning.

�Today�s charges allege that ten foreign nationals committed voter fraud in Minnesota, one voting illegally as recently as this August�s primary,� said Attorney General Todd Blanche.

�The law is clear, only American citizens may vote in American elections, and enforcing this law is fundamental to our democracy. That should not be a partisan concept,� he said.

On Monday, the U.S. Department of Justice announced more arrests and guilty pleas in several election-related cases up and down the Eastern seaboard, the Pacific, and even in the Midwest. That thing that Democrats and the Left claim rarely happens � illegal aliens interfering and even voting in U.S. elections � seems to just keep happening.

As my RedState colleague Ward Clark reported last week, 16 individuals across several states were nabbed and charged. This time it involves 12 individuals, three of them illegally in the country. This sweep incorporates parts of Florida, Pennsylvania, New Jersey, and spreads as far as Utah and Hawaii.

Amazing what happens when the DOJ does the work of prosecuting crimes and criminals.

Today, the Justice Department announced charges and guilty pleas involving 12 individuals, including three illegal aliens, in connection with illegal voting, fraudulent voter registration, and related election crimes across the country. The cases include voting by aliens in federal elections, false claims of U.S. citizenship to register or vote, false statements on citizenship applications, and the alleged disposal of approximately 300 mail-in ballots by a former postal carrier.

Here is a rundown of the miscreants in question:

In the Middle District of Florida, a 75-year-old Canuck named Christiane Vinette Young was in the country illegally. Young has been charged with three counts of voting by an alien when she cast a ballot in the 2022 and 2024 general elections, and in the 2022 primary election.

In the Southern District of Florida, a Haitian national named Valery Zidor, who was under temporary protected status (TPS) at the time he voted, falsely claimed U.S. citizenship, registered to vote in 2024, and then voted in the general election. Zidor pled guilty to two counts of making a false claim of citizenship in order to vote, and one count of voting by an alien.

Nigerian national George Olawunmi Johnson, a lawful permanent resident in the District of Kansas, registered to vote in February 2010 and allegedly cast a ballot in the 2024 general election. Johnson was charged with one count of false claim to U.S. citizenship, one count of false claim to U.S. citizenship in order to cast a vote, one count of fraudulent election conduct, and one count of voting by an alien in a federal election.

In the District of New Jersey, two foreign nationals who had permanent residency in the U.S. were charged with illegally voting in a federal election as well as falsifying statements while applying for U.S. citizenship.

Jamaican national Patrick Terrance Reid voted in person in the 2012 and 2016 presidential elections, and by mail-in ballot in the presidential elections for 2020 and 2024.

Venezuelan national Danubis Bernat voted in person during the 2024 general election.

Another lawful permanent resident, Mexican national Imelda Magallanes from the Western District of Texas, was charged with one count of voting by an alien in a federal election. This example is the reason why giving out driver's licenses like candy to illegal aliens and even lawful foreign residents without any checks and balances is a terrible idea.

Voting records from the Midland County Elections Office indicate that Magallanes first registered to vote in October 2020 using her Texas driver�s license as identification. Voting records also reveal that Magallanes voted in the November 2024 general election.

In the District of Hawaii, Filipino national and lawful permanent resident Bernadette Acaso voted in the 2024 election via mail-in ballot. Acaso pled guilty to unlawfully voting as an alien.

U.S. citizen Damon Matai Seei may have been doing someone else's bidding in his role as a USPS mail carrier. Seei was charged with "unlawful secretion, destruction, and delay of mail after he allegedly unlawfully threw away mail that he was entrusted to deliver � including approximately 300 mail-in ballots to registered voters in Utah."

The Eastern District of Pennsylvania had the motherlode of malfeasance. Four aliens, including two illegal aliens, were charged with election-related crimes. One of the illegal aliens submitted at least eight fraudulent voter registrations, and he voted in at least one election. This is one reason why the U.S. Supreme Court ruling that the Department of Homeland Security (DHS) could continue to perform Systematic Alien Verification for Entitlements (SAVE) checks is so critical.

Cliff Sanon, 39, an illegal alien from Haiti who has been residing in Philadelphia, Pennsylvania, was charged by criminal complaint with one count of submitting a fraudulent voter registration application. Sanon allegedly submitted a voter registration application in February 2026 prior to the May 2026 primary election, despite being a citizen of Haiti and not an American citizen. The complaint further alleges that this was among eight fraudulent voter registration applications submitted by Sanon, who also voted in the November 2022 election.

Dilea Ochoa-Perez, 43, an illegal alien from Mexico who has been residing in Coatesville, Pennsylvania, was charged by information with two counts of voting as an alien. According to the information, Ochoa-Perez allegedly illegally voted in Chester County in the November 2022 and November 2024 general elections, even though she was a citizen of Mexico at the time of both elections and not a U.S citizen.

Trinidad & Tobago national Sade Guppy, 37, a lawful permanent resident, was charged by information with one count of voting as an alien. According to the information, Guppy allegedly illegally voted in Philadelphia County in the November 2022 general election, even though she was not a U.S. citizen.

Mexican national Eduardo Gallardo Maldonado, 66, a lawful permanent resident, was charged by information with one count of voting as an alien. According to the information, Maldonado allegedly illegally voted in Philadelphia County in the November 2024 general election, even though he was not a U.S. citizen.

Along with doing the work that should have been done years ago, this extensive sweep by the DOJ to arrest these bad actors is having the appropriate chilling effect. Just as First Assistant U.S. Attorney Bill Essayli is doing in California, DHS and DOJ continue to announce major moves to assist local and state election officials in combating voter fraud as a heads-up to any wannabe fraudsters. But it is evident that the varied and wide-ranging nature of these arrests will keep anyone who is thinking about it on their heels, because they have no concept of where or when the hammer might fall.

This is the way.

Debate erupted this week over voter I.D. requirements after Reuters reported that an investigation found 30,000 noncitizens were "erroneously" registered to vote in 11 states. Jackson, a nondenominational Christian leader and descendant of enslaved ancestors, said the findings underscored what he described as a growing problem of noncitizen voting that disenfranchises American citizens.

In an interview with Fox News Digital, Jackson charged, "Why the Democrats are so committed to this can only be explained one way: they think it empowers people who shouldn't vote to vote, and they believe those people are going to vote for them."
"This is nothing but a power grab," he posited, emphasizing that "every vote by a noncitizen does in fact cancel out the vote of an American citizen, or it amplifies it in a way that's illegal or inappropriate."

Reuters reported on Wednesday that more than 30,000 self-declared noncitizens were added to U.S. voter rolls since 2000.

The outlet attributed the erroneous registrations to "software glitches and clerical errors" and said its review suggested "inadvertent bureaucratic failures, *rather than organized efforts to register immigrants illegally." Reuters said it was unable to determine how many noncitizens actually cast ballots.

The errors occurred in California, Illinois, Iowa, Nevada, Ohio, Oregon, Pennsylvania, South Dakota, Texas, Utah and Virginia.
Don Palmer, the senior legal fellow for election integrity with the Heritage Foundation, told Fox News Digital that due to legal loopholes and loose reporting requirements, he believes the 30,000 number "is actually quite low."

"I think it's undercounting it. I think those are the identified non-citizens that have been accidentally or erroneously placed on the voter rolls through the mistake of the driver's license agency. I think it�s much more because we don't know in a lot of states, either they have not conducted the audits or they're not using tools to find noncitizens that may have accidentally been placed on the rolls," he said.
Palmer said "the answer really is that there needs to be more care taken to developing a system of verifying citizenship and you just don't see that in most states."

"If they're going to do voter registration, they need to make sure that there's a verification in place for identity and for citizenship, just as if you come into an agency and you're getting a driver's license or identification card, you've got to show that I.D., you've got to make sure that your identity is confirmed, similarly, if you're going to register someone to vote at the driver's license agency, there needs to be a verification process or a documentation process to ensure that you are a citizen," he said.

Meanwhile, after hearing the 30,000 figure, Jackson told Fox News Digital that "the sad reality is I'm not shocked."
"I wonder if it's more," he said, adding, "We've been told, particularly by Democrats, that that's not happening, that there's nothing to see here, and yet we hear again and again documentation that it is happening."
With this in mind, he decried efforts to resist more stringent voter eligibility verification and identification. He took particular issue with those equating voter I.D. requirements as anti-Black and a new form of Jim Crow.
"Forgive me for being personal about this for a moment, but I just find this deeply insulting and deeply offensive because the implication is that somehow if you are black, no matter how wealthy, educated, well-to-do, somehow getting an ID is a problem for you," he said.
"But on the other hand, if you're white, no matter how poor, no matter how uneducated, no matter what your circumstances are, somehow you can get an I.D., that's not a problem, I mean, it's preposterous."

He pointed to the hotel where he was staying as an example.
"Look, I'm in a hotel right now � What was the first thing they asked me for when I walked up to the counter? May we see your I.D., please? Should I say, �Wait a minute, oh, you're discriminating against me. You know Black people can't get I.D.s; how dare you ask?� he said. "I mean, it's ridiculous."

"I don't hate illegal aliens, I don't want to see them harmed or hurt, but they don't have a right to vote in our elections, and they shouldn't be permitted to do so," he concluded. "Anybody who wants to say, well, �You're a bigot, you are a hater,� I mean, they're going to say that. But I think most Americans are people of goodwill and don't feel that way at all; we're simply trying to preserve the integrity of our electoral system."

The Supreme Court cleared the way Friday for the Trump administration to implement its overhauled immigration database, which it says is aimed at combatting voter fraud, in time for November’s elections over the dissent of the liberal justices.
The overhaul faced opposition from Democrats and some voting groups, and a judge had blocked it for violating federal privacy law. The Supreme Court’s emergency ruling lifts that block, finding the challengers’ claims are likely to fail.

The majority wrote that “the Federal Government has an obligation to respond to requests from state and local election officials seeking to verify the citizenship of voters.”
“The order below prevents the Federal Government from using the program it believes is best suited to the task,” the court wrote.
The Department of Homeland Security’s (DHS) Systematic Alien Verification for Entitlements (SAVE) service is used to determine eligibility for certain federal programs.

The DHS made significant updates after President Trump directed the agency to ensure election officials had appropriate access to verify their voters’ citizenship. The changes connect SAVE to Social Security records, among other updates.
The three liberal justices publicly dissented, led by Justice Ketanji Brown Jackson.
“In my view, however, the harm caused by burdening or disenfranchising even a few lawful voters outweighs the nonexistent harm that the Government experiences when it is prevented from taking an action that it likely lacks the authority to take,” Jackson wrote, joined by Justices Sonia Sotomayor and Elena Kagan.

It is not a final ruling, but the justices’ order means the overhaul can proceed for the midterms as the litigation continues. The case now returns to the lower courts.
However, states are now within the federally mandated 90-day “quiet period” before an election, during which they are barred from systematic voter purges. Any deletions now must be done on an individualized basis, limiting the immediate impact of the court’s decision.
The dispute is among election-related emergency litigation that has swarmed the Supreme Court in the lead-up to the midterms.

Trump’s win comes just days after the court ruled against him on his mail-in voting plan. And days earlier, the court ruled against Missouri Republicans by lifting a judge’s directive to proceed with their new congressional map. That case has now returned to the justices once again.
Solicitor General D. John Sauer told the Supreme Court that the SAVE overhaul is needed to protect election integrity.
“DHS’s SAVE system was not up to the job because it lacked comprehensive data about natural-born citizens, permitted searches only one record at a time, and required the user to supply a person’s alien registration number (or other DHS number)—which States often do not know,” Sauer explained.

U.S. District Judge Sparkle Sooknanan, an appointee of former President Biden, blocked it in June. She found the changes violated the Social Security Act and a federal law that regulates how the government can disclose individuals’ personal data.
The Trump administration brought her ruling to the Supreme Court after the U.S. Court of Appeals for the District of Columbia Circuit declined to lift her order in a 2-1 vote.
Voting groups called the overhaul “unprecedented” in their filings with the Supreme Court and urged the justices to not get involved.

“Today’s decision is profoundly disappointing, as it puts millions of Americans at risk of being unlawfully targeted by the administration’s unreliable voter purge database weeks before the midterm elections,” the League of Women Voters said in a statement. The group is leading the lawsuit.
“However, this case is not over,” the statement continued. “The D.C. district court ruled that the expanded SAVE program violated multiple laws. We will be doing everything in our power to protect Americans’ voting and privacy rights by ensuring that the district court decision stands.”

Democrats have spent years telling Americans that non-citizen voting is a �conspiracy theory.� Florida just put more names, charges, and signed admissions on the table.

Florida Attorney General James Uthmeier, joined by Governor Ron DeSantis, announced Thursday that 20 defendants are being arrested and prosecuted for voting fraud in a statewide election-integrity sweep targeting illegal ballots in Florida elections, including the 2024 general election.

Sixteen of those defendants are non-citizens accused of falsely swearing they were U.S. citizens, then voting. Four others are convicted felons accused of registering and voting while still on probation.

The announcement pushes Florida past 100 election-fraud prosecutions since DeSantis signed Senate Bill 524 in 2022 and created the Office of Election Crimes and Security. More than half of those cases have been opened since Uthmeier took office.

�Florida will not allow anyone to steal the vote of Americans at the ballot box,� Uthmeier said. �These defendants swore they were qualified electors, cast ballots in our elections, and later confirmed they were never eligible to vote.�

DeSantis was just as blunt: �We have prioritized election integrity in Florida, and we have zero tolerance for voter fraud.� He used the same event to roll out a new Association of State and Local Election Officials, with Secretary of State Cord Byrd tasked with exporting Florida�s playbook to other states.

According to FOX 13 Orlando, investigators used federal immigration databases, voter-registration applications, poll-book signatures, and vote-by-mail certificates to lock down the cases. U.S. Citizenship and Immigration Services helped confirm the defendants were not citizens.

Statewide Prosecutor Brad McVay put it in language Democrats will hate: �Florida�s elections laws are not mere suggestions.�

Each charged offense is a third-degree felony. Most of the defendants face up to 10 years in state prison if convicted as charged. One faces up to 20. Another faces up to 15.

This is not a paperwork mix-up. Several of the accused later signed forms admitting they were never U.S. citizens, after they had already voted.

Among those named in the Attorney General�s charging package:

Astrid Shamatu Navarrete Quintana, 24, Fort Myers � Mexican national and lawful permanent resident since 2023. Registered in August 2024, swore she was a citizen, voted in person on Election Day 2024, then signed a form admitting she is not a U.S. citizen.
Selvin Uton Whilby, 74, Tampa � Jamaican national and green-card holder since 1989. Registered in 2008, voted by mail in the 2024 primary and general elections, with a vote-by-mail trail dating to 2008.
Cyntia Vanessa Canales, 62, Ocala � Chilean national. Registered in 2012 and again in 2022, each time claiming citizenship and listing her place of birth as Florida. Voted early in person in October 2024.
Craig William Smith, 69, Ocala � Bahamian national, permanent resident since 1978. Registered in 2002. Voted in both 2024 elections as part of a history going back to 2006.
Kadian Gabrielle Amai Johnson, 29, Lehigh Acres � Jamaican national. Registered Sept. 30, 2024, voted in person Nov. 5, 2024, then admitted in writing she is not a citizen.
James Mark Hollingsworth, 62, Lake Suzy � Canadian national and permanent resident since 1967. Registered through the DMV in 2021, voted by mail in both 2024 elections. After getting a non-citizen notice, he emailed the supervisor of elections acknowledging he is a permanent resident and that he had been voting in Florida. He faces four felony counts.
Giorgio Dominique Mucelli, 66, Melbourne � Canadian citizen and lawful permanent resident charged with voting as a non-citizen and false affirmation after voting in seven general elections from 2004 through 2024, including 2024.
Donta Ta White, 44, Tampa � convicted felon still serving a 10-year probation term that does not end until 2032. After signing a Department of Corrections form warning that registering or voting before completing his sentence is illegal, he filed two October 2024 registration applications claiming his rights had been restored and voted early in person.

The remaining named defendants include nationals of the United Kingdom, Indonesia, Mexico, and Canada in Polk, Okeechobee, Columbia, and Collier counties. Cases span Brevard, Collier, Columbia, DeSoto, Hillsborough, Lee, Marion, Okeechobee, and Polk.

The cases land just weeks before the 2026 midterms�and they put specific names, dates, counties, and alleged ballots behind a debate that too often gets buried beneath slogans.

Federal prosecutors announced the charges Thursday against Cliff Sanon, Dilea Ochoa-Perez, Sade Guppy, and Eduardo Gallardo Maldonado. Two are described by the government as illegal aliens; the other two are lawful permanent residents.

The most serious allegation centers on Sanon, 39, a Haitian national living in Philadelphia.

According to the Justice Department, Sanon submitted a voter-registration application in February 2026 even though he was not a U.S. citizen. Prosecutors say that application was one of eight fraudulent registrations he submitted, and they further allege that he voted in the November 2022 election.

Sanon was charged by criminal complaint with one count of submitting a fraudulent voter-registration application. If convicted, he faces a maximum of five years in prison, one year of supervised release, a $250,000 fine, and a $100 special assessment.

That �eight applications� detail is what makes this more than another abstract argument about election safeguards:

Pennsylvania�s own rules are straightforward. The Pennsylvania Department of State says a person must be a United States citizen for at least one month before the next election in order to register.

The state also says every applicant must affirm U.S. citizenship and can face incarceration, fines, or deportation for submitting false information.

Applicants must register at least 15 days before an election, live in Pennsylvania and their election district for at least 30 days, and be 18 by Election Day. The state�s online guidance also makes clear that owning property or a business in a county does not by itself establish voting residence.

Those requirements matter here because the federal allegations are not about a technical mistake over a polling place. Prosecutors say the defendants were not citizens when the registrations or ballots at issue were submitted.

U.S. Attorney David Metcalf framed the prosecutions as a basic question of national sovereignty.

�Our sovereignty as a nation belongs to the American people and no one else,� Metcalf said in the department�s announcement. �Anyone, including illegal aliens, who votes illegally in our elections will be prosecuted for corrupting our democracy.�

HSI Philadelphia Special Agent in Charge Nathan Abel said unlawful ballots can undermine confidence in elections and diminish the voices of citizens. Homeland Security Investigations handled the Pennsylvania cases.

These are not isolated from the administration�s broader election-integrity push.

On September 18, the Justice Department announced charges against 16 people in cases spanning Texas, Massachusetts, Wisconsin, New Jersey, Michigan, Georgia, and Idaho. The alleged conduct included unlawful voting, false citizenship claims, illegal registration, naturalization fraud, passport fraud, and related offenses uncovered during the investigations.

That earlier package included eight defendants in Texas alone. In one case, prosecutors alleged that a Venezuelan national and DACA recipient voted nine times between 2008 and 2024; another defendant was accused of voting under a false name and making a false statement on a passport application.

The department also described cases involving alleged voting in Massachusetts, Wisconsin, New Jersey, and Michigan. As with the Pennsylvania defendants, those people are presumed innocent unless the government proves its allegations in court.

And on the same day as the Pennsylvania announcement, federal prosecutors in New Jersey charged two more noncitizens with illegal voting and allegedly lying about their voting history on naturalization applications.

The New Jersey U.S. Attorney�s Office says one defendant allegedly voted in the 2012, 2016, 2020, and 2024 federal elections. The second allegedly voted in 2024.

Every defendant in the Pennsylvania cases is presumed innocent unless proven guilty in court.

Charges are allegations, not convictions, and the four cases by themselves do not establish the national scale of noncitizen voting.

What the charging papers do establish is why safeguards matter: the alleged violations are concrete, traceable, and in several cases said to have survived long enough to reach multiple election cycles.

Citizens should not have to choose between confidence in elections and honest discussion about vulnerabilities. The answer is enforcement grounded in evidence�one registration, one ballot, and one provable case at a time.

Agents with Homeland Security Investigations (HSI) and the Federal Bureau of Investigation (FBI) arrested a legal immigrant in New Jersey last week for allegedly voting in multiple federal elections, including the 2020 and 2024 presidential elections, Breitbart News has learned.

Sanata Coulibaly, a legal immigrant from Senegal, was arrested on September 17 and charged with procurement of citizenship or naturalization unlawfully and voting by an alien.

According to prosecutors, Coulibaly first entered the United States in September 1993 and was given a green card by the Obama administration in November 2009. In 2018, 2020, and 2024, Coulibaly allegedly voted illegally in each of the elections.

�This alien from Senegal has been charged with procurement of citizenship or naturalization unlawfully and voting by an alien after allegedly voting in three general elections in New Jersey,� Department of Homeland Security (DHS) Secretary Markwayne Mullin said:

Sanctuary politicians can try to claim that this kind of voter fraud isn�t happening, but it�s very real and is a serious threat to our country. Non-citizens have no right to vote in our elections. The Trump Administration will always protect the integrity of our election systems so that only American citizens are electing American leaders. [Emphasis added]

In July, New Jersey Gov. Mikie Sherrill (D) admitted that a �software error� in the state�s Motor Voter registration system allowed about 6,600 foreign nationals to register to vote and that around 400 of them have voted illegally in the state�s elections since 2023.

DHS officials have suggested that as many as 35,000 foreign nationals are registered to vote in New Jersey alone.

A Philippine citizen living in Lehigh County, Pennsylvania, pleaded guilty last week to unlawfully casting a ballot in the 2024 general election, federal authorities announced Monday.
The U.S. Attorney’s Office for the Eastern District of Pennsylvania stated that Evelyn Novelles Miller, a Lawful Permanent Resident from the Philippines, entered the guilty plea on September 16. The case stemmed from an investigation coordinated by Homeland Security Investigations (HSI) Allentown and the Federal Bureau of Investigation (FBI).

Investigators opened the case after receiving reports that an individual living in Lehigh County had improperly registered and cast a ballot. Federal filings state that Miller registered to vote online on October 9, 2024, and cast her ballot in person at a polling location in Emmaus on November 5, 2024.
Special agents from HSI and the FBI interviewed Miller at her home on July 29, 2025. During the interview, Miller confirmed to investigators that she had registered online before the deadline and voted at her local precinct on Election Day, recounting the specific steps she took at the polling station.

Last week, the Department of Justice (DOJ) announced that 37-year-old Evelyn Miller of the Philippines, who resided in Emmaus, Pennsylvania, pleaded guilty to illegal voting.

On Monday, Breitbart News learned that Miller, who was approved for a green card by Biden�s Department of Homeland Security (DHS) in July 2024, registered to vote on October 9, 2024, and illegally voted in the presidential election on November 5, 2024.

The Department of Justice (DOJ) announced charges against 16 people in multiple states in connection with alleged illegal voting, voter registration and other election-related crimes, including cases involving noncitizens accused of casting ballots in federal elections.
DOJ followed the announcement with a warning on social media, saying some of those charged allegedly voted in the 2022 and 2024 elections, and warning others against attempting to illegally participate in U.S. elections.

"Let this be a warning to ANYONE trying to cheat and undermine our elections," the DOJ wrote. "Spread the word!"
According to DOJ, eight non-citizens residing in Texas were charged, while the other cases involved defendants in Idaho, Georgia, Massachusetts, Wisconsin, New Jersey and Michigan.
The allegations include noncitizens voting in federal elections, false claims of U.S. citizenship to register or vote, and false statements related to naturalization.

During the investigations, the DOJ said authorities also uncovered alleged passport and identification fraud, wire fraud and firearm-related offenses.
The cases are part of a broader Trump administration enforcement effort targeting alleged illegal voting and election-related crimes.
In Georgia, DOJ said Analiea Milliscent Eccles, a Venezuelan national and DACA recipient, voted nine times between 2008 and 2024. She was charged with voting as a noncitizen and falsely claiming U.S. citizenship to vote.

Avila Gomez, a Mexican national residing in Idaho, is accused of falsely claiming U.S. citizenship to register to vote and then voting in May 2022 and November 2024. The indictment also includes wire fraud, passport, identification-document and firearm-related charges.
DOJ said Santana Coulibaly, a lawful permanent resident in New Jersey, registered to vote in 2016, voted in federal elections in 2018 and 2020 and submitted a provisional ballot in the 2024 presidential election. She also faces allegations involving statements made in her naturalization applications.
Assistant Attorney General Colin M. McDonald of the DOJ's Fraud Division told Fox News that the Trump administration has now charged 50 non-citizens with illegal voting.
"America's elections are for Americans," McDonald said.
In a separate interview, Department of Homeland Security (DHS) Secretary Markwayne Mullin said a broader investigation was underway.

Mullin said officials have more than 1,620 open cases and have made 151 arrests. He also said authorities are looking into more than 300,000 suspected cases, a figure he said continues to grow.
Mullin asserted that "every single vote that was at the hands of an illegal [immigrant], canceled out a citizen that was legally registered and able to vote."

"One is too many, but the fact that we have 300,000 cases we're looking into right now and 1,620 cases that are under investigation, and 151 arrests is unacceptable," Mullin said.
The Justice Department noted that the charges announced Friday are accusations and that all defendants are presumed innocent unless proven guilty beyond a reasonable doubt.

An illegal alien from Mexico was indicted by a federal grand jury this week for numerous crimes, including voter fraud, making a false statement applying for a passport, and unlawful possession of a firearm.

Fredy Avila Gomez is also being indicted on wire fraud and stealing government funds.

Based on court records, from 2017 to 2026, Gomez intentionally defrauded US government agencies and the State of Idaho. The list of agencies included Health and Human Services, Idaho Department of Health and Welfare, and the Centers for Medicaid and Medicare Services.

Gomez allegedly made false claims to be a citizen of the United States in order to vote in elections.

He has his first court appearance scheduled for September 21st in the US District Court for the District of Idaho. Gomez is looking at a maximum of 20 years in federal prison if he is convicted on the charges.

The prosecutors handling the case are Assistant US Attorneys Sean Mazorol and Darci Crane.

The DOJ created the National Fraud Enforcement Division earlier this year to prosecute individuals committing fraud against the United States and its citizens.

For years, Democrats have consistently denied that illegal immigrants were voting in elections in the United States. Whenever a left-wing legislator discussed the topic of illegal immigrants voting in the nation�s elections, such concerns were always arrogantly dismissed. Those expressing regular concerns or insisting it was happening were often mocked, ridiculed, and branded as delusional conspiracy theorists. As such, since illegal immigrants voting in elections �never happens,� Democrats have repeatedly said there is no need for voter identification laws.

However, the thing that Democrats say never happens happened again � again. A �Mexican alien� was arrested after an investigation discovered he had voted in past elections. Homeland Security Investigations arrested Ludwig Uriel Espejo-Carrillo and �administratively charged him with unlawful voting and false claim to U.S. citizenship.� Espejo-Carrillo became a lawful permanent resident in 2013 and voted illegally in an election as far back as 2015, according to the Department of Homeland Security. And federal law stipulates that �non-citizens, including permanent legal residents, cannot vote in federal, state, and most local elections.�
Holding illegal voters accountable, ensuring voter integrity, and upholding election security are the bare necessities that any administration should promise to its citizens regarding elections. Yet, it wasn�t until the election of President Donald Trump and the efforts of his administration that consistent, dedicated action was regularly taken to remedy such situations. He was the only president who had the courage to address the issue and allocate the necessary resources to try to eradicate it.

Espejo-Carrillo is being held responsible and will be deported for his crimes, Mullin said. However, who or what will bring accountability to Democrats who have peddled the lie that illegal immigrants and noncitizens have not been voting in U.S. elections? Espejo-Carrillo is only the most recent example of such wrongdoing. These illegal acts have been either covered up by Democrats, investigated with little enthusiasm by Democrats, or altogether ignored.
Without Trump, it is unlikely that anything would have ever been done about noncitizens voting in elections.

This follows the arrest of several illegal voters this week alone. In Texas, Attorney General Ken Paxton announced the arrest of seven foreign nationals who had already been indicted for illegal activity tied to the 2024 general election on Tuesday.

Still, Democrats say this almost never happens, and the spineless Republicans in the Senate, led by RINO John Thune, caved on the SAVE Act.

The Daily Wire reported on Thursday that federal immigration authorities also arrested Ludwig Uriel Espejo-Carrillo, a Mexican national and green card holder in El Paso, Texas, who lied about his citizenship to vote in American elections.

According to the report, Espejo-Carrillo became a lawful permanent resident under Obama, and he is now awaiting deportation.

Homeland Security Secretary Markwayne Mullin described the alien�s actions as a �threat to our republic.�

�We cannot and will not allow the votes of American citizens to be canceled out by non-citizens illegally voting in our elections,� Mullin said.

�Thanks to the hard work of the men and women of ICE, this criminal will be deported from the United States.�

DHS confirmed the report on Thursday, writing,

Our message to aliens who vote in American elections is clear: we will find you, arrest you, and you will face the consequences.

On September 3, @HSIElPaso arrested Ludwig Uriel Espejo-Carrillo, an alien from Mexico, and charged him with unlawful voting and false claim to U.S. citizenship after illegally voting in American elections in 2015.

Espejo-Carrillo will remain in ICE custody pending removal from the United States.

We cannot and will not allow the votes of American citizens to be cancelled out by non-citizens illegally voting in our elections.

Homeland Security Investigations arrested a 56-year-old Nigerian national in Lynn, Massachusetts, and the Justice Department has charged her with unlawfully voting as an alien after she allegedly cast ballots in the 2022 midterms and the 2024 presidential election, Fox News congressional correspondent Bill Melugin reported Wednesday, citing DOJ.

Gladys Adaeze Okafor is expected to make her first appearance in federal court in Boston later today.

According to the Justice Department account relayed by Melugin, Okafor is a lawful permanent resident. She holds a green card. She has not applied for U.S. citizenship.

Under federal law, that means she is not allowed to vote in federal elections, period. Prosecutors say that did not stop her.

In July 2022, she registered to vote in Lynn and falsely attested that she was a U.S. citizen. She then voted in that year�s midterms. In 2023, she submitted a second voter registration form and again swore she was a citizen. She then allegedly voted in the 2024 presidential election.

DOJ says she admitted the 2024 vote in a recorded interview with an HSI agent last week.

Federal law already bars noncitizens from voting in federal elections. The honor system is what failed.

Okafor did not have to produce a passport or a naturalization certificate. She attested. Lynn registered her. She voted. Then she attested again.

That is exactly why Republicans have pushed the Safeguard American Voter Eligibility legislation, the SAVE Act / SAVE America Act, to require documentary proof of citizenship to register for federal elections and photo ID to vote. The House passed a version this year. Senate Democrats and RINOs have treated proof of citizenship like a dirty word.

The left spent years insisting noncitizen voting was a �conspiracy theory.� Texas just put seven more names on a booking sheet.

Attorney General Ken Paxton announced Tuesday the arrest of seven foreign nationals who had already been indicted for illegal activity tied to the 2024 general election.

Federal prosecutors said six defendants were indicted on September 10, while a seventh was charged by criminal complaint on September 11. One defendant was arrested on September 11, five were arrested on September 14, and one fugitive surrendered to federal authorities on Tuesday, according to the U.S. Department of Justice.

The defendants are:

Helen Sayen Adams, a Nigerian citizen and lawful permanent resident, allegedly claimed U.S. citizenship when registering to vote and cast a ballot in Tarrant County in November 2024.

Joshua Nmelichukwu Akpom, a Nigerian citizen and lawful permanent resident, is charged with allegedly making false statements on a naturalization application regarding prior voter registration and voting.

Carlos Salas Barrios, a Mexican citizen and lawful permanent resident, allegedly cast a provisional ballot in Tarrant County despite not being a U.S. citizen. The ballot was ultimately rejected.

Khalwinder Singh Bhengura, an Indian citizen and lawful permanent resident, allegedly claimed U.S. citizenship when registering to vote and later cast a ballot in the 2024 election.

Celestin Katubadi, a citizen of the Democratic Republic of the Congo and lawful permanent resident, allegedly cast a provisional ballot after falsely claiming citizenship. That ballot was also rejected.

Rocio Thrasher, a Mexican citizen and lawful permanent resident, allegedly claimed U.S. citizenship when registering and voted in the November 2024 election.

Moises Anwar Arellano-Alba, a Mexican national who had been ordered deported, allegedly claimed U.S. citizenship, voted early in Dallas County, and had previously been convicted of a felony. He surrendered to federal authorities Tuesday.

Fox News reported that Moises Anwar Arellano-Alba, a 36-year-old Mexican national, is an illegal alien who had already been ordered deported. Prosecutors say he lied about U.S. citizenship on a Texas driver�s license application, voted early in Dallas County in 2024, and is a convicted felon, including a 2023 conviction for lying on a passport application. He later admitted in immigration proceedings that he had voted.

Others, according to the same federal account, include green-card holders who still swore they were U.S. citizens on voter registration forms and then cast ballots in Tarrant and Dallas counties. In at least two cases, the ballots were provisional and later rejected. Casting them was still a crime.

�Foreign influence has no place in American elections. Today, my office is announcing our efforts to arrest foreigners who attempted to cheat the system and violate our laws that uphold election integrity,� Paxton said. �I will not tolerate attempts to rig elections and silence the will of American citizens and voters. I will continue to fight to ensure that Texas has free and fair elections.�

In August 2024, TGP reported that Paxton�s Election Integrity Unit was already running undercover operations on nonprofit registration booths parked outside DPS driver-license offices, the exact pipeline that can put ineligible names on the roll.

Paxton said then that the Biden-Harris open border had created the conditions for foreign nationals to influence American elections, and that registering or voting as a noncitizen is a crime.

In June 2025, after Texas finally got access to the federal SAVE citizenship database under President Trump�s executive order, Paxton opened investigations into 33 potential noncitizens referred by Secretary of State Jane Nelson for allegedly voting in the 2024 general election. Tuesday�s arrests are the first public payoff from that work, not the last.

This March, The Gateway Pundit also reported a Justice Department review finding tens of thousands of noncitizens on voter rolls nationwide and dozens of confirmed illegal ballots already identified.

The Department of Justice announced charges against a 30-year-old Mexican national who allegedly voted illegally in the 2024 election.

Katya Rodriguez, 30, who lives in Harrisburg, Pennsylvania, has been charged with �false statement of citizenship in order to vote, fraudulent registration, and voting as an alien,� per a news release from the agency.

�The integrity of our elections, which are fundamental to democracy, should be of utmost importance to every American,� Attorney General Todd Blanche said.

�It is a cherished right for eligible American citizens, and only eligible American citizens, to vote for their representatives in government,� he added.

�Election fraud is a serious crime, and it is the duty of the Department of Justice to treat it as such.�

Rodriguez faces up to 11 years in prison, as well as a fine and a term of supervised release after her sentence.

Homeland Security Investigations led the investigation into the case.

Pennsylvania, which has 19 electoral votes, was a heated battleground state in the 2024 election.

President Donald Trump won the state with 50.4 percent of the vote, while now-former Vice President Kamala Harris fell short with 48.7 percent, according to a report from Politico.

The Department of Justice said that the prosecution is part of Operation Take Back America � an initiative that �marshals the full resources of the Department of Justice to repel the invasion of illegal immigration.�

Four other individuals in Pennsylvania, New Jersey, and Wisconsin were charged last week for the alleged illegal casting ballots in the 2022 and 2024 elections, per a separate news release from the agency.

�As alleged, these five individuals in New Jersey, Wisconsin, and Pennsylvania, including two illegal aliens, stole votes from American citizens when they decided to break the law and undermine our elections,� FBI Director Kash Patel said.

�Protecting election integrity for the American people is one of the top priorities for this FBI. Every American citizen has a right to free and fair elections, and we will not hesitate to use all available resources to investigate every credible allegation of election fraud and illegal voting.�

Thomas Holtzman, 68, and his wife Marisol Guzman, 50, both of Carlisle, Pennsylvania, were also charged after Guzman allegedly illegally voted in 2024.

Holtzman, while a U.S. citizen, was charged with �false statement of citizenship in order to vote and aiding and abetting and fraudulent registration and aiding and abetting.�

Guzman faces up to one year in prison, while Holtzman could spend 10 years behind bars.

Obama Judges Refuse to Revive Trump�s SAVE Citizenship-Verification System Ahead of Midterms � Trump-Appointed Judge Katsas Dissents

Two Obama-appointed judges on the D.C. Circuit just slammed the door on President Trump�s effort to give states a working tool to check voter rolls for non-citizens.

In a 2-1 vote, the U.S. Court of Appeals for the District of Columbia Circuit refused to allow the federal government to restart its expanded Systematic Alien Verification for Entitlements, or SAVE, system while the Trump Administration appeals a lower court�s nationwide ruling.

The Gateway Pundit reported in July that a Trump-appointed federal judge in Florida smashed Sooknanan�s ruling for Florida, Ohio, Iowa, and Indiana, states covered by a December 2025 settlement that required DHS to keep those SAVE features online. Judge T. Kent Wetherell II ordered the system restored for those states and rejected Sooknanan�s claim that the upgrades violated the Social Security Act or the Privacy Act.

The Gateway Pundit later reported on the separate Florida decision directing DHS to restore the system�s expanded search capabilities for four states.

We also reported that 26 states were using SAVE for voter registration or list maintenance, that the system processed roughly 198 million cases in 2025, and that 24 states, most of them blue, still refuse to use it. New Jersey jumped into ERIC instead, a system that does not even flag non-citizens. Then the illegal-alien voter scandals started piling up.

On Friday, Obama-appointed Judges Sri Srinivasan and Robert Wilkins rejected the government�s request for a stay. Trump-appointed Judge Gregory Katsas dissented.

The majority called a stay �extraordinary relief� and said the government had not made a �strong showing� it would win on the merits.

They leaned hard on a procedural claim that the Justice Department forfeited its central arguments under the Social Security Act�s confidentiality rules by raising them too late. They refused to consider those arguments even for purposes of an interim stay.

Judge Katsas was having none of it.

Katsas laid out the history the majority buried.

SAVE exists because Congress said so, first in the 1986 Immigration Reform and Control Act, then in the 1996 illegal-immigration law that requires DHS to answer state inquiries about citizenship and immigration status.

For years the old system was nearly useless for elections. States could not check U.S.-born citizens.

They could not search by Social Security number. They could not upload voter lists in bulk.

That is why Florida sued. That is why a settlement required the upgrades. That is why Trump�s March 2025 election-integrity executive order directed DHS and the Social Security Administration to make the tool work.

Katsas noted that 27 states now use SAVE for voter verification and that those states made some 60 million voter-verification queries between January 1, 2025, and April 1, 2026. Nationwide, more than 1,300 government agencies use SAVE. It processed about 25 million queries in FY 2024 and 200 million in FY 2025.

His core legal point: the Social Security Act�s confidentiality rule does not ban what modified SAVE actually does. SSA citizenship records rest on statutes that long predate the 1990 cutoff the district court waved around. The upgraded system returns a citizenship or death indicator. It does not dump Americans� Social Security numbers onto county clerks.

�The government is likely to succeed in showing that modified SAVE does not violate the Social Security Act�s prohibition on disclosure of SSNs or related records,� Katsas wrote.

He also said the government will suffer irreparable harm if the stay is denied, DHS cannot carry out duties Congress imposed, states cannot maintain clean rolls, and the government is trapped between Sooknanan�s nationwide vacatur and the Florida court�s order to restore the same features for four states.

That last point is the circus the Left created. One Biden judge in Washington shuts the system down for the whole country. One Trump judge in Florida orders it turned back on for four states. Two Obama judges in the D.C. Circuit just refused to pause the Washington order.

A federal judge on Friday issued a preliminary injunction blocking President Trump�s executive order related to the Post Office�s mail-in ballot rules.

US District Judge Indira Talwani, an Obama appointee, replaced the Temporary Restraining Order (TRO) that she granted last month.

The Trump DOJ on Thursday already asked the Supreme Court to lift Judge Talwani�s TRO.

States are already beginning to send out ballots for the midterm elections.

The Trump Administration will likely appeal Judge Talwani�s preliminary injunction.

DOJ Solicitor John Sauer argued in his emergency petition that the Postal Service possesses legal authority to regulate mail-in ballot designs.

John Sauer told the Supreme Court that the Postal Service�s new rule �imposes only modest envelope-design and addressee-information requirements for federal-election ballots sent.�

�The Rule�s regulation of the U.S. Mail�not federal elections � is plainly constitutional,� John Sauer wrote. �While the States have primary authority to regulate the manner of elections, they cannot choose to use the federal mails to carry out their elections but then insist that their election-related mail is somehow exempt from the Postal Service�s rulemaking authority, conferred by Congress, to regulate envelope design and addressee information.�

Judge Talwani has been assigned to two separate lawsuits against President Trump�s mail-in ballot executive order.

The Boston-based Judge previously blocked President Trump�s March 2025 executive order, specifically his attempt to create a federal voter list.

In March 2025, President Trump signed Executive Order 14248: Preserving and Protecting the Integrity of American Elections.

Judge Talwani previously said, �The Constitution does not grant the President any specific powers over elections.�

The US Supreme Court last Monday upheld part of President Trump�s executive order restricting mail-in ballots on a separate case ahead of the midterm elections.

The Supreme Court paused Judge Indira Talwani�s August 11 ruling that blocked key parts of President Trump�s executive order restricting mail-in ballots.

EO14399 Background

On March 31, 2026, President Trump issued Executive Order (EO) 14399 entitled Ensuring Citizenship and Integrity in Federal Elections. The EO orders the Department of Homeland Security (DHS) United States Postal Service (USPS) and the Attorney General (AG) to take steps within their power to secure mail-in balloting and ensure all voters in federal elections are U.S. citizens.

Section 2 orders the DHS Secretary to transmit to each State a list of confirmed U.S. citizens who will be above the age of 18 at the time of an upcoming Federal election. It requires the list to be updated and transmitted to State election officials no fewer than 60 days before each regularly scheduled Federal election, or promptly upon request by a State for such an election. It provides for individuals to access their records and update or correct them and for States to routinely supplement or provide suggested modifications through a designated DHS contact.

Section 3 ordered the Postmaster General to initiate proposed rulemaking provisions specifying that all outbound ballot mail must be mailed in an envelope that:

is marked as Official Election Mail;
contains tracking technology such as a unique Intelligent Mail barcode;
has undergone a mail envelope design review by the USPS to ensure compliance with USPS mailing standards.

The rulemaking provision order further specifies that:

no fewer than 90 days prior to a Federal election, any State may choose to notify the USPS if it intends to allow for absentee ballots to be transmitted by the USPS.
any notifying State should further indicate whether it intends to submit to the USPS, no fewer than 60 days before the election, a list of state voters eligible to vote in a Federal Election to whom the State intends to provide an absentee ballot to be transmitted via the USPS;
the USPS shall not transmit absentee ballots from any individual unless those individuals have been enrolled on a State-specific list;
the USPS shall provide each State with a list of individuals who are enrolled with the USPS, for absentee ballots provided by the State, along with unique ballot envelope identifiers for their absentee ballots;
the USPS shall enable each State to routinely supplement and provide suggested modifications to the State�s Absentee Participation List in advance of any Federal election, consistent with applicable State law.

Section 4 orders the Attorney General to enforce compliance with the applicable Federal statutes and prioritize the investigation and potential prosecution of State and local officials or others who issue Federal ballots to individuals not eligible to vote in a Federal election as per Section 2.

CONSTITUTIONAL AUTHORITY

While the U.S. Constitution allocates the conduct of elections to the states, it provides overriding legislative authority to Congress:

�The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Place of Chusing [sp.] Senators� I Sec. IV

The Constitution provides the President undisputed authority to enforce all laws made by Congress or the states:

��he shall take Care that the Laws be faithfully executed�� II Sec. III:

Federal law clearly prohibits non-citizens from voting:

�(a)It shall be unlawful for any alien to vote in any election held solely or in part for the purpose of electing a candidate for the office of President, Vice President, Presidential elector, Member of the Senate, Member of the House of Representatives �� 18 U.S. Code � 611
�(f)Whoever knowingly makes any false statement or claim that he is a citizen of the United States in order to register to vote or to vote in any Federal, State, or local election (including an initiative, recall, or referendum)� Shall be fined under this title or imprisoned not more than five years, or both.� 18 U.S. Code � 1015

Federal law also prohibits mail fraud:

�Whoever, having devised or intending to devise any scheme or artifice to defraud, � or attempting to do so, places in any post office or authorized depository for mail matter, any matter or thing whatever to be sent or delivered by the Postal Service, or knowingly causes to be delivered by mail� shall be fined under this title or imprisoned�� 18 U.S. Code � 1341
�Whoever steals, takes, or abstracts, or by fraud or deception obtains, or attempts so to obtain, from or out of any mail, post office, or station thereof, letter box, mail receptacle, or any mail route or other authorized depository for mail matter� Shall be fined under this title or imprisoned�� 18 U.S. Code � 1708

There are also a variety of other laws the President has a duty to enforce such as:

LEGAL CHALLENGES

Although EO14399 is constitutionally sound as explained above, several legal challenges were filed by Democrat aligned state AGs, Senators and civic groups seeking temporary and permanent injunctions against the order. The most prominent lawsuit is California v. Trump which 23 Democrat AGs filed in Massachusetts where they correctly believed would offer favorable rulings.

Cal. v. Trump Plaintiffs allege that Section 2 of the EO transgresses State Constitutional power to determine the manner of elections by creating a federal State Citizenship List that conflicts with state voter rolls. They contend that States are only authorized to issue a ballot to individuals not on the list.

They also allege that Section 3 of the EO transgresses State Constitutional power to determine manner of elections by creating new limitations on voters using mail-in voting.

But there are basic fallacies in these claims:

A federal state citizenship list is not a voter roll;
States may still issue ballots for state elections to individuals not on the list;
There is no new burden imposed on voters. States simply notify the USPS of any individuals for which the state wants to use the USPS for federal ballot delivery.

TALWANI�S UNCONSTITUTIONAL INJUNCTION

But on June 25, 2026, Massachusetts federal Judge Indira Talwani, an Obama appointee who should have recused herself for donating to Democrat Presidential and Senatorial candidates, agreed with the Plaintiffs� arguments in Cal. v. Trump and went much further.

She claimed: �Therefore, because the States determine who is eligible to vote for their state legislators, the Constitution indirectly grants the States authority to determine who is eligible to vote for federal legislators.� That is like claiming a bank will determine who can access your bank account.

After admitting she has no statutory authority to judicially review Plaintiffs� claims, she authorized herself to do it anyway: �a claim alleging that the President acted in excess of his statutory authority is judicially reviewable even absent an applicable statutory review provision.� Talwani also admitted that:

�the EO explicitly requires that its directives comply with the law.� but then Talwani refuses to accept it and ��considers whether the President has the authority to issue the EO regardless of the qualifying language.�

The EO does not address voter eligibility, but Talwani concluded: �The Constitution provides that only the States determine voter eligibility requirements�� even though there is no such Constitutional clause.

Although 18 U.S.C. �� 611, 1015 explicitly mandate that only citizens can vote, Talwani ignored those laws and only considered the 2002 Help America Vote Act (HAVA) saying: �Notably, nowhere in HAVA does Congress prescribe who should be included on State voter lists.� She further rationalized that:

�Accordingly, �the President lacks any authority to compile voter lists for each State� even though a federal ballot mail list is not a voter list. She also noted: �However, no law enacted by Congress delegates authority to control mail-in voting to USPS� despite the reality that establishing federal ballot mail criteria in no way attempts to control the entire state mail-in voting process.

To contend claims were ripe for her to adjudicate, she speculated without citations that: �It is clear that the federal agencies charged with compiling Confirmed Citizen Lists lack the ability to create complete and accurate lists of the U.S. citizens residing in every State.�

She further speculated that: �The Lists are being used as an enforcement mechanism that � will chill local election officials from complying with legal obligations to ensure that all eligible citizens may vote.�

Remarkably, the 1st Circuit Court of Appeals in Massachusetts upheld Talwani�s speculative claims adding its own speculation on top of hers: ��were the (executive order) to take effect for the elections�in November, it would sow confusion and threaten disenfranchisement of many eligible voters�

U.S. SUPREME COURT OVERTURNS TALWANI

But the U.S. Supreme Court admonished Talwan�s bizarre arguments and reversed both her and the Appeals Court.

In regards to preparing citizenship lists in Section 2(a), the U.S. Supreme Court concluded:

�This provision is an internal directive from the President to a subordinate. It imposes no obligation on the States so they suffer no concrete harm��;
�This internal directive does not regulate the States� voter registration processes. Nor does it impinge on the States� authority to create and enforce a legal code for elections.�

In regards to instructions for the AG the Supreme Court added: �The States lack standing to challenge �2(b) for much the same reason: It does nothing to them� and �Setting prosecutorial priorities lies within the President�s Article II power.�

They further concluded that: �Section 3 orders the Postal Service to initiate the process of proposing a rule that might bind the States in the future� And it imposes no legal requirements on the States (or, for that matter, on anyone outside the Executive Branch).�

The U.S. Supreme Court quoted precedents to explain the procedural fallacy of Talwani�s injunction:

�Standing requires an injury that is concrete, particularized and imminent rather than conjectural or hypothetical.�
�Ripeness forbids federal courts to adjudicate disputes that are dependent on contingent future events that may not occur as anticipated, or indeed may not occur at all.�
�But the States cannot manufacture standing merely by inflicting harm on themselves based on their fears of hypothetical future harm that is not certainly impending.�

The U.S. Supreme court issued an even more pointed series of comments for how Talwani speculated claims in attempting to give herself authority to adjudicate them:

�At the time this suit was filed�the time when standing is measured�the District Court had to engage in a string of speculations to find this suit justiciable.�
�It first had to speculate about whether the Postal Service would propose a rule.�
�Then it had to speculate about how the agency would weigh the comments it received.�
�Then it had to speculate about whether the agency would issue a final rule.�
�Then it had to speculate about what the final rule would say.�
�Finally, after all that, the District Court still had to speculate about whether the text of a hypothetical final rule would harm the States.�

The U.S. Supreme Court continued with more admonishments: �When a federal court improperly intrudes on a coordinate branch in this way, interim relief is justified. Such harm exists here because the injunction meddles in the workings of the Executive Branch, preventing it from even trying to lawfully implement the Order.�

The Supreme Court explained: �The Executive Order makes no demand of the States, so staying the District Court�s injunction will not concretely harm them. That is why this suit was not justiciable in the first place.�

The Supreme Court reiterated: �But the Order itself does not harm the States, so the District Court lacked jurisdiction to bar the Government from trying to implement it.� Finally, the Supreme Court removed the injunction citing: �And for the reasons discussed, that injunction is likely to irreparably harm the Government if it remains in place while the appellate process runs its course.�

CIRCUMVENTING THE U.S. SUPREME COURT

Although Talwani was forced to rescind her previous injunctions against President Trump�s federal election integrity EO, the Supreme Court remand did not stop her. The very next day, August 27, Talwani issued a temporary restraining order with the same flaws the Supreme Court disallowed. That order was issued in a new complaint, Cal v. USPS, filed by the same AGs against the new USPS mail-in ballot rule that establishes secure criteria for federal ballot mail. Talwani�s new order did not mention the new complaint and USPS rule had only been published a day earlier. Contrast that to those of us who have waited years to have federal election cases heard.

Talwani�s new injunction concludes: �Now that the USPS has published the Final Rule, Plaintiffs� challenges are ripe.� But she cites only a new round of speculative claims that the Supreme Court banned based on conditions of what may likely happen after the Rule is implemented:

�The Final Rule�s mandatory requirements necessitating immediate action of Plaintiff States likely constitute concrete injury-in-fact��
�Similarly, Plaintiff Organizations are likely to have standing��
�Plaintiff Organizations are also likely to have standing based on the significant risk ��
�If Plaintiff States are unable to comply with the Final Rule, � they will violate their obligations��
�Through the Final Rule, the USPS is refusing to send mail ballots to eligible voters unless States or local election officials submit their mail ballot envelopes and return envelopes��

Although the USPS regulates all mail, Talwani finds: �the court is unaware of, and no party has proffered, any delegation Congress has made that would permit the USPS to regulate election mail.�

Despite decades of all types of ballot fraud dating at least to Lyndon Johnson�s 1948 U.S. Senate Election, Talwani claims: �The record continues to lack any evidence regarding fraudulent absentee or mail-in voting�.

She then uses her new speculations to again attempt to usurp the authority of the Executive Branch by issuing an injunction against USPS preparatory steps to mandate:

Federal Ballot Mail Portal registration
Federal Ballot Mail Portal voter enrollment
USPS verification that Outbound Federal Ballot Mail meets enrollment standards

THE NATIONAL SECURITY THREAT
In summary, Judge Indira Talwani:

made speculative, unconstitutional and dangerous rulings that were overturned by the U.S. Supreme Court;
jeopardized 2026 elections by actively fighting to delay implementation of mail-in ballot security and U.S. Citizenship verification provisions for months
used false arguments to side with State AGs of her political party on issues that facilitate election cheating over the interests and protection of American voters;
demonstrated a clear political agenda in attempting to falsely rule on the Cal v. USPS case the day after it was filed;
ignored explicit instructions from the U.S. Supreme Court to limit her Constitutional overreach and conform with basic judicial procedures that determine harm;
betrayed American voters by placing the most radical demands of her political party over the clear authority of all three branches of the federal government.

These actions pose a clear national security threat for all American voters. They even treasonously aid China, given recently declassified intelligence showing China�s massive interference campaigns in U.S. elections including potential absentee ballot fraud. Americans demand accountability and Congress must muster courage for impeachments especially for such a postal child case of judicial corruption in our elections.

BREAKING: U.S. Supreme Court Justice Kavanaugh Makes Decision On Emergency Hearing on Michigan Citizens Only Vote Petition

Only moments ago, Justice Brett Kavanaugh denied Americans for Citizen Voting–Michigan’s (ACVM) emergency request that the U.S. Supreme Court order their proof-of-citizenship and photo-ID constitutional amendment onto Michigan’s November 3 ballot.

The ACVM group had collected more than 700,000 signatures—well above the 446,198 required number to appear on the ballot.

Staff members of the Michigan Board of Elections allegedly took a “random“ sampling of 1,000 signatures and determined that 17 did not meet the required standard.

The problem is, the Michigan Board of Elections, which is under the direction of Michigan’s dirty Secretary of State Jocelyn Benson, sat on the petition signatures for 5 1/2 months before even looking at it.

By the time they notified the petition organization, there was an issue with a small number of them; they only had a very short window to try to prove the names and signatures on the petition pages were valid.

Fortunately, the attorneys for the petitioners were able to come up with 23 affidavits from individuals attesting that the signatures on the petitions were theirs, which should have satisfied the MI Board of Canvassers demand. But on Aug 4, during a contentious back and forth, the MI Board of State Canvassers deadlocked 2–2 during a public hearing.

Two radical Democrats sitting on the board refused signatures that they both agreed were “perfect matches” with Michigan’s qualified voter file but dismissed them.

Even though they were received on Saturday, the two Democratic board members, who are also ACLU lawyers, claimed the signatures were received after the 10 AM deadline, so they refused to accept them.

In a normal world, this would go to the state Supreme Court, and they would rule in favor of the petitioners, as the Secretary of State‘s office has clearly gone out of their way to ensure that this proposal did not make it on the ballot.

If the signatures were perfectly matched, why were they being challenged in the first place? And why did they wait so long to tell the petitioners there was even a problem? And who made the decision about which random pages would be pulled from the boxes of petitions?

This situation is even more tragic when one considers that Michigan Secretary of State Jocelyn Benson told clerks in 2020 to ignore signature matching on absentee ballots for the November election.

Organizers argued the Board’s delay, its refusal to count late voter affidavits, and the Michigan Supreme Court’s failure to act violated due process and equal protection.

Kavanaugh asked the State for a response, received a briefing on September 2, and issued a one-line denial on September 3 with no written opinion and no referral to the full Court.

The denial means the federal courts will not force the measure onto this year’s ballot. The Board of State Canvassers can finalize the November ballot at its Friday, September 4, meeting.

The only remaining path for 2026 is the still-pending Michigan Supreme Court case (No. 170595).

The extremely liberal and partisan MI Supreme Court has not scheduled an argument or issued an order. If it does not act before ballots are locked by the MI Board of Canvassers tomorrow and subsequently printed, the proposal is off the November ballot and would most likely return, if at all, in 2028.

Sadly, this is yet another blow from the courts that allows Democrats to destroy the sanctity of Michigan’s elections.
